Abstract

Social communication is a vital instrument in expanding legal access for communities, particularly for vulnerable groups that frequently encounter structural and cultural barriers. The main challenges identified include limited legal literacy, insufficient dissemination of information, and the gap between legal language and everyday community language. These issues result in low legal awareness and restricted capacity of individuals to defend their rights. This study employs a qualitative approach through in-depth interviews and participatory observation of communities in both urban and rural areas. It examines the role of social communication in bridging these gaps by emphasizing its functions of socialization, education, and public participation. The proposed alternative solutions include strengthening community-based legal communication, utilizing accessible digital media, and fostering collaboration among state institutions, civil society organizations, and local leaders in disseminating legal information. Therefore, social communication serves not only as a medium of message exchange but also as a strategic instrument for achieving inclusive justice.

Abstract

The effectiveness of the jurisdiction of the International Court of Justice (ICJ) in enforcing international humanitarian law related to war crimes and forced displacement in Gaza faces complex challenges. Although the ICJ has international legal authority to adjudicate violations of international obligations, the implementation of ICJ decisions, in particular provisional measures that have been issued regarding Gaza, are often ignored by Israel. This non-compliance is further complicated by global political factors, especially the United States' support for the temporary relocation policy of Gazans which exacerbates patterns of forced displacement. This research uses a normative juridical method, with a focus on studying international legal norms, such as the 1945 Statute of the International Court of Justice, the 1949 Geneva Convention IV, and the 1998 Rome Statute. A conceptual approach is used to dissect the concept of the effectiveness of the ICJ's jurisdiction, while a case approach is applied in analyzing the application of the ICJ's jurisdiction to the post-2023 Gaza conflict. political domination of big countries. Therefore, strengthening the ICJ's jurisdiction requires effective compliance system reform and firmer political support from the international community so that the ICJ does not simply become a normative symbol.

Abstract

The regulaion of traditional markets and modern stores stated in Regional Regulation Number 11 in 2011 section 19 points 1, explains that the mini market is at least 1 km from the traditional market. This research aims to find out and to analyze: 1) Polecy Regulation about establishment of traditional markets and Modern Stores; 2) the implementation of Policy about the establishment of traditional markets and Modern Stores in Kramatmulya District. The writer makes thi study using descriptive analytical research i.e. describing a case based on the rules and regulation relating to positive law that has close relation with the problem of this research. In this study the method used are empirical juridical method, i.e., the method using data from books or literature or regulations regarding with the problem observed as the results of the interview or observation to a place of research. To collect data in this study uses observation and interview. The research location is in Kramatmulya District. The results showed: 1) Responses regarding establishment permit BPPT modern stores beginning with the meeting of the study after getting pleas from the community. 2) response of the Government and businessmen regarding the rules of modern stores Setup significantly influential to the existence of traditional market in district Kramatmulya. Regulations concerning modern store setup is currently regulated in the regulations of Kuningan Regency number 11 in 2011. The society gave a positive response towards the regulation of modern stores setup in Kramatmulya District . Keywords: Modern Store Setup, the presence of traditional markets   Abstrak Ketentuan mengenai pasar tradisional dan toko modern di dalam Peraturan Daerah Nomor 11 Tahun 2011 menurut Pasal 19 Angka 1, dijelaskan bahwa minimarket berjarak minimal 1 km dari pasar tradisional. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisa : 1) Regulasi Kebijakan Pendirian Toko Modern dan Pasar Tradisional, dan 2) Implementasi Kebijakan Pendirian Toko Modern dan Pasar Tradisional di Kecamatan Kramatmulya. Penulis melakukan penelitian, menggunakan spesifikasi penelitian deskriptif analisis, yaitu menggambarkan sesuatu hal upaya yang jelas dan melalui peraturan-peraturan dan peraturan perundang-undangan yang berlaku berkaitan dengan hukum positif yang ada kaitannya dengan masalah ini. Adapun metodenya adalah yuridis empiris yaitu metode yang bersifat mendapatkan data dari buku-buku atau literatur ataupun peraturan perundang-undangan mengenai apa yang diteliti hasil wawancara maupun observasi ke tempat penelitian. Lokasi penelitian di Kecamatan Kramatmulya. Hasil penelitian menunjukkan : 1) Tanggapan BPPT mengenai ijin pendirian toko modern diawali dengan rapat kajian setelah mendapatkan permohonan dari masyarakat. 2) Tanggapan pemerintahan desa dan pelaku usaha mengenai peraturan tentang penataan toko modern berpengaruh secara signifikan terhadap keberadaan pasar tradisional di Kecamatan Kramatmulya. Peraturan tentang penataan toko modern saat ini diatur dalam Peraturan Daerah Kabupaten Kuningan Nomor 11 Tahun 2011. Masyarakat memberikan tanggapan yang positif terhadap peraturan tentang penataan toko modern di Kecamatan Kramatmulya.

