Abstract

The Procedures and Requirements for Payment of Old Age Security stated that the benefits of Old Age Security at the Institution of Social Security Employment can only be taken when workers enter retirement or at the age of 56 years, which elicits opposition reactions from various parties. The focus of this research was conducted to examine and criticize whether the Old Age Security (OAS) and Job Loss Guarantee (JLG) policies for workers who have been terminated have reflected the conception of an Indonesian welfare state that is socially just for all Indonesians, as well as to find out how the future concept (Ius Constituendum) of OAS and JLG for workers reflects the welfare state for social justice. A statutory and conceptual approach are used to support the type of normative legal research in this research. The results of the study indicate that the OAS and JLG policies have not described the concept of an Indonesian welfare state with social justice. To describe the OAS and JLG policies that reflect the welfare state, future policies must still provide convenience for workers to receive OAS benefits and continue to carry out OAS benefits.

Abstract

Although alternative method exists as stipulated in Article 3 paragraph (1) and Article 4 paragraph (3) of the Industrial Relations Dispute Settlement Law, in fact, the dispute resolution in Indonesia’s industrial relation has been focusing on litigation mechanisms. However, litigation is not the best way to fulfill both disputing parties’ desire for justice as the output is win-lose. As such, alternative method exists, puts forward the ‘win-win’ solution. Nonetheless, the current legal framework only sets the clear rule of the aforementioned alternative method to be conducted in person, despite the global pandemic Covid-19. Accordingly, ODR is established to enable virtual procurement. This article will analyze the conception and benefits of online dispute resolution, its implementation gaps in the context of industrial relations dispute resolution, and its regulatory formulation to gain legitimacy in Indonesian law. Applying normative legal research, this article uses statutory, conceptual and comparative approaches. From the research conducted, it is indicated that online dispute resolution is technically superior as it is simple, fast, and low in cost. Even under the Industrial Relations Dispute Settlement Law, its application is feasible, specifically through mediation and conciliation. In Indonesia, implementation of online dispute resolution is possible by amending the Industrial Relations Dispute Settlement Law, considering the prioritization of alternative dispute resolution based on practices in Cambodia, Spain, and ILO Guidelines, as well as the superiority of online dispute resolution based on practices in the United States and UNCITRAL Technical Notes.

Abstract

Studi ini bertujuan menganalisa terkait kompleksitas problematika mengenai pengalihan hak rahasia dagang melalui sebab lain yang dibenarkan oleh peraturan perundang-undangan serta memformulasikan perbuatan yang termasuk dalam sebab lain yang dibenarkan oleh peraturan perundang-undangan. Studi ini merupakan penelitian hukum normatif dengan mengaplikasikan pendekatan peraturan perundang-undangan, historis, serta konseptual. Bahwa hasil studi menunjukkan terdapat kekaburan norma pada Pasal 5 ayat (1) huruf e UU RD mengenai pengalihan hak rahasisa dagang melalui sebab-sebab lain yang dibenarkan oleh peraturan perundang-undangan. Adapun 2 (dua) cara yang dapat menjadi dasar legitimasi untuk mengatasi problematika tersebut. Pertama, dengan menginterpretasikan secara sistematis dengan mengaitkannya ke UU HC, UU Paten, dan UU Merek dan Indikasi Geografis sehingga pengalihan hak dapat dilakukan dengan perbuatan merger, akuisisi dan pembubaran perusahaan. Kedua, dengan menggunakan metode analogi atau argumentum per analogiam dengan cara melaksanakan undang-undang untuk menyelesaikan suatu perkara yang tidak diatur oleh undang-undang, tetapi terdapat kesamaan dengan perkara yang diatur oleh undang-undang untuk menemukan kesamaan asas yang terkandung didalamnya. Hasilnya adalah pengalihan rahasia dagang dapat dilaksanakan melalui perbuatan hukum peleburan dan pemisahan perusahaan, karena asas yang terkandung dalam peleburan dan pemisahan perusahaan adalah pengalihan aktiva perusahaan, dalam hal ini rahasia dagang masuk sebagai aktiva dari perusahaan. Kata Kunci: Hak Rahasia Dagang, Pengalihan Hak ABSTRACT This study aims to analyze the complexity of problems regarding the transfer of trade secret rights through other causes justified by the legislation and formulate the actions included in other causes justified by the legislation. This study uses normative legal research method by using statute approach, historical approach, and conceptual approach. The results of the study show that there is norm ambiguity in Article 5 paragraph (1) letter e Trade Secrets Act regarding the transfer of trade secret rights through other causes justified by laws and regulations. There are 2 (two) ways that can be the basis of legitimacy to overcome these problems. First, by interpreting systematically by linking it to the Copyright Act, Patent Act, and Trademark and Geographical Indication Act so that the transfer of rights can be done by merger, acquisition and dissolution of the company. Second, by using the method of analogy or argumentum per analogiam by applying the law to resolve a case that is not mentioned by the law but contains similarities with the case mentioned by the law to find the similarity of the principles contained therein. The result is that the owner of the trade secret can transfer the trade secret he owns through the legal act of consolidation and separation of the company, because the principle contained in the consolidation and separation of the company is the transfer of company assets, in this case the trade secret is included as an asset of the company. Abstract

