Abstract

Izin merupakan instrumen yang paling sering digunakan oleh pemerintah dalam penyelenggaraan pemerintahan. Salah satu fungsi izin adalah sebagai instrumen pengendalian dan pengawasan pemerintah bagi masyarakat, termasuk dunia usaha. Isu paling penting bagi dunia adalah kemudahan perizinan usaha, termasuk dalam hal investasi dengan penyelenggaraan pelayanan terpadu satu pintu (PTSP) di daerah. Semakin mudah prosedur perizinan, maka persepsi investor terhadap iklim investasi semakin baik, namun secara teori, maka fungsi pengendalian izin akan semakin longgar. Penelitian ini hendak membahas tentang paradoksal antara penyederhanaan perizinan yang berlangsung di Provinsi Lampung dengan semakin longgarnya fungsi pengawasan izin. Pembahasan dalam penelitian ini akan dibedah dengan menggunakan metodologi penelitian hukum yang bercorak normologis, sehingga hukum dipahami sebagai seperangkat norma peraturan tertulis. Pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan yang berlaku di bidang perizinan investasi sebagai bahan hukum. Hasil penelitian akan diupayakan untuk mengonstruksi pemaknaan penyederhanaan izin yang tidak menghilangkan fungsinya sebagai instrumen pengendalian. Penyederhanaan perizinan dimaknai sebagai pemangkasan rantai birokrasi, bukan pengurangan fungsi izin sebagai instrumen pengendalian.License is the instrument which is the most often used by the government in the administration. One of the functions of the permit is as an instrumen of control and supervision of the government for the community, including the business world. The most important issue for the world is the ease of business licensing, including in terms of investment with the implementation of one-stop service (PTSP) in the region. The easier the licensing procedure, the investor perceptions of the investment climate the better, but in theory, the permission control function will be looser. This research is about to discuss about the paradox between simplification of licensing which take place in Lampung Province with increasingly control function of permit supervision. The discussion in this study will be dissected by using legal research methodology that is patterned norm, so that law is understood as a set of norms of written regulation. The approach used is the approach of legislation applicable in the field of investment licensing as legal material. The results of the research will be attempted to construct the meaning of simplification of license which does not eliminate its function as control instrument. The simplification of licensing is interpreted as the cutting of the bureaucratic chain, not the reduction of the function of the license as a control instrument.

Abstract

Understanding Pancasila as an open ideology, certainly can not be separated from the interpretation (hermeneutics/tafsir) in the text and context. When reading is interpreted as a physical process of scanning a line of words in the text by the sense of sight and digested by the brain, then understanding is the result of a set of reading processes to the text. There will always be a gap of understanding "intended" by both the author and the reader. This paper begins with the question: Why can Pancasila be categorized as part of Islamic interpretation (hermeneutics/tafsir)? Can Pancasila indoctrination use the Islamic approach? This paper uses philosophical methods and discourse analysis (language approach). Based on this method, it will get the art of understanding Pancasila as part of Islamic teachings to understand the text and its context. The research results shows that Pancasila is not contrary to the teachings of Islam, even the substance contained in the five principles of Pancasila are part of Islam itself. The indoctrination of Pancasila with an Islamic approach is relevant to be taken in the midst of a radicalism movement that is in the name of Islamic interests. There is a paradox between "accusations" that Islam is behind the radicalism movement against the Unitary Republic of Indonesia (NKRI) with the teachings of Islam itself that teaches that love of the homeland as a half of the faith (hubbul wathoni minal iman).

Abstract

Tujuan pengabdian masyarakat ini yaitu untuk memberikan pemahaman kepada kelompok masyarakat sipil di Lampung yang berkaitan dengan (a) isu-isu kebijakan publik apa saja yang perlu direspon oleh masyarakat sipil; dan (b) upaya yang dilakukan oleh kekuatan masyarakat sipil dalam mempengaruhi dan mengontrol kebijakan publik di Daerah. . Metode dalam pengabdian ini dilakukan dengan metode ceramah dan diskusi, pembahasan studi kasus dan pelatihan advokasi kebijakan. Untuk mengevaluasi kegiatan pengabdian masyarakat dilakukan dengan pendekatan kualitatif yaitu dengan melihat respon peserta terhadap kemampuan dalam mengidentifikasi kebijakan publik yang dikategorikan bermasalah dan kapasitas peserta dalam menindaklanjuti kebijakan publik yang bermasalah. Pengabdian  dilaksanakan di Bandar Lampung dengan peserta adalah kelompok masyarakat yang dikategorikan  sebagai masyarakat sipil. Materi pengabdian meliputi : (a) Literasi Kebijakan (b) Kebijakan Publik yang bermasalah dan (c) Advokasi Kebijakan. Target luaran yaitu peningkatan pemahaman masyarakat dalam mengidentifikasi kebijakan publik yang bermasalah dan kemampuan melakukan advokasi kebijakan. Hasil pengabdian masyarakat ini yaitu peserta berhasil melakukan evaluasi identifikasi kebijakan kublik yang bermasalah yaitu (a) kebijakan pembangunan terminal agro-bisnis di Lampung selatan. (b) pembangunan Pusat Pemerintahan di Kota Baru. Kebijakan pembangunan Pusat Pemerintahan Pemerintah Provinsi Lampung di Kota Baru di (c) Pembangunan Flyover di MBK Jalan Teuku Umar. Konflik ini berakibat pembangunan jalan layang dihentikan sementara. (d) beberapa kasus korupsi di Lampung.

