Abstract

Pepaya menjadi salah satu produk unggulan yang ditekuni oleh para petani di Desa Sabrang, Kecamatan Ambulu, Kabupaten Jember, dengan pertimbangan potensi ekonomi dari hasil panen yang didapatkan. Permasalahan utama yang muncul adalah hasil panen yang tidak dapat dilaksanakan secara bersamaan sehingga menghasilkan inefisiensi dalam proses distribusi hasil panen ke luar daerah. Pada sisi lain, hasil panen melebihi permintaan konsumsi masyarakat setempat sehingga terdapat menurunan nilai produk yang digunakan sebagai makanan ternak. Terhadap permasalahan ini, diperlukan inovasi pengolahan produk papaya ke dalam berbagai macam produk ekonomi sekaligus sebagai upaya pemberdayaan ekonomi masyarakat, khususnya para perempuan purna buruh migran yang tergabung dalam kelompok PPT Desbumi Harmonis di desa setempat. Inovasi dimaksudkan untuk meningkatkan keterampilan bagi perempuan purna buruh migran sehingga dapat mendukung program Desa peduli Buruh Migran (DESBUMI). Upaya ini merupakan bagian dari program pendidikan luar sekolah guna memberikan pengetahuan dan ketrampilan yakni melalui pelatihan inovatif. Pelatihan ini menghasilkan inovasi sabun papaya padat, sabun cair cuci tangan dan lulur yang berbahan papaya.

Abstract

The Editorial Board proudly presents the recent publication of the Indonesian Journal of Law and Society Volume 2 Issue 1 (March 2021). It is the third issue that the journal has consistently and rigorously selected manuscripts for publication from March 2020. In this issue, the critical topics examined by the authors mainly deal with the recent discourses on the law in changing societies, which includes its impacts from COVID-19 to the way of the Indonesian government that strived for leveraging more investments to end up an industrial economy. In this second year, the Indonesian Journal of Law and Society covers five scholarly papers. This issue spans from Indonesia’s hegemony campaign in tobacco industries, Nigeria’s reproductive rights in the wake of the COVID-19 pandemic, Indonesia’s constitutional complaint against constitutional rights, Indonesia’s AI-based legislative drafting, to state institutions’ dispute settlement from the Newmont divestment case.

Abstract

Election becomes the main feature of liberal democracy and a prerequisite of the working of democracy. After Indonesia’s reformation, an election has played an important role in engaging citizens to participate in the government. It includes the subsequent introduction of elections at the local level that portrays an increasing role of citizens in democracy at the grassroots. Consequently, every position of the regional head, both at the provincial and district/city levels, should involve citizens’ direct intervention to implement “the regional head to be democratically elected”, the norm outlined in Article 18 (4) of the 1945 Constitution. This paper aims to trace the historical trajectory and development of the direct regional head election and analyze the extent to which its continuities and changes in the last two decades have linkages to the performance of Indonesian democracy. By examining the relevance of regional head elections to Indonesia’s contemporary democracy after two decades of reform, this paper specifically reflects on the interpretation of the above constitutional norm through regional head elections, which in practice become problematic because money politics is often unavoidable. This money politics in this local election encourages the regression of the Indonesian democracy because direct regional head elections do not necessarily reduce vote manipulation as had been practiced in regional head votings by members of the Regional People’s Representative Council. Abstrak Pemilu menjadi substansi utama dalam demokrasi liberal dan merupakan prasyarat berfungsinya demokrasi. Setelah reformasi Indonesia, pemilu berperan penting dengan melibatkan warga untuk berpartisipasi dalam pemerintahan, yang kemudian mencakup dikenalkannya pemilihan tingkat lokal sebagai peningkatan peran warga negara dalam demokrasi di akar rumput. Oleh karena itu, setiap jabatan kepala daerah, baik di tingkat provinsi maupun kabupaten/kota, harus melibatkan intervensi langsung warga negara untuk melaksanakan “kepala daerah dipilih secara demokratis”, norma yang dituangkan dalam Pasal 18 ayat (4) UUD 1945. Tulisan ini bertujuan untuk menelusuri lintasan sejarah dan perkembangan pemilihan kepala daerah langsung serta menganalisis sejauh mana kesinambungan dan perubahannya dalam dua dekade terakhir memiliki keterkaitan dengan kinerja demokrasi Indonesia. Dengan mengkaji relevansi pemilihan kepala daerah terhadap demokrasi kontemporer Indonesia setelah dua dekade reformasi, tulisan ini secara khusus merefleksikan interpretasi norma konstitusi di atas melalui pemilihan kepala daerah yang dalam praktiknya menjadi problematik karena sering tidak dapat terhindarkan dari politik uang. Politik uang dalam pemilihan kepala daerah ini mendorong regresi demokrasi di Indonesia karena pemilihan secara langsung tidak serta merta dapat mengurangi praktik manipulasi suara sebagaimana yang pernah dipraktikkan dalam pemilihan kepala daerah oleh anggota Dewan Perwakilan Rakyat Daerah.