Tujuan dari studi ini untuk mengkaji lebih lanjut terkait dengan extrajudicial killing yang merupakan pembunuhan yang dilakukan oleh aparat negara tanpa adanya proses peradilan terlebih dahulu yang kerap terjadi di Indonesia dan untuk mengetahui bagaimana pertanggungjawaban dari negara yang memiliki kewajiban untuk menjaga dan menghormati hak asasi manusia bagi setiap warga negaranya terhadap pelaku serta korban dari tindakan extrajudicial killing. Studi ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan komparatif. Hasil dari studi ini menunjukan bahwa masih terdapat kekosongan hukum terkait dengan penggunaan kekuatan bagi aparat kepolisian dalam menjalankan tugas menjaga keamanan serta ketertiban di lingkungan masyarakat yang mengakibatkan aparat kepolisian tidak memiliki parameter terlebih dahulu dalam penggunaan kekuatan. Permasalahan tersebut berdampak pada timbulnya perampasan hak asasi manusia yakni hak untuk hidup untuk para korban yang dalam hal ini merupakan tersangka/pelaku kejahatan tindak pidana. The purpose of this study is to examine further related to extrajudicial killing, which is murder committed by state apparatus without any prior judicial process that often happens in Indonesia, as well as to find out how the responsibility of the state, which has the obligation to protect and respect human rights for each of its citizens towards the perpetrators and victims of extrajudicial killing. This study uses normative research methods with legislative and comparative approaches. The results of this study shows that there is still a legal vacuum related to the use of force for police officers in carrying out their duties to maintain security and public order in the community, which results in police officers not having prior parameters in the use of force. These problems affect the deprivation of human rights, namely the right to life for victims who are suspects/perpetrators of criminal acts.

Abstract

The process of inheritance that is not managed (onbeheerde nalatenschap) is the aim of this research until finally the inheritance passes to the state, as well as knowing the position of the state and the role of the state and the Notary/PPAT in managing the inheritance that is not managed. Normative research is used as the research method, when typing in inheritance, no one appears as an heir so it is classified as neglected inheritance (Onbeheerde Nalatenschap). The Heritage Hall is one of the state's efforts to realize aspects of the use and maintenance of any inherited assets that are not managed and to create orderly administration. The Inheritance Property Hall in the form of efforts to maintain and care for inherited assets that are not managed in order to maintain the value of the assets under the care of the Inheritance Hall, is expressed in 2 ways, namely through a rental process through making a rental agreement before a Notary, and carry out buying and selling before the PPAT by obtaining a sales permit from the Ministry of Law and Human Rights. Proses dari pewarisan yang tidak terurus (onbeheerde nalatenschap) merupakan tujuan penelitian ini hingga akhirnya warisan tersebut jatih kepada negara, serta mengetahui kedudukan negara dan peran negara serta Notaris/PPAT dalam mengurus harta warisan yang tidak terurus tersebut. Penelitian normatif digunakan sebagai metode penelitian ini, ketikan dalam pewarisan tidak ada satupun yang yang muncul sebagai seorang ahli waris sehingga sebagai harta peninggalan tak terurus (Onbeheerde Nalatenschap). BHP dalam upaya menjaga nilai dari harta peniggalan yang tidak diurus tersebut dalam upaya pemanfaatan yang dapat dilakukan dengan sewa menyewa ataupun jual beli melalui akta yang dibuat oleh Notaris/PPAT agar menjaga nilai dari suatu harta peninggalan yang tidak diurus tersebut sehingga tidak mengalami pengurangan nilai atau hilangnya nilai.

