Abstract

This paper aims to analyze the relevance of the Coordinating Ministry in carrying out the functions of synchronization and coordination among state ministries in the administration of government in Indonesia, and to compare it with practices in several countries that adopt a Presidential system. The research employs a normative juridical method with statutory, conceptual, and comparative approaches. The findings indicate that the Coordinating Ministry plays a strategic role in maintaining policy coherence among ministries. However, overlapping authority with other ministries that also possess coordinative functions, coupled with the relatively large number of Coordinating Ministers, has the potential to hinder government effectiveness if not managed properly. A comparative study with Presidential countries such as the United States, the Philippines, Brazil, and South Korea suggests that governmental coordination can be carried out more efficiently by a single office or specialized institution. Therefore, this study recommends a reduction in the number of Coordinating Ministers in Indonesia and the strengthening of a single strategic coordinating institution under the President, as well as the possibility for the Vice President to assume a coordinating role when directly mandated by the President.

Abstract

Tujuan dari kegiatan pengabdian kepada masyarakat betapa pentingnya memberikan paradigma baru dalam memandang genosida yang terjadi bagi warga Palestina. Prinsip keadilan sejati nyatanya tidak berlaku bagi kasus-kasus kejahatan kemanusiaan yang terjadi di seluruh dunia, khususnya di Paliestina. Prinsip ini menjadikan keadilan berubah makna menjadi devil’s justice yang menggambarkan bagaimana kekuasaan dan hawa nafsu menuyelimuti jiwa manusia terhadap manusia lainnya. Keadilan model seperti ini tidak mencerminkan keadilan sejati bila dikaitkan dengan pendekatan keselamatan bagi manusia dalam bingkai Hak Asasi Manusia (HAM). Hasil dari pengabdian kepada masyarakat ini adalah memberikan pemahaman secara holistik terhadap kasus-kasus kemanusiaan yang terjadi dan bagaimana pemberian sudut pandang ini merubah paradigma bagi peserta yang hadir di T-Space, Bintaro, Tangerang Selatan dari keadilan dalam sebuah peperangan dan kejahatan manusia yang terjadi berubah menjadi tumbahnya rasa hormat kepada martabat manusia yang dikesampingkan dalam peristiwa kejahatan. Salin itu, dengan pengabdian kepada masyarakat ini turut memberikan pemahaman bagaimana kekerasan secara keilmuan bukan hanya kekerasan personal saja, lebih jauh dari itu kekerasan struktural melalui tatanan sosial, dan kekerasan kultural yang lebih kompleks telah terjadi, sehingga dalam menganalisa genosida yang terjadi di Palestina, seluruh peserta mendapatkan pandangan yang menyeluruh dan holistik tersebut.

Abstract

This research aims to examine the repairing Law no 11 of 2020 concerning Job Creation by issuance of Perppu No. 2 of 2022 concerning Job Creation and Questioning the constitutionality of Law no. 6 of 2023 after Constitutional Court Decision no. 54/2023. Constitutional Court Decision No. 91/2020 decides Law no. 11 of 2020 concerning Job Creation as Conditionally Unconstitutional and mandates law makers to improve it with meaningful community participation. The government took action to the decision by issuing Perppu no. 2 of 2022 concerning Job Creation. Constitutional Court Decision No. 54/2023 states the issuance of Perppu no. 2 of 2022 concerning Job Creation fits on UUD NRI 1945. Even though the Constitutional Court's decision is final and binding, it is considered to harm substantive justice in society. The research method applied is normative juridical research with a statutory approach and a case approach supported by primary and secondary legal materials which are then managed qualitatively. Previous research analyzed the constitutionality of the job copyright law based on Constitutional Court Decision no. 91/PUU-XVIII/2020, but this research analyzes the dynamics of the constitutionality of the job copyright law based on Constitutional Court Decision No. 91/PUU-XVIII/2020 and 54/PUU-XXI/2023. The results obtained from this research are, the issuance of Perppu no. 2 of 2022 concerning Job Creation which was subsequently enacted into Law no. 6 of 2023, againts Counstitutional Court Decision No. 91/2020, had requirement to provide meaningful participation, and was enacted into law when it no longer had any operational power. Constitutionality; Job Creation; Unconstitutional ConditionsPenelitian ini bertujuan untuk menilik perbaikan Undang-Undang Ciptaker terdahulu dengan menerbitan Perppu No. 2 Tahun 2022 tentang Cipta Kerja dan Menyoal dinamika konstitusionalitas UU No. 6 Tahun 2023 pasca Putusan MK Nomor 91/PUU-XVIII/2020 dan 54/PUU-XXI/2023. Putusan MK No. 91/PUU-XVIII/2020 memutus UU No. 11 Tahun 2020 tentang Cipta Kerja Inkonstitusional Bersyarat dan mengamanatkan pemerintah untuk memperbaikinya dengan partisipasi masyarakat secara bermakna. Pemerintah melaksanakan putusan tersebut dengan memilih menerbitkan Perppu No. 2 Tahun 2022 tentang Cipta Kerja dibandingkan dengan membentuk undang-undang. Putusan MK No. 54/PUU-XXI/2023 menyatakan Penerbitan Perppu No. 2 Tahun 2022 tentang Cipta Kerja tidak bertentangan dengan UUD NRI 1945. Meskipun Putusan MK bersifat final and binding tetapi dinilai mencederai keadilan substantif ditengah-tengah masyarakat. Metode penelitian yang diaplikasikan yaitu penelitian yuridis normatif dengan pendekatan perundang-undangan (statue approach) dan pendekatan kasus (case approach) yang didukung bahan hukum primer dan sekunder yang kemudian dikelola secara kualitatif. Hasil yang diperoleh dari penelitian ini yakni, penerbitan Perppu No. 2 Tahun 2022 tentang Cipta Kerja yang selanjutnya ditetapkan menjadi UU No. 6 Tahun 2023, tidak sejalan dengan amar Putusan MK No. 91/PUU-XVIII/2020, yang mensyaratkan keberadaan partisipasi masyarakat secara bermakna, dan ditetapkan menjadi undang-undang saat sudah tidak memiliki daya laku.

Abstract

This study aims to analyze the legal problems concerning the replacement of a candidate pair or one of the candidates for regional head who passes away within 30 and 29 days prior to election day. This research employs a normative juridical method through statutory, conceptual, and comparative approaches. The findings demonstrate that the death of a candidate pair or one of the candidates for regional head, occurring with a one-day difference between 30 and 29 days before election day, results in the loss of the right of political parties or coalitions to nominate a replacement candidate. Therefore, it is necessary to amend Article 54 of Law No. 10 of 2016 to establish a single deadline for the nomination of replacement candidates, in order to ensure legal certainty and the continuity of regional head elections.
