Abstract

The purpose of this paper is to determine the role and function as well as the driving and inhibiting factors of the Bawaslu of West Java Province in preventing general election violations. The Election Supervisory Body is an organ for organizing general elections in Indonesia which has the task of maintaining the quality of democracy through general elections. In this paper, the method used is through a normative juridical approach. The results show that the functions of Bawaslu in preventing election violations include identifying and mapping election violations, coordinating, supervising, guiding, monitoring and evaluating the implementation of elections, coordinating with relevant government agencies and increasing public participation in election supervision. As a driving factor, there is an increase in the position and strengthening of Bawaslu's functionality. The inhibiting factors are the uncertainty and various interpretations of technical regulations, the planning system has not been well consolidated and the Election Supervisory Body (Bawaslu) of West Java Province does not yet have an effective strategy in preventing transactional politics and community participation in supervision which is still relatively low.Tujuan dari penulisan ini untuk mengetahui peran dan fungsi serta faktor pendorong dan penghambat Bawaslu Provinsi Jawa Barat dalam melakukan pencegahan pelanggaran pemilihan umum. Badan Pengawas Pemilu merupakan organ penyelenggaraan pemilihan umum di Indonesia yang memiliki tugas menjaga kualitas demokrasi melalui adanya pemilihan umum. Dalam penulisan ini, metode yang digunakan adalah melalui pendekatan yuridis normatif. Hasil penelitian menunjukan bahwa fungsi Bawaslu dalam melakukan pencegahan pelanggaran pemilu meliputi identifikasi dan pemetaan pelanggaran pemilu, mengoordinasikan, mensupervisi, membimbing, memantau dan mengevaluasi penyelenggaraan pemilu, berkoordinasi dengan instansi pemerintah terkait dan meningkatkan partisipasi masyarakat dalam pengawasan pemilu. Sebagai faktor pendorong yaitu adanya peningkatan kedudukan dan penguatan fungsionalitas Bawaslu. Faktor penghambat yaitu adanya ketidakpastian dan interpretasi yang beragam dari peraturan teknis, sistem perencanaan belum terkonsolidasi dengan baik dan Badan Pengawas Pemilu (Bawaslu) Provinsi Jawa Barat belum memiliki strategi efektif dalam mencegah politik transaksional serta partisifasi masyarakat dalam pengawasan yang masih tergolong rendah.

Abstract

Natural resources have a significant role in supporting national development as a good natural resources management will generate foreign exchange for the country. This study aims to analyze the local governments’ and communities’ efforts in utilizing and managing coastal and marine resources as well as to find out the inhibiting factors in the utilization of coastal and marine resources to achieve environmental sustainability. The method used in this study was normative juridical research method, in which the study was carried out by examining and interpreting theoretical matters on principles, conceptions, doctrines, and legal norms relating to the management of coastal and marine resources. Meanwhile, the data analysis used was a juridical-qualitative analysis, where the analysis describes descriptive-analytical and prescriptive. The qualitative analysis, that is descriptive and prescriptive in nature, was carried out by ensuring that laws do not conflict with one another, paying attention to hierarchy and legal certainty, and examining both written and unwritten laws. Then, the type of data used in this study was primary legal materials in the form of laws and regulations. The results of the analysis showed that the management of coastal and marine resources must be carried out collaboratively between all parties to create an environmental sustainability-based management, and a synchronization and harmonization of legal products made by the central and local governments is needed to realize an optimal management of coastal and marine resources.

