Some time ago, there was a debate in the world of constitutional law, especially in legislation. This is because in early 2020, the use of the Ombibus Law method was realized in the formation of several bills that were included in the priority prolegnas. In particular, the use of the Ombibus Law method is part of the implementation of the government's political agenda in improving several legal problems in Indonesia, especially in the world of employment. Then, one of the arguments used is to realize people's welfare through expanding employment opportunities. This can be seen from the enactment of Law Number 11 of 2020 concerning Job Creation where the formation of the law uses the Ombibus Law method which has never been used in Indonesia, moreover, this method is generally used in countries that adhere to the common law legal system. . One of the problems that arise from this situation is the submission of a judicial review of Law Number 11 of 2020 concerning Job Creation. The tests carried out on the law were a material test and a formal test, in which the application for a formal review contained in the application to the Constitutional Court included an objection to the use of the Ombibus Law method which does not have a clear legal basis in positive law in Indonesia. The research method used in this research is normative research with analytical descriptive nature. This study aims to find out how the urgency of the Omnibus Law method in the formation of laws in Indonesia is related to the goal of the welfare state. The results of this study will answer how the urgency of using the Omnibus Law method in Indonesia is and what is its relation to the goal of the welfare state

This study aims to analyze the legal position of the Governor's Letter of Appeal Number 8 of 2021 concerning the Development of a No Smoking Area associated with the rights of cigarette sellers and users. This research is a type of descriptive research using a qualitative approach. The technique used to collect data using observation, literature study and tracing and archives. The results show that the Governor's Letter of Appeal Number 8 of 2021 concerning the Development of a No Smoking Area has ambiguity in its regulation in positive law in Indonesia, both from legal sources that are followed up, the substance and who signed the Governor's Appeal do not have certainty. If the Governor's Letter of Appeal Number 8 of 2021 concerning the Development of a No Smoking Area is discretionary, then it is not in accordance with AUPB. The application of the Governor's Letter of Appeal Number 8 of 2021 concerning the Development of a No Smoking Area is contrary to the Decision of the Constitutional Court Number 6/PUU-VII/2009 and the Constitutional Court Number 57/PUU-IX/2011. Then, with the issuance of the Governor's Letter of Appeal Number 8 of 2021 concerning the Development of No Smoking Areas, it has caused losses for cigarette sellers and cigarette users, not only in Jakarta, but also outside Jakarta. In practice, legal products in the form of a Governor's Letter of Appeal are only found in Jakarta. It is hoped that in the future there will be a clear setting of boundaries regarding the formation of the Governor's Letter of Appeal.

Purpose: The purpose of this study is to find out the differences in various aspects of state administration between Indonesia and England.Research methodology: The research methodology used in this study is normative juridical with a comparative law approach.Results: After comparing the Indonesian and England state administrations from various aspects briefly in this study, conclusions are obtained based on the compared aspects of various aspects, namely the legal system, form of state, form of government, system of government, form of constitution and legislative structure.Limitations: This research was only carried out through a literature study without directly seeing, feeling and conducting empirical studies between Indonesia and England in practice, so that the limitations of this research are clear in detail. Researchers hope that in the future a direct comparative study between the two countries will be carried out in order to produce more comprehensive research. Contribution: This research is expected to be a reference in constitutional law research in Indonesia, especially in this case is the comparison of constitutional law between Indonesia and England.

Conflict is usually related to other individuals or groups, therefore it is often called social conflict. Based on Law Number 7 of 2012 concerning Handling of Social Conflict, what is meant by Social Conflict is violent feuds and/or physical clashes between two or more community groups that take place within a certain time and have wide-reaching impacts resulting in insecurity and social disintegration thereby disrupting social stability. national and impede national development. Sociologists argue that the root of the emergence of conflict is the existence of social, economic, political relations whose roots are the struggle over sources of ownership, social status and power whose availability is very limited with unequal distribution in society. This type of research is normative legal research with a case, regulation, and analysis approach. This study aims to provide a strategy for resolving legal disputes between companies and the community through a legal sociology approach.

The pre-prosecution process often occurs, so that the case files go back and forth from investigators to the Public Prosecutor, incomplete case files will have an impact on the pre-prosecution process. The purpose of this study is to determine the return of case files by the Public Prosecutor in pre-prosecution. This type of research is normative legal research with a case approach, legislation, and analysis. The results of the study were obtained as follows, because there is no single provision that provides a limit on the number of times case files can be returned, this can be related to the legal objectives of a person's human rights, and for the sake of legal certainty for justice seekers, the return of investigation results or additional investigator results by The Public Prosecutor to investigators, must have strict limitation criteria. The consequences if the case file is not returned from the public prosecutor if within seven days the case file is not returned, the investigation case file is considered complete.