Abstract

 Basic service management is the obligation of Local government and one of the constitutional rights of citizen. Basic service is run based on Local Regulation (Perda) which is oriented for the prosperity of society especially for poor society. Based on that condition, it is required a progressive character of perda for guarantying availability, accessibility, and service quality.

Abstract

Tulisan ini mengajukan argumentasi bahwa modal sosial masyarakat, partisipasi komunitas-komunitas agama di suatu wilayah merupakan salah satu faktor pendukung bekerjanya instrumen hukum dan kebijakan. Tulisan ini mengambil studi di Kota Metro yang mayoritas masyarakatnya adalah suku Jawa dan juga memiliki beragam pemeluk agama. Filosofi hidup Rumongso Melu Handarbeni yang diyakini oleh masyarakat Jawa dalam prakteknya ikut mendukung berbagai program Pemerintah Kota Metro. Di sisi lain keberadaan berbagai komunitas agama yang ada di Kota Metro sesungguhnya memiliki potesi yang besar dalam mendukung Kota Metro yang berwawasan lingkungan. Agama dengan ajaran tentang kepedulian lingkungan akan dapat menjembatani proses bertemunya modal sosial dan kebijakan pemerintah dalam mengatasi permasalahan lingkungan khususnya sampah di Kota Metro. Agama Islam dan Kristen dapat menjadi prototype dalam membangun kesadaran lingkungan antarpemeluknya. Pada konteks inilah usaha Pemerintah Kota Metro dalam membentuk sebuah produk hukum daerah sebaiknya memperhatikan modal sosial masyarakat. Hal ini harapanya akan mampu mendukung proses transformasi Kota Metro menuju Kota yang berwawasan lingkungan.This article discribes about social capital behold, the participate of religion communities in the region is one of the supporting factor to operation of legal instruments and the policy.This paper a study in Metro when the major of Javanese and also has a variety of faiths. The Philosophy of life RumongsoMelu handarbeni believed with Javanese to supporting the various programs of Metro’s Government. Therefore, the existence of the religion communities in Metro actually has a great potention to be support of Metro’s environmentally concept. Religion with theory about environmental concerns will be able to bridge the convergence of social capital and government policies to superintend environmental issues specially of waste in Metro. Islam and Christianity can be a prototype to build environmental awareness among its adherents. In this context, the Metros’ Government efforts to arrange a legal product should be attention the community’s social capital. It can be to support the process of transformation Metro City of environmentally concept.

Abstract

Extradition and prosecution are cornerstones of international law cooperation’s enforcement to prevent immunity from criminal responsibility, especially regarding the refusal to extradite nationals. The principle’s implementation in its development is influenced by the trend from abolitionist countries to refuse the requests for Mutual Legal Assistance in criminal matters (MLA) related to death penalty crimes. Guarantees from requesting the state not to impose death penalty sentences needs to implement nationality jurisdiction if the state refuses to extradite its citizens to another country. Countries that impose death penalty demonstrate that the nationality principle is very successful in investigating crimes committed abroad, whereas countries that have abolished the death penalty consider the nationality principle to be a violation of human rights. This paper focuses its discussion on the usefulness of Article 8 paragraph (5) of the Criminal Code Draft, which regulates the exceptional nature of the death penalty in the nationality principle’s implementation. This paper concludes that the exceptional nature of the death penalty in nationality principles' implementation is regulated in Article 8 paragraph (5) of the Criminal Code Draft. This Article elaborates that a country of hindered crime could prevent MLA requests from Indonesia related to death penalty crimes based on its international obligations and the perspective of human right. This research uses a normative approach and pragmatic-descriptive analysis.

