Abstract

The Procedures and Requirements for Payment of Old Age Security stated that the benefits of Old Age Security at the Institution of Social Security Employment can only be taken when workers enter retirement or at the age of 56 years, which elicits opposition reactions from various parties. The focus of this research was conducted to examine and criticize whether the Old Age Security (OAS) and Job Loss Guarantee (JLG) policies for workers who have been terminated have reflected the conception of an Indonesian welfare state that is socially just for all Indonesians, as well as to find out how the future concept (Ius Constituendum) of OAS and JLG for workers reflects the welfare state for social justice. A statutory and conceptual approach are used to support the type of normative legal research in this research. The results of the study indicate that the OAS and JLG policies have not described the concept of an Indonesian welfare state with social justice. To describe the OAS and JLG policies that reflect the welfare state, future policies must still provide convenience for workers to receive OAS benefits and continue to carry out OAS benefits.

Abstract

Penelitian ini memiliki tujuan memberikan pemahaman pengaturan mengenai desa dalam hukum positif di Indonesia dan mengetahui pengaturan pemilihan Desa Adat serta Desa Dinas dengan adanya Undang-Undang Desa. Metode yang dipergunakan pada artikel terkait pengaturan pemilihan Desa Adat serta Desa Dinas dengan berlakunya Undang-Undang Desa ini mempergunakan jenis penelitian hukum yuridis normatif, dengan mempergunakan pendekatan perundang-undangan ataupun statute approach dalam melakukan analisis artikel ini. Hasil dari studi ini mendapatkan jika pengaturan pemilihan Desa Adat atau Desa Dinas sebenarnya telah diatur dalam Undang-Undang Desa tepatnya pada Pasal 6 ayat (1). Namun terjadi konflik norma antara Pasal 6 tersebut dengan Pasal penjelasannya. Pasal 6 tidak mewajibkan masyarakat memilih salah satu baik itu desa dinas maupun desa adat. Namun, dalam penjelasan menyebutkan jika pada satu wilayah hanya ada desa ataupun desa adat. Padahal dilihat dari segi sosiologis khususnya di wilayah Bali dari berabad-abad lalu sampai saat ini ada sistem pemerintahan desa yang memiliki sifat ganda baik desa adat maupun desa dinas. Selain itu dengan adanya aturan ini tidak selaras dengan Perda Bali No. 4 Tahun 2019 yang mana keberadaan Desa Adat telah diakui dan memiliki status sebagai subyek hukum pada sistem pemerintahan Provinsi Bali. Sehingga diperlukan suatu kontruksi hukum yang mampu menyelesaikan permasalahan yang terjadi. This study aims to provide an understanding of the regulation of villages in positive law in Indonesia and to know the arrangements for the election of Traditional Villages and Village Offices with the existence of the Village Law. The method used in the article related to regulating the selection of Traditional Villages and Village Offices with the enactment of the Village Law uses a normative juridical legal research type, using a statutory approach or a statute approach in analyzing this article. The results of this study show that the arrangement for the election of a Traditional Village or an Office Village has actually been regulated in the Village Law to be precise in Article 6 paragraph (1). However, there is a conflict of norms between Article 6 and the explanatory Article. Article 6 does not oblige the community to choose either official or customary villages. However, the explanation states that in one area there are only villages or traditional villages. In fact, seen from a sociological point of view, especially in the Bali region, from centuries ago to the present, there is a village government system that has dual characteristics, both customary and official villages. In addition, the existence of this rule is not in line with the Bali Regional Regulation No. 4 of 2019 in which the existence of the Traditional Village has been recognized and has a status as a legal subject in the government system of the Province of Bali. So that we need a legal construction that is able to solve the problems that occur.

