Abstract

The village head's role as a mediator in palm oil theft cases essentially serves as a neutral third party to resolve conflicts between perpetrators and victims without resorting to the courts. This study aims to analyze the role of the village head as a mediator in resolving palm oil theft crimes related to the principle of justice in Pinarik Village, Dolok Sigompulon District, North Padang Lawas Regency. The village head's role as a mediator has a clear legal basis. Based on Law Number 6 of 2014 concerning Villages, the village government has the authority to manage and resolve problems that arise within the village. This study used a normative juridical method with data collection techniques through observation, interviews, and documentation. Informants in this study consisted of the village head, traditional leaders, and community members. The results indicate that the village head's role as a mediator has been quite effective, with a mediation success rate of approximately 90%. This success is influenced by several factors, such as the village head's neutral and fair attitude, support from village officials and community leaders, the community's level of legal awareness, and an understanding of the perpetrator's socio-economic conditions. Several obstacles were encountered, such as low public legal awareness, limited authority of the Village Head, economic factors, and the weak deterrent effect of sanctions imposed through mediation.

Abstract

The enactment of Law No. 1 of 2023 on the Indonesian Criminal Code (KUHP Baru) marks a fundamental shift in the regulation of concurrence of criminal offenses (concursus), replacing the mixed cumulative-absorption system inherited from the colonial Wetboek van Strafrecht. This study examines the transformation of sentence cumulation in concursus and evaluates the extent to which the new regime re-actualizes proportionality and individualization in sentencing. Employing a normative juridical method with statutory, conceptual, and comparative approaches, the research analyses Articles 123–128 of the new KUHP alongside doctrinal developments and hypothetical case simulations. The findings reveal that the new KUHP explicitly abandons the pure cumulative stelsel in favor of an aggravated absorption system (stelsel absorpsi yang dipertajam), whereby the maximum penalty for multiple acts is set at the most severe principal threat plus one-third, and judicial discretion is bounded by overarching sentencing objectives that mandate proportionality and individual culpability. The discussion demonstrates that this structural change harmonizes Indonesian concursus law with modern sentencing theories, particularly limiting retributive excess and enabling individualized sanctions. However, residual ambiguity in the definition of “multiple acts” and the absence of operational guidelines for aggravation pose risks of disparity. The article concludes that the new KUHP constitutes a significant normative advancement toward proportionality and individualization, but its practical realization demands coherent implementing instruments and intensive judicial training

Abstract

Legal protection for construction service providers in construction contracts remains inadequate despite the enactment of Law Number 2 of 2017 on Construction Services. The existing regulatory framework imposes extensive obligations on service providers while failing to establish effective legal consequences for service users who delay contractual payments, thereby creating an imbalance of rights and obligations. This study aims to examine the regulatory weaknesses in the legal protection of construction service providers and to propose a reconstruction of the legal framework grounded in the principles of Pancasila justice. Employing a normative legal research method, the study analyzes statutory regulations, legal doctrines, judicial principles, and conceptual approaches to identify inconsistencies within the current legal regime. The findings reveal that the existing framework does not adequately ensure equitable contractual protection, as Article 47 lacks explicit provisions imposing sanctions on service users for late payments. These deficiencies are reflected in three interrelated dimensions: legal substance, which fails to provide balanced sanction mechanisms; legal structure, characterized by the absence of an independent and competent construction contract audit institution; and legal culture, where procurement practices continue to prioritize the lowest bid over fairness, professionalism, and service quality. To address these shortcomings, this study proposes a reconstruction of Article 47 by introducing mandatory payment obligations within agreed contractual periods, accompanied by enforceable sanctions in the form of material and immaterial compensation for unjustified payment delays. The proposed reconstruction integrates the values of Pancasila justice, emphasizing balance, proportionality, good faith, and social justice as fundamental principles of contractual relations. The study contributes to the development of construction contract law by offering a justice-oriented regulatory model that strengthens legal certainty, enhances contractual fairness, protects construction service providers, and promotes a more equitable legal system in Indonesia's construction services sector

Abstract

Reconstruction plays a crucial role in criminal evidence, specifically to clarify and illustrate the occurrence of a crime by reenacting how the suspect committed the crime, thereby further convincing the investigator of the truth of the suspect's or witness's testimony. Reconstruction is used to obtain a picture of the criminal incident committed by the suspect and to reconcile the statements of the suspect and witnesses, thus clarifying the crime. The evidentiary power of the reconstruction (re-enactment) conducted by investigators during the investigation of a crime lies in the reconstruction's results, as evidence from the suspect/defendant outside of court. If it is consistent with other evidence, it will serve as a tool for finding evidence or clues in court.

