Abstract

Fenomena perkawinan paksa masih menjadi persoalan serius dalam masyarakat Indonesia, khususnya pada komunitas yang kental dengan norma adat. Artikel ini mengkaji bentuk perlindungan hukum terhadap korban perkawinan paksa di Kecamatan Panca Rijang, Kabupaten Sidenreng Rappang, dengan membandingkan regulasi dalam Undang-Undang Perkawinan dan norma adat setempat. Metode penelitian yang digunakan adalah normatif dengan pendekatan studi literatur dan empiris melalui wawancara mendalam dengan korban, orang tua, tokoh adat, dan aktivis HAM lokal. Hasil penelitian mengungkapkan adanya hambatan signifikan dalam implementasi perlindungan hukum nasional akibat dominasi dan pengaruh norma adat yang kerap bertentangan dengan UU Perkawinan, sehingga menyebabkan ketidakpastian hukum bagi korban. Terlebih, lemahnya koordinasi antar lembaga penegak hukum dan kurangnya pemahaman masyarakat turut memperburuk kondisi perlindungan. Penelitian ini menegaskan pentingnya harmonisasi antara hukum nasional dan norma adat, serta perlunya sinergi lintas sektor dalam pelaksanaan upaya perlindungan yang meliputi tahap preventif, represif, dan rehabilitatif. Kesimpulannya, pengintegrasian hukum formal dan tradisional menjadi kunci efektifitas perlindungan korban perkawinan paksa di wilayah tersebut, sekaligus mewujudkan perlindungan hak asasi yang komprehensif sesuai standar HAM nasional dan internasional

Abstract

The execution of fiduciary security at the Tunas Muda Savings and Loan Cooperative frequently encounters legal and factual obstacles despite being regulated under Law No. 42 of 1999, and has become increasingly complex following Constitutional Court Decision No. 18/PUU-XVII/2019, which restricts creditors’ unilateral authority to execute collateral. This study aims to analyze the legal effectiveness of creditor rights protection and to identify obstacles in the execution process of fiduciary security at the Tunas Muda Savings and Loan Cooperative. The research employs a socio-legal approach with an empirical legal research design, using primary data obtained through interviews and observations, and secondary data collected through document study, all of which are analyzed using qualitative descriptive techniques. The findings show that the legal effectiveness of fiduciary security execution is not yet optimal; the main obstacles include the non-registration of collateral objects, low legal awareness among debtors, limited litigation costs, and collateral objects that have been transferred or have depreciated in value. These results indicate that Constitutional Court Decision No. 18/PUU-XVII/2019 provides greater protection for debtors but simultaneously reduces efficiency and legal certainty for creditors by requiring court proceedings when default is disputed. The study concludes that enhanced compliance with fiduciary security registration by cooperatives and regulatory improvements are needed to balance protection between creditors and debtors so that fiduciary security execution can proceed more efficiently and fairly.

Abstract

This study examines the implementation of Article 4(1) of Law Number 8 of 1999 on Consumer Protection in the regulation and control of parking as an effort to fulfill consumer rights, particularly the right to safety and comfort in using parking infrastructure. Problems arise when breaches of obligation by parking attendants occur and they refuse to assume responsibility for their negligence, raising questions about the form of dispute resolution when no accountability is taken by the attendant. This study employed a socio-legal approach with an empirical legal research design to analyze the implementation of Article 4(1) of Law Number 8 of 1999 on Consumer Protection in parking regulation and to investigate monitoring and law enforcement activities related to on-street parking on Panjaitan Street in Gorontalo City. Field data and relevant regulations were analyzed to describe patterns in the fulfillment of legal obligations by parking attendants and the realization of consumer rights. The findings show that parking activities have been routinely monitored by the Transportation Agency; however, implementation remains constrained by limited monitoring facilities and the absence of a clear mechanism for allocating responsibility for damage to or loss of consumers’ vehicles. In conclusion, the implementation of consumer protection provisions in parking practices on Panjaitan Street has not yet fully ensured legal certainty of protection for consumers, thereby necessitating stronger monitoring mechanisms and more explicit formulations of parking attendants’ liability within the framework of consumer protection law enforcement.

This study critically examines the validity of illegal SIM card sales agreements under Article 1320 of the Indonesian Civil Code. The proliferation of digital telecommunications has triggered unlawful registrations using manipulated personal data, creating fundamental legal flaws in consumer contracts. Employing a normative juridical methodology, this research demonstrates that such illicit transactions categorically fail to fulfill the objective requirement of a lawful cause. Consequently, these defective agreements are deemed strictly null and void, mandating total restitution. Furthermore, the ensuing legal liability is multidimensional: civil liability burdens negligent sellers, strict administrative sanctions apply to telecommunication operators, and severe criminal penalties target data falsifiers. Injured consumers retain absolute rights to seek comprehensive compensation through robust dispute resolution mechanisms or formal civil litigation. Ultimately, this study highly recommends strengthening statutory regulations and harmonizing the Civil Code, Consumer Protection Law, and Personal Data Protection Law to ensure absolute national legal certainty for all citizens.

