Abstract

Abstract Coal mining activity is one of the sources of the non-tax state income sector that contributes to the state. However, the activity has a negative impact that damages the environment and other living creatures. This article focuses on how the impact of mining activities and the transportation of coal in particular in the Jambi Province is reviewed from the Paris Agreement perspective, international environmental principles, as well as from a human rights perspective. This research is carried out using normative juridical research. The result is that the mining and transportation of coal in the province of Jambi is an activity that reflects the lack of commitment of Indonesia as a ratifying party of the Paris Agreement, in terms of climate stability on Earth. This activity is also contrary to the principles of conservation and protection of the environment under national and international law because it creates imbalances in the environment through the presence of environmental damage and pollution. In addition, the activity is also indicated as a violation of the right to the living environment that should be accessible by every citizen. And for that, coal mining and transportation activities must be stopped by weighing the many negative impacts perceived by society and the environment. Abstrak Aktivitas pertambangan batubara merupakan salah satu sumber dari sektor penghasilan negara bukan pajak yang memberikan kontribusi kepada negara. Namun aktivitas tersebut memberikan dampak negatif yang merugikan lingkungan dan makhluk hidup lainnya. Artikel ini berfokus kepada bagaimana dampak dari aktivitas pertambangan dan pengangkutan batubara terkhususnya di Provinsi Jambi ditinjau dari Paris Agreement, prinsip lingkungan internasional serta dari perspektif hak asasi manusia. Penelitian ini dilakukan dengan menggunakan jenis penelitian yuridis normatif yang mana mendapatkan hasil bahwa aktivitas pertambangan dan pengangkutan batubara merupakan aktivitas yang mencerminkan kurangnya komitmen Indonesia sebagai negara yang turut meratifikasi Paris Agreement dalam hal menjaga kestabilan iklim di bumi. Aktivitas tersebut juga bertentangan dengan prinsip pelestarian dan perlindungan lingkungan menurut hukum nasional serta hukum internasional karena menimbulkan ketidakseimbangan pada lingkungan melalui hadirnya kerusakan dan pencemaran lingkungan. Selain itu, aktivitas tersebut juga terindikasi adanya pelanggaran terhadap hak atas lingkungan hidup yang seharusnya dapat dinikmati oleh setiap warga negara. Dan untuk itu, aktivitas pertambangan dan pengangkutan batubara harus dihentikan menimbang banyaknya dampak negatif yang dirasakan oleh masyarakat dan lingkungan.

Abstract

In the contemporary digital age, corruption has evolved into a common enemy, transcending borders and becoming a transnational and extraordinary crime. Within the ASEAN framework, corruption is no longer perceived as the concern of a single nation but as a shared threat to all member states and the global community at large. Despite the pervasive and deeply entrenched nature of corruption, concerted efforts have been made to combat this scourge. Among these measures, asset recovery stands out as an extraordinary tool, addressing not only the prevention and enforcement aspects but also the crucial task of repatriating ill-gotten gains to their rightful country of origin. Indonesia and the ASEAN community have entered into various treaties aimed at facilitating asset recovery, with the ASEAN Mutual Legal Assistance Treaty (AMLAT) serving as a pivotal legal instrument in this endeavour. Recognizing the transnational nature of corruption, interstate relations and diplomatic cooperation have assumed a vital role in supporting the success of asset recovery processes. This study explores the evolving landscape of corruption in the digital age, its transformation into a transnational concern, and the collective efforts undertaken within ASEAN to combat it. By focusing on asset recovery as an extraordinary measure, it sheds light on the multifaceted dimensions of eradicating corruption and emphasizes the importance of international collaboration in returning misappropriated assets to their rightful owners.

Abstract

The disposal of nuclear waste into the Sea of Japan is a complex and contentious issue that intertwines international law and environmental concerns. Japan, a major producer of nuclear waste, faces international pressure to manage this waste according to global legal and environmental standards. The United Nations Convention on the Law of the Sea (UNCLOS) provides a framework for managing marine resources, including waste disposal, but ambiguities in the law complicate the definition of state responsibilities. From an environmental perspective, the disposal of nuclear waste could have long-lasting detrimental impacts on marine ecosystems and human health, emphasizing the need for sustainability in decision-making processes. Moreover, international conventions like the Espoo Convention and the Aarhus Convention stress the importance of public participation in environmental governance, advocating for civil society's involvement to ensure public interests and concerns are addressed. This research aims to analyze Japan's disposal actions and explore the role of UNCLOS 1982 in protecting the international marine environment, using a normative juridical approach to examine legal conflicts, gaps, and ambiguous norms.

