Abstract

This study aims to analyze the legal protection of consumers in e-commerce transactions with the Cash On Delivery (COD) payment method in Samarinda City. The focus of the research includes consumer legal protection according to Law Number 8 of 1999 concerning Consumer Protection and Law Number 11 of 2008 concerning Information and Electronic Transactions, the effectiveness of legal protection, and obstacles in the implementation of consumer protection. The research method used is empirical juridical with an analytical descriptive approach and data collection techniques through interviews, observations, and questionnaires distributed to e-commerce consumers in Samarinda City. The results of the study show that the existing legal protection is not fully effective because there are still various obstacles, such as low consumer awareness of their rights and weak law enforcement against irresponsible business actors. The Borneo Non-Governmental Consumer Protection Agency, the Samarinda City Police, and SPX Express have an important role in handling consumer disputes. It was found that consumers often suffer losses due to non-conforming or damaged goods, as well as difficulties in the process of returning goods and refunds. This study recommends improving consumer education, strengthening regulations related to COD transactions, and improving coordination between relevant institutions in handling consumer complaints.

Abstract

Desa adalah kesatuan masyarakat hukum yang memiliki batas wilayah yang berwenang untuk mengatur dan mengurus urusan pemerintahan, kepentingan masyarakat setempat berdasarkan prakarsa masyarakat, hak asal usul, dan/atau hak tradisional yang diakui dan dihormati dalam sistem pemerintahan Negara Kesatuan Republik Indonesia. Salah satu misi pemerintah pada saat ini yaitu untuk membangun daerah pedesaan yang dapat dicapai melalui sebuah pemberdayaan masyarakat dengan tujuan untuk meningkatkan produktivitas dan keanekaragaman usaha yanga ada, terpenuhinya sarana dan fasilitas untuk mendukung peningkatan ekonomi desa, membangun dan memperkuat institusi yang mendukung rantai produksi dan pemasaran, serta mengoptimalkan sumber daya manusia sebagai dasar pertumbuhan ekonomi desa Sementara perihal tata kelola organisasi pada pemerintahan desa, hal yang paling sering dibahas adalah bentuk akuntabilitas pengelolaan keuangan alokasi dana desa. Pengelolaan/penggunaan keuangan desa merupakan kegiatan yang penuh dengan risiko. Hal ini dikarenakan besarnya dana yang dikelola oleh desa. Risiko-risiko tersebut dapat disebabkan oleh lingkungan internal maupun eksteral pengelola keuangan itu sendiri. Maka langkah awal sangat perlu untuk dilakukan kajian untuk mengidentifikasi risiko-risiko tersebut dimana dengan melakukan Penerapan  manajemen  risiko dalam  pengelolaan  dana  desa  dapat meningkatkan  kinerja  pengelolaan dana desa, dan mengurangi resiko yang timbul. Oleh karena itu perlu diberikan pengetahuan dan wawasan kepada masyarakat tentang  pengetahuan tentang pengelolaan/penggunaan dana desa yang baik; tentang resiko-resiko apa saja yang dapat timbul dalam pengelolaan/penggunaan dan desa; Masyarakat dapat mengetahui dan belajar bagaimana cara memitigasi resiko-resiko yang timbul dari pengelolaan / penggunaan dana desa tersebut.

Abstract

Introduction: This research discusses legal protection aimed at child defendants, especially in cases of sexual violence committed against minors. This is based on a case study in Decision Number 13/Pid.Sus-Anak/2023/PNBPP and Decision Number 3/Pid.Sus-Anak/2023/PNBPP.Purposes of the Research: This research focuses on the stages or steps in the application of the law that protects the rights of child defendants with reference to Law Number 11 of 2012 concerning the Child Criminal Justice System.Methods of the Research: This research was conducted with a normative method in the form of a case study to evaluate the steps in the judiciary by starting with the arrest, investigation, prosecution, and conclusion with the welfare of children affected by the crime of sexual violence.Findings of the Research: The results of the study found that, although the criminal threat against perpetrators of sexual violence is quite severe, the implementation of punishment for children of sexual violence still prioritizes the principle of restorative justice, taking into account the psychological and social aspects of children. In both of the decisions analyzed, the child defendant received a prison sentence of different durations, and was required to undergo job training as part of the rehabilitation process. Legal protection for child defendants remains indispensable and plays an important role in guaranteeing the rights of every child as well as providing a deterrent effect in cases of sexual violence.

