Abstract

The purpose of this study is to identify the strategies that EFL teachers use to overcome learning barriers in the classroom. A mixed methods approach was used to collect data through a Likert-scale questionnaire with 30 teachers and interviews with three teachers from various regions in Indonesia. Quantitative findings revealed that teachers frequently employed strategies such as differentiated instruction, motivational support, and digital media integration. Through thematic coding, the qualitative analysis further revealed specific techniques, including simplifying materials, employing collaborative learning, managing student focus, and encouraging passive learners through praise and rapport building. These results underscore the importance of adaptive, student-centered teaching practices for addressing the diverse challenges in EFL classrooms. The study suggests that a combination of cognitive, emotional, and technological strategies is essential for improving learning outcomes.

Abstract

In reality, collecting donations often does not match the original purpose of providing the funds. This is a common occurrence and is frequently reported by television, mass media, and online media. In this study, several issues are examined, including the implementation of regulations regarding donations, the legal protection afforded to donors against the misuse of donation funds by recipients, and the solutions for actions taken by recipients who misuse donation funds. The form of this research is normative legal research, utilizing secondary data as its primary source of information. The data analysis used is qualitative descriptive analysis. Legal protection for donors in the context of acts of misuse of donation money by recipients of donations is a complex issue and requires serious attention. On the one hand, existing regulations have provided a sufficient legal framework to protect donors; on the other hand, there are still many challenges to their implementation in the field. Cases of misuse that occur show that the existing regulations are not fully effective in preventing misuse of funds. It is essential to strengthen the supervision and accountability of institutions that collect donations. Transparency in fund management, independent audits, and certification for trusted foundations are some steps that can be taken to increase donor trust. In addition, educating the public about their rights as donors is also crucial in building better legal awareness. With the various solutions proposed, the donation ecosystem in Indonesia can become more efficient and transparent. The public must feel safe and confident that every donation given will be used for the right purpose. Only in this way can we build a healthy and sustainable donation culture in Indonesia.

Abstract

The auction method is typically used to bring together two parties in a legal transaction. In an auction, there are two parties involved: the party submitting the bid and the party that wins the auction. Auctions can be carried out on land that has been obtained and registered with a mortgage. In practice, there are also irregularities in the auction process, particularly in auctions conducted on land that has not been certified. This is the case, for example, in Court Decision Number 03/Pdt. Eks / 2020 / Pn.Tbk Jo. Number 29 / Pdt.G / 2015 / Pn.Tbk. This study will discuss the Implementation of Regulations regarding the execution of auctions for land collateral that has not been certified. How is the Bank's Accountability for the Execution of Auctions for Land That Has Not Been Certified? What is the Solution to the Execution of Auctions for Land That Has Not Been Certified? The research methodology employed in this study is a normative research approach. Regulations governing the Execution Auction include Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Land Registration, Auction PMK, Mortgage Law, Regulation of the Minister of Agrarian Affairs Number 16 of 2021 concerning the Third Amendment to the Regulation of the Minister of Agrarian Affairs/Head of the National Land Agency Number 3 of 1997 concerning Implementing Provisions of Government Regulation Number 24 of 1997 concerning Land Registration. The role of the bank in the smooth running of the transfer of rights from the bank as the applicant for the auction of land to the auction winner is part of the bank's responsibility, as referred to in the theory of strict liability, which requires the bank to be jointly responsible for it even though the bank did not make a mistake. To address the issue of auction execution on uncertified land, several legal solutions can be employed. First, the government needs to accelerate the land certification process through the Systematic Land Registration (PTSL) program. Second, there needs to be stricter regulations related to auction execution. Third, education and socialization to the community regarding land rights and applicable legal procedures are also critical. Fourth, establishing mediation or dispute resolution institutions at the local level can be an alternative solution to resolving disputes that arise from auction execution. Fifth, the government should also consider providing incentives for landowners who are willing to undergo certification.

Abstract

The swift advancement of Artificial Intelligence (AI) has revolutionized the process of legal decision-making by enhancing efficiency, precision, and the digitalization of judicial systems. Nevertheless, this shift has not been matched by a robust ethical and regulatory framework in Indonesia, leading to issues concerning transparency, accountability, the safeguarding of human rights, and legal certainty. This research aims to develop an ethical and regulatory structure for AI within Indonesia's legal decision-making framework by merging principles of AI governance with constitutional ideals. A normative legal methodology is employed, utilizing conceptual, statutory, and comparative approaches through the examination of national legislation, legal theories, and international AI governance standards. The results indicate that AI regulation in Indonesia remains disjointed, lacking defined standards for AI ethics, algorithmic auditing, legal accountability, and oversight for AI-assisted legal decisions. The study advocates for a holistic framework that incorporates transparency, fairness, accountability, human supervision, human rights protection, and Pancasila values, serving as a normative basis for AI regulation in the legal domain. This framework aims to lay the groundwork for developing adaptable, accountable, and human-centric AI policies, ultimately reinforcing legal certainty and public confidence in Indonesia's legal system.

