Abstract

This article aims to describe the application of the concept of neutrality law in the current era with the contamination of digitalization. The main problem refers to the intervention of third countries or neutral states in the Russian conflict v. Ukraine, then questioned the existence of neutrality law in the era of digitalization. The method used is a normative juridical method with a statute approach analyzed qualitatively and descriptively. The results show that validity is needed in determining the attitude of third countries or neutral states that intervene with belligerents (Russia/Ukraine). The determination of the validity is based on the scale of the intervention provided by the third country. Validity refers to the 1907 Hague Convention and the UN Charter, which generally outlines violations of territorial sovereignty and international law. So, in conclusion, the concept of open access, broad and immeasurable digitalization, cannot be avoided in the conflict between Russia and Ukraine. This does not necessarily become a justification because the essence of the principle of neutrality and intervention is very different; the two cannot be combined unless a violation of international law indicates one. So basically, neutrality law can no longer be the primary regulation to control the attitude of a neutral state but requires new norms that shape the attitude of a neutral state so that it can be used as international customary law.

Abstract

The conflict between the Indonesian government and the KKB separatist group in Papua is a conflict that has existed for a long time and until now there has been no meeting point. The Indonesian government has taken various ways to resolve the conflict. Previously, Indonesia had also been faced with the same problem. Namely the Free Aceh Movement (GAM) group which demanded that Aceh be independent and stand alone as a legitimate state. In both conflicts, it has caused unconduciveness in society, both in terms of economy, politics, and so on. As a result of both conflicts, both with KKB and GAM have claimed many lives and have even targeted civilians. Then in an effort to resolve the government has a different way. In this study, the author will describe how the government's efforts to resolve conflicts with the Armed Criminal Group (KKB) in Papua and also with the Free Aceh Movement (GAM) group in Aceh differ.

Abstract

This research aims to find out what factors cause families to commit criminal acts against children. This research uses empirical research methods by taking a qualitative approach. The results of this research found that cases of criminal acts against children occurred twice at the Gorontalo City Police in the past 3 years. In the child kidnapping case handled by the Gorontalo City Police, this case has become a case that has shocked Gorontalo residents recently. There was talk of a six year old child with the initials NV who suddenly disappeared and had even been searched for but not found around the city of Gorontalo until it was recently discovered that he had been taken by his aunt to Jakarta without his parents knowing. The perpetrator has been arrested by the Gorontalo City Police and stated that this case is currently in the second stage, namely the prosecutor's handling stage. Meanwhile, in the case of abuse that resulted in death, a five year old child died as a result of torture which caused several lacerations and bruises until the victim finally died. The perpetrators of this case are known to be the victim's step-grandmother, the victim's step-mother and none other than the victim's biological father.

Abstract

the purpose of this study is to determine the legal protection of personal data of bank customers according to Law No. 8 of 1999 on Consumer Protection and how the implementation of the Financial Services Authority (OJK) Regulation No. 12/PJOK.03/2021.  The method used is using sociological juridical research method, using a descriptive qualitative research approach and interactive analysis techniques. The result of this research is that it arises because the issue of data protection and customer information in Indonesia has become a new problem in the banking world. On the other hand, adequate forms of protection for a customer's privacy rights have not been implemented into legal instruments. Similarly, the existence of various laws (UU) that have the authority to manage one's data and information, are not given limits to avoid violations that result in unprotected data and information of a person.

Abstract

Food safety in Indonesia is still far from safe, we often see food poisoning incidents that occur a lot nowadays. In general, this often results in consumers being in a weak and disadvantaged position, so there is a need for regulations that can bridge the interests of business actors and the interests of consumers without harming either party. Forms of responsibility of a business actor towards consumers in the legal order in Indonesia Civil liability based on legal events can be divided into two, namely: liability based on fault, namely liability that can arise due to breaches of contract or unlawful acts, whether caused by careless actions or intentional actions. Responsibility based on risk is the responsibility that must be borne by a business actor for his business activities which cause losses to consumers.

Abstract

This study endeavors to conduct a meticulous analysis and comparison of the discretionary policy frameworks employed by India and Indonesia in response to the challenges posed by the COVID-19 pandemic. The research delineates its focus into two primary dimensions: firstly, an examination of the structure and application of discretionary policies formulated by the central governments of both nations; secondly, an in-depth exploration of the challenges and strategic considerations in the local-level implementation of these policies, aligned with the dynamic nature of the pandemic. Employing a rigorous research methodology, this study entails the systematic analysis of pertinent legal and policy documents, a comprehensive review of existing literature, and a nuanced conceptual and philosophical interpretation of discretionary policies in the context of pandemic management. The findings of this research underscore the distinctive approaches undertaken by India and Indonesia in the implementation of discretionary policies. India adopts a more centralized model, whereas Indonesia pursues a decentralized trajectory. Both nations encounter challenges in inter-governmental coordination, with India grappling with the harmonization of central and state policies, and Indonesia contending with disparities between central and local governance. Furthermore, the research underscores the imperative for both countries to reassess and develop legislative frameworks that are adaptive and dynamic, harmonizing legal rigidity with the requisite flexibility to effectively respond to the rapidly evolving conditions of the pandemic. Crucially, the research emphasizes the necessity for enhanced transparency and accountability within the realm of discretionary policy. Both countries are urged to fortify these elements to cultivate public trust and ensure the efficacious and equitable implementation of policies during the ongoing public health crisis.