Abstract

Tenaga honorer sering mengalami ketidakadilan dalam pekerjaan mereka, terlihat dari kehidupan mereka yang jauh dari sejahtera meskipun memiliki kewajiban yang sama dengan Aparatur Sipil Negara. Rumusan masalah penelitian ini adalah mengenai pengaturan dan perlindungan hukum bagi tenaga honorer studi di Kabupaten Kuningan. Metode penelitian yang digunakan adalah yuridis empiris. Hasil penelitian menunjukkan bahwa pengaturan tenaga honorer sebagai pekerja telah diatur dalam beberapa undang-undang, seperti Undang-Undang Nomor 43 Tahun 1999 tentang Pokok-Pokok Kepegawaian dan Peraturan Pemerintah Nomor 48 Tahun 2005 tentang Pengangkatan Tenaga Honorer Menjadi Pegawai Negeri Sipil. Tenaga honorer di Kabupaten Kuningan mendapatkan perlindungan secara preventif dan represif. Perlindungan preventif meliputi jaminan kesehatan, sementara perlindungan represif termasuk jaminan kecelakaan kerja, jaminan kematian, dan bantuan hukum. Kesimpulan dari penelitian adalah pengaturan dan perlindungan tenaga honorer sudah sesuai dengan peraturan perundang-undangan. Saran pemerintah perlu melakukan pembaharuan hukum untuk meningkatkan kesejahteraan tenaga honorer. Hal ini bertujuan agar mereka dapat memiliki gaji yang adil dan layak sesuai dengan beban kerja dan tanggung jawab mereka. Pemerintah juga disarankan memberikan prioritas kepada tenaga honorer untuk diangkat menjadi Calon Pegawai Negeri Sipil atau Pegawai Pemerintah dengan Perjanjian Kerja. Dengan demikian, diharapkan tenaga honorer dapat lebih sejahtera di masa depan.

Abstract

The rapid development and advancement of Information Technology has led to changes in the activities of human life in various fields which have directly influenced the birth of new forms of legal action, the use and utilization of Information Technology must continue to be developed to maintain, maintain and strengthen national unity and integrity based on Legislation in the national interest, that the use of Information Technology plays an important role in trade and national economic growth to create public welfare. The purpose of this service focuses more on teenagers, both boys and girls, while other targets are the objectives of holding this counseling, namely the community in general. The approach method used in this Community Service is through the workshop approach method, lectures then at the end of the event a question and answer session is held, with this question and answer the community is given the opportunity to ask questions according to the theme of extension, or the community can ask questions outside the predetermined theme. The benefit of holding legal counseling in Margasari Village, Luragung District, Kuningan Regency, West Java Province is to create a better legal awareness of the community so that every member of the community realizes and lives up to their rights and obligations as citizens and creates a legal culture in attitudes and behaviors that are aware, obedient, and obey the law and can understand good information in the use of gadgets and social media in the digital era as it is today.