Abstract

Background: The Amazon forest is one of the areas experiencing the largest deforestation in the world and this causes a decrease in environmental quality that occurs in its region, and Brazil is responsible for half of the deforestation in the Amazon because deforestation in the Brazilian Amazon region has the largest percentage compared to other regions.   Objective: In line with the formulation of the problem described above, the purpose of writing this paper is to find out why there is a decline in environmental quality and how the role and efforts of Brazilian indigenous people are to protect the environment in the Amazon Forest region.   Method: The researchers used qualitative approach here. The data were obtained from various documents, including journals and news from different platforms. The researcher analyzed the data by reading every document thoroughly and concluding the result.   Result: The result of the conversion of forest land in the Amazon is that other lands are easier and faster to evict as well when compared to the first time this exploitation activity was carried out in the 1970s to mid-2000s. Large areas of rainforest in the Amazon were eventually filled with livestock, soybean farming, excavation of dams and minerals, as well as clearing of land for urban projection and colonialization projects.   Conclusion: From this writing, it can be concluded that the deforestation that occurs in the Amazon Forest is caused by human activities or irresponsible parties who turn the forest into land for personal gain.

Abstract

Tindakan Union Busting (penghalang-halangan) serikat pekerja/buruh di Indonesia menjadi salah satu permasalahan yang cukup krusial. Praktik Union Busting yang dilakukan pengusaha atau majikan telah memberikan dampak yang serius bagi hak-hak normatif pekerja. Tidak hanya itu, mekanisme Union Busting semakin sulit untuk dibuktikan karena para pengusaha atau pihak perusahaan yang memiliki taktik tertentu. Hal ini terjadi pada tindakan penghalang-halangan serikat pekerja yang menggunakan Pemutusan Hubungan Kerja (PHK) sebagai instrumennya. Permasalahan yang terjadi selain terkait upaya tersembunyi yang dilakukan pengusaha, hal demikian juga terkait dengan peran aparat penegak hukum khususnya pengawasan karena belum optimalnya pengawasan pada bidang perburuhan khususnya perkara Union Busting. Oleh karena itu, melalui artikel ini akan dikaji dengan menggunakan metode yuridis normatif (pendekatan peraturan perundang-undangan) mulai dari PHK dan mekanismenya sebagai instrumen Union Busting hingga penegakan hukumnya.

Abstract

This study is to examine the legal convergence related to environmental protection policies with investment policies in a constitutional perspective. The environment has become a supreme power in the constitutional life of Indonesia. The concept of environmental sovereignty is clearly regulated in Article 25A, Article 28H paragraph (1) and Article 33 paragraph (3) and (4). These articles provide green nuances to the 1945 Constitution, so that the implementation of the articles in the 1945 Constitution provides new thinking for lawmakers so that the concept of the environment can be realized in every law made. The problems that will be in this study are How is the Convergence of Law Related to Environmental Protection Policy with Investment Policy in Constitutional Perspective Environmental Protection Policy with Investment Policy. Abstract

ABSTRAK. Pengelolaan irigasi di Kabupaten Tanggamus belum dilandaskan pada peraturan daerah dan belum dilakukan dengan baik, hal ini terlihat dari coverage jaringan irigasi yang hanya dapat mengaliri 5.000 Ha sawah sehingga setiap tahunnya mengakibatkan trend penurunan produksi pertanian. Penelitian yang bertujuan untuk memetakan legal framework kebutuhan pengelolaan irigasi di Kabupaten Tanggamus Provinsi Lampung ini dilakukan dalam koridor doctrinal research serta menggunakan statute dan conceptual approach. Adapun temuan penelitian ini adalah: Legal framework kebutuhan Perda Pengelolaan Irigasi di Kabupaten Tanggamus Provinsi Lampung diatur dalam 12 peraturan perundang-undangan terkait pengelolaan irigasi yang isinya memaparkan aspek kewenangan dan aspek substantif pengelolaan irigasi yang dapat dijadikan dasar dalam pembentukan Perda tentang Pengelolaan Irigasi di Kabupaten Tanggamus. Legal framework tersebut, selain dalam bentuk rezim hukum yang sifatnya sektoral, berkaitan juga dengan rezim hukum pemerintahan daerah. Legal Framework of Local Regulation Irrigation Management Needs in The District Tanggamus Lampung Province  ABSTRACT. Irrigation management in Tanggamus not be based on local regulations and have not done well, it can be seen from the irrigation network coverage that can only flow through 5,000 hectares of rice fields so that each year resulting in a decline trend in agricultural production. The study aimed to mapping the legal framework needs of irrigation management in Tanggamus District, Lampung Province is done in the corridors of doctrinal research as well as the use of the statute and conceptual approach. The findings of this study are: Legal framework needs of regulation Irrigation Management in Tanggamus Lampung province arranged in 12 (twelve) legislation related to irrigation management that it exposes aspects of authority and substantive aspects of irrigation management which can be used as a basis for the establishment of Regulation on Management irrigation in Tanggamus. The legal framework, other than in the form of legal regime sectoral nature, is also related to the legal regime of the regional autonomy.
