Abstract

Abstract: In this era of globalization and advances in digital technology, the copyright protection system faces increasingly complex challenges. This research is a normative law study with a comparative approach to legal systems in developed and developing countries, as well as the role of global institutions in shaping international norms. The study examines key legal instruments such as the Bern Convention, TRIPS Agreement, and WIPO Copyright Treaty (WCT), and evaluates their implementation in various countries. The results show that developing countries like Indonesia still face obstacles in the implementation of copyright protection, ranging from weak digital law enforcement to low public awareness. The study emphasizes the need for inclusive global governance so that the copyright protection system can be fairly adapted to domestic conditions.   Abstrak: Dalam era globalisasi dan kemajuan teknologi digital ini, sistem perlindungan hak cipta menghadapi tantangan yang semakin kompleks. Penelitian ini adalah studi hukum normatif dengan pendekatan komparatif terhadap sistem hukum di negara maju dan berkembang, serta peran lembaga global dalam membentuk norma internasional. Studi ini meneliti instrumen hukum utama seperti Konvensi Bern, Perjanjian TRIPS, dan Perjanjian Hak Cipta WIPO (WCT), serta mengevaluasi penerapannya di berbagai negara. Hasil penelitian menunjukkan bahwa negara-negara berkembang seperti Indonesia masih menghadapi hambatan dalam pelaksanaan perlindungan hak cipta, mulai dari penegakan hukum digital yang lemah hingga rendahnya kesadaran publik. Studi ini menekankan perlunya tata kelola global yang inklusif agar sistem perlindungan hak cipta dapat disesuaikan secara adil dengan kondisi domestik.

Abstract

his study aims to analyze the role of the Financial Services Authority (OJK) in Solo as a regulator and facilitator in providing fintech consumer protection through alternative dispute resolution, as well as to identify the obstacles encountered in its implementation. The study employs an empirical legal method with a descriptive qualitative approach. Primary data were obtained through interviews with the OJK in Solo, while secondary data were sourced from laws and regulations, academic literature, and official OJK reports. The results indicate that the OJK plays a role in regulating, supervising, and facilitating dispute resolution through the Consumer Protection Portal Application (APPK), as well as referring cases to the Financial Services Dispute Resolution Center (LAPS SJK) when internal resolution is not achieved. In addition, the OJK also conducts financial education as a form of preventive protection. Major challenges include low levels of financial and digital literacy, the complexity of proving financial well-being, limitations in the restoration of consumer rights, and difficulties in coordinating oversight. Therefore, improving public literacy, ensuring compliance by fintech providers, and fostering institutional synergy are necessary to achieve more effective consumer protection and provide legal certainty.

Abstract

Perlindungan data pribadi nasabah dalam layanan perbankan digital menjadi isu yang semakin relevan di tengah pesatnya perkembangan teknologi digital. Layanan seperti mobile banking dan internet banking mempermudah akses ke layanan perbankan, namun juga menimbulkan risiko terkait kebocoran atau penyalahgunaan data pribadi. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap data pribadi dalam konteks perbankan digital di Indonesia, dengan fokus pada regulasi yang ada serta tantangan dalam penerapannya. Perlindungan ini diatur oleh berbagai peraturan, termasuk Undang-Undang Perlindungan Data Pribadi (UU PDP), peraturan dari Otoritas Jasa Keuangan (OJK), serta Bank Indonesia. Meskipun peraturan tersebut cukup komprehensif, tantangan dalam implementasi masih banyak ditemukan, seperti cepatnya perkembangan teknologi, ketidakjelasan regulasi, dan rendahnya tingkat literasi digital baik di kalangan masyarakat maupun pegawai bank. Penelitian ini diharapkan dapat memberikan kontribusi dalam pengembangan kebijakan perlindungan data pribadi di sektor perbankan digital, serta memberikan rekomendasi untuk meningkatkan efektivitas perlindungan data nasabah.

Abstract

Indonesia, as the world’s largest archipelagic country, occupies a strategic position in the Asia-Pacific region, which makes its sea lanes vulnerable to transnational narcotics smuggling. Narcotics trafficking through Indonesian waters not only disrupts national security but also has far-reaching consequences for international security, global politics, and human rights. Despite existing international legal frameworks such as the 1982 United Nations Convention on the Law of the Sea (UNCLOS) and the 1961 Single Convention on Narcotic Drugs, Indonesia faces significant enforcement challenges. These include vast maritime borders, limited resources for surveillance, and the involvement of sophisticated international criminal syndicates. This research aims to analyze international law enforcement efforts in combating narcotics smuggling in Indonesian sea lanes, focusing on both legal frameworks and the practical challenges faced in enforcement. The study uses a normative legal research method, examining secondary data from legal documents, books, and journals. The results indicate that while international cooperation frameworks have been established, the effectiveness of narcotics law enforcement remains hindered by logistical and technological gaps. The study concludes that improving international collaboration, enhancing surveillance technology, and strengthening community-based preventive measures are essential for combating narcotics trafficking in Indonesian waters effectively.

Abstract

This study analyzes the construction of news coverage of the Palestinian-Israeli conflict by NU Online using a framing analysis approach. Focusing on thematic and rhetorical aspects, this study highlights how NU Online influences readers' perceptions through the use of lexicon, details, and coherence in the news text. This research uses a qualitative approach with a constructionism paradigm. Data were obtained through framing analysis of the Zhongdang Pan and Gerald M. Kosicki model, focusing on four framing dimensions: syntax, script, thematic, and rhetorical. The results show that NU Online tends to emphasize the political and colonial aspects of the conflict. This analysis provides insight into how the media shapes complex conflict narratives. It also discusses the dynamics of the conflict between Palestine and Israel and the consensus efforts made through a case study of the 1993 Oslo Peace Agreement. The research highlights the prospects for resolving the conflict, the implications of the peace agreement on the Palestinian people, and the difficulties in implementing the agreement. With a focus on ideological conflicts and territorial rights, this research provides deep insights into the complexity of the Palestinian-Israeli conflict. Legal protection for child victims of war in the perspective of International Humanitarian Law, focusing on the case of Palestinian child prisoners tortured by Israeli soldiers. The article highlights human rights violations, legal protections required for child victims, and sanctions that can be imposed on Israel for violations of International Humanitarian Law.