Abstract

Kehidupan bermasyarakat dan hukum mempunyai keterkaitan yang tidak dapat dipisahkan. Penelitian ini bertujuan untuk melakukan tinjauan yuridis terhadap Putusan Nomor 36/Pid.Sus-TPK/2023/PN Smr yang memutus perkara tindak pidana korupsi. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan menganalisis berbagai peraturan perundang-undangan terkait, khususnya Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, serta putusan-putusan pengadilan sebelumnya dalam perkara sejenis. Penelitian ini mengkaji empat aspek utama, yaitu: (1) penerapan hukum pidana materiil dan hukum pidana formil dalam putusan tersebut, (2) konsistensi penerapan hukum dibandingkan dengan putusan-putusan sebelumnya, dan (3) Pertimbangan hukum hakim dalam menjatuhkan putusan tersebut telah sesuai dengan Ketentuan peraturan perundang-undangan yang berlaku, khususnya Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi (4)kekuatan dan kelemahan putusan dari perspektif yuridis dalam upaya pemberantasan tindak pidana korupsi di Indonesia. Hasil penelitian menunjukkan bahwa Putusan Nomor 36/Pid.Sus-TPK/2023/PN Smr secara umum telah menerapkan ketentuan hukum pidana materiil dan hukum pidana formil dengan tepat. Namun, untuk menilai konsistensi penerapan hukum dan mengidentifikasi kekuatan serta kelemahan putusan secara spesifik, diperlukan akses terhadap putusan tersebut dan putusan-putusan sebelumnya yang relevan. Penelitian ini berkontribusi dalam memberikan tinjauan yuridis terhadap putusan pengadilan dalam perkara tindak pidana korupsi dan pentingnya konsistensi penerapan hukum untuk menjamin kepastian hukum dan keadilan.

Abstract

Perkembangan teknologi informasi memunculkan tantangan hukum baru, terutama terkait Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (ITE) yang kemudian direvisi menjadi Undang-Undang Nomor 19 Tahun 2016. Tujuan dari penelitian ini (1) untuk mengetahui bagaimana perbandingan penegakan hukum terhadap kasus pemalsuan data dalam UU ITE (2) untuk mengetahui bagaimana bentuk penegakan hukum terhadap putusan Nomor 68/Pid.Sus/2024/PN. Bjm dan Nomor 764/Pid.B/2016/PN.Jkt.Sel dalam UU ITE. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan undang-undang, data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer dan sekunder. Hasil dari penelitian ini yaitu (1) Perbedaan dari ke-empat peraturan tersebut ialah terletak pada penegakan hukum dari masing-masing Undang-Undang tersebut. Adapun persamaan dari UU PDP, UU ITE Tahun 2008, UU ITE Tahun 2016 dan UU ITE Tahun 2016 ialah terletak pada jenis pelanggaran yang didalamnya mengatur tentang salah satu kasus yang sering terjadi yaitu pemalsuan data pribadi. (2) Putusan Nomor 68/Pid.Sus/2024/PN.Bjm dan Nomor 764/Pid.B/2016/PN.Jkt.Sel merupakan langkah maju dalam penegakan hukum terhadap tindak pidana dalam UU ITE. Aparat penegak hukum perlu terus meningkatkan upaya penegakan hukum terhadap putusan-putusan ini agar tercipta ruang digital yang aman dan kondusif bagi masyarakat

Abstract

The rapid advancement of information technology has brought significant changes to the world of commerce, particularly through e-commerce. Online buying and selling systems offer convenience to consumers, but they also present new challenges, one of which is the increasing circulation of counterfeit goods. In Indonesia, consumer protection regulations are outlined in Law Number 8 of 1999 on Consumer Protection and Law Number 11 of 2008 on Electronic Information and Transactions. However, despite the clear regulations, the implementation of consumer protection in online transactions still faces obstacles, especially in regions such as Samarinda. This study aims to analyze consumer protection laws in Samarinda, focusing on the roles of Non-Governmental Consumer Protection Agency Borneo and the Police. The findings indicate that protection efforts include consumer education regarding their rights and complaint channels to address counterfeit goods cases. However, low consumer awareness remains a major challenge to the effectiveness of these protections. Moving forward, there is a need to enhance education about the risks of online transactions and improve coordination between agencies to minimize online fraud. Consumer protection depends not only on regulations but also on the active role of society and relevant institutions in creating a safer e-commerce ecosystem. Collaboration among agencies, along with heightened consumer awareness, is key to tackling the problem of counterfeit goods in the online marketplace.

