Abstract

Perundungan atau bullying bukanlah fenomena yang baru, melainkan telah terjadi di berbagai belahan dunia, termasuk Indonesia, dan dapat dialami oleh siapa saja. Tindakan bullying banyak ditemukan di berbagai tingkat pendidikan, mulai dari sekolah dasar hingga perguruan tinggi. Meskipun jumlahnya lebih sedikit, perundungan di lingkungan perguruan tinggi tetap menimbulkan dampak serius, baik secara psikis maupun fisik, bahkan hingga menyebabkan kematian. Salah satu kasus yang mencuat terjadi di Kota Semarang, di mana seorang mahasiswi Program Pendidikan Dokter Spesialis (PPDS) menjadi korban perundungan di sebuah kampus ternama di Indonesia. Tindakan perundungan ini jelas melanggar hak asasi manusia dan bertentangan dengan prinsip kemanusiaan yang adil dan beradab sebagaimana tercantum dalam Pancasila, khususnya sila kedua. Pelaku perundungan terkait erat dengan studi kriminologi, yang mempelajari perilaku kriminal dan individu yang melakukan kejahatan. Artikel ini mengadopsi metode penelitian kualitatif dengan pendekatan studi pustaka untuk mengkaji lebih dalam mengenai fenomena perundungan di lingkungan perguruan tinggi, serta implikasi hukum dan etisnya.

Abstract

Viktimisasi merupakan konstruksi yang menjelaskan bagaimana seorang korban tercipta dari sebuah tindak pidana. Dalam viktimologi, para korban yang muncul karena sebuah tindak pidana memiliki klasifikasi atau yang dikenal dengan istilah tipologi korban. Dalam perkembangan viktimologi, konsep-konsep humanis seperti hak asasi manusia ikut terlibat dan hukum pidana tidak hanya berorientasi pada penegakan hukuman saja tetapi juga mulai memiliki dimensi repatriasi atas kerugian yang dialami oleh korban tindak pidana. Akan tetapi, terdapat permasalahan dualisme dalam menentukan korban, apakah pelaku tindak pidana tersebut merupakan korban atau bukan. Hal seperti ini dapat ditemukan dalam situasi konflik seperti peperangan. Hal ini akan berimplikasi pada penegakan hukum pidana dan repatriasi hak. Artikel ini membahas tentang viktimisasi, tipologi korban, dualisme viktimisasi dalam perang, dan repatriasi hak korban kejahatan perang dalam kasus kudeta militer Myanmar.

Abstract

Anti-Corruption education will continue to be needed with the aim of producing an honest generation for Indonesia. Local Javanese cultural wisdom has an important role in instilling Anti-Corruption Education values such as the values of honesty, discipline, simplicity, fairness, caring, hard work, independence, introspection and courage. The purpose of this study is to analyze the implementation strategy of instilling anti-corruption education values based on local wisdom of Javanese culture. This research method is descriptive qualitative research. The research setting in this study was State Middle Schools 4, 8, 19 Semarang Cyty, SMP Nasima dan SMP Al-Azar Semarang City. The data sources for this research are primary data sources, namely social studies teachers, students and school principals. Secondary data such as teaching modules, attitude journals, documentation, books, magazines, newspapers, written archives that are directly related to the object. Data collection techniques through observation, interviews and documentation. Test the validity of the data using source triangulation and engineering triangulation techniques. The data analysis technique uses interactive analysis of data collection, data reduction, data presentation and verification. The results of this research are local Javanese cultural wisdom values that are relevant to Anti-Corruption Education such as "Becik Ketitik Ala Ketara", "Asrah Jiwa", "Berbudi Bawa Leksana", "Aja Ngolek Wah, Mengko dadi Owah", "Ambrasta Dur Hangkara", "Aja Dahwen Yen Kepengin Kajen", "Adhang-adhang Tetesing Embun", "Ana Adu Ulate Ora Ana Begjane", "Aja Gumedhe".

Abstract

Tourism development in rural areas often encounters various legal challenges, especially concerning adherence to local regulations and respect for traditional values. This paper explores the legal aspects involved in the development of tourism villages within Wonogiri Regency, focusing on the integration of local wisdom. Wonogiri, a regency in Central Java, Indonesia, boasts a rich cultural heritage and a strong tradition of community-based governance. Through a comprehensive review of existing literature and legal documents, this study examines the legal framework governing tourism village development in Wonogiri, highlighting the incorporation of local wisdom into relevant regulations and policies. Additionally, it analyzes the role of legal mechanisms in safeguarding indigenous knowledge, protecting cultural heritage, and ensuring equitable benefits for local communities. By evaluating case studies and empirical data, this research identifies best practices and challenges in aligning legal frameworks with local values, offering insights for policymakers, practitioners, and stakeholders involved in sustainable tourism development. Ultimately, this study underscores the importance of harmonizing legal norms with indigenous principles to promote responsible tourism that respects the cultural integrity and socio-economic well-being of rural communities in Wonogiri Regency and beyond.

