Abstract

A marriage that is legal according to the law if the marriage is carried out according to each religion and belief and is recorded in accordance with the prevailing laws and regulations and is proven by a marriage certificate. However, some husband and wife only perform marriages that are legal according to religion and are not yet legally valid or carry out an underhand marriage so that it cannot be proven by a marriage certificate, so the couple can apply for Itsbat Nikah to the Syar'iyah Court by fulfilling predetermined conditions. This study aims to determine and understand the implementation of Itsbat Nikah in Lhokseumawe City, the legal consequences of unregistered marriages and recorded marriages. This study uses an empirical or juridical sociological method (sociological legal research) which is descriptive in the form of written or spoken words from people who are used as sources of information. The Itsbat Nikah was held in Lhokseumawe City by involving the APIK Legal Aid Institute which was energized with the government and the Syar'iyah Court in the Mobile Marriage program. The legal consequence of registering Marriage is to obtain legal certainty for married couples and children born in marriage. Itsbat Nikah can make it easier for the community to apply for a legal marriage but under the responsibility it becomes a legal marriage according to positive law and obtains a marriage book. The Lhokseumawe Government needs to socialize to the public about the importance of marriage registration, so that the community becomes more aware of the legal consequences and legal strength of marriage which is recorded in accordance with statutory regulations. Keywords: Itsbat Marriage, Legal Consequences.

Abstract

Industrial Revolution Era 4.0. requires us to continue to innovate, this innovation is something that is expensive and must be protected. One step to protect innovation is the protection of Intellectual Property Rights (IPR). Geographical Indications as one form of Intellectual Property Rights that has economic value, so it needs to get legal protection. This research is a qualitative research using Normative Juridical Approach.Geographical Indication is a sign that shows the area of origin of goods and / or products which due to geographical environmental factors including natural factors, human factors, or a combination of the two factors, give a certain reputation, quality and characteristics to the goods and / or products produced. To get protection for geographical indications, you need to request protection from the Minister. The concept of protection against geographical indications is communal protection, therefore applicants for geographical indications can come from the elements of: (1) Institutions that represent the public in a particular geographical area that is commercializing an item and / or product in the form of: a. natural resources; b. handicraft items; or c. industrial output. Abstract

In the section weighing Qanun Aceh Number 11 of 2018 on Islamic Financial Institutions (LKS) states that the juridical reason of the establishment of Qanun LKS is a follow-up to the implementation of Article 21 Qanun Aceh Number 8 of 2014 on the Principals of Islamic Shari'ah. After the promulging of Qanun LKS, many Conventional Bank Financial Institutions in Aceh decided to close their business in Aceh, so that if people still want to use conventional bank services, then the transaction must be done outside Aceh. In fact, almost all business actors in Aceh's economic activities are connected to outside areas, while in outside areas many business actors, especially corporations, have not fully used the Shari'ah banking system. The formulation of the problems discussed in this study is: "Is the legal politics promulgated Qanun Aceh Number 11 of 2018 on Islamic Financial Institutions has been able to improve the economy in Aceh?". The research method used in this research is normative-empirical research on the implementation of normative law provisions (laws) in action on any particular legal event that occurs in a society with a Live Case Study approach, which is an approach to a legal event whose process is still ongoing or has not ended. The results showed that in practice Aceh's economic independence is still very low, in the case of business actors, many obstacles are experienced in the services of Islamic banks, including difficulty making transactions with partners from outside Aceh who generally use conventional bank accounts. The advice given in this study is that conventional financial institutions that have been established in Aceh in facilitating the transactions of business people in Aceh and to succeed financial institutions based on islamic sharia principles only need to open Sharia business units from their conventional financial institutions that have been formed, this is in accordance with the mandate of Article 21 Qanun Aceh Number 8 of 2014 on The Principals of Islamic Shari'ah which is the basis or juridical reason of the establishment of Qanun LKS so that for business actors who transact with business actors outside Aceh who predominantly have not used shari'ah financial institutions can be facilitated in conducting business transactions, so that this will have an final impact on improving the economy in Aceh.