Abstract

The aims this article is to find out the norms violated against the nominee comparison in the nominee deed of the limited liability company establishment deed, to analyze the violated norms and principles related to the nominee comparison of beneficial owner shares in a limited liability company, and to analyze the legal consequences of the nominee comparison holder on the beneficial owner of the limited liability company shares. The research method used is normative legal research. The comparison of nominees in the deed of establishment of limited liability company violates several norms such as article 1320 of the Civil Code the objective requirements of a lawful cause, article 1338 of the Civil Code regarding good faith, ratification of the deed carried out by a notary in article 44 paragraph (1) of the Law on Notary Position-Changes, article 48 paragraph (1) and article 54 paragraph (4) of the Limited Liability Company Law, article 33 paragraph (1) of the Investment Law, article 2 of the Banking Law , money laundering, forgery of letters. The legal consequences for nominee comparison of the beneficial owner of shares not only cause the cancellation of the nominee agreement entered into by the nominee with the beneficial owner of the shares, but also appears to be very broad, namely the votes issued at the general meeting of shareholders, money laundering crimes, know your customer principle, inheritance process, taxes, actio pauliana in bankruptcy. Tujuan penulisan artikel jurnal ini untuk mengetahui pelanggaran norma terhadap komparisi nominee dalam akta nominee pada akta pendirian perseroan terbatas, untuk menganalisa norma dan prinsip yang dilanggar terkait adanya komparisi nominee atas beneficial owner saham pada perseroan terbatas, serta untuk menganalisa akibat hukum pemegang komparisi nominee atas beneficial owner saham perseroan terbatas. Adapun metode penelitian yang dipergunakan yakni penelitian hukum normatif. Komparisi nominee dalam akta pendirian perseroan terbatas melanggar beberapa norma seperti Pasal 1320 Kitab Undang-Undang Hukum Perdata yakni tidak memenuhi persyaratan objektif kausa yang halal, Pasal 1338 Kitab Undang-Undang Hukum Perdata mengenai itikad baik, pengesahan akta yang dilakukan oleh notaris pada Pasal 44 ayat (1) UU Jabatan Notaris-Perubahan, Pasal 48 ayat (1) dan Pasal 54 ayat (4) UU Perseroan Terbatas, Pasal 33 ayat (1) UU Penanaman Modal, Pasal 2 UU Perbankan, tindakan pencucian uang, pemalsuan surat. Akibat hukum terhadap komparisi nominee atas beneficial owner saham tidak hanya menimbulkan batalnya perjanjian nominee yang diadakan oleh pihak nominee dengan beneficial owner saham, namun nampak yang ditimbulkan sangat luas yakni terkait suara yang dikeluarkan saat rapat umum pemegang saham, tindak pidana pencucian uang, know your customer principle oleh bank, proses pewarisan, pajak, actio pauliana dalam kepailitan.