Abstract

Background: Bawaslu, as an electoral conflict resolution institution in Indonesia, faces persistent challenges, including the ineffectiveness of Gakkumdu, inconsistent normative interpretations, and the prevalence of money politics. Objective: This research aims to identify the weaknesses of Bawaslu as an institution for resolving electoral disputes, particularly during the 2024 election, and to formulate institutional strengthening strategies for Bawaslu within Indonesia’s electoral legal system. Methods: This study employs normative doctrinal legal research using statutory, conceptual, and analytical approaches, supported by primary and secondary legal materials. Data analysis is conducted through qualitative legal interpretation by systematically examining regulatory provisions to identify normative gaps and institutional weaknesses. Results: Three systemic weaknesses were identified: (1) formalistic procedural requirements that hinder the prosecution of money politics violations; (2) institutional design weaknesses within Gakkumdu that contribute to inter-agency deadlocks; and (3) a permissive legal culture that undermines the neutrality of election organizers. Conclusion: Strengthening Bawaslu requires the harmonization of electoral regulations, reconstruction of Gakkumdu’s institutional design, reinforcement of Bawaslu’s binding enforcement authority, and cultivation of an ethical legal culture among election organizers based on substantive justice.

Abstract

This study examines the policy of appointing deputy regional heads without direct elections in the Riau Islands Province and analyzes the factors determining its effectiveness in regional governance. Previous studies predominantly emphasize procedural and normative aspects, while the implications for governance effectiveness and local democratic legitimacy remain underexplored. This research employs a normative legal method using statutory and conceptual approaches, focusing on Law Number 23 of 2014 and Law Number 6 of 2020. The findings reveal that such appointments can be normatively justified as an exceptional mechanism within the framework of functional democracy and open legal policy to ensure governmental continuity during leadership vacancies. However, their effectiveness is contingent upon the integration of three key dimensions: clarity of normative authority design, strength of institutional coordination, and political-administrative legitimacy supported by regional legislatures (DPRD). The novelty of this study lies in developing an integrative analytical framework linking normative, institutional, and legitimative factors as determinants of governance effectiveness, moving beyond purely procedural analysis. The study highlights the need for regulatory reform to strengthen the implementation of norms, clarify authority distribution, and ensure that non-electoral appointments remain limited, accountable, and aligned with democratic principles.     Penelitian ini menganalisis kebijakan pengangkatan wakil kepala daerah tanpa pemilihan langsung di Provinsi Kepulauan Riau serta faktor-faktor yang menentukan efektivitasnya dalam penyelenggaraan pemerintahan daerah. Kajian sebelumnya cenderung berfokus pada aspek prosedural dan normatif, sementara implikasi terhadap efektivitas tata kelola dan legitimasi demokrasi lokal masih terbatas. Penelitian ini menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual, khususnya terhadap Undang-Undang Nomor 23 Tahun 2014 dan Undang-Undang Nomor 6 Tahun 2020. Hasil penelitian menunjukkan bahwa pengangkatan tanpa pemilihan langsung dapat dibenarkan sebagai mekanisme pengecualian dalam kerangka demokrasi fungsional dan open legal policy guna menjamin keberlanjutan pemerintahan dalam kondisi kekosongan jabatan. Namun, efektivitasnya ditentukan oleh integrasi tiga dimensi utama, yaitu kejelasan desain kewenangan normatif, kekuatan koordinasi kelembagaan, dan legitimasi politik-administratif melalui dukungan DPRD. Kebaruan penelitian ini terletak pada pengembangan kerangka analitis integratif yang menghubungkan faktor normatif, institusional, dan legitimatif sebagai penentu efektivitas pemerintahan daerah, melampaui pendekatan prosedural. Implikasi penelitian ini menegaskan perlunya reformulasi regulasi untuk memperkuat norma pelaksana, memperjelas pembagian kewenangan, serta memastikan bahwa mekanisme non-elektoral tetap terbatas, akuntabel, dan selaras dengan prinsip demokrasi.
