Abstract

Indonesia continues to face an increasing number of agrarian conflicts that are complex, multidimensional, and rooted in structural inequality in land control and use. The current litigation-based mechanisms, both in the General Court and the State Administrative Court, are often unable to provide quick, fair, and inclusive resolutions due to procedural rigidity, high costs, and public distrust. Nonlitigation efforts led by government agencies such as the National Land Agency (BPN) also tend to be ineffective due to a lack of neutrality and professional mediation capacity. In response, this study proposes the urgent establishment of an Alternative Dispute Resolution Institution (LAPS) specifically for agrarian disputes. LAPS aims to institutionalize mechanisms such as mediation, negotiation, and conciliation within a professional, independent, and participatory framework. Using a normative juridical method with statutory and conceptual approaches, this research argues that LAPS not only enhances legal certainty and access to justice but also aligns with progressive legal theories, distributive justice, and the sociolegal needs of marginalized communities. The institutionalization of ADR in agrarian law is a transformative step to achieve substantive justice and long-term social stability in land governance in Indonesia. This study found that the current litigation and non-litigation mechanisms are not yet effective in resolving agrarian conflicts fairly and inclusively. Therefore, the establishment of an independent and participatory Agrarian Dispute Resolution Alternative Institution (LAPS) is needed to realize substantive justice and legal certainty in land governance in Indonesia.

Abstract

The execution process of fiduciary guarantees in bankruptcy cases in Indonesia faces significant legal challenges. Although Law No. 42 of 1999 on Fiduciary Guarantees grants priority rights to creditors holding fiduciary guarantees, its implementation is often hindered by unclear procedures and inconsistencies between fiduciary guarantee law and bankruptcy law. This study aims to analyze the obstacles creditors face in executing fiduciary guarantees in bankruptcy cases and to find legal solutions to enhance legal certainty for creditors. The research method uses a normative approach, analyzing relevant regulations and court rulings, and comparing fiduciary guarantee law with bankruptcy law. The results indicate that legal uncertainty, a 90-day execution suspension after bankruptcy, and the role of the receiver, which delays the execution of fiduciary guarantees, are the main barriers. Therefore, it is recommended to implement legal reforms that provide clearer and more efficient execution procedures and ensure better protection of creditors' rights in bankruptcy situations. Thus, this study contributes to improving the fiduciary guarantee legal system in Indonesia.

Abstract

Catcalling or verbal sexual harassment is a social phenomenon that is rampant in Indonesia. It involves unwanted sexualized remarks that dehumanize the victim and can have a psychological impact. Although Law Number 12 of 2022 on Criminal Acts of Sexual Violence (UU TPKS) has regulated non-physical sexual harassment in Article 5, its application in the field still faces various obstacles. This study aims to determine the legal formulation of the application of sanctions against perpetrators of verbal sexual harassment (catcalling). This research uses an empirical normative approach. The results show that the legal formulation of the application of sanctions against perpetrators of verbal sexual harassment has progressed with explicit regulation in Article 5 of Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (TPKS Law). To realize substantive and effective justice, it is necessary to improve the formulation of sanctions, integrate non-criminal sanctions, increase the capacity of law enforcers, and strengthen public education.

Abstract

Buying and selling is an activity that takes place and is inherent in every society in the State of Indonesia. Therefore, there are many rules that regulate the matter of buying and selling in Indonesia. Agreements made by the community in terms of buying and selling must be clear and have a legal basis because every agreement born of an agreement is bound by law, as stated in article 1338 of the Civil Code (KUHPerdt). Buying and selling also has its own way, including buying and selling in the ijon or ngijon system, namely selling fruit that has not been seen. This research is categorized into the type of empirical normative legal research, it is based on the issues and or themes raised as research topics. Empirical normative legal research uses case studies in the form of products of legal behavior, for example reviewing laws and their application in society.

Abstract

This article aims to know and analyze efforts to reconstruct the principle of legal certainty which is the object of the case in the Ethics Court of the Ethics Council of the Election Organizer in Indonesia. This research uses normative legal research methods or doctrinal legal research. This article shows that there is legal uncertainty in the regulation of the Ethics Council of Election Organizers. Therefore, this article provides recommendations for specific arrangements regarding legal certainty that become material elements of the case that can be submitted to the Honorary Council of Election Organizers.

Abstract

Penelitian ini mengeksplorasi dampak impor pakaian bekas di Indonesia dari aspek ekonomi, kesehatan, dan hukum, serta menyoroti tantangan dalam implementasi kebijakan larangan impor berdasarkan Peraturan Menteri Perdagangan Nomor 51/M-DAG/PER/7/2015. Larangan ini bertujuan melindungi masyarakat dari risiko kesehatan yang disebabkan oleh pakaian bekas impor yang terkontaminasi bakteri dan jamur, serta mendukung industri tekstil lokal. Namun, pelaksanaan kebijakan ini menghadapi hambatan signifikan, termasuk lemahnya pengawasan di jalur distribusi dan celah regulasi akibat ketidakkonsistenan dengan peraturan lain, seperti Peraturan Menteri Keuangan Nomor 6/PMK.010/2022. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual untuk mengidentifikasi ketidaksesuaian regulasi dan menggali solusi berdasarkan prinsip-prinsip hukum. Hasil penelitian menunjukkan bahwa meskipun kebijakan ini dirancang untuk menciptakan keadilan sosial dan perlindungan konsumen, implementasinya masih belum efektif karena kurangnya koordinasi antarinstansi, rendahnya kesadaran masyarakat, dan adanya konflik norma yang menciptakan ketidakpastian hukum. Untuk mengatasi tantangan ini, diperlukan pengawasan yang lebih ketat, edukasi kepada masyarakat, dan insentif bagi UMKM tekstil agar mampu bersaing di pasar domestik. Selain itu, harmonisasi regulasi dan penerapan sanksi tegas terhadap pelanggaran menjadi kunci dalam memastikan keberhasilan kebijakan larangan impor pakaian bekas. Dengan langkah-langkah tersebut, kebijakan ini diharapkan dapat mendukung pertumbuhan industri lokal, melindungi konsumen, dan menciptakan ekosistem perdagangan yang berkelanjutan.