Abstract

This study examines the legal consequences of land sale and purchase transactions based on receipts on ownership rights within the Indonesian agrarian legal system. The main issue lies in the practice of the community, which still uses receipts as the basis for transactions without fulfilling the formal procedures established by law. This study aims to analyze the evidentiary weight of receipts and their implications for the legal certainty and protection of land rights. The method used is normative legal research employing a legislative, conceptual, and case-based approach, through a literature review of primary and secondary legal sources. The results of the study indicate that a receipt only serves as evidence of payment and cannot legally prove the transfer of land rights. Consequently, transactions based on receipts do not provide legal certainty and have the potential to lead to disputes. In conclusion, the transfer of land rights must meet formal requirements through an authentic deed and land registration to ensure legal certainty and the protection of rights.

Abstract

This study examines the inconsistencies in the regulation of inheritance rights for adopted children within Indonesia’s positive legal system, which is influenced by legal pluralism namely, civil law, Islamic law, and customary law. The primary issue lies in the inconsistency of legal norms, which creates legal uncertainty and the potential for injustice toward adopted children who, sociologically speaking, have become part of the family. This study aims to analyze the normative status of adopted children in inheritance matters and to identify the conflicts of norms that arise. The method used is normative legal research employing legislative, conceptual, and comparative approaches, analyzed qualitatively through legal interpretation and argumentation. The results of the study indicate that adopted children have not been consistently recognized as heirs, with limited solutions such as mandatory wills that do not fully guarantee substantive justice. Furthermore, differences in judicial interpretation reinforce legal uncertainty in practice. This study underscores the importance of harmonizing and reforming inheritance law to create legal certainty and justice that is more responsive to social realities.

Abstract

The rapid growth of financial technology lending (fintech lending) in Indonesia has increased public access to digital financing but has also created legal problems related to consumer protection against default risks. Consumers frequently face unlawful debt collection practices, misuse of personal data, lack of transparency in loan terms, and legal uncertainty caused by illegal fintech lending platforms. Although various studies have discussed fintech legality and consumer protection, limited research has specifically examined the effectiveness of legal protection against default-related risks and the responsibility of fintech lending providers. This study aims to analyze consumer legal protection in fintech lending services and evaluate the responsibility of providers in safeguarding consumer rights. The research employs a normative legal method using statutory and conceptual approaches. Data were collected through a literature review of legislation, legal doctrines, and scholarly publications concerning consumer protection and fintech lending. The findings indicate that existing regulations, including consumer protection, personal data protection, and fintech lending regulations, have not been fully effective due to weak supervision of illegal platforms, inadequate enforcement of personal data protection provisions, and persistent abusive debt collection practices. The study concludes that fintech lending providers must ensure transparency, data security, and ethical collection procedures. Strengthening regulatory supervision, improving coordination between relevant regulations, and imposing stricter sanctions on illegal operators are necessary to enhance consumer protection and create a secure and sustainable digital financial ecosystem.

Abstract

This study aims to analyze the legal position of itsbat nikah on marriages that take place when one of the parties is still bound by a valid marriage and examine how religious courts balance the principle of monogamy with the usefulness of law in judicial practice. This study fills in the gap of previous research that focused more on judges' considerations and the legal consequences of marriage itsbat, while the analysis of normative inconsistencies between marriage legalization and marriage prohibition is still limited. The research uses normative legal methods with legislative, case, and conceptual approaches. Primary legal materials are in the form of laws and regulations and the Decision of the Gorontalo Religious Court Number 311/Pdt.P/2019/PA. Gtlo, supported by secondary legal material that is analyzed qualitatively through systematic and grammatical interpretation. The results of the study show that the granting of the application for itsbat nikah in the decision is normatively contrary to the principle of monogamy and the provisions of the prohibition of marriage in Indonesian marriage law. However, judges use judicial reasoning that is oriented towards the usefulness of the law by prioritizing the protection of family legal status, the certainty of civil relations, and the interests of the parties. These findings show a conflict between legal certainty and legal expediency in the implementation of itsbat nikah. The study concluded that the practice of granting itsbat nikah to marriage carried out while still bound by a previous marriage reflects normative inconsistencies in the application of marriage law. Therefore, clearer and more consistent judicial guidelines are needed to ensure harmony between the protection of civil rights and the enforcement of the principle of monogamy in religious judicial practice.

Abstract

The rapid advancement of digital technology has given rise to cryptocurrency as a new economic instrument that challenges the traditional concepts of property under Indonesian civil law. This study analyzes the legal status of cryptocurrency assets within the Indonesian civil law system and the urgency of transforming the concept of property to accommodate modern digital realities. The main issue discussed is the ambiguity surrounding the status of cryptocurrency assets as legal objects under the Civil Code (KUHPerdata), which still primarily focuses on tangible physical objects, thereby creating a legal void in protecting property rights and digital asset transactions. This research employs a normative legal method with an analytical approach to examine legislation, legal doctrines, and comparative studies of international regulations. The findings indicate that although cryptocurrencies have been recognized as commodities through regulations by Bappebti and OJK oversight under the P2SK Law, their legal status as civil objects remains ambiguous because the Civil Code has yet to accommodate intangible digital objects with economic value. The study identifies the transformation of the property concept through the deconstruction of the physical existence requirement as an urgent need to ensure legal certainty and adequate protection for cryptocurrency users. The research recommendations include expanding the definition of "property" in the Civil Code, explicitly regulating property rights over cryptocurrency assets, and developing adaptive digital dispute resolution mechanisms to establish a civil law system responsive to the development of modern financial technology.