Abstract

The idea of Islamic law codification aims to provide clear limits on the law so that it is easy to be socialized in the midst of the community and to help the judge in referring to which law he will apply to the case faced without having to do ijtihad again. The problem in this research is how is the Islamic law codification system applied in Indonesia and how is the codification of Islamic law seen from the aspect of legal certainty that exists in Indonesia. The result of this study is the Islamic law codification system in Indonesia pursued through the path of Islamic law compilation sourced from Impres No. 1/1991, besides that the Islamic law which has become a positive law today is related to private law, namely ubudiyah and muamalah. Whereas those related to public law are still the idealized law. Islamic law codification will certainly be able to guarantee the values of legal certainty for the entire community,because it is appropriate that Indonesia has its own legal style that is independent of the legal culture of colonial heritage. Abstract

Mindanao is the second largest island in Philippines and one of the three main island groups along with Luzon and Visayas, the South Philippines . Mindanao is one of region in Southeast Asia which has been spectacularly a bright spot of world-class terrorism, because of the very high incidents of piracy and the ever-growing threat of terrorism. Southeast Asia is the region most vulnerable to piracy, accounting for about 50 percent of all attacks worldwide. This situation is exacerbated by the indigenous people of terrorist groups with strong maritime traditions. The nexus exchange between piracy and terrorism makes maritime terrorism in Southeast Asia a regional security concern. The Abu Sayyaf (ASG), Free Aceh Movement (Gerakan Aceh Merdeka, GAM), and Jemaah Islamiyah (JI) are the three terrorist groups in South Philippines, Southeast Asia with the intent and proven ability to engage in maritime terrorism. Of this group, the Abu Sayyaf is the best known but least understood and it has been source of tension in the South Philippines and Southeast Asia

Abstract

This article examines various government policy issues that often intersect with the interests of many people,even though policy is the main foundation in upholding integration between government, society and welfare. Thevarious policy processes that exist indicate that each policy must be formulated appropriately to create synergybetween inputs and outputs. This also applies to flood prevention in West Aceh. Therefore, this study will examinehow the existing policy models in West Aceh in dealing with floods? And how is the effectiveness of the policy inovercoming the flood disaster in West Aceh? This study is described using a qualitative descriptive approach andliterature study as the research method of this study. Some policies in West Aceh consist of policies made usingthe rational model and also the incremental model. In addition, the study found that the policy model for dealingwith floods in Aceh Barat has not had a positive impact on the annual flood mitigation that always occurs.

Abstract

The crime of corruption is a special offense which is regulated separately in the criminal law book. In the process of handling corruption cases, the principle of priority or precedence in the settlement process applies. This is in accordance with Article 25 of Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, which states that investigations, prosecutions, examinations in court in corruption cases take precedence over other cases for prompt settlement. This study aims to determine the application of material criminal law to the crime of livestock budget corruption in the case of decision Number 1/Pid.Pra/2019.Pn.Lsm, and to find out how the judge's considerations in making a decision on the crime of corruption in the livestock budget in decision Number 1/ Pid.Pre/2019.Pn.Lsm. This study uses a descriptive normative legal research method. Sources of primary and secondary legal materials, data collection techniques are library research, while the analysis of legal materials used in this study is qualitative analysis. Based on the results of the study, it is known that the application of material criminal law to perpetrators of corruption in the livestock budget in the case of decision number 1/Pid.Pra/2019.Pn.Lsm is that in its development, pretrial arrangements are regulated in Article 1 number 10 Jo. Article 77 of the Criminal Procedure Code, there is often treatment of law enforcement officials who are not really serious in reaching the material truth so that the person concerned does not get real legal protection from the state. For that obtain real legal protection from the state. For this reason, such developments can be accommodated through whether or not the determination of suspects is legal and whether the seizure is legal or not, it has been recognized as being the area of pretrial authority, so as to minimize arbitrary treatment by law enforcement officers. It is recommended that law enforcement officers, whether prosecutors, lawyers and judges, must have good knowledge of legal science, especially regarding the criminal law of corruption. If his actions are based on the proper application of criminal law from law enforcement, a sense of justice can be felt for all people.

Abstract

International community has recognized the superiority and quality of original Indonesian products, as a result, some native Indonesian products are claimed by foreigners as their trademarks, for example Gayo Arabica Coffee and Toraja Coffee. Indonesia in providing protection is a bit behind in seeing the potential of its own region. The research problem is to examine the juridical claims of foreign companies against products with potential Indonesian Geographical Indications, and the settlement mechanism based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications. Research method used is normative juridical with a statute approach. Claim of foreign companies against products with the potential for Indonesian Geographical Indications is the use of Intellectual Property Rights without rights, based on the MUI Fatwa decision, this is an injustice that is unlawful. The legal settlement mechanism for foreign brand claims against products with potential Indonesian Geographical Indications based on Law Number 20 of 2016 concerning Marks and Geographical Indications is dependent on the violation of the claim, whether the party making the claim is in good faith or not. If at the time a sign is applied for registration as a Geographical Indication, a sign is used in good faith, the party can still use it for a period of two years, but if there is no good faith, it can take the mechanism of filing a lawsuit in the form of an application for compensation against the User of the Geographical Indication without rights.