Abstract

Studi ini bertujuan untuk mengetahui dan memberikan pengetahuan mengenai perlindungan hukum secara umum serta langkah konkret bagi korban serta yang data pribadinya bocor. Penelitian ini disusun menggunakan jenis metode penelitian hukum empiris dengan lokasi penelitian dilakukan di Kantor legalpartner.id, Asosiasi Profesional Perlindungan Data Indonesia, dan Kantor Advokat di Denpasar. Data yang digunakan dalam penelitian ini berupa data primer dan data sekunder. Data primer yang dikumpulkan dalam bentuk hasil wawancara dengan beberapa informan. Teknik penentuan informan tersebut menggunakan penentuan sampel secara sengaja (purposive sampling). Sedangkan, data sekunder terbagi atas bahan hukum primer, sekunder, dan tersier. Data-data penelitian dikumpulkan dengan menggunakan teknik observasi, wawancara, dan dokumentasi. Data yang telah terkumpul kemudian diolah secara kualitatif. Hasil studi menunjukkan bahwa perlindungan umum data pribadi didasarkan pada ketentuan pada Pasal 28G ayat (1) UUD NRI Tahun 1945. Kewajiban pemerintah tersebut kemudian diderivasikan melalui beberapa peraturan perundang-undangan di Indonesia. Selain itu, langkah konkret yang dapat diambil oleh korban ketika datanya bocor adalah dengan memilih jalur hukum yang disediakan berupa penanganan perkara pada ranah perdata, administratif, dan/atau pidana sesuai jalur hukum yang dipilih korban atau dengan kata lain pengajuan perkara tersebut dilakukan secara litigasi atau non litigasi. This study aims to find out and provide knowledge about legal protection in general as well as concrete steps for victims and whose personal data is leaked. and the Advocate's Office in Denpasar. The data used in this study are primary data and secondary data. Primary data collected in the form of interviews with several informants. The technique of determining the informants uses purposive sampling. Meanwhile, secondary data is divided into primary, secondary, and tertiary legal materials. The research data were collected using observation, interview, and documentation techniques. The data that has been collected is then processed qualitatively. The results of the study show that the general protection of personal data is based on the provisions of Article 28G paragraph (1) of the 1945 Constitution of the Republic of Indonesia. The government's obligations are then derived through several laws and regulations in Indonesia. In addition, a concrete step that can be taken by the victim when the data is leaked is to choose the legal route provided in the form of handling cases in the civil, administrative, and/or criminal domains according to the legal route chosen by the victim or in other words the submission of the case is carried out by litigation or non-litigation.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis kewajiban notaris dalam melekatkan lembaran sidik jari penghadap pada minuta akta berdasarkan UUJN dan akibat hukum terhadap kedudukan akta dan notaris yang tidak melakukan pembubuhan sidik jari para penghadap pada minuta akta berdasarkan UUJN. Jenis penelitian yang digunakan dalam artikel ini adalah penelitian hukum normatif yang dilakukan dengan mengkaji peraturan perundang-undangan yang berlaku serta menggunakan data sekunder sebagai data utama. Berdasarkan hasil penelitian, dapat dirumuskan kesimpulan sebagai berikut: (1) Notaris bebas untuk menggunakan penafsiran manapun mengenai metode mana yang akan dipakai dan bebas untuk menentukan pembubuhan sidik jari atau tanda tangan; dan (2) Dalam UUJN tidak ada satu pasal yang menyebutkan akta Notaris yang tidak dilekatkan sidik jari dapat terdegradasi ataupun menurunkan sifat akta Notaris menjadi akta di bawah tangan, hal ini sebagaimana ditegaskan dalam Pasal 16 ayat (11) UUJN. The purpose of this study is to identify and analyze the obligation of a notary to affix the appearers fingerprint sheet to the minutes of the deed based on the Notary Act and the legal consequences of the deed as well as position of the deed when the notary who did not affix the fingerprints of the appearers to the minutes of the deed. This article use a normative legal research where the assessment of the applicable laws and regulations is carried out by using secondary data as the main data. Based on the research results, the following conclusions formulated: (1) Notary are free to use any interpretations regarding which method will be used and free to determine the affixing of fingerprints or signatures; and (2) In Notary Act, there is no article states that a Notary Deed which not attached with the appearers fingerprint sheet can be degraded its nature as an underhand deed due to what is confirmed in Article 16 paragraph (11) of the Notary Act.

Abstract

The purpose of this study is to analyze how the application of cyber notary in the form of Artificial Intelligence in notary practices is contrary to the principles of the Tabellions Officium Fideliter Exercebo and the authenticity of the deed shifts when an electronic deed takes place. The normative juridical method is carried out using a statutory approach and a conceptual approach with primary legal sources, namely the Law on Notary Offices, secondary legal sources from scientific papers and journals and tertiary legal sources from books and seminars. The results od this study found that the application of artificial intelligence in the concept od cyber notary has not provided legal certainty for the users of notary services, this is because the legal umbrella that covers them is in conflict with one another and when applied in notary practice the products produced by notaries become inauthentic or under hand.

Abstract

Tujuan dari penulisan ini adalah untuk mengetahui proses pembentukan dan urgensi dari Pembentukan Komponen Cadangan sebagai kekuatan pertahanan negara. Metode normatif digunakan pada penelitian ini. Dari hasil penelitian dapat disimpulkan bahwa Pembentukan Komponen Cadangan ini merupakan bagian dari upaya mempertahankan Keamanan Nasional. Dalam Proses pembentukannya Komponen Cadangan dimulai dengan pendaftaran, seleksi, pelatihan dasar kemiliteran, dan penetapan. Mengenai urgensi dari pembentukannya sesuai dengan amanat dari UUD 1945 serta Undang Undang yang berkaitan dengan keamanan nasional, penting untuk melakukan pembentukan komponen cadangan. Pertimbangan lainnya karena ancaman terhadap kedaulatan negara semakin rumit dan untuk memperkuat pertahanan negara. Kata Kunci: Pembentukan Komponen Cadangan, Pertahanan Negara, Urgensi. ABSTRACT The purpose of this article is to ascertain the method and urgency of the Reserve Component’s formation as a national defense force. This study employed normative methodologies. The findings of the study allow for the conclusion that measures to sustain national security include the creation of this reserve component. Registration, selection, basic military training, and determination mark the beginning of the Reserve Component formation process. Establishing a reserve component is crucial given the urgency of the organization’s formation in accordance with the 1945 Constitution’s mandate and national security regulations. Another factor is to bolster state defense since threats to state sovereignty are becoming more sophisticated. Keywords: Formation of Reserve Components, National Defence, Urgency.

