Abstract

The implementation of GDPR and PSD2 in the EU as well as the PSD2 alignment with GDPR, encourage central banks in various countries including Indonesia to immediately implement an open banking system that also prioritizes privacy data protection. The PDP bill principle of explicit consent must be applied in open banking financial transactions that in Indonesia as stated in the National Standard Open API Payment (SNAP) 2021 (a Technical Standards and Governance Guideline). However, there are some fundamental differences regulated in PSD2 when compared to SNAP which will hinder Indonesia's adequate GDPR. This research is normative research with statutory approach and comparative approach. The results showed that there are some fundamental differences between PSD2 and SNAP, including the parties involved, data portability and the concept of re-consent or re-confirmation which are not regulated in SNAP but regulated in PSD2, for the concept of sensitive data payment, neither SNAP nor PSD2 provide the specific concept, both define it broadly.

Abstract

Sebagian besar masyarakat di desa Botubarani yang memiliki pemukiman di pinggir pantai dan pesisir belum menyadari adanya pengaturan tentang hak batas ruang dan hak pemanfaatan wilayah pesisir dan pantai. Paradigma masyarakat tentang penguasaan wilayah pesisir dapat dimanfaatkan untuk kesejahteraan dan kepentingan ekonomi seluas-luasnya oleh masyarakat setempat tanpa memperhatikan kelestarian lingkungan hidup. Implementasi program penyuluhan di desa Botubarani dilaksanakan dengan menggunakan metode sosialisasi. Tujuan yang diharapkan dari kegiatan tersebut adalah memberikan edukasi yang dapat mendorong pengetahuan, pemahaman, wawasan tentang penetapan batas ruang dan pemanfaatan wilayah pesisir khususnya pada masyarakat desa Botubarani. Penyluhan tersebut diterima dengan baik masyarakat hingga menghasilkan pembentukkan sebuah kelompok pemberdayaan masyarakat sebagai alternatif penegakkan hukum dan keamanan pesisir Botubarani.

Abstract

The Principle of Constante Justitie, or the principle of a simple, fast, and light trial, is intended so that handling cases can be resolved in a short time. It does not need to take a long time. The problem in this paper is: (1). how is the application of the Constante Justitie principle or the simple, fast, and low-cost principle as expected by justitiabellen? (2). How to renew the criminal justice system through the principle of Constante Justitie, which can guarantee justitiabellen satisfaction. This research is normative juridical research, namely legal research that aims to find methods, norms, or das sollen. The results showed that the application of the principles of justice, speed, and light costs that guarantee justitiabellen satisfaction has not been following the mandate of laws and regulations. The renewal of the criminal justice system, especially the Principle of Constante Justitie, which can guarantee justitiabellen satisfaction, has now been pursued by the Supreme Court by issuing various regulations such as the Supreme Court Rules or PERMA or Supreme Court Circulars or SEMA, but it has not been successful.

Abstract

This article aims to analyze legal subjects whose rights have been violated by the Fiduciaire Act. The Act law can be revoked by the Constitutional Court. The act that violates the rights of subjects is the rule in the provisions of parate executie on Fiduciaire Act. The first analysis is the ontology of parate executives that inflict certain subjects, and the second analysis is the ratio decidendi decision of the Constitutional Court Number 18/PUU-XVII/2019. This paper uses dogmatize analysis. The decisions of the Constitutional Court are analyzed with the doctrine of experts and regulations. Parate execution is a right attached to the recipient fiduciary which can exercise if the fiduciary giver breaks the commitment. Collateral is auctioned through a public offering submitted by the recipient of guarantee. Default by a fiduciary giver occurs if there is an agreement between the giver and the fiduciary recipient. Default occurs based on legal remedies in determining the default. The agreement of the collector with the fiduciary acquirer, the emergence of a broken pledge experienced by the fiduciary giver can give birth to a parate executie.