Kejaksaan Republik Indonesia (Kejaksaan) adalah lembaga pemerintahan yang fungsinya berkaitan dengan kekuasaan kehakiman yang melaksanakan kekuasaan negara di bidang penuntutan serta kewenangan lainnya yang dimiliki sebagai salah satu penegak hukum. Dalam penelitian ini, fokus yang akan dijadikan topik utama adalah Jaksa. Jaksa adalah pegawai negeri sipil dengan jabatan fungsional yang memiliki kekhususan dan melaksanakan tugas, fungsi dan kewenangannya berlandaskan pada undang-undang. Apabila sudah masuk dalam persidangan, Jaksa beralih status menjadi Penuntut Umum (selama telah diberikan perintah tugas sebagai Penuntut Umum dalam suatu perkara). Penuntut Umum merupakan Jaksa yang telah diberikan kewenangan untuk melakukan penuntutan dan melaksanakan penetapan hingga putusan Hakim serta hal lainnya yang telah diatur di dalam undang-undang. Jaksa memiliki peranan penting sebagai bagian dari faktor penting penegakan hukum di Indonesia. Penelitian ini menggunakan jenis penelitian normatif yuridis dengan mengaitkan pokok pembahasan terhadap topik utama di dalam penelitian ini yakni peranan Jaksa dalam penegakan hukum serta peranannya sebagai faktor yang mempengaruhi sebagai penegak hukum. Hasil dari penelitian ini akan memperlihatkan bagaimana peranan Jaksa dalam penegakan hukum di Indonesia.

The Attorney General's Office of the Republic of Indonesia is a government institution that has an important role in the criminal justice process which has the main task of carrying out prosecutions and other authorities that it has as one of the law enforcers. In this research, the focus that will be the main topic is the role of prosecutors in the criminal justice system in Indonesia. Prosecutors are civil servants with functional positions who have specificity and carry out their duties, functions and authorities based on the law. When he enters the trial, the Prosecutor switches status to become a Public Prosecutor (as long as he has been given a task order as a Public Prosecutor in a case). The Public Prosecutor is a Prosecutor who has been given the authority to prosecute and carry out decisions up to the Judge's decision and other matters that have been regulated in the law. This study uses a juridical normative research type by linking the subject matter to the main topic in this research, namely the role of the prosecutor in law enforcement in the criminal justice system in Indonesia.

Penelitian ini dilakukan untuk mengkaji Hak-hak pelaku narkoba untuk mendapatkan rehabilitasi sesuai dengan hukum positif yang berlaku di Indonesia. Berdasarkan Pasal 54 Undang-undang Nomor 35 tahun 2009 mengenai Narkotika bahwasanya Penyidik dapat memberikan rehabilitasi bagi pengguna narkoba. Dalam mendapatkan Hak rehabilitasi, tersangka harus melakukan proses asesmen medis dan hukum untuk melakukan proses rehabilitasi. Dengan ini tersangka yang sudah sesuai persyaratan yang tertuang dalam Pasal 54 Undang-undang Nomor 35 tahun 2009 dan sesuai dengan peraturan kepala BNN No. 11 tahun 2014 untuk dilakukannya rehabilitasi karena pengguna narkoba merupakan kejahatan yang merugikan diri sendiri dan orang lain yang harus di rehabilitasi untuk mengurangi dan menghentikan kecanduan yang dimiliki

Dalam perkembangannya, permasalahan menengai penyalahgunaan narkotika semakin lama semakin meningkat dengan semakin maraknya penyelundupan, peredaran dan perdagangan gelap, penyalahgunaan. Keadaan demikian ditindaklanjuti dengan penangkapan, penahanan terhadap para pelaku penyalahgunaan maupun para pengedar narkotika. Upaya penanggulangan masalah narkotika, tidaklah cukup dengan satu cara melainkan harus dilaksanakan dengan rangkaian tindakan yang berkesinambungan dari berbagai macam unsur, baik dari lembaga pemerintah maupun non pemerintah. Rangkaian tindakan tersebut mencakup usaha-usaha yang bersifat preventif, represif dan rehabilitatif. Penelitian ini dilakukan untuk mengkaji Hak-hak pelaku narkoba untuk mendapatkan rehabilitasi sesuai dengan hukum positif yang berlaku di Indonesia. Hukum merupakan sesuatu yang abstrak, karena tidak dapat dilihat atau diraba, tetapi dapat dirasakan keberadaannya. Hal ini karena hak bukanlah objek, melainkan tindakan (setelah dilaksanakan). Untuk mempelajari hal ini, kita harus memperhatikan keberadaan hukum melalui efektifitas hukum dalam masyarakat. Memperdebatkan efektivitas hukum di tengah masyarakat berarti membicarakan efektivitas atau penegakan hukum dalam mengatur dan/atau menegakkan kepatuhan terhadap hukum. Jadi dapat dipastikan ada faktor-faktor yang mempengaruhi efektifitas hukum. Kemudian ada juga faktor-faktor yang mempengaruhi apakah hukum itu benar-benar berfungsi dalam masyarakat. Dalam penelitian ini digunakan jenis penelitian normatif hukum yang menghubungkan topik penelitian dengan topik utama penelitian ini. Hasil penelitian ini menunjukkan bahwa efektivitas penegakan hukum di masyarakat dipengaruhi oleh beberapa faktor, yaitu aturan hukum (peraturan), lembaga kepolisian, tempat atau fasilitas, dan kesadaran masyarakat itu sendiri.