Abstract

Abstrak : Advokat yakni seseorang dengan profesi yang memberi jasa hukum di luar ataupun di dalam pengadilan. Advokat sudah diterangkan dalam undang-undang diantaranya ada UU RI No.18 Tahun 2003, advokad memiliki hak imunitas dimana hak itu dipakai dalam menjalankan pekerjaannya sebagai salah satu subjek pemberi bantuan hukum, selain itu hak ini dimiliki oleh advokat atas kekebalan hukum dalam hal pembelaan perkara yang sudah menjadi tanggung jawab dari advokad, bahkan secara perdata ataupun pidana advokat tidak dapat dituntut balik dalam menjalankan tugasnya Dalam realitanya masih sering terjadi problematika dari hak imunitas tersebut, dengan itu tujuan dari penulisan ini yakni untuk mengetahui pengaturan serta batasan hak imunitas advokat dalam pemberian bantuan hukum di peradilan pidana. Penulisan kali ini mempergunakan metode dengan pendekatan yuridis normatif, dengan pemaparan secara analisis deskriftif dan teknik pengumpulan studi kepustakaan. Adapun hasil yang diperoleh yakni pengaturan hak imunitas diatur di dalam UU Advokat dan UU Bantuan hukum, penerapan pada sistem peradilan pidana disesuaikan dengan tahapan proses persidangannya. Yang menjadi batasan dari penggunaan hak imunitas tersebut oleh advokat adalah peraturan perundang-undangan serta kode etik profesi advokat. Laws regarding advocates include RI Law No. 18 of 2003, advocates have the right of immunity where this right is used in carrying out their work as one of the subjects providing legal aid, in addition to this right is owned by advocates for legal immunity in cases of defense of cases that have been becomes the responsibility of the advocate, even in civil or criminal terms the advocate cannot be prosecuted in carrying out his duties. criminal justice. Writing this time uses a method with a normative juridical approach, with descriptive analysis presentation and literature study collection techniques. The results obtained are that the regulation of immunity rights is regulated in the Advocate Law and the Legal Aid Law, the application of which to the criminal justice system is adjusted to the stages of the trial process. The limitations of the use of the right of immunity by advocates are statutory regulations and the code of ethics for the advocate profession.

Abstract

This writing aims to analyze, identify, and elaborate on the legal protection of the economic rights of copyrighted works in Indonesia, based on the UUHC (Undang-Undang Hak Cipta or Copyright Law), and the legal certainty of economic rights for creators who are not registered with the Collective Management Institute after the enactment of PP (Peraturan Pemerintah or Government Regulation) Number 56 of 2021 concerning the Management of Copyright and/or Music Royalties. This study employs normative research with a statutory approach and analysis of legal concepts. The results indicate that the protection of creators' economic rights under the UUHC is regulated by Article 9, paragraph 3, which states that "any person without the permission of the creator or copyright holder is prohibited from copying and/or commercial use of the work." Copyright infringement will result in the perpetrator being classified as committing a criminal act in accordance with Article 113, paragraphs (1), (2), (3), and (4) of the UUHC. Additionally, repressive protection can be pursued through litigation and non-litigation means. To address the decarbonization related to exclusive rights between the UUHC and PP No. 56 of 2021, the resolution involves vertical harmonization, which requires the alignment of one law with the provisions of other laws and regulations that occupy different hierarchical positions.