Abstract

Penelitian ini menganalisis efektivitas penegakan hukum terhadap pelanggaran izin tinggal oleh warga negara asing (WNA) di Gorontalo dalam perspektif hukum keimigrasian Indonesia. Penegakan hukum dilakukan melalui dua jalur utama, yaitu tindakan administratif keimigrasian seperti pencabutan izin, detensi, dan deportasi. Studi ini menggunakan metode yuridis normatif dan empiris dengan mengkaji regulasi, data kasus, serta wawancara dengan petugas imigrasi. Hasil penelitian menunjukkan bahwa meskipun kerangka hukum telah tersedia, implementasi di lapangan masih menghadapi tantangan berupa keterbatasan sumber daya manusia, koordinasi lintas instansi yang belum optimal, birokrasi yang rumit, serta rendahnya kesadaran masyarakat dalam pelaporan pelanggaran. Untuk meningkatkan efektivitas penegakan hukum, diperlukan penguatan kapasitas petugas, penyederhanaan prosedur, edukasi masyarakat, serta penguatan sinergi lintas sektor melalui TIMPORA. Pendekatan humanis juga penting agar penegakan hukum berjalan adil dan menghormati hak asasi manusia. Penelitian ini merekomendasikan reformulasi kebijakan dan penguatan koordinasi guna menciptakan sistem keimigrasian yang lebih responsif dan berkeadilan

Abstract

This study aims to analyze the regulation of dress for women in the Sharia Regional Regulation from the perspective of Human Rights by looking at the position of the Sharia Regional Regulation in the national legal system and laws and regulations and analyzing the Mukomuko Regional Regulation Number 5 of 2016, using normative juridical research methods with a Legislative, Historical, and Conceptual approach. This research needs to be carried out because of the large number of Sharia Regional Regulations that have emerged at the central government or local government scales that have the opportunity to trigger political, social and legal problems. Sharia Regional Regulations that enter the private space also harm Human Rights that have been guaranteed by the 1945 Constitution, such as in Mukomuko Regional Regulation Number 5 of 2016 which is found to violate Human Rights in principle. The formation of the Regional Regulation should be adjusted to national laws and regulations, namely paying attention to multicultural aspects and prioritizing the principles of Human Rights.

Abstract

The study aims to examine the legal implications of Law No. 3 of 2024 on the authority of the Supreme Audit Agency (BPK) in conducting financial audits of villages. The main issue raised is how these regulatory changes expand, clarify, and strengthen the role of the BPK in directly overseeing village financial management, as well as their impact on transparency, accountability, and financial governance in villages. The research approach applied is a legal study from the perspectives of legislation, history, comparison, and conceptual analysis. Information was collected through literature review using official regulations, official documents, legal literature, and relevant previous study findings. The study findings show that Law No. 3 of 2024 provides a stronger legal basis for the BPK to conduct direct audits of villages, no longer limited to audits of district/city budgets. The BPK's authority now includes administrative audits, performance audits, and investigative audits, making village financial oversight more comprehensive and substantive. The impact of these changes is increased transparency, accountability, and public participation in village financial oversight, as well as the strengthening of good governance principles at the village level. This study underscores the importance of strengthening village government capacity, inter-agency collaboration, and the development of open reporting systems to support the effectiveness of village financial oversight in the new regulatory era.

Abstract

The increase in bullying cases among children, particularly in the Gorontalo region, has raised serious concerns regarding legal protection and the psychological impact experienced by victims. This study aims to analyze the effectiveness of the law in providing protection for children as victims of bullying from a victimology perspective, as well as to assess the implementation of mediation or restorative justice systems applied by law enforcement officials. The method used is empirical legal research with a qualitative approach, involving observation, interviews with police officers, victims, perpetrators, and documentation studies at the Gorontalo Police Headquarters and the Women's Empowerment and Child Protection Agency. The findings of the study indicate that the role of the police in child protection has been carried out through preventive and repressive measures, but there are still obstacles in coordination between institutions and low public awareness. The mediation system or restorative justice is considered to offer a more humane alternative resolution, but its effectiveness heavily depends on the understanding and readiness of all parties involved. The implications of this study emphasize the need for strengthened education, improved capacity of law enforcement officials, and cross-sectoral collaboration to create an adaptive and responsive legal protection system for child bullying victims in Indonesia, particularly in Gorontalo.
