Abstract

Perumahan dan pemukiman merupakan salah satu kebutuhan dasar bagi setiap manusia yang berpengaruh besar terhadap pemenuhan kebutuhan dasar manusia lainnya seperti sandang, pangan dan kesehatan. Perumahan juga dilihat sebagai salah satu fasilitas dasar bagi berhasilnya rencana pembangunan, serta dapat diartikan sebagai saran yang dapat memberi jasa-jasa bagi kelancaran kegiatan-kegiatan di bidang sosial, ekonomi dan administrasi pemerintahan. Pada mulanya orang menguasai tanah kavling berdasarkan surat penunjukan kavling, yang dikeluarkan oleh instansi yang mengelola kawasan setempat. Jadi pengertian asli tanah kavling tidak lain dari tanah yang sudah dipetak. Untuk dapat memiliki tanah kavling siap bangun ini masyarakat bisa memperolehnya dengan cara membeli, baik dengan cara tunai/kontan maupun kredit yang sebelumnya harus melalui suatu perjanjian terlebih dahulu. Metode yang di gunakan menggunakan metode pendekatan yuridis normatif yang didukung oleh wawancara.  Tuntutan hukum perdata bagi penjual tanah kavling kepada pembeli tanah kavling yang mengalami kerugian akibat tindak pidana pemalsuan yang dilakukan oleh perantara adalah pembeli berhak menuntut adanya penggantian kerugian kepada pihak penjual berdasarkan perbuatan. Pihak penjual tanah kavling bertanggung jawab untuk memberikan kepastian perolehan hak atas tanah yang sudah dibeli para pembeli tanah kavling.

Abstract

Tujuan studi ini untuk mendeskripsikan faktor-faktor yang mempengaruhi belum adanya Peraturan Daerah yang mengatur tentang penyelenggaraan pemberian bantuan hukum bagi masyarakat miskin di Kabupaten Pati serta faktor-faktor yang mempengaruhi penyelenggaraan bantuan hukum bagi masyarakat miskin oleh Pemerintah Kabupaten Pati. Studi ini menggunakan metode penelitian yuridis empiris/non doktrinal dengan metode analitis deskriptif kualitatif. Hasil studi menunjukkan bahwa belum adanya Peraturan Daerah yang mengatur tentang penyelenggaraan bantuan hukum bagi masyarakat miskin di Kabupaten Pati disebabkan prioritas Peraturan Daerah yang akan ditetapkan, terbatasnya sumber daya manusia sebagai penyusun Peraturan Daerah, serta proses penyusunan Peraturan Daerah yang membutuhkan waktu yang lama. Efektivitas pelaksanaan penyelenggaraan pemberian bantuan hukum bagi masyarakat miskin di Kabupaten Pati dipengaruhi oleh faktor dasar hukum, faktor pemberi bantuan hukum, faktor kesadaran masyarakat, serta faktor terbatasnya anggaran. Prioritas pembahasan Rancangan Peraturan Daerah yang mengatur penyelenggaraan pemberian bantuan hukum untuk menjadi Peraturan Daerah menjadi penting sebagai wujud hadirnya Pemerintah Kabupaten Pati dalam menjamin hak-hak masyarakat, khususnya masyarakat miskin untuk mengakses keadilan sekaligus upaya menciptakan kesejahteraan bagi seluruh masyarakat di Kabupaten Pati. ABSTRACT The purpose of this study is to describe the factors that influence the absence of a regional regulation that regulates the provision of legal aid for the poor in Pati Regency and the factors that influence the implementation of legal aid for the poor by the Government of Pati Regency. This study uses empirical/non-doctrinal juridical research methods with qualitative descriptive analytical methods. The results of the study show that there is no Regional Regulation that regulates the implementation of legal aid for the poor in Pati Regency due to the priority of Regional Regulations to be stipulated, limited human resources as drafters of Regional Regulations, and the process of drafting Regional Regulations which takes a long time. The effectiveness of the implementation of the provision of legal aid for the poor in Pati Regency is influenced by legal basis factors, legal aid provider factors, community awareness factors, and budget constraints. The priority for discussing the Draft Regional Regulation which regulates the provision of legal aid to become a Regional Regulation is important as a manifestation of the presence of the Pati Regency Government in guaranteeing the rights of the community, especially the poor to access justice as well as efforts to create prosperity for all people in Pati Regency.

Abstract

Background: The key to successful regional governance is the DPRD's ability to carry out its functions simultaneously, proportionally and sustainably. In fact, the implementation of DPRD functions does not always run as it should. There is a need for an internal DPRD oversight body to enforce the DPRD's Rules of Procedure and code of ethics. The Ethics Council as one of the permanent apparatuses of the DPRD is expected to be able to guarantee the upholding of the DPRD's rules and code of ethics. Aim: This research focuses on the reasons for the non-optimal implementation of their duties and authorities. Method: This legal research uses a non-doctrinal or empirical juridical approach, the type of data used is primary data, secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials. Methods of data collection using interview techniques and literature study. The collected data was then analyzed qualitatively. Findings: The reason or cause for not optimally carrying out the duties and authorities of the DPRD honorary body in enforcing the DPRD's rules and code of ethics is the existence of internal factors including the tendency to be subjective. There is an opinion within the DPRD that the DPRD's honorary body can act on alleged violations of the rules and regulations.

