Abstract

ABSTRAK: Desa atau yang dikenal dengan istilah lain merupakan satuan pemerintahan terkecil yang memiliki kewenangan otonom untuk mengatur dan mengurus pemerintahannya sendiri. Sebagai satuan pemerintahan terkecil yang berada di daerah, banyak persoalan pemerintahan terkait penataan desa yang dihadapi seperti: efektifitas penyelenggaraan pemerintahan, peningkatan kualitas pelayanan publik dan kesejahteraan masyarakat, yang tentu saja membutuhkan peranan aktif pemerintah daerah melalui regulasi yang mendukung pembangunan desa. Tulisan ini bertujuan memberikan algoritma/formula Peraturan Daerah Penataan Desa yang mampu mewujudkan desa yang maju dan berdaya saing. Dengan menggunakan pendekatan socio legal dan teori perundang-undangan serta konsep hukum pengayoman dan hukum progresif, dihasilkan algoritma peraturan daerah sebagai berikut: Peraturan Daerah Penataan Desa harus beranjak dari persoalan riil yang secara umum terjadi di suatu daerah dengan melandaskan pembentukannya pada aspek filosofi, sosiologis dan yuridis; peranan pemerintah daerah harus ditegaskan sampai pada aspek pendanaan hingga pengawasan dan evaluasi; memberikan ruang akses yang seluas-luasnya bagi desa untuk mengembangkan potensinya terkait pemekaran maupun perubahan status. Dengan demikian, diharapkan desa yang maju dan berdaya saing dapat terwujud melalui Peraturan Daerah Penataan Desa. Local Regulation Algorithm of Village Arrangement Toward A Visible and Competitive Village ABSTRACT: The village or other known term is the smallest unit of government with autonomous authority to regulate and administer its own government. As the smallest government unit in the region, many governance issues related to village arrangement are faced such as the effectiveness of government administration, improvement of public service quality and community welfare, which of course require active role of local government through local regulation that supporting village development. This paper aims to provide an algorithm/formulation of Local Regulation Village Arrangement that is able to realize a visible and competitive village. By using socio legal approach and the theory of legislation as well as the concept of hukum pengayoman and hukum progresif, the result of local regulation algorithm as follows: Local Regulation of Village Arrangement must be moved from real problem which generally occur in a region by based its formation on philosophy, sociology and juridical aspect; The role of local government should be emphasized to funding aspects up to monitoring and evaluation; Provide the widest possible access space for villages to develop their potential for division and status change. Thus, it is expected that visible and competitive villages can be realized through the Local Regulation of Village Arrangement.

Abstract

Provisions of Law no. 41 of 2009 concerning the Protection of Sustainable Food Agricultural Land (UU PLP2B) is basically intended to classify a certain area of land that is allowed for appropriate food agriculture activities. This research is to examine the problems of sustainable agricultural land protection after the Job Creation Act and find a solution. The research method is a normative research method with a statute approach and uses content analysis. The findings of this study are changes in agricultural land protection regulations that can cause significant shrinkage of agricultural land and threaten farmer groups for investment. The abolition of the obligation to provide replacement land for affected farmers is not profitable for the farmer, because he will lose his agricultural land. The solution is that the government in determining the location of development projects must avoid the use of fertile/productive agricultural land.

Abstract

This study aims to determine whether the settlement of criminal cases through restorative justice is an effort to fulfill the constitutional rights of citizens. The method used in this research is normative legal research with a statutory approach and a conceptual approach. The results of the study show that the settlement of cases through restorative justice is an effort to fulfill the constitutional rights of citizens because the principle of resolving cases through restorative justice can be said to be more able to guarantee justice and equality before the law (equality before the law) as regulated in Article 27 paragraph (1), Article 28D paragraph (1) and Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia.

Abstract

One of the objectives of transmigration is to move people from one area to another in the context of population distribution and development. Transmigration participants will be given residential land and business land. The promised land for business often needs to be clarified or still has the status of forest land. Transmigrants are still facing the problem of obtaining business land so horizontal and vertical land disputes are often found in the province of Lampung. This study aims: first, to analyze government policies in resolving land status disputes in transmigration villages in Lampung Province. The type of research used is normative empirical with a statutory approach. Legal materials required by legislation, documents, and library materials. The data obtained were analyzed using qualitative methods. The results of the study show that the Government's Policy in Settlement of Transmigration Village Land Status Disputes in Lampung Province, especially in the Purwotani village area which is included in Register 40 Gedongwani is carried out through a community empowerment program in the form of a social forestry program which is in line with Presidential Regulation 88 of 2017 concerning the Settlement of Land Tenure in Forest Areas. The legal implication is that transmigrants do not get land ownership rights as business land but only use forest land (social forestry). It is recommended to the government considering that transmigrants control land business first then the determination of the Gedongwani Register 40 forest area, the government should release the forest area by changing the forest area boundaries and give it to transmigrants with land ownership rights, and not limited to social forestry.