Abstract

This research discusses the reality of the metaverse with emphasis placed on the need for a rule of law for certain activities within it that is related to Private International Law. This research observes what the metaverse is, its prevalent structure and the recent dialectics on the place of international law as a comprehensive and much needed legal regime within its system. This article utilises a normative legal research methodology and uses qualitative data such as legal theories and related research to arrives at a certain conclusion on the place of Private International Law in the Metaverse. The first part of this research elaborates on the relationship between the Metaverse and Law and the importance of a clear rule of law in the Metaverse. The second part provides an overview of Private International Law in regards to the notions that exist within it to determine a prescriptive jurisdiction. The third section discusses tacit choice of law as an alternative answer to the current uncertainty in the commercial world of the Metaverse. While the last part talks about the incorporation of metaverse regulations in the domestic and regional scenes. The  article finds that the need for a clear legal framework not only in regards to choice of law but also for all aspects of the Metaverse is direly needed. While tacit choice can provide legal certainty in the world of commercial contracts, a comprehensive cybersecurity regime is needed for a Metaverse that is truly based in rule of law.

Abstract

Keberadaan sekretariat dalam mendukung kinerja pengawasan Pemilu merupakan suatu hal yang sangat penting, khususnya dalam hal penanganan pelanggaran. Keberadaan staf sekretariat merupakan salah satu pilar dalam hal penanganan pelanggaran, di awali dari fungsi konsultasi, penerimaan laporan, proses penanganan pelanggaran mulai dari proses pembuktian hingga kajian sangat bergantung kepada sejauh mana staf sekretariatr memahami aspek hukum dan pengkajiannya baik secara materil maupun formil. Hal ini menjadi tantangan tersendiri apalagi mengingat keberadaan staf sekretariat khususnya di Kabupaten Muaro Jambi hanya 1 (satu) yang berlatar belakang pendidikan hukum untuk mendukung pimpinan yang hanya 1 yang berlatar pendidikan hukum serta 1 kepala sekretariat yang juga berlatar pendidikan hukum. Oleh karena itu perlu workshop hukum serta pengelolaan kesekretariatan untuk memangun pemahaman dan skill bagi staf sekretariat Bawaslu Kabupaten Muaro Jambi dalam rangka penguatan kemampuan asistensi staf sekretariat mengenai hukum dalam proses penanganan pelanggaran khususnya dalam menghadapi Pilkada serentak Tahun 2024

Abstract

Shipwreck cargo or Benda Muatan Kapal Tenggelam (BMKT) in Indonesia, often referred to as underwater cultural heritage (UCH), holds significant economic potential for Indonesia, a nation prosperous in UCH sites. However, the preservation and management of these assets frequently encounter legal challenges at both national and international levels. This study examined the complex legal landscape surrounding shipwreck cargo in Indonesia, highlighting the divergent perspectives of national legislation and international norms. Indonesia's domestic laws allow for the auctioning of shipwreck cargo, which presents an opportunity for economic advancement. However, this approach clashes with the principles outlined in the Convention on Protection of the Underwater Cultural Heritage 2001, which underscore the collective heritage value of UCH objects and discourages their commercialization. This legal divergence underscores the need for Indonesia to balance its national interests with its international commitments in managing shipwreck cargo. By examining these legal intricacies, this study reveals the challenges of the coexistence of conflicting legal frameworks. It provides insights into potential strategies for harmonizing preservation efforts with commercial interests, thereby facilitating a balanced approach to the management of shipwreck cargo. By navigating these complexities, Indonesia can effectively leverage its underwater cultural heritage while fulfilling its obligations as a member of the international community.