Abstract

Salak Sidimpuan yang berasal Tapanuli Selatan memiliki potensi untuk mendapatkan perlindungan hukum sebagai indikasi geografis. Penelitian ini menganalisis perlunya Salak Sidimpuan mendapatkan perlindungan hukum sebagai Indikasi Geografis Tapanuli Selatan dan upaya Pemerintah Daerah dalam rangka memberikan perlindungan terhadap Salak Sidimpuan sebagai kekayaan alam Tapanuli Selatan. Metode pendekatan penelitian yuridis empiris. Kabupaten Tapanuli Selatan menjadi lokasi penelitian dalam penelitian ini. Metode pengumpulan data melalui studi penelitian kepustakaan serta studi lapangan. Metode analisis dimulai dari pengumpulan data, reduksi data, penyajian data dan penarikan kesimpulan. Urgensi Salak Sidimpuan mendapatkan perlindungan hukum sebagai Indikasi Geografis Tapanuli Selatan karena secara ekonomis, salak sidimpuan memiliki pengaruh yang besar karena sebagian besar masyarakat Tapanuli Selatan perekonomiannya ditopang oleh buah Salak Sidimpuan. Secara Yuridis, Salak Sidimpuan yang memiliki karakteristik berbeda dengan salak daerah lain, memiliki reputasi yang baik, dan masih terjaga Eksistensinya sampai saat ini memerlukan perlindungan hukum sebagai Indikasi Geografis dan dapat dimiliki komunal bagi masyarakat Tapanuli Selatan. Upaya Pemerintah Daerah dalam memberikan perlindungan hukum terhadap Salak Sidimpuan hanya diberikan Pemerintah Daerah melalui Dinas Koperasi, Perindustrian dan Perdagangan Kabupaten Tapanuli Selatan. Pemerintah Daerah memberikan bimbingan, advokasi dan pembinaan terhadap Koperasi yang didirikan petani Salak Sidimpuan.

Abstract

Hukum adat yang dipraktikkan masyarakat Desa Bumi Sari dalam penyelesaian sengketa adalah melalui musyawarah yang melibatkan tokoh adat dan pihak terkait, namun praktik musyawarah ini belum merujuk pada aturan perundang-undangan yang berlaku seperti Pasal 6 UndangUndang Nomor 44 Tahun 1999, Pasal 98 Undang-Undang Nomor 11 Tahun 2006 yang juga memberikan penguatan atas keberadaan lembaga adat di Aceh, serta Pasal 13 Qanun Aceh Nomor 9 Tahun 2008 tentang Pembinaan Kehidupan Adat Istiadat. Masyarakat belum terbiasa dengan istilah Peradilan Adat, padahal sejatinya Peradilan Adat merupakan lembaga yang tepat dalam menyelesaikan perkara yang terjadi di masyarakat. Pengabdian masyarakat ini menggunakan metode sosialisasi dan diskusi mendalam terkait mekanisme penyelesaian sengketa non litigasi dan peradilan adat. Kegiatan pengabdian kepada masyarakat ini bertujuan meningkatkan pemahaman masyarakat Desa Bumi Sari terhadap mekanisme penyelesaian sengketa non litigasi melalui komunikasi peradilan adat. Pengakuan negara terhadap mekanisme non litigasi ini dimuat dalam beberapa peraturan perundang-undangan, secara khusus mekanisme penyelesaian sengketa melalui peradilan adat secara teknis operasional telah diatur dalam Peraturan Gubernur Aceh Nomor 60 Tahun 2013 tentang Pelaksanaan Penyelesaian Sengketa/Perselisihan Adat dan Istiadat. Pelaksanaan kegiatan pengabdian kepada masyarakat melalui sosialisasi ini memberikan informasi tambahan bagi peserta pengabdian sehingga meningkatkan pemahaman masyarakat Desa Bumi Sari mengenai mekanisme dan jenis perkara yang dapat diselesaikan melalui mekanisme peradilan adat. Diperlukan kegiatan lanjutan guna penguatan kapasitas bagi aparat pemerintahan gampong sebagai tokoh yang berperan dalam penyelesaian sengketa melalui peradilan adat.