Abstract

The position of theory is very important in science, this can be seen from the task of theory, namely deepening the problem being studied. The existence of a theory can strengthen what previously stood alone, so that they reinforce each other and questions that are not yet clear are explored more deeply. In any field that is a field of legal science, theory can be a practical guide that explains how to approach the subject matter to be studied. Legal theory generally follows the flow of positive law, namely the search for just law. Law is an order issued by a sovereign authority, addressed to the government and given sanctions if violated (Austin). Pure law is a necessity that regulates human behavior as intelligent creatures (Kalsen). The application of legal theory emphasizes that a positive legal system will operate effectively if it follows the rules and norms of society. The combination of the three judges, certainty theory and utility theory is the right way to apply it in Indonesia.

Abstract

The State of Indonesia is a state based on law and not based on power. Law must be made commander in chief in carrying out the wheels of national and state life.Method approach used _in study This is doctrinal approach. Study This make secondary data as source mainly. Secondary data collection done with study library, that is with learn regulations, documents nor books and _ doctrine or opinion of scholars. Data processing is done through the editing process for correcting erroneous data, adding missing data and complete missing data complete. Results studies show that happening decision disparity about authority judge case economy proposed Shari'ah by Institution Protection Consumers (LPKSM) between judges on religious courts and court country caused exists difference view to authority judge case economy proposed Shari'ah by Institution Protection Consumers (LPKSM). Difference decision between religious court judges and court country about authority judge case the caused by difference interpretation.

Abstract

The Omnibus Law on Health had been approved which in consequence allow other medical professional organizations to be established as doctors’ right to organize in which may provoke ethical problems. The recent Omnibus Law on Health enabled opportunity for multi-bar organizations; even it was in accordance with single-bar system. This paper aims to review the medical professional organization system in the Omnibus Law on Health which is most in line with the freedom of association and does not reduce the right to health as a human right that must be accepted by the wider community. The author argues that the emergence of several professional organizations as embodiment of doctor’s right may not suitable as it may procure ethical ambiguity. However, the compulsion to join single organization per se was a violation of our Constitution. In this case, we need the highest regulatory and controlling authority from the State to preserve the public interest. The concept of this federal multi-bar association may solve this problem.

Abstract

The community service activities carried out at the Kudus Religious Court aim to make the members of the Kudus community whose marriages cause problems that lead to divorce proceedings. Before the divorce decision is handed down by the Religious Court Judge, mediation must be carried out by the mediator at the Kudus Religious Court so that it can be agreed that no divorce will occur. The mediator who will mediate the parties who will file for divorce can come from a Judge Mediator or a Non-Judge Mediator.  This service accompanies the disputing parties when mediation is carried out by a non-judge mediator. This is done because there are still many disputing parties who cannot be mediated successfully so that divorce is still ongoing.  The failure of Non-Judge Mediators in the Religious Courts in reconciling the disputing parties (husband and wife) is mostly due to the egos of each one which is difficult to understand the importance of marriage, so that many still end in divorce. Because of these conditions, there is still a need for socialization about marriage in general.

Abstract

ABSTRACT This study is to examine the legal protection of occupational safety and health of employees of PT PLN UPT Semarang about the rights of workers, namely the right to obtain protection against safety ". The formulation of the problem studied is how the legal protection of the safety and health of employees of PT PLN UPT Semarang employees and the obstacles and efforts made in providing employees of PT PLN UPT Semarang. The method in this research is non-doctinal research In this study, researchers used non-doctrinal legal research methods. This research is a type of legal examination that opens and sees how a rule applies in the eyes of the community, the population is PT PLN UPT Semarang and the research subjects are employees who work at the company. The method of data collection is done by means of direct research in the form of observation and interviews, besides that a literature study is used. In the data analysis method used is qualitative data analysis. Legal protection of the safety and health of employees of PT PLN UPT Semarang has been running well which is indicated by making efforts, namely the provision of personal protective equipment in the form of personal protective equipment, health and employment insurance facilities as well as counseling, coaching, and supervision of workers regarding their work. Abstract