Abstract

This paper aims to examine the complex and often contentious relationship between constitutionalism and integralism in the Indonesian government and provides a criticism of democratization within the contemporary state. Integralist state portrays the relationship between the state and the people as analogous to a family, with the state as a father and the people as children (the Family Principle). Those that adhere to this view, with regard to contemporary Asian politics, claim that Asian values are inherently integralist, that Asia’s particular history and values different considerably from the West’s, and that Pancasila, Indonesia’s state philosophy, is utilized to establish romanticized relations between the ruler and the ruled. The data presented in this paper was collected from relevant articles on Indonesian democracy and Asian values. It also demonstrates how Pancasila, as Indonesia’s core guiding philosophy, has influenced debates over how the constitutional should be applied and interpreted. As the research shows, during the regimes of Sukarno and Suharto, Pancasila was manipulated in order to promote the goals of the state, and that a reliance on integralism during Indonesia’s founding years severely diminished human rights and Indonesia’s capacity for an efficient democracy. By continually putting the priorities of the state above those of the people, the Indonesian government has contradicted its adoption of human rights and liberal democracy is often challenged by the spirit of integralism.

Abstract

Sovereignty remains a crucial debate in international law. Simultaneously, regionalism offers a new pathway for which sovereignty is often contested whether it surrenders due to economic interests. This paper revisits the notion of state sovereignty in the light of economic globalization and enquires about legal personality in international relations. Overall, this paper emphasizes revisiting the concept of sovereignty and legal personality in this 21st century, which has evolved amidst the more globalized world due to international economic relations. The present study was based on historical and analytical methods as doctrinal research. The historical approach was adopted to study international treaties and agreements to know the historical background and evolution of international economic law institutions. Then, it exemplified the European Union's evolution that transcends the state boundaries, following the debate on the relevance of the state sovereignty after the Brexit case under the discussion of the waning of the state sovereignty. Finally, this discussion ended with the international legal personality owned by regional bodies, taking the EU and ASEAN as the comparison. At the outset, the EU was projected as the new governance structure that gradually disrupted the state concept under the Westphalian Peace 1648 due to its member states' desire to form the state-level structure. The European Union redefines the new model of sovereignty against the Westphalian model, which is incomparable to the ASEAN intergovernmental model and other regional bodies regarding sovereignty concerns and legal personality.

Abstract

Upon the publication of the Indonesian Journal of Law and Society Volume 3 Issue 1 (March 2022), the journal has consistently and timely published bi-annual issues within its starting three-year, with its gradual improvement in terms of management and article publication. This journal also has steadily embraced more authorships from different jurisdictions, in spite of its design as an interdisciplinary forum for academicians, researchers, students, and practitioners to share their ideas and findings after a rigorous peer-review process. In this issue, critical topics spanning from legal pluralism and decolonization to human rights are critically examined. While this edition generally discusses contemporary discourses of how law and society are intertwined in the development of the legal system, most articles also highlight how Asia as a region with diverse and distinct legal traditions takes a considerable role, representing more developing countries as a starting point for a comparative analysis of law and society.

Abstract

The Inquiry rights was the implementation of the oversight function of House Representative (DPR) to Presiden/and  or Vice President. The  use  of  inquiry  right  as  a  political  strategy  in impeachment mechanism to President/and or Vice President depend on reality and political consensus of the DPR, so there are possibilities and tendencies that the rule of law and democracy    are not be able to maintained as stipulated in Article 1 the 1945 Constitution. The decree of impeachment of the President and/or Vice President as provide in the 1945 Constitution tend unable  to uphold the rule of law when the Constitutional Court decided the President and / or Vice President violated the constitution, namely the dismissal of the President and or the Vice President made by the Assembly through a political decision (politeke beslssing). The efforts to maintains consistency of the concept of law as stipulated in Article 1 paragraph (3), Article 7B paragraph (3) and paragraph (7) of the 1945 Constitution, without opening  the chance intervention of political interests and obligations of the Assembly to implement the decision of the Constitutional Court. Therefore, the rule of law must be a cornerstone in the practice of constitutional law in  Indonesia.