Abstract

Tulisan ini mengajukan argumentasi bahwa modal sosial masyarakat, partisipasi komunitas-komunitas agama di suatu wilayah merupakan salah satu faktor pendukung bekerjanya instrumen hukum dan kebijakan. Tulisan ini mengambil studi di Kota Metro yang mayoritas masyarakatnya adalah suku Jawa dan juga memiliki beragam pemeluk agama. Filosofi hidup Rumongso Melu Handarbeni yang diyakini oleh masyarakat Jawa dalam prakteknya ikut mendukung berbagai program Pemerintah Kota Metro. Di sisi lain keberadaan berbagai komunitas agama yang ada di Kota Metro sesungguhnya memiliki potesi yang besar dalam mendukung Kota Metro yang berwawasan lingkungan. Agama dengan ajaran tentang kepedulian lingkungan akan dapat menjembatani proses bertemunya modal sosial dan kebijakan pemerintah dalam mengatasi permasalahan lingkungan khususnya sampah di Kota Metro. Agama Islam dan Kristen dapat menjadi prototype dalam membangun kesadaran lingkungan antarpemeluknya. Pada konteks inilah usaha Pemerintah Kota Metro dalam membentuk sebuah produk hukum daerah sebaiknya memperhatikan modal sosial masyarakat. Hal ini harapanya akan mampu mendukung proses transformasi Kota Metro menuju Kota yang berwawasan lingkungan.This article discribes about social capital behold, the participate of religion communities in the region is one of the supporting factor to operation of legal instruments and the policy.This paper a study in Metro when the major of Javanese and also has a variety of faiths. The Philosophy of life RumongsoMelu handarbeni believed with Javanese to supporting the various programs of Metro’s Government. Therefore, the existence of the religion communities in Metro actually has a great potention to be support of Metro’s environmentally concept. Religion with theory about environmental concerns will be able to bridge the convergence of social capital and government policies to superintend environmental issues specially of waste in Metro. Islam and Christianity can be a prototype to build environmental awareness among its adherents. In this context, the Metros’ Government efforts to arrange a legal product should be attention the community’s social capital. It can be to support the process of transformation Metro City of environmentally concept.

Abstract

Indonesia, known as a Country with high biodiversity, faces significant challenges in protecting its genetic resources from the increasing threats of exploitation and biopiracy, often perpetrated by foreign entities exploiting Indonesia's genetic wealth without proper authorization or fair benefit-sharing. Therefore, it is crucial to analyze the legal protection of genetic resources in Indonesia as communal intellectual property, particularly in relation to the Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) and national efforts to protect genetic resources. This study employs a normative legal research method, examining various legal sources to address issues related to genetic resources. The research adopts a statutory and conceptual approach by analyzing existing legislation and the protection frameworks implemented in Indonesia for genetic resources. A qualitative analysis is further conducted by describing and interpreting various research sources to provide comprehensive answers to the research questions. The Result indicate that the TRIPS Agreement offers intellectual property protection standards that predominantly emphasize individual rights, failing to fully address the protection of communal intellectual property. In response to this limitation, Indonesia has implemented national policies, including Government Regulation No. 56 of 2022 and the Access and Benefit Sharing (ABS) mechanism. These policies aim to protect indigenous peoples' rights and ensure that the benefits derived from the utilization of genetic resources are distributed equitably. However, the implementation of these protections faces significant obstacles, such as weak institutional capacity, limited public awareness, and gaps in harmonization with international standards. To address these challenges, strategic measures are necessary, including strengthening cross-sector coordination, enhancing indigenous community education, and developing a more comprehensive benefit-sharing mechanism. These steps are essential to ensure that genetic resources are not only protected but also contribute sustainably to the nation’s welfare.

Abstract

Pesatnya perkembangan pasar modern saat ini berbanding terbalik dan bahkan menjadi ancaman bagi eksistensi pasar tradisional (pasar rakyat) yang merupakan motor penggerak perekonomian rakyat. Kontrasnya, pengaturan dalam produk hukum daerah justru berpihak pada pertumbuhan pasar modern dan mengesampingkan keberlanjutan pasar rakyat. Kajian ini bertujuan untuk menguji pengaturan mengenai pasar modern dan pasar rakyat dengan indikator nilai-nilai Pancasila. Penelitian ini sangat urgen dilakukan guna mengidentifikasi dan menyelesaikan problem hukum dalam pengaturan pasar modern dan pasar rakyat saat ini. Kajian ini menggunakan metode penelitian hukum normatif dengan pendekatan filosofis, pendekatan konseptual, dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa ada ketimpangan pengaturan yang terjadi dalam perumusan pasal per pasal pengaturan dalam produk hukum daerah. Ketimpangan tersebut berupa keberpihakan pemerintah daerah terhadap pasar modern dan lemahnya perlindungan terhadap pasar rakyat. Keberpihakan ini dapat dimaknai sebagai sebuah perubahan paradigma pembangunan yang lebih berorientasi pada liberalisasi perdagangan dibanding perlindungan terhadap pasar rakyat sebagai warisan budaya bangsa yang mencerminkan nilai-nilai Pancasila yaitu nilai kegotongroyongan, solidaritas dan kebhinekaan. Untuk itu, ke depan, regulasi yang mengatur mengenai penataan pasar modern dan pasar rakyat hendaknya dapat menyeimbangkan keduanya dan konsisten, koheren dan koresponden dengan nilai-nilai Pancasila.

