Abstract

This article analyzes corporate criminal liability policy as stipulated in the Draft of the Indonesian Criminal Code (RUU KUHP). The study focuses on two essential dimensions: the normative construction of corporate criminal responsibility and the practical readiness of law enforcement agencies to implement this policy. Employing a normative legal method with conceptual and comparative approaches, this research finds that despite the progressive legal framework in the RUU KUHP, the institutional and technical readiness of legal practitioners remains limited. Strengthening institutional capacity and drafting comprehensive technical guidelines are crucial to ensure the effective enforcement of corporate criminal liability in Indonesia.

Abstract

Freedom of the press is an important foundation of democracy, but it is not without limits. There are legal limits that must be adhered to, especially regarding news that can defame a person's good name. This article discusses who can be held criminally responsible if the press reports defamation, based on Law Number 40 of 1999 concerning the Press. This study uses a normative-juridical method, namely by analyzing relevant laws, legal theories, and court decisions. The results show that the Press Law actually prioritizes dispute resolution through the Press Council. However, if this defamation case has met the elements of a crime, the responsible party is not only the journalist. This can also include the person in charge of the editorial office, the press company, and even other parties involved in the crime. To determine who is responsible, an in-depth analysis is needed of the roles and responsibilities of each party in the production and distribution of news.

Abstract

The Public Prosecutor's Office's authority to investigate economic crimes in Indonesia remains limited, both normatively and institutionally. Yet the complexity and magnitude of losses resulting from economic offenses demand an institution with adequate juridical and technical capabilities. To address issues concerning the legal basis for these limitations, their impact on law enforcement, and an ideal legal‐policy model for the Public Prosecutor's Office, a normative legal approach was employed, incorporating statutory, case‐law, historical, comparative, and conceptual analyses. The discussion examines the grounds for such limitations under positive law, the prevailing legal‐policy direction, and the design of criminal institutions, according to which the Public Prosecutor's Office may exercise investigative functions only where governed by a lex specialis provision. Moreover, the normative and practical effects of these limitations on enforcement effectiveness are analyzed, particularly in relation to inter-agency coordination, legal certainty, and public confidence. In light of the Public Prosecutor's Office's success in handling major corruption cases, which are part of the broader category of economic crimes, there is a pressing need to formulate a legal‐policy model to expand and strengthen the institution's role. As a solution, a criminal‐law reform model is proposed that positions the Public Prosecutor's Office as the principal investigative body through centralized authority, accountable procedures, and integrated cross‐agency governance. This model is intended to establish a more centralized, efficient, and credible system for enforcing economic criminal law while reinforcing the direction of national criminal-law reform.

Abstract

Every criminal, civil, and state administrative justice system, including Indonesia's, recognises the importance of legal aid.  Professionals with extensive knowledge of the law provide legal aid since the idea behind it is to ensure that everyone has the chance to exercise their rights.  Those who give legal assistance do so because they are committed to high ideals, such as helping people achieve economic and social equality and defending their fundamental human rights.

Abstract

Penelitian ini mengkaji perlindungan hak asasi manusia dalam proses peradilan pidana terhadap orang dengan gangguan jiwa. Meskipun berbagai peraturan hukum di Indonesia, seperti Kitab Undang-Undang Hukum Pidana (KUHP), Undang-Undang Nomor 18 Tahun 2014 tentang Kesehatan Jiwa, dan prinsip-prinsip HAM internasional telah mengatur hak individu dengan gangguan jiwa, penerapannya di lapangan masih belum optimal. Dalam praktiknya, individu dengan gangguan jiwa yang tersangkut kasus pidana sering mengalami pengabaian hak, seperti tidak mendapatkan pemeriksaan psikologis yang layak, tidak didampingi oleh ahli kesehatan mental, hingga perlakuan diskriminatif selama proses penyidikan, penahanan, dan persidangan. Dengan pendekatan kualitatif melalui studi literatur dan analisis kasus, penelitian ini menemukan bahwa stigma sosial terhadap gangguan jiwa turut memengaruhi penegakan hukum, dan berpotensi menyebabkan pelanggaran hak asasi manusia. Temuan ini menegaskan pentingnya integrasi antara pendekatan psikologis, hukum progresif, dan prinsip HAM dalam sistem peradilan pidana Indonesia. Penelitian ini merekomendasikan adanya reformasi hukum berbasis keadilan inklusif, pelatihan khusus bagi aparat penegak hukum dalam menangani pelaku dengan gangguan jiwa, serta penguatan akses terhadap layanan kesehatan jiwa yang layak. Tujuannya adalah agar proses peradilan tidak hanya menekankan aspek legalistik, tetapi juga menjunjung tinggi martabat dan kondisi psikologis pelaku.

Abstract

Pelecehan seksual, baik dalam bentuk fisik maupun non-fisik, masih menjadi persoalan hukum dan sosial yang serius di Indonesia. Sebelumnya, regulasi yang ada dalam Kitab Undang-Undang Hukum Pidana (KUHP) belum mampu menjangkau kompleksitas kekerasan seksual yang terjadi, khususnya yang tidak meninggalkan jejak fisik. Penelitian ini bertujuan untuk menganalisis transformasi pengaturan pelecehan seksual melalui Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS), dengan fokus pada pelecehan seksual fisik dan non-fisik serta perlindungan hukum terhadap korban. Metode yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, dengan analisis terhadap peraturan perundang-undangan, asas hukum, dan doktrin yang relevan. Data yang digunakan berupa bahan hukum primer dan sekunder yang dianalisis secara kualitatif melalui interpretasi sistematis dan teleologis. Hasil penelitian menunjukkan bahwa UU TPKS membawa perubahan mendasar dengan mengklasifikasikan secara tegas berbagai bentuk kekerasan seksual, termasuk pelecehan non-fisik seperti komentar seksual dan siulan. Undang-undang ini juga memperkuat hak-hak korban melalui jaminan pemulihan, perlindungan, dan akses keadilan. Implementasinya masih menghadapi tantangan struktural dan kultural, seperti rendahnya perspektif korban di kalangan aparat hukum, budaya patriarki, serta belum optimalnya infrastruktur pendukung seperti UPTD PPA. Oleh karena itu, dibutuhkan langkah integratif antara penegakan hukum, pendidikan publik, dan reformasi budaya institusional agar norma hukum benar-benar efektif dan berpihak pada korban.