Abstract

The rapid expansion of the digital economy, financial technology, cryptocurrencies, virtual assets, and blockchain has transformed financial transactions while simultaneously creating new opportunities for digital financial crime. Crimes such as online fraud, crypto-enabled money laundering, ransomware attacks, and cross-border illicit financial flows increasingly exploit technological innovations, making criminal asset recovery more complex. These developments expose significant weaknesses in Indonesia’s legal framework, particularly regarding the regulation of digital assets, tracing of criminal proceeds, and enforcement of effective recovery mechanisms. This study examines the shortcomings of Indonesia’s criminal asset recovery regime by analyzing the interaction between criminal liability, digital asset tracing, and compliance with Financial Action Task Force (FATF) standards. The research employs a doctrinal legal method using statutory, conceptual, comparative, case, and law reform approaches. The findings reveal that Indonesia’s regulatory framework remains fragmented and inadequately addresses the unique characteristics of cryptocurrencies and virtual assets. Regulatory inconsistencies, limited blockchain investigative capacity, weak beneficial ownership verification, fragmented institutional coordination, and incomplete alignment with FATF standards reduce the effectiveness of criminal asset recovery. Accordingly, this study proposes the Integrated Digital Asset Recovery Framework (IDARF), integrating criminal liability, blockchain-based asset tracing, beneficial ownership verification, FATF compliance, international cooperation, due process, human rights protection, and victim-oriented asset recovery. The proposed framework provides a normative foundation for legal reform through the enactment of a Digital Asset Recovery Act, the establishment of a Digital Asset Recovery Center, and strengthened institutional integration to improve Indonesia’s capacity to combat digital financial crime.

Abstract

Housing, as a basic human necessity, demands not only physical comfort but also assurance of safety and legal protection for its residents. In recent years, the rise in security violations within residential areas has raised serious concerns, especially regarding the authority of housing management and the frequent neglect of residents’ rights. Various security policies such as 24-hour gate security, CCTV installation, and visitor access restrictions are often enforced without a clear legal basis and without the participation of residents, thereby creating the potential for legal violations, including those related to criminal law and human rights. This study aims to analyze the forms of criminal liability that may be imposed on housing management in cases of negligence or abuse of authority in the implementation of security policies. It also examines the forms of legal protection available to residents and identifies potential criminal law violations arising from such policies. The research adopts a normative and empirical juridical approach, with a case study conducted at DL Sitorus I Housing Complex in Simalungun Regency. The results of the study show that the security policies at DL Sitorus I lack a valid internal legal foundation, were not developed through participatory means, and are not supported by standardized operating procedures (SOPs). This situation creates room for overreach by security personnel, such as arbitrary detention of visitors and unauthorized interrogations, which may violate Article 333 of the Indonesian Penal Code. Management may be held indirectly criminally liable under the principles of culpa in vigilando (negligence in supervision) and culpa in eligendo (negligence in the selection of personnel). The study recommends the formulation of internal regulations based on resident participation and the provision of legal training for security officers to ensure a fair, transparent, and legally compliant residential security system that upholds the principles of criminal law and human rights protection.

Abstract

The freedom of expression in public is a human right guaranteed in Indonesia's legal system through Law No. 9 of 1998. The handling of public demonstrations by the Indonesian National Police, particularly the Samapta unit, plays a strategic role in maintaining order and security during protests. This study aims to analyze the role of the Samapta unit in managing public demonstrations, identify the challenges faced, and examine the implementation of human rights principles in crowd control. Using a normative legal method with a juridical normative approach, this study analyzes secondary data in the form of regulations, legal literature, and official documents, as well as primary data from Law No. 9 of 1998, Law No. 2 of 2002 concerning the Indonesian National Police, and related regulations. The results show that the role of the Samapta unit in managing public demonstrations includes three main aspects: preventive, repressive, and educational. The preventive role is carried out through coordination and security preparations as stipulated in Article 10 of Law No. 9 of 1998, the repressive role involves the dispersal of protests under certain conditions as per Article 15, and the educational role is implemented through socialization and community guidance. However, the implementation of human rights in protest security still faces challenges in aspects such as proportionality of force, non-discrimination, accountability, and public participation. The study concludes that, although it has a strong legal foundation, improvements in regulations, human resources capacity, and supervision systems are needed in handling public demonstrations.

Abstract

The rapid expansion of algorithm-driven digital platforms has transformed the relationship between the state, citizens, and private technology companies, creating constitutional challenges beyond conventional constitutional law. Algorithmic governance increasingly enables private platforms to influence freedom of expression, privacy, access to information, and other constitutional rights, prompting the emergence of Digital Constitutionalism. However, existing scholarship largely emphasizes European and North American perspectives, while Indonesia remains underexplored. This study examines how the rule of law should be reinterpreted to address the constitutional implications of algorithmic governance in Indonesia. Using normative legal research with constitutional, statutory, conceptual, and comparative approaches, it analyzes constitutional provisions, legislation, judicial decisions, international legal instruments, and academic literature. The findings show that Indonesia's constitutional framework still focuses on state–citizen relations, despite the growing constitutional influence of digital platforms. Therefore, rule of law principles—including legality, legal certainty, due process, transparency, accountability, and equality before the law—should be reconstructed to accommodate algorithmic governance. The study proposes an Indonesian Digital Constitutionalism Framework that strengthens constitutional protection of digital human rights while providing guidance for constitutional reform, digital governance regulation, and democratic accountability in the digital era.