Abstract

The current method that is very appropriate for limiting children's social interactions while preventing the practice of minor human rights violations is to get more intense in inviting children to actualize what they see and read into human rights theory through a case study approach. The research method used in this theory is the Creswell case study, the focus of the case study is the specification of the case in an event, whether it includes individuals, cultural groups or a portrait of life. The results of this study indicate that elementary school children more easily understand the theory that is transformed in the form of the case method by the teacher. This is because the case study approach is carried out based on practice or actualization through a good habit process.

Abstract

Departing from legal issues regarding progressive taxes with different percentages from non-progressive taxes, this study aims to find out whether the determination of progressive taxes is in accordance with the principles of justice and humanity or not. Because as we know, this progressive tax has a larger percentage than non-progressive taxes. In addition, the purpose of this study is also to find out how the government can determine which taxpayers are charged as progressive taxpayers, of course there is a separate classification so that the taxation government classifies them as progressive taxpayers. This research is a type of normative research with a statute approach, historical approach, and analytical approach. The source of data from this study is secondary legal material consisting of primary, secondary and tertiary legal materials. Data collection techniques are document and literature studies, then for data analysis is a descriptive qualitative method. Determination of the percentage of progressive tax in this case is in accordance with the provisions of the law in force and by taking into account or in accordance with the principles of justice and humanity, besides that the taxation government in determining the taxpayer as a progressive taxpayer has its own provisions.

Abstract

This article discusses the legal protection of clients without contracts in legal services according to Law no. 8 of 1999 concerning Consumer Protection The purpose of this article is to find out the relationship between lawyers and clients in legal service agreements and to find out legal protection for clients without contracts on legal services according to Law no. 8 of 1999 concerning Consumer Protection. The method used is a normative article using library data. The result of this article is that the relationship between advocates and clients is a relationship in the form of a symbiotic mutualism that requires each other, as regulated in the Law on Advocates No. 18 of 2003 concerning Advocates that Advocates and Clients each have rights and obligations. where the advocate is obliged to provide legal assistance to the client and is entitled to an honorarium for his services. Meanwhile, the client is obliged to provide an honorarium to the advocate and is entitled to legal assistance from the advocate. while the legal protection to clients in the legal service agreement is regulated in Law no. 8 of 1999 concerning Consumer Protection, as well as the settlement method, namely through the general judiciary, the Advocate Code of Ethics Council Session, and arbitration.

Abstract

This study aims to analyze criminological reviews based on the theory of anomie criminal acts of fraud (Illegal Investment) and law enforcement of criminal acts of fraud in the Gorontalo Regional Police. This study uses the Normative - Empirical method. By using primary data and secondary data, data collection techniques through interviews, observation, and literature studies. The results of this study indicate the causes of people becoming perpetrators of illegal investment fraud, namely wanting to enrich themselves, and taking advantage of opportunities for the lack of public knowledge about the mechanisms and ways of working investment products and the general public. Factors that lead to criminal acts of illegal investment: Economic, environmental, and social factors Investing in Indonesia is regulated in Law no. 25 of 2007 concerning Investment. Law enforcement by the Gorontalo Regional Police general criminal investigation cyber investigation process through complaints of victims of illegal investments. To obtain the identity of the perpetrator, and the role of the perpetrator in the implementation of investment fraud crimped es, an investigation process is carried out up to the final stage of the legal process.

Abstract

Sexual harassment provides a feeling of insecurity and comfort to the victim, even at a more severe level, the victim can experience trauma. The very broad scope of sexual harassment shows how complex the problem is. So widespread, verbal sexual harassment (indecent comments, sexually suggestive jokes and so on) or what is known as catcalling is an interesting issue to study. This is because verbal sexual harassment or catcalling often occurs in the community but is considered normal by the community, even though catcalling can create feelings of insecurity, comfort and even fear for the victim. The type of legal research in this research is normative legal research, which is a process to find a rule of law, legal principles, and legal doctrines in order to answer the legal issues faced. The approach used in this research is a statutory approach, namely research on legal products. In this study the authors found that legal protection for victims of catcalling is still inadequate, judging from the lack of accommodation of repressive legal protection, this is because there are no specific rules governing the act of catcalling.