Abstract

Addressing sexual violence in higher education must be a top priority for several critical reasons. First, it causes serious harm to victims—physically, socially, and psychologically. Second, many incidents go unreported due to stigma or pressure from perpetrators, forcing victims into silence. Third, sexual violence is often normalized and not seen as requiring urgent action. Behaviors like catcalling, loud sexual remarks, whistling, or inappropriate physical contact—such as touching or poking—are frequently overlooked as forms of sexual violence. To tackle this, continuous and structured legal education must be promoted. This is especially vital for partner institutions like undergraduate students at the Midwifery Academy of the Health Polytechnic under the Ministry of Health in Jambi Province. Raising awareness and strengthening understanding of sexual violence prevention should be embedded in educational environments. Additionally, establishing a dedicated task force at Poltekkes Kemenkes Jambi is an essential preventive step. This task force would help ensure a safe and supportive academic atmosphere, where all members of the campus community can participate in learning and other activities without fear of harassment or violence. These efforts aim to build a campus culture that fully rejects and prevents all forms of sexual violence.

Abstract

This paper discusses the concept of the precautionary principle as a bridge between the dichotomy of ecosystem protection and human safety. A pertinent example is the proposed evacuation road in Kerinci, which has yet to receive permission due to its planned route through Kerinci Seblat National Park. The issue is analyzed using a normative approach. The research concludes that the precautionary principle establishes a balance between the objectives of ecosystem safety and human safety as a fundamental right. Therefore, the state must not neglect its responsibilities and should maintain oversight of all policies, ensuring that prior decisions are guided by stringent risk analysis. This approach emphasizes the importance of integrating ecological considerations into development policies, ultimately aiming for sustainable coexistence between human needs and environmental preservation.

Abstract

The purpose of this research is to analyze the use of power of attorney in land sale and purchase practices. According to KUHPerdata, Article 1792 of the Civil Code governs the delegation of power to sell in the context of real estate transactions in Indonesia. The transfer of land rights can only be executed by the actual owner, whereas this power of attorney is solely for management purposes. Several things can cause the power of attorney to be terminated, including the grantor's withdrawal, the grantee's or the grantor's bankruptcy, or the grantee's notification of termination. The normative juridical approach is utilised for the research. Since the Absolute Power of Attorney deed fails to fulfil the objective requirements according to Article 1320 of the Civil Code, as regulated in the Minister of Home Affairs Instruction No. 14 of 1982, the author argues that it cannot be used to transfer land rights and is thus null and void by law. Government Regulation No. 24 of 1997, Article 39, Paragraph 1, Letter d, forbids the use of absolute power of attorney to transfer land rights; this regulation is still frequently cited even though the instruction is no longer in effect.

Abstract

Penelitian ini bertujuan untuk mengintegrasikan metode Project-Based Learning (PjBL) dalam pembelajaran ilmu politik melalui studi kasus perilaku politik masyarakat pada Pemilihan Gubernur Provinsi Jambi tahun 2020. Penerapan PjBL dilakukan sebagai upaya untuk meningkatkan kapasitas analitis mahasiswa terhadap fenomena politik riil serta mendorong kemampuan berpikir kritis, kolaboratif, dan mandiri. Secara substantif, penelitian ini menganalisis kecenderungan perilaku politik masyarakat Jambi berdasarkan tiga pendekatan utama: sosiologis, psikologis, dan rasional. Metode yang digunakan adalah action research dengan pendekatan kualitatif deskriptif, didukung oleh model siklus Kurt Lewin (perencanaan, tindakan, observasi, dan refleksi). Data dikumpulkan melalui mini-riset lapangan oleh mahasiswa dan dianalisis dengan teknik interactive model analysis. Hasil penelitian menunjukkan bahwa perilaku politik masyarakat Jambi pada Pilgub 2020 masih sangat dipengaruhi oleh faktor sosiologis, terutama asal-usul geografis calon. Masing-masing pasangan calon memperoleh suara dominan di wilayah asalnya. Selain itu, pendekatan psikologis juga berperan dalam menentukan pilihan, terutama melalui persepsi terhadap visi, misi, dan kesiapan program pasangan calon nomor urut tiga, Al Haris dan Abdullah Sani, yang akhirnya terpilih sebagai gubernur dan wakil gubernur. Sebaliknya, pendekatan rasional terbukti tidak terlalu dominan; pemilih lebih mempertimbangkan figur dan faktor emosional daripada platform partai atau kebijakan rasional. Tingkat partisipasi masyarakat tercatat sebesar 68,65%, menunjukkan adanya ruang perbaikan dalam meningkatkan kesadaran dan partisipasi politik warga. Studi ini tidak hanya menghasilkan pemahaman empirik tentang perilaku pemilih, tetapi juga menunjukkan efektivitas metode PjBL dalam pembelajaran politik berbasis penelitian dan kontekstualisasi lapangan.
