Abstract

The upcoming 2024 General Election (Pemilu) is a new milestone in the conduct of democratic festivities in Indonesia. The year 2024 marks the starting point where elections are held simultaneously every five years, considering another dimension, which is the simultaneous holding of Regional Head Elections (Pilkada) in the same year. One of the cornerstones of the Election Supervisory Board (Bawaslu) is the Sub-district Election Supervisory Committee, known as Panwascam. Panwascam is the lowest-level election supervisory institution that is most effective and equipped to handle electoral violations while serving as a filter for handling violations. Therefore, the capacity and competence of Panwascam are crucial in handling electoral violations. The Chairperson and Members of Bawaslu Muaro Jambi during the 2020 Pilkada had to deal with cases of alleged ethical violations (even if found not proven to have violated ethics). However, what is of concern is that these reports emerged as a consequence of the handling of violations carried out by Bawaslu Muaro Jambi Regency. This workshop will enhance the understanding and knowledge of Panwascam, who predominantly do not have a legal education background, to comprehend the concepts of reasoning, interpretation, and legal analysis. ABSTRAKPemilihan Umum (Pemilu) serentak 2024 mendatang merupakan warna baru dalam penyelenggaraan pesta demokrasi di Indonesia. Tahun 2024 merupakan starting point dimana Pemilu diselenggarakan secara serentak setiap lima tahun sekali mengingat dimensi lain yakni Pemilihan Kepala Daerah (Pilkada) juga dilaksanakan secara serentak di tahun yang sama. Salah satu ujung tombak Bawaslu adalah Pengawas Pemilu Kecamatan atau yang dikenal dengan sebutan Panwascam. Panwascam merupakan Lembaga pengawas pemilu terbawah yang paling efektif dan memiliki kelengkapan organ penanganan pelanggaran Pemilu sekaligus sebagai filter penanganan pelanggaran. Maka dalam hal ini tentu kepasitas dan kompetensi Panwascam sendiri dituntut dalam hal penanganan pelanggaran Pemilu. Ketua dan Anggota Bawaslu Muaro Jambi pada Pilkada 2020 harus berhadapan dengan perkara dugaan pelanggaran etik (sekalipun diputuskan tidak terbukti melanggar etik), namun yang menjadi perhatian adalah laporan ini muncul karena imbas dari penyelesaian penanganan pelanggaran yang dilakukan oleh Bawaslu Kabupaten Muaro Jambi. Dengan dilakukannya Workshop ini akan dilakukan peningkatan pemahaman dan pengetahuan Panwascam yang dominan bukan berlatar belakang Pendidikan hukum untuk dapat memahami Konsep penalaran dan penafsiran serta pengkajian hukum.

Abstract

This article aims to analyze the regulation of the use of underwater drones in international law from the perspective of Indonesian law. This article concludes that the regulation regarding the use of underwater drones that cross national borders has not been specifically regulated both in international law and in national law. Therefore, it is necessary to make special arrangements regarding the use of underwater missiles in terms of attack, spying, and collecting marine data so that foreign countries do not freely operate underwater drones in the territorial sea of ​​other countries and do not violate the right of peaceful passage as regulated. in UNCLOS 1982. In the future, the government needs to strengthen the maritime security system in Indonesian territory and take firm action against persons involved in the entry of foreign military assets into Indonesian territory. Abstract

Abstrak. Perkembangan teknologi informasi telah membawaa perubahan besar dalam sistem penegakan hukum pidana di Indonesia, khususnya melalui pemanfaatan rekaman Closed Circuit Television sebagai alat bukti elektronik. Artikel ini menganalisis keabsahan rekaman CCTV dalam praktik peradilan pidana Indonesia dengan pendekatan yuridis normatif, mengkaji peraturan perundang-undangan, dokumen hukum, dan literatur akademik terkait. Hasil kajian menunjukkan bahwa meskipun KUHAP belum secara eksplisit mengatur alat bukti elektronik, legitimasi hukum terhadap rekaman CCTV telah diperkuat melalui Undang-Undang Informasi dan Transaksi Elektronikdan yurisprudensi Mahkamah Konstitusi. Pengakuan ini didukung oleh konsep functional equivalent approach, yang menempatkan bukti elektronik setara dengan alat bukti konvensional. Namun, keabsahan rekaman CCTV sangat bergantung pada keaslian, integritas, serta prosedur perolehan dan penyajian yang sesuai dengan hukum acara pidana, termasuk aspek forensik digital dan chain of custody. Tantangan utama meliputi sinkronisasi regulasi, pemahaman teknis aparat penegak hukum, dan perlindungan hak asasi. Artikel ini merekomendasikan penguatan regulasi, peningkatan kapasitas teknis, serta harmonisasi antara KUHAP dan UU ITE untuk mengoptimalkan penggunaan CCTV sebagai alat bukti yang sah, efektif, dan berkeadilan dalam sistem peradilan pidana Indonesia.Kata Kunci: Validitas: alat bukti elektronik; Digital Forensik; Hukum Pidana