Abstract

Sebuah studi dari Universitas Stanford menunjukkan bahwa Indonesia menempati peringkat terakhir sebagai negara dengan rata-rata jumlah langkah harian terendah dalam survei selama 68 hari. Menurut Ernawati Hendrakusumah, hal ini disebabkan oleh infrastruktur yang belum memadai. Padahal, berjalan kaki dapat meningkatkan interaksi sosial serta menciptakan kesan kota yang ramah dan berkelanjutan. Penelitian ini menggunakan metode normatif dengan mengkaji teori, konsep, serta peraturan perundang-undangan. Penelitian normatif bertujuan mengidentifikasi definisi, konsep, dan prinsip hukum.Walkability mempertimbangkan beberapa parameter, seperti kualitas fasilitas, konektivitas jalur, kondisi jalan, pola penggunaan lahan, dukungan masyarakat, kenyamanan, dan rasa aman. Berdasarkan indeks walkability global, komponen pendukungnya meliputi keselamatan, kenyamanan pejalan kaki, serta keberadaan regulasi hukum. Dalam Pasal 274 ayat (2) UU LLAJ, disebutkan ancaman pidana bagi pihak yang mengganggu fungsi sarana jalan, dengan hukuman penjara maksimal satu tahun atau denda hingga dua puluh juta rupiah.Pejalan kaki dapat dikategorikan menjadi pejalan penuh, pengguna kendaraan pribadi, dan pengguna transportasi umum. Indikator walkability mencakup infrastruktur, aksesibilitas, daya tarik, kenyamanan, pemerataan, dan keselamatan. Pemerintah daerah menghadapi berbagai tantangan dalam membangun infrastruktur pejalan kaki berbasis kota pintar, seperti keterbatasan anggaran, minimnya fasilitas, rendahnya kesadaran publik, serta lemahnya perencanaan. Terdapat kekosongan hukum mengenai hak pejalan kaki dalam konteks kota pintar, sehingga dibutuhkan produk hukum dan sistem teknologi informasi terpadu untuk menjamin perlindungan hak pejalan kaki di era modern

Abstract

The absence of term limits for legislative members has resulted in a pattern of power entrenchment, thus hampering the process of leadership regeneration and strengthening oligarchic tendencies within parliament. The absence of term limits in the Law of MD3 opens up space for power entrenchment, the formation of political dynasties, conflicts of interest, and a decline in the integrity of representation, reflected in the increasing constituency disconnect, the phenomenon of self-serving legislation, and the high number of legislative corruption cases. Therefore, a comprehensive design is needed to formulate a term limit model that aligns with the constitutional mandate. The study uses normative legal methods through legislative and conceptual approaches, examining the 1945 Constitution, the MD3 Law, the Election Law, Constitutional Court decisions, as well as the theories of constitutionalism, Habermas's deliberative democracy, and Madison's theory of power limitations. The analysis is conducted descriptively-analytical and interpretative-normative to build a cohesive legal argument. The results show that constitutionally, term limits can be justified as an integral part of the principle of power limitation and legal certainty; the current absence of norms has been shown to reduce the effectiveness of the representation function and open up opportunities for abuse of authority. From a leadership regeneration perspective, term limits increase the plurality of political actors, reduce incumbency advantage, and encourage policy innovation, while simultaneously breaking patronage networks that hamper oversight functions. Meanwhile, from a checks and balances perspective, term limits can strengthen the collegial independence of the House of Representatives (DPR) and increase the credibility of its oversight function over the executive, but they need to be designed proportionally to avoid creating an expertise gap or disrupting policy continuity.

Abstract

This research is motivated by the increasing problem of abandoned land and absentee land, which indicates the ineffective enforcement of the land regulatory framework despite the comprehensive formulation of normative frameworks such as the Basic Agrarian Law (UUPA), Government Regulation No. 20 of 2021, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency (BPN) No. 20 of 2021. Uncultivated land and agricultural land ownership by owners not domiciled in the area result in inefficient use of space, increase the risk of agrarian conflict, and reduce the social function of land, as seen in Jonggon Jaya Village. This research aims to analyze the effectiveness of land regulatory framework enforcement, identify legal and administrative factors that hinder the handling of abandoned land and absentee land, and formulate strategies and formulations for strengthening the legal framework that is more responsive to local agrarian dynamics. The method used was sociological juridical research, combining normative analysis of land regulations with empirical findings through interviews, field observations, and review of land administration documents. These were then analyzed using Lawrence M. Friedman's legal system theory (structure, substance, and legal culture). The research results indicated that weaknesses in law enforcement stem from weak institutional capacity, fragmentation of legal substance, the absence of objective parameters for determining abandoned land, and low community compliance with land management obligations. To address these issues, this study offered five innovative policy formulations: the formulation of the Integrated Land Utilization Index (IULT), the development of Conditional Management Rights, the implementation of an electronic domicile verification system (E-DOM), the establishment of a Local Land Activation Fund, and the implementation of digital, electronically proven administrative protocols. These findings emphasize that strengthening the land regulatory framework requires synergy between normative reform, modernization of the administrative system, and strengthening of the community's legal culture to achieve sustainable agrarian justice.