Abstract

Humanitarian Intervention dalam dunia Internasional masih menjadi perdebatan, karena satu sisi hukum Internasional menjamin hak suatu negara mengintervensi negara dalam pencegahan pelanggaran HAM, sedangkan disisi lain humanitarian intervention bertentangan dengan prinsip kedaulatan negara akan tetapi setiap warga negara memiliki hak untuk dilindungi oleh negaranya termasuk tindakan yang dilakukan pemerintah Myanmar terhadap Etnis Rohingya yang dikategorikan sebagai kejahatan kemanusiaan (crimes against humanity) yang berdampak pada hilangnya status kewarganegaraan serta diskriminasi beragama. Intervensi Kemanusiaan (Humanitarian Intervention) sebagai wujud langkah mencegah atau menghentikan kejahatan HAM berat dengan unsur-unsur tertentu (diploatic and military) dalam suatu negara. Metode Penelitian yang digunakan ialah metode penelitian hukum normative dengan sumber utama prosedur pengumpulan data ialah bahan hukum yang berisi aturan hukum yang bersifat normatif. Hasil penelitian menunjukkan bahwa pengaturan hukum Internasional terkait Humanitarian Intervention penting diselenggarakkan dan diatur dalam Piagam PBB serta berbagai konvensi tentang pencegahan dan Hukuman bagi Tindak Kejahatan Genosida 1948, dan perjanjian internasional terkait lainnya.. Sedangkan Peran office of high Commissioner for human Right (OHCHR) atau Komisi Hak Aassi Manusia yang melindungi etnis rohingya dengan menekan pemerintah untuk bertanggung jawab.

Abstract

Incest is intercourse committed by someone who has blood relations in Indonesian law, incest includes acts that are prohibited by every religion and is included in the types of criminal acts, in the aceh qanun incest includes the qualifications of the type of adultery finger where Uqubat Hudud and Uqubat Ta'zir as someone who does it, the crime of incest often happens to children who are victims of this due to economic factors, social media and the low level of education of people who do it, with the occurrence of this crime it is very important with the existence of the Child Protection Act as legal umbrella for people or victims who commit incest, settlement of legal disputes legal protection of children as perpetrators of criminal acts or victims of incest with Law Number 35 of 2014 amendments to Law Number 23 of 2004 concerning Child Protection and Law Number 11 concerning Justice System a ak then it can be resolved through litigation or non-litigation (Restorative Justice and Diversion).

Abstract

Konstitusi merupakan kumpulan asas-asas yang menyelenggarakan kekuasaan pemerintahan, hak-hak dari yang diperintah dan hubungan antara pemerintah dan yang diperintah). Secara umum konstitusi atau undang-undang dasar berisi 3 (tiga) hal pokok, yaitu: Pertama, adanya jaminan terhadap hak-hak asasi manusia dan warga negara; Kedua, ditetapkannya susunan ketatanegaraan yang bersifat fundamental; dan Ketiga, adanya pembagian dan pembatasan tugas ketatanegaraan yang juga bersifat fundamental. Metode penelitian dalam tulisan ini menggunakan metode penelitian yuridis normatif yaitu penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan kepustakaan atau data sekunder belaka. Secara umum, terdapat beberapa perbedaan antara Konstitusi Negara Portugal dan Negara Uzbekistan dalam hal sifat, prosedur perubahan konstitusi, bentuk pemerintahan, bentuk negara, serta sistem pemerintahan. Abstract