Abstract

The war in Syria has caused a major humanitarian crisis, causing millions of civilians to flee to various countries, especially in the Middle East. This condition demands a fast, equitable, and effective distribution of humanitarian aid. In the distribution process, the protection of human rights (HAM) is crucial so that all refugees gain access to aid fairly and without discrimination. This study aims to analyze the implementation of human rights protection in the distribution of humanitarian aid for Syrian refugees and identify the challenges faced. The method used is a normative and empirical legal approach with a case study in Jordan, a country with many Syrian refugees, and a strategic point for the distribution of international aid. Data were obtained from an analysis of global and national refugee law and the results of interviews and observations in the field. The findings show that although there are international legal instruments such as the 1949 Geneva Convention, Additional Protocols, and the UN Charter, their implementation in the field is still weak. Discrimination in access to aid, lack of transparency, and exploitation of vulnerable groups such as women and children were found. In addition, dependence on international organizations and weak coordination between humanitarian actors hamper distribution effectiveness. Strengthening monitoring mechanisms, increased coordination, and human rights-based policies are needed to make aid distribution more inclusive and equitable.

Abstract

Arbitration is an alternative methode of dispute resolution for business conflicts, as regulated in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. This study aims to analyze the advantages and challenges of arbitration in resolving business disputes in Indonesia. The findings indicate that arbitration offers several key advantages, including a faster process, more controlled costs, confidentiality, and final and binding decisions. However, its implementation still faces challenges, such as a lack of understanding among business actors regarding arbitration mechanisms, difficulties in enforcing arbitral awards, and, in some cases, higher costs compared to litigation in court. To optimize the role of arbitration, further socialization efforts, reforms in award enforcement, capacity building for arbitrators, and the simplification of regulations related to arbitration costs are necessary. With these measures, arbitration can become one of solution for resolving business disputes in Indonesia.

Abstract

Abstract. Human protection is an important aspect in the continuity of human life that cannot be taken by force or separated from human existence, each individual must be protected from criminal acts that result in the deprivation of the right to freedom of life of each individual, one of which is sexual crime, in fact in various countries, one of which is Indonesia and Germany, the majority of victims of sexual crimes are minors. The problems in this study are (1) whether the implementation of child witness protection in Indonesia and Germany is in accordance with the laws in each country, and (2) whether the handling by the institution has provided a sense of security for child witnesses of sexual crimes. By using comparative juridical, the results of this research are: that the implementation of regulations on the protection of child victims of sexual crimes in both countries is in accordance with the regulations on the protection of witnesses and victims. The handling carried out by the institution in protecting witnesses and victims has provided a sense of security for child witnesses of sexual crimes. Abstrak. Perlindungan manusia adalah aspek penting didalam keberlangsungan kehidupan manusia yang tidak dapat diambil paksa maupun di pisahkan keberadaan nya dari diri manusia, setiap individu harus terlindung dari tindak pidana kejahatan yang mengakibatkan terampasnya hak kebebasan hidup setiap individu, salah satunya tindak pidana kejahatan seksual, faktanya di berbagai negara salah satunya Indonesia dan Jerman mayoritas korban tindak pidana kejahatan seksual adalah anak dibawah umur. Permasalahan di dalam penelitian ini adalah (1) Apakah pelaksanaan perlindungan saksi anak di Indonesia dengan negara Jerman telah sesuai dengan undang-undang di masing-masing negara, dan (2) Apakah penanganan yang dilakukan lembaga telah memberikan rasa aman bagi saksi anak kejahatan seksual?. Dengan menggunakan yuridis komparatif, hasil dari penelitian ini adalah : bahwa pelaksanaan peraturan perlindungan saksi korban anak kejahatan seksual di kedua negara telah sesuai dengan peraturan perlindungan saksi dan korban. Penanganan yang dilaksanakan lembaga dalam melindungi saksi dan korban telah memberikan rasa aman bagi saksi anak tindak pidana kejahatan seksual

Abstract

This study aims to analyze the impact of restitution on the mental health of child victims of sexual intercourse from a long-term perspective through a longitudinal approach. The main focus of this research is to evaluate the effectiveness of restitution as a form of legal protection and psychological recovery for child victims of sexual crimes. The contribution of this study lies in reinforcing the argument that restitution is not merely financial compensation but also a crucial instrument in trauma recovery and the restoration of safety and self-worth in child victims. This research employs a juridical-empirical approach with a longitudinal method, combining normative analysis of restitution regulations with observation and interviews involving child victims who received restitution over a specific period. The findings conclude that restitution in criminal law functions as a form of recovery that is not limited to financial aspects but also serves as recognition of the victim’s suffering and as a component of restorative justice. This longitudinal study demonstrates that comprehensive restitution, supported by psychosocial interventions, has a positive impact on the mental health recovery of child victims of sexual abuse.