Abstract

Budaya tidak berwujud merupakan warisan budaya dari leluhur yang diturunkan dari generasi ke generasi dimana sangat bernilai dan memiliki daya guna yang tinggi, oleh karenanya sangat penting untuk dilindungi. Penelitian ini bertujuan mengetahui bagaimana Perlindungan Hukum terhadap budaya tidak berwujud benda yang diatur dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 serta mengetahui upaya yang perlu dirumuskan oleh Indonesia untuk melindungi budaya tidak berwujud tersebut dalam kerangka penerapan Convention for the Safeguarding of the Intangible Cultural Heritage 2003. Permasalahan terkait hal ini yaitu perlindungan hukum mengenai warisan budaya tak berwujud benda di Indonesia melalui sistem hukum yang berlaku positif di Indonesia belum mampu secara maksimal, belum optimal dan unikatif dalam memberikan perlindungannya. Penelitian ini merupakan penelitian yuridis normatif dimana penelitian yang dilakukan dengan cara meneliti bahan pustaka terkait Perlindungan hukum terhadap budaya tidak berwujud berdasarkan Convention for the Safeguarding of the Intangible Cultural Heritage 2003 dan Penerapannya di Indonesia. Berdasarakan hasil penelitian dapat disimpulkan perlindungan terhadap budaya tidak berwujud sudah diatur dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 serta Peraturan Menteri dan Kebudayaan Nomor 106 Tahun 2013 Tentang Warisan Budaya Takbenda. Selain itu perlunya dibentuk sanksi dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 bagi negara pihak yang tidak menjalankan kewajiban pelestarian dan perlindungan budaya tidak berwujud di tingkat nasional.

Abstract

The purpose of this research is to knowwhat the aspects of international law in regards to the use of deepfake technology relating to personal data protection are, and how it impacts the Indonesia’s national law based on the law principle of social engineering which dictates that the law is created to guide people towards a better way, and the principle of social controlling as a planned process to force people to abide by the customs, norms and other values held by society so there won’t be any deviated behaviours specifically in the use of deepfake technology, and how to align international and national law using the principle of planning, organizing, actuating, and controlling. This research uses a normative law type of approach. The source of data used consists of: a) Primary legal material, such as Convention 108+, Convention for the Protection of Individuals with Regards to the Processing of Personal Data; Constitution and Convention of the international telecomunication union (with annexes and optional protocol). Concluded at Geneva on 22 December 1992; Republic of Indonesia's Act No. 19 (of) 2016 about Electronic and Information Transaction; b) As for the secondary legal material used are books, articles, journals, reports, and various scientific papers and etc. Which supports the primary legal material; c) As for the tertiary legal materials used are dictionaries, interviews, newspaper, the internet, and etc. Which can support both the primary and secondary legal materials. Data analysis are conducted in a descriptive-qualitative manner. This research specified the use of descriptive analysis.

Abstract

This research aims to provide a general understanding of the jurisdiction for rebel groups before and after their recognition as belligerents, or the shift of the groups in question from domestic legal subjects to legal subjects of the international law. The type of method used in this research is in the form of normative legal research, which utilizes the collection of legal materials relevant to the object of research in the form of literature; The materials referred to are such as: (a) Primary legal materials: The Charter of United Nation, The Geneva Convention, The Hague Convention; (b) Secondary legal materials: legal science books, legal science journals, legal research reports, scientific articles, seminar materials, workshops, and so on; (c) Tertiary legal materials: Legal materials which precepts or provides an explanation on the primary and secondary legal materials, such as legal dictionaries, newspapers, the internet and so on.