Tujuan penelitian ini untuk mengkaji bagaimana Pengaturan Pengelolaan Anggaran Dana Desa Terhadap Pembangunan Guna Mewujudkan Pembangunan Berkelanjutan berdasarkan Undang-Undang Nomor 6 tahun 2014 tentang Desa serta Mengkaji faktor-faktor apa saja yang menghambat Efektivitas Pengelolaan Anggaran Dana Desa Terhadap Pembangunan Guna Mewujudkan Pembangunan Berkelanjutan. Metode penelitian yang digunakan adalah pendekatan yuridis empiris dengan menggunakan data hukum primer, data hukum sekunder dan data hukum tersier serta alat pengumpul data yang digunakan yaitu melalui observasi atau terjun langsung kelapangan, wawancara dan kepustakaan. Hasil penelitian ini adalah berdasarkan kajian dari Undang-Undang Dasar Republik Indonesia 1945, Undang-Undang Republik Indonesia Nomor 6 Tahun 2014 tentang Desa, dan Peraturan Presiden Nomor 59 Tahun 2017 tentang Pelaksanaan Pencapaian Tujuan Pembangunan Berkelanjutan. Bahwa dalam hal pembangunan tersebut memang desa di kabupaten kuningan sudah sangat baik dan insfatruktur fasilitas desa sudah sangat baik. Strategi pembangunan yang dilakukan oleh pemerintah saat ini mengatasi ketimpangan pembangunan yaitu untuk melaksanakan pembangunan nasional yang berorientasi dan memberi perhatian besar terhadap pembangunan desa. Penghambat berjalannya pembangunan desa untuk tahun 2020-2021 ini adalah Covid-19 sehingga tertundanya visi misi yang telah dibuat desa untuk pembangunan, baik dari segi perbaikan jalan atau pun fasilitas desa lainnya

Abstract

Penelitian ini bertujuan untuk meningkatkan kesadaran hukum terhadap tindakan perundungan di lingkungan Pondok Pesantren Al-Ma’mur, Desa Cipondok, Kadugede, Kuningan. Sosialisasi dilakukan sebagai upaya preventif untuk mengurangi dan mencegah kasus-kasus perundungan yang sering terjadi di lingkungan pendidikan, khususnya di pesantren. Metode yang digunakan dalam sosialisasi ini mencakup ceramah, diskusi kelompok, dan penyebaran materi edukatif yang berfokus pada dampak negatif perundungan dan pentingnya pengetahuan hukum terkait. Hasil dari kegiatan ini menunjukkan peningkatan pemahaman dan kesadaran para santri mengenai hukum dan implikasi dari perundungan, serta adanya perubahan sikap yang lebih positif terhadap upaya pencegahan perundungan. Dengan demikian, diharapkan pesantren dapat menjadi lingkungan yang lebih aman dan kondusif bagi pembelajaran para santri.

Abstract

The constitution is a set of principles that organize government power, the rights of the governed and the relationship between the government and the governed). In general, the constitution or basic law contains 3 (three) main points, namely: First, there is a guarantee for human and citizen rights; Second, the establishment of a fundamental constitutional structure; and Third, there is a division and limitation of constitutional tasks which are also fundamental in nature. The research method in this paper uses normative juridical research methods, namely library law research which is carried out by examining library materials or mere secondary data. In general, there are several differences between the Constitutions of Portugal and the State of Uzbekistan in terms of nature, procedures for amending the constitution, form of government, form of state, and system of government.

Abstract

In 2020, the government issued Law Number 11 of 2020 on Job Creation. This law has received numerous criticisms from the community, especially in the effort to realize self-sufficiency, security, and food sovereignty, as well as to protect agricultural land from the threat of land conversion. The government, on the other hand, claims that a job creation law, often known as omnibuslaw, can simplify and integrate fundamental permits from laws pertaining to location, environmental, and building permits. The problem under study was the implications of Law Number 20 of 2020 concerning Job Creation on spatial planning and watersheds management, employing a normative research method. The results highlight that the aforementioned law has reconstructed law number 26 of 2007 concerning Spatial Planning, which uses digital maps in the determination of RDTR, the integration of spatial planning and zoning plans, as well as the creation of single map policy to overcome land intersection, influencing permits in the regions. In addition, law number 41 of 1999 concerning Forest Area Limits has also been reconstructed, governing the adequacy of forest areas and forest cover in watersheds, which must be maintained at least 30 percent of the area of river basins. The 30% loss of the forest area may result in policy liberalization and the uncontrolled utilization of forest lands for industrial and commercial purposes. At the end, it will exacerbate tensions between spatial planning and watershed management, especially in preserving the adequacy of forest areas and forest cover in watersheds, which is critical to preventing erosion, landslides, and floods, as well as sustaining tree stands, litter, and undergrowth plant.