Abstract

This study aimed to analyze the arrangement of flexible labor relations before and after the passing of the copyright work law, the influence of the arrangement of flexible labor relations on the legal protection of workers’ rights, as well as the ideal arrangement of labor relations in the future in protecting workers’ rights. This study used normative juridical, historical, statutory, and conceptual methods. Data collection techniques were obtained from primary, secondary, and tertiary legal materials. The data obtained were analyzed using descriptive analytical techniques. The results of the study showed that the arrangements in the labor law after the enactment of the work copyright law had undergone many changes, namely the validity period of work agreements for a particular time which was extended in Government Regulation Number 35 of 2021, and the expansion of the scope of outsourcing. The regulation of the flexibility of labor relations affected the guarantee of workers’ rights to obtain job security and welfare as mandated in the constitution. Strengthening the government’s position in industrial relations and repositioning the position of workers juridically and sociologically was needed to regulate flexible labor relations to guarantee workers’ rights in the future.

Abstract

This article aims to discuss further the importance of the characteristics of non-litigationdispute resolution through mediation in resolving industrial relations disputes. Thisresearch is descriptive with a normative research type, using a statutory approachand data collection using literature study, then the data is analyzed qualitatively. Theresults obtained from this research are that each type of dispute resolution has itscharacteristics. One of the main reasons why disputes cannot be resolved througharbitration is limited authority. Apart from that, the lack of information, abilities,and knowledge of the parties regarding conciliation and negotiation is the cause ofthese problems. Therefore, mediation is chosen due to its distinctive characteristicscompared to other non-litigation resolutions, such as the mediator's role in assistingthe parties, the absence of decision-making authority, the mediation process focusingon the future, and fostering the creation of win-win solutions.

Abstract

The aims of this study are to determine the shift of the corporatist industrial relations model (Employment Law) towards contractualist industrial relations (Job Creation Law) which affects the position of the parties in an employment relationship, and to find out more about the autonomous legal position of the company (Work Agreement, Company Regulation, Joint Work Agreement) in the contractualist industrial relations model from the perspective of the Job Creation Law. The method applied in this study is combined legal research method between normative and empirical. The application of this method is an approach to strengthen the data in the writing, in addition to examining legal norms, field research is also conducted. The result of this study finds that the enactment of the Job Creation Law has shifted the corporatist industrial relations model, which offers space for the state to enter into industrial relations, towards a contractualist industrial relations model that is based on the agreement between the parties and restricts the role of the state in industrial relations. In the contractualist industrial relations model, the parties are given an open space to determine the work arrangement. Under these conditions, the preparation of autonomous laws, namely Work Agreements, Company Regulations, and/or Collective Labor Agreements (CLAs) is crucial in preventing disputes in industrial relations. Abstrak Tujuan dalam penulisan ini adalah untuk mengetahui pergeseran model hubungan industrial koorporatis (UU Ketenagakerjaan) kearah hubungan industrial kontraktualis (UU Cipta Kerja) berpengaruh terhadap penempatan kedudukan para pihak dalam suatu hubungan kerja, serta untuk mengetahui lebih lanjut terkait kedudukan hukum otonom perusahaan (Perjanjian Kerja, Peraturan Perusahaan, Perjanjian Kerja Bersama) pada model hubungan industrial kontraktualis perspektif UU Cipta Kerja. Metode yang digunakan dalam penulisan ini menggunakan metode penelitian hukum gabungan antara normatif dan empiris. Penggunaan metode tersebut sebagai upaya dalam memperkuat data pada penulisan, disamping mengkaji atas norma hukum juga melakukan penelitian lapangan. Hasil dalam penulisan ini mendapatkan pemahaman bahwa berlakunya UU Cipta Kerja, telah menggeser model hubungan industrial korporatis yang memberi ruang terhadap peran negara untuk masuk dalam hubungan industrial, ke arah model hubungan industrial kontraktualis yang mendasarkan pada kesepakatan para pihak dan merestriksi peran negara dalam bingkai hubungan industrial. Pada model hubungan industrial kontraktualis para pihak diberikan ruang terbuka untuk menentukan kesepakatan kerja. Dalam kondisi seperti ini, penyusunan hukum otonom yaitu Perjanjian Kerja, Peraturan Perusahaan, dan/atau Perjanjian Kerja Bersama (PKB) memegang peranan penting dalam pencegahan terjadinya perselisihan dalam suatu hubungan industrial.

Abstract

This research addresses legal issues related to the use of deed minutes as evidence in criminal cases involving false statements made by a notary. According to Article 66 paragraph (1) of Law No. 2 of 2014 and Article 23 paragraph (1) of the Regulation of the Minister of Law and Human Rights No. 7 of 2016, discrepancies arise regarding the admissibility of deed minutes in judicial processes when false information is provided. The research examines the regulations for using deed minutes as evidence in criminal justice cases involving falsified statements by a notary and explores the legal status and consequences of deed minutes when proven to contain falsified information.