Abstract

Article 29 of the 1961 Vienna Convention stipulates that diplomatic officers are inviolable, may not be arrested or detained. They must be treated with respect and receiving countries must take appropriate steps to prevent attacks on their persons, freedoms and dignity. So the consequence arising from the inviolability of a diplomatic official is immunity from the jurisdiction of the receiving country. However, the jurisdictional immunity possessed by diplomatic officials can be waived by the sending country as contained in Article 32 of the 1961 Vienna Convention. This article aims to find out how the mechanism in the issuance of immunity (immunity waiver) by the sending country against diplomatic officials. The results of the study show that the subject who has the right to waive the immunity of diplomatic officials who commit violations in the receiving country is the sending country. This waiver of immunity can be carried out after an application is submitted by the receiving country and submitted by the Head of State, Minister of Foreign Affairs or the Head of the Diplomatic Representative of the sending country.

Abstract

Exploration activities and exploitation of natural resources are examples of causes of damage by human activities. One of the activities that are rampant in Indonesia is mining activities, one of which is unlicensed gold mining (PETI). These activities can have a sustainable impact on environmental damage and pollution and bring a number of adverse impacts to various sectors such as environmental, social and health which in the process use toxic materials, namely mercury, so that waste from mining can pollute rivers and the surrounding nature. So to avoid this, the Minamata Convention on Mercury is present as an international agreement that aims to reduce and eliminate the impact of mercury on environmental and human health. To implement the Convention, the Government of Indonesia has ratified the convention by issuing Law of the Republic of Indonesia Number 11 of 2017 concerning Ratification of the Minamata Convention on Mercury and Presidential Regulation Number 21 of 2019 concerning the National Action Plan for Reducing Mercury Elimination (RAN-PPM). Following up on these rules, law enforcement must be carried out on the activities of PETI which in the process used mercury.

Abstract

This article evaluates Indonesia’s progress towards its national goal of food security. To meet the Indonesian population’s right to food by formulating national policies and supporting regulations on agriculture for food sovereignty while conducting economic diplomacy utilizing its membership in the WTO Agreement on Agriculture and the G33 coalition. Normative juridical research and comparative legal analysis examine provisions concerning agriculture in Indonesia’s national legal instruments and WTO’s Agreement on Agriculture. The article finds that Indonesia has failed to attain either food security or food sovereignty, postponed by international negotiations where developed countries object to the developing and least-developed countries’ Special Products and Special Safeguard Mechanism. The provisions are imperative for supporting Indonesia’s economic growth to attain food security and eradicate poverty, considering the significant gap between developed and developing economies. This article suggests that Indonesia strengthen its bilateral economic relations with influential, more economically developed members of the WTO agreement to garner international support to meet national food security and exercise Indonesia’s right to regulate within its jurisdiction, leading to food sovereignty.

Abstract

Abstrak Eksistensi formulasi tindak pidana informasi dan transaksi elektronik di Indonesia yang diatur dalam Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik, Undang-Undang Republik Indonesia Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik, dan Undang-Undang Republik Indonesia Nomor 1 Tahun 2024 Tentang Perubahan Kedua Atas Undang-Undang Republik Indonesia Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik, telah sering dilakukan judicial review kepada Mahkamah Konstitusi. Dominasi pokok perkara judicial review adalah tentang kebebasan berpendapat seperti pasal pencemaran nama baik dan ujaran kebencian. Padahal, kebebasan berpendapat merupakan salah satu hak paling mendasar dalam kehidupan bernegara yang secara konstitusional diakui eksistensinya. Oleh karena itu, Majelis Hakim MK melalui Putusan MK Nomor 105/PUU-XXII/2024, menganulir salah satu unsur di dalam beberapa pasal yang berpotensi disalahgunakan untuk mengkriminalisasi kebebasan berpendapat di ruang digital. Kata Kunci:         Tindak Pidana, Informasi Dan Transaksi Elektronik, Pasca Putusan MK Nomor 105/PUU-XXII/2024