Abstract

The aim of this research is to understand and comprehend the urgency of implementing Artificial Intelligence in service business transactions as well as the application of the Consumer Protection Law in regulating business transactions using Artificial Intelligence. This research was conducted using a type of normative legal research supported by empirical data. In research activities, researchers also use data collection techniques through interviews and documentation. Based on the research that has been carried out, the results show that the implementation of Artificial Intelligence in business transactions provides a number of significant benefits in business. This includes increased operational efficiency, better data analysis, being able to answer messages automatically and the ability to make decisions in a more timely manner. In addition, the application of the Consumer Protection Law in business transactions using Artificial Intelligence is very important to maintain consumer rights and security.

Abstract

Sexual violence is one of the major crimes like other crimes that affects and has an impact on the destruction of the social fabric of the Indonesian nation. According to Islam, sexual violence itself is a form of cultural values ​​and social backgrounds that deviate from a human perspective. Crimes like this damage the human side for both women and children in accordance with Article 82 in Law Number 23 of 2002 concerning Child Protection. This research is to find out the factors of sexual violence perpetrated by teachers on children, to find out the mode of sexual violence perpetrated by teachers on children, to find out the legal protection given to children as victims of sexual violence. This research uses normative juridical research, namely by examining library materials or secondary data. Research that refers to legal norms contained in laws and regulations. Research results Children still do not understand the dangerous conditions around them because they do not have knowledge and self-control. The perpetrator's mode by persuading the child to feel comfortable with the perpetrator and persuading the child to want to have sex and the legal protection that can be given to children who are victims of sexual crimes are regulated in Law no. 35 of 2014 concerning Amendments to Law no. 23 of 2002 concerning Child Protection.

Abstract

The Principle of Constante Justitie, or the principle of a simple, fast, and light trial, is intended so that handling cases can be resolved in a short time. It does not need to take a long time. The problem in this paper is: (1). how is the application of the Constante Justitie principle or the simple, fast, and low-cost principle as expected by justitiabellen? (2). How to renew the criminal justice system through the principle of Constante Justitie, which can guarantee justitiabellen satisfaction. This research is normative juridical research, namely legal research that aims to find methods, norms, or das sollen. The results showed that the application of the principles of justice, speed, and light costs that guarantee justitiabellen satisfaction has not been following the mandate of laws and regulations. The renewal of the criminal justice system, especially the Principle of Constante Justitie, which can guarantee justitiabellen satisfaction, has now been pursued by the Supreme Court by issuing various regulations such as the Supreme Court Rules or PERMA or Supreme Court Circulars or SEMA, but it has not been successful.

Abstract

Artikel ini bertujuan untuk memenuhi luaran laporan pengabdian pada program penanganan sampah melalui Bank Sampah di Kabupaten Boalemo. Metode yang digunakan yaitu dengan mendesain peraturan desa melalui pelatihan dan pendampingan penyusunan Peraturan Desa serta sosisalisasi dan pelatihan untuk kader desa dan masyarakat dalam penanganan sampah di desa Bongo Nol. Hasil yang dicapai dalam program KKS pengabdian ini adalah ; (1) terbentuknya peraturan desa Bongo Nol tentang Pembentukan dan Pengelolaan Bank Sampah yang menjadi basis yuridis bagi pemerintah desa untuk mengelola sampah yang dapat meningkatkan pendapatan bagi desa dan masyarakat desa Bongo Nol dengan bentuk penyertaan dana desa yang menjadi modal dalam pembentukan Bank Sampah, pengangkatan pengelola bank sampah, dalam proses pencapaian pembentukan peraturan desa tersebut, dilakukan tahapan pencapaian melalui pendampingan kepada aparat desa dalam penyusunan perdes, uji publik kepada masyarakat desa, pembahasan, sementara proses penetapan, pengesahan hingga ke pengundangan perdes tentang Pembentukan dan Pengelolaan Bank Sampah akan dialkukan secara internal antara pemerintah desa (kepala desa) dengan Badan Permusyawaratan Desa yang secara yuridis memang memiliki kewenangan untuk penetapan, dan pengundangan; (2) terbentuknya bank sampah yang dilakukan dengan tahapan pendirian bank sampah (termasuk pengelolanya) yang berpusat di kantor desa dan ditambah satu uni bank sampah yang berada di Dusun yang berada di Jalan Trans Boalemo dengan pertimbangan produksi jumlah sampah yang ada di dusun tersebut cukup besar disbanding dusun-dusun lainnya. (3) keterampilan pengelolaan sampah melalui kegiatan pelatihan pengelolaan sampah oleh mitra Kelompok KKS Pengabdian.