Abstract

Purpose: This study investigates the legal legitimacy and democratic consequences of the “empty box” (kotak kosong) mechanism in Indonesia’s local elections, particularly in uncontested single-candidate regional head races. The increasing frequency of such elections raises concerns regarding diminished political competition, legitimacy, and voter choice within Indonesia’s democratic processes. Methodology/approach: This study adopts a normative juridical approach by analyzing statutory laws, especially Law No. 10 of 2016, and key Constitutional Court rulings, such as Decision No. 100/PUU-XIII/2015. Additionally, this study incorporates secondary data from relevant local election cases and academic literature published between 2016 and 2024. Results/findings: The findings reveal that the empty box mechanism is legally acknowledged and constitutionally permitted as a tool for democratic resistance. However, its increasing usage reflects systemic problems: weak internal democracy among political parties, the dominance of political elites, and the absence of viable alternatives. These factors contribute to declining electoral competitiveness and limit the meaningful participation of voters. Conclusions: While the empty box offers a symbolic form of dissent, it does not resolve deeper structural constraints undermining local democratic processes. This mechanism highlights dissatisfaction but fails to generate substantive democratic alternatives. Limitations: This study is limited to doctrinal legal analysis and case study reviews without empirical field research, which may restrict the generalizability of its findings to other countries. Contribution: This study contributes to the ongoing discourse on electoral reform in transitional democracies by assessing the empty box as an instrument of political expression and identifying the need for structural democratic improvements.

Abstract

The widespread misuse of Komix cough medicine can be seen from the discovery of many packets of cough medicine in places where teenagers usually gather. Abuse of Komix cough medicine is increasingly widespread, as indicated by the frequent findings and increasing number of cases among teenagers in the Kanyurang village community. Efforts to overcome the abuse of class III narcotics contained in the drug Komix among teenagers in the Lampung Regional Police area are carried out with several efforts, including Pre-emptive, which is the first step for prevention carried out by the police by holding outreach and counseling. Preventive, is real prevention carried out by the Police in the form of vehicle raids in vulnerable areas where narcotics are distributed and trafficked. The final effort is Repressive, which has gone through several stages, namely inquiry, investigation, arrest, search, confiscation, examination, detention, and filing. The inhibiting factors in efforts to overcome the abuse of class III narcotics contained in the drug Komix among teenagers in the Lampung Regional Police are community factors and family factors, where there is a lack of understanding in the community, especially teenagers, about the dangers of drugs as well as social factors and the friendship environment. In efforts to overcome criminal acts through pre-emptive and preventive efforts, we can increase cooperation with religious institutions to strengthen faith for all levels of society and can tighten supervision, increase the intensity of patrols consistently, and carry out their duties and functions as law enforcement officers as regulated in the law. -invitation.keywords: Law Enforcement; Class III Narcotics; Komix Drugs.

Abstract

Corruption often occurs in Indonesian society. In terms of the amount of state financial losses, the number of cases, the scope that has penetrated every aspect of society's life, and the aspect of criminal acts that are carried out more methodically, developments continue to increase from year to year. The increase in uncontrolled corruption cases has the potential to be a disaster for the state, nation as well as the economy.This journal research is based on two problems, namely how the defendant recovers state losses caused by corruption committed by the Village Head and also how the judge considers when handing down a decision against the defendant for a criminal act of corruption committed by the Head of Braja Gemilang Village, East Lampung Regency (Decision Study Number 14/Pid.Sus TPK/2022/PN Tjk). Based on data obtained from a news portal, Firli Bahuri as Chair of the Corruption Eradication Commission (KPK) said that from 2012 to 2021, as many as 686 village heads were involved in village fund corruption in 601 cases. The high number of corruption cases committed by village heads is considered urgent considering the large number of APBD funds that are not allocated properly. The purpose of conducting this research is so that readers know, understand and analyze how judges can impose sentences on village heads who commit criminal acts of corruption and also so that readers can find out how defendants of criminal acts of corruption recover state losses in criminal acts of corruption.Keywords: Corruption, Village Head, Judge's Consideration