Abstract

The social welfare institution known as LPKS plays a crucial role in providing protection and guidance to children, though its implementation remains suboptimal. This discussion focuses on the LPKS strategy in shaping the social behavior of children with legal issues and the factors hindering its effectiveness. This research employs a qualitative descriptive method with a phenomenological approach, involving direct field observations, interviews, and documentation. The findings regarding the LPKS strategy in shaping the social behavior of children with legal problems include several aspects. Firstly, there is a normative role. Secondly, LPKS performs a practical role by addressing various needs such as mentoring, psychological therapy, spiritual or religious therapy, arts training activities, and legal protection throughout the legal process. Additionally, it provides educational guidance focusing on the developmental and mental aspects of children. Finally, the ideal role is to enhance LPKS performance. The primary inhibiting factor affecting the LPKS strategy in shaping the social behavior of children with legal problems is budget limitations. These limitations arise due to the substantial budget required to cover a large area, while existing resources remain insufficient.

Abstract

Birokrasi sebagai struktur, sistem, dan tatanan aturan yang ditetapkan dalam mengendalikan aktifitas organisasi pada sistem administratif penyelenggaraan negara dengan arah tujuan peningkatan kualitas pelayanan publik, akuntabilitas kerja, dan terhindar (korupsi, kolusi, nepotisme). Kebijakan pada dasarnya bentuk tindakan, kebijaksanaan, dan keputusan (eksekutif, legislatif, yudikatif) berdasarkan aturan hukum yang berlaku. Era disruptive innovation mengalami perkembangan teknologi informasi komunikasi, pergerakan kebijakan pemerintah berpengaruh besar pada birokrasi pelayanan publik khususnya disektor penerbangan. Hal ini menempatkan kenyataan bahwa tranportasi udara sangat penting sebagai penunjang aktivitas tiap individu diera kini dan dimasa yang akan datang. Harapan besar rakyat mendapat rasa keadilan, kesetaraan, jaminan, perlindungan, kesempatan, keamanan dan kenyamanan setiap pengguna jasa bandar-udara. Ekspektasi birokrasi pelayanan publik sesungguhnya patuh terhadap tatananan sistem prosedur dan aturan hukum yang berlaku untuk kepentingan bersama. Terobosan inovasi modern penyelenggaraan pelayanan publik mengedepankan standar transparansi sebagai bentuk (keadilan, kepastian, jaminan), serta menyiapkan SDM-multifaset yang memberikan pelayanan prima-excellent.

Abstract

This research examines and analyzes the concept and regulation of the trademark dilution doctrine, which has long developed in the United States, as a form of legal comparison, as well as the implementation of the dilution doctrine in the substantive examination of trademark registration in Indonesia. The research method used is normative juridical research employing statutory, conceptual, comparative, and case study approaches. This study uses secondary data in the form of primary, secondary, and tertiary legal materials, which are then qualitatively analyzed. Data collection techniques involve literature study by tracing widely published written information. The results of this study show that trademark violations in Indonesia are dominated by imitation marks, thereby requiring legal reform in trademark law through the adoption of the dilution doctrine similar to that of the United States. Article 21 paragraph (1)(c) of the Indonesian Trademark and Geographical Indication Law mandates the application of the dilution doctrine, although it does not explicitly regulate it. This indicates that Indonesia has the potential to implement the dilution doctrine. However, the significant differences between the United States and Indonesia make full implementation of the doctrine difficult. One of the main challenges in implementing the dilution doctrine is the communal character of Indonesian society. When analyzed using Jeremy Bentham’s Utilitarianism Theory, the result shows that implementing the dilution doctrine would produce greater pain for Indonesia. Therefore, adjustments and legal formulations are needed to accommodate the interests of all parties, including clear and detailed regulations that govern dispute resolution and evidentiary standards in court. The implementation of the dilution doctrine in substantive examination also needs to be tightened to reduce future trademark disputes.

Abstract

The oversight is carried out by the Ethics Council and MKMK, where the Ethics Council is responsible for enforcing breaches of the code of ethics and maintaining the dignity and integrity court. The existence of the Ethics Council is currently in a status quo, seemingly in a state of limbo because, on the one hand, the Constitutional Court has legally explained that the enactment of Law No. 7 of 2020 marks the end of the Ethics Council's existence. On the other hand, PMK No. 2 of 2014, which serves as a guideline for the supervision of the Ethics Council, has not yet been revoked by a new PMK. As a result, the mechanism for overseeing the code of ethics for Constitutional Court judges is in a vacuum and cannot function effectively. Attempts to explain how the oversight of the MKMK is viewed from both a historical and practical perspective within Indonesia's constitutional system. It then compares it with other countries and examines the issues surrounding the implementation of oversight over the Ethics Council and MKMK, effectively enforce the code of ethics for judges, and how the oversight mechanisms interact with descriptive-qualitative methods. The findings are numerous, including the ineffectiveness in handling ethical cases because no authority has been delegated to the Ethics Council, and MKMK is formed on an ad hoc basis. The creation of PMK for the formation of the Ethics Council is affected by conflicts of interest, and passive oversight by Constitutional Court judges occurs because the Ethics Council examines allegations of code of ethics violations based on reports from the public. Therefore, the author proposes a normative reformulation to restore the role of Judicial Commission as the external overseer of the Constitutional Court to maintain and enforce the honor, dignity, and proper conduct of Constitutional Court judges.