Penelitian yang berjudul Pelaksanaan Pelayanan Publik Terhadap Peningkatan Kepuasan Masyarakat Pada Kantor Kecamatan Dawe Kabupaten Kudus bertujuan untuk mengetahui dan menjelaskan pelaksanaan pelayanan publik di Kantor Kecamatan Dawe Kabupaten Kudus dan pelayanan publik di Kecamatan Dawe Kabupaten Kudus sudah mampu meningkatkan kepuasan masyarakat. Metode dalam penulisan tesis ini  menggunakan pendekatan yuridis sosiologis, yang artinya penelitian ini dikaji dengan melihat penemuan fakta-fakta di lapangan yang dijadikan dasar oleh penulis sebagai data yang diperoleh dari lapangan sesuai dengan kenyataan yang ada, penulisan ini bersifat deskriptif analitis. Permasalahan penelitian ini dianalisis dengan teori keadilan. Berdasarkan hasil penelitian dan pembahasan dapat diketahui bahwa pelaksanaan pelayanan publik di Kantor Kecamatan Dawe Kabupaten Kudus adalah dengan menerapkan yang pertama transparansi dalam hal ini, melalui Standar Operasional Prosedur (SOP) dijamin adanya transparansi, serta terbuka bagi masyarakat untuk menyampaikan keluhan dan informasi balik tentang perlakuan pelayanan melalui Indeks Kepuasan Masyarakat (IKM) dan pelayanan publik di Kecamatan Dawe Kabupaten Kudus sudah mampu meningkatkan kepuasan masyarakat adalah dengan cara peningkatan sumber daya manusia, peningkatan sarana dan prasarana, penambahan personil, menerapkan 5S (senyum, sapa, salam, sopan, santun) dalam pelayanan.

Abstract

Abstract The study entitled Management Implementation Rank and Position Civil Servants as Effort to Realize Good Governance in Environmental District Government Demak is motivated bureaucratic reforms in the system of governance (good governance), especially the arrangement of human resources personnel with management ranks and positions of civil servants to realize the civil service state apparatus in order to perform their duties professionally and responsibility in carrying out the tasks of the government.This research was conducted in order to determine implementation management ranks and positions of civil servants to achieve good governance in Demak regency government environment and to determine government policy Demak to optimize the management ranks and positions of civil servants in order to realize good governance.The method used by the author is juridical empirical data collection was done using interview guide with research sites in the Civil Service Agency, Education and Training Demak and processing of data with descriptive analysis.The results of this study indicate that the implementation of management ranks and positions of civil servants Governments Demak district in accordance with Law No. 5 of 2014 on State Civil Reform and Government Regulation No. 11 of 2017 concerning civil service management, but some longer guided by the provisions considering there are no technical regulations that govern. PolicyDemak regency government to optimize the management ranks and positions of civil servants in order to realize good governance based on the principles or the basic principles of good governance (good governance) which is in line with the Grand Design State Civil Administrative Development 2020-2024. Use of information systems in the civil service merit-based civil service agency, Education and Training Demak is used for the management ranks and positions of civil servants in local government environment in order to simplify, speed up the process flow of personnel services. Keywords : management, rank, position, civil servants, good governance  Abstrak Penelitian dengan judul Implementasi Manajemen Pangkat dan Jabatan Pegawai Negeri Sipil sebagai Upaya Mewujudkan Good Governance di Lingkungan Pemerintah Kabupaten Demak ini dilatarbelakangi  reformasi birokrasi dalam sistem tata kelola pemerintahan yang baik (good governance) terutama penataan sumber daya manusia aparatur dengan manajemen pangkat dan jabatan PNS untuk mewujudkan PNS sebagai aparatur negara agar dapat melaksanakan tugas secara profesional dan tanggungjawab dalam melaksanakan tugas pemerintahan.Penelitian ini dilakukan dengan tujuan untuk mengetahui implementasi manajemen kepangkatan dan jabatan PNS untuk mewujudkan Good Governance di lingkungan Pemerintah Kabupaten Demak dan untuk mengetahui kebijakan Pemerintah Kabupaten Demak untuk mengoptimalkan manajemen pangkat dan jabatan PNS dalam rangka mewujudkan Good Governance.Metode pendekatan yang digunakan penulis adalah yuridis empiris dengan pengambilan data dilakukan dengan menggunakan pedoman wawancara dengan lokasi penelitian di Badan Kepegawaian, Pendidikan dan Pelatihan Kabupaten Demak dan pengolahan data dengan deskriptif analisis.Hasil penelitian ini menunjukkan bahwa implementasi manajemen pangkat dan jabatan PNS di Lingkungan Pemerintah Kabupaten Demak sesuai dengan Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara dan Peraturan Pemerintah Nomor 11 Tahun 2017 tentang Manajemen PNS, tetapi beberapa berpedoman pada ketentuan lama mengingat belum ada regulasi teknis yang mengatur. Kebijakan Pemerintah Kabupaten Demak untuk mengoptimalkan manajemen pangkat dan jabatan PNS dalam rangka mewujudkan Good Governance berdasarkan asas-asas atau prinsip-prinsip  dasar good governance (tata kelola pemerintahan yang baik) yang sejalan dengan Grand Design Pembangunan Aparatur Sipil Negara 2020-2024. Pemanfaatan sistem informasi berbasis sistem merit PNS pada Badan Kepegawaian, Pendidikan dan Pelatihan Kabupaten Demak digunakan untuk manajemen pangkat dan jabatan PNS di Lingkungan Pemerintah Kabupaten dalam rangka mempermudah, mempercepat alur proses pelayanan kepegawaian.Kata kunci : manajemen, pangkat, jabatan, PNS, good governance