Abstract

Pandemi COVID-19 telah menjadi tantangan baru dan berpengaruh pada usaha manusia untuk melahirkan alternatif-alternatif baru. Alternatif tersebut juga mencakup pada tatanan pendidikan, yang tampak mulai meninggalkan pola tatap muka secara konvensional menuju pembelajaran daring maupun campuran atau blended learning. Sejauh ini, alternatif untuk tetap dilaksanakannya pembelajaran sekolah adalah dengan penerapan pertemuan daring, yang diaplikasikan pada hampir semua jenjang pendidikan, termasuk tingkat sekolah dasar. Namun, dalam penerapannya, terdapat ragam permasalahan di lapangan, seperti yang terjadi di SD Negeri Tamanbaru, Kecamatan Banyuwangi, Kabupaten Banyuwangi, Provinsi Jawa Timur. Di sekolah tersebut, terjadi kesenjangan antara guru dan siswa terhadap penggunaan teknologi sebagai pendukung pembelajaran daring. Kesenjangan disebabkan karena pengetahuan dalam pengoperasian media pembelajaran daring, berikut tantangan keterbatasan daya beli paket data internet baik pada guru maupun siswa. Penelitian ini diselenggarakan berbasis pengabdian masyarakat, dengan tujuan untuk menyediakan alternatif pada masyarakat akar rumput dengan inovasi sistem pembelajaran daring melalui pengenalan media belajar yang baru kepada guru dan siswa. Dengan kegiatan ini, diharapkan pembelajaran secara daring dapat terlaksana secara efektif dan efisien. Metode pelaksanaan yang digunakan adalah wawancara dan survei kepada guru (sasaran), pembuatan modul untuk guru, pelatihan dan pendampingan dalam penggunaan media belajar (google meet dan google form) dan evaluasi program penerapan media belajar yang baru kepada siswa. Acuan keberhasilan program pengabdian ini adalah guru dan siswa sebagai sasaran mayoritas lebih nyaman dan mudah dalam menggunakan media tersebut. Sebagai konsekuensinya, guru mendapatkan keterampilan digital yang lebik baik dalam pembelajaran berbasis daring di masa pandemi COVID-19.   Development of Learning Media at SDN Tamanbaru Banyuwangi and Its Relevance to Fulfillment of the Right to Education The COVID-19 pandemic has become a new challenge and an impact on human efforts to generate new alternatives. This alternative also includes educational settings, which seem to have begun to leave conventional face-to-face patterns towards online learning or blended learning. So far, the alternative for implementing school learning is by implementing online meetings at almost all levels of education, including the elementary school level. However, there are various problems in the field in its application, such as what happened at SD Negeri Tamanbaru, Banyuwangi District, Banyuwangi Regency, East Java Province. In this school, there is a gap between teachers and students regarding the use of technology to support online learning. The gap is due to knowledge in the operation of online learning media, along with the challenges of limited purchasing power of internet data packages for both teachers and students. This research was conducted based on community service to provide an alternative to grassroots communities with an innovative online learning system by introducing new learning media to teachers and students. With this activity, it is hoped that online learning can be carried out effectively and efficiently. Implementation methods used are interviews and surveys to teachers (target), making modules for teachers, training and mentoring in learning media (google meet and google form), and evaluating the program of implementing new learning media for students. The reference for the success of this service program is that teachers and students are more comfortable and easier to use the media. Therefore, teachers get better digital skills in online-based learning during the COVID-19 pandemic.

Abstract

This paper traces the trajectory of Indonesian democracy that has developed in the last twenty years, specifically regarding the extent to which its continuities and changes have been consistent with the rationale for reformation. It enquires whether the current democracy has been transformed based on liberal constitutionalism or the new democracy has restored the integralist ideal. In recent years, the mass protests that increasingly color Indonesian politics have become a critical response to a failing system. This analysis asserts that the lack of functioning political parties in Indonesia and the breakdown of Indonesian democracy as a result of integralism ignores essential checks and balances. The situation is exemplified by the cooperation of the opposition parties in the cabinet, including the promotion of gotong royong (mutual help) in the form of Prabowo Subianto, Joko Widodo’s rival in the 2019 Presidential Election. Subianto has long been implicated in human rights abuses, going back to East Timor invasion in the 1970s. This attitude also indicates the serious threat that gradually negates the hard-won liberal democracy at the dawn of the reformation. Among these trends, the current democracy reveals the ineptness of the existing political parties that were essentially liberalized in the early Reformation. As it stands, they have been unable to prevent the current system from being led to a more autocratic model.

Abstract

The COVID-19 pandemic that has spread across all countries requires humans to avoid crowds, affecting students' learning activities in primary schools. SDN Wonoayu is located in the Pilangkenceng sub-district, Madiun district, carrying out online learning activities for the semester 2019/2020 using the Whatsapp group. The teachers of SDN Wonoayu had difficulty in recapitulating their assignments. Also, some parents faced the same, particularly their challenges in utilizing Whatsapp for their child's learning media and their business media. Students were less able to understand because of independent learning. It required direct interaction to study the material or practice memorization. This program was expected to assist in uploading material, implementing assignment collection, and assisting teacher assessments of students during learning at home using Google Classroom. The Google Form's features were used as a medium for quizzes so that the grades automatically could be easily recapitulated by teachers. Using Google Meet could help learning media for both students and teachers to interact virtually to review material or memorization practices. The work program was carried out with the following steps: introduction (observation and problem identification), looking for literature and information that would be used as additional learning media, counsellingLearning Media learning media to teachers according to health protocols, applying learning media to students, and mentoring teachers. In summary, this KKN program could meet success indicators of> 70% based on questionnaire data given to Islamic Education Teachers, PJOK Teachers, and Grade 4 Student Samples.