Abstract

In 2020, the government issued Law Number 11 of 2020 on Job Creation. This law has received numerous criticisms from the community, especially in the effort to realize self-sufficiency, security, and food sovereignty, as well as to protect agricultural land from the threat of land conversion. The government, on the other hand, claims that a job creation law, often known as omnibuslaw, can simplify and integrate fundamental permits from laws pertaining to location, environmental, and building permits. The problem under study was the implications of Law Number 20 of 2020 concerning Job Creation on spatial planning and watersheds management, employing a normative research method. The results highlight that the aforementioned law has reconstructed law number 26 of 2007 concerning Spatial Planning, which uses digital maps in the determination of RDTR, the integration of spatial planning and zoning plans, as well as the creation of single map policy to overcome land intersection, influencing permits in the regions. In addition, law number 41 of 1999 concerning Forest Area Limits has also been reconstructed, governing the adequacy of forest areas and forest cover in watersheds, which must be maintained at least 30 percent of the area of river basins. The 30% loss of the forest area may result in policy liberalization and the uncontrolled utilization of forest lands for industrial and commercial purposes. At the end, it will exacerbate tensions between spatial planning and watershed management, especially in preserving the adequacy of forest areas and forest cover in watersheds, which is critical to preventing erosion, landslides, and floods, as well as sustaining tree stands, litter, and undergrowth plant.

Abstract

Teenagers are the future generation of a nation whose mindset and social association must be protected and guided. They can threaten the future of a nation when they are not well directed anymore. Nowadays, teenagers are threatened by drug abuse, an addictive thing which influences immune system, emotion, mindset, and reason. Teenage drug abusers could be increased in annually, therefore an understanding of what lies behind it is needed. One of several factors believed to be the background of drug abused by teenagers is psychological well-being. Based on these problems, legal guidance and legal counseling among adolescents need to be carried out so that adolescents can better understand and have deterrence against drugs. The approach method used in this dedication activity to the community is in the form of legal counseling about preventing drug abuse and a participatory approach, meaning that participants are required to be active in participating throughout the activity.

Abstract

A growing perspective in society concerns the high costs of handling legal proceedings. This mindset influences actions, especially among the underprivileged. Therefore, when facing legal issues, they are reluctant to pursue the court process and simply accept the unfair treatment without doing anything. They don't know where else to fight for their rights. In other situations, unfair treatment is met with violence, resulting in them becoming victims. Ultimately, access to justice is deemed inaccessible to the lower classes. Article 28D paragraph (1) of the 1945 Constitution states that everyone has the right to recognition, guarantees, protection, and certainty of fair law, as well as equal treatment before the law. Therefore, the Kuningan University Legal Aid Center has gone out into the community to provide counseling on every legal issue faced by the people of Mancagar Village, along with training on the P4GN program, in order to create a Shining Village. Drug crimes are considered extraordinary crimes, requiring extraordinary efforts to eradicate them. Drug abuse, the majority of whom are young people (those of productive age), has reached a very alarming level.

Abstract

Narcotics abuse is a national problem that is considered serious by the government and can cause damage to the morals of a nation. In Indonesia, narcotics abuse is increasing over time. Narcotics abuse has a negative impact on both dealers and users, both physically and psychologically. This is what creates a sense of vigilance in the community, to always make the best efforts to prevent the distribution and use of narcotics at various levels. Therefore, education is needed to increase legal knowledge and understanding through legal counseling to the community. The aim of this legal counseling activity is to increase public legal awareness. This legal counseling effort was carried out in Cengal Village, Japara District, Kuningan Regency, which was held on January 30 2024. This event was opened with a speech from a Lecturer at the Faculty of Law, Kuningan University to convey the aims and objectives of carrying out this event and was continued by a speech from the head of Cengal Village or others. represents it as a welcome greeting. This agenda was carried out as an effort to provide understanding and to increase awareness among the community and village officials about the dangers of drugs which are becoming more common every day as well as legal assistance for people who need legal assistance services at the Faculty of Law, Kuningan University, namely PKBH or Legal Assistance and Consultation Center.
