Abstract

Artikel ini mengalisis kedudukan dan fungsi Pembukaan UUD 1945 dengan mempelajari tren global pembukaan konstitusi di dunia. Ada dua rumusan masalah, pertama bagaimana kedudukan dan fungsi pembukaan konstitusi yang menjadi tren global? Kedua, bagaimana kedudukan dan fungsi Pembukaan UUD 1945? Dengan menggunakan metode penelitian yuridis normatif, artikel ini memperoleh kesimpulan, pertama, terjadi tren global kedudukan hukum pembukaan konstitusi, tidak hanya sekedar simbolis pembuka yang berisikan sejarah, sumber kedaulatan, pernyataan kemerdekaan, Tuhan, tujuan negara maupun identitas nasional, melainkan berkembang menjadi interpretatif dan subtantantif sebagai dasar pengujian maupun penerapan hukum. Pembukaan konstitusi juga memiliki fungsi sosial sebagai alat pemersatu, namun terkadang juga dapat menjadi alat pemecah. Kedua, Pembukaan UUD 1945 memiliki kedudukan hukum tidak hanya seremonial, melainkan intepretatif dan subtantif dalam pengujian norma di MK dan MA, serta berbagai kebijakan yang harus merujuk Pembukaan lebih khusus Pancasila. Seringnya penggunaan Pancasila secara berdiri sendiri, membuat Pembukaan UUD 1945 acap kali memiliki makna simbolis semata sebagai tempat Pancasila berada. Dari segi fungsi sosial, Pembukaan UUD 1945 dapat menjadi alat pemersatu bangsa, khususnya dengan keberadaan Pancasila sebagai jiwa dan falsafah bangsa. Namun, penggunaan Pancasila secara berlebihan, dapat juga mengakibatkan penindasan seperti yang terjadi pada Orde Baru. Disarankan, penggunaan Pancasila seharusnya dalam bingkai Pembukaan UUD 1945 sebagai satu kesatuan, serta perlunya pembatasan kekuasaan secara wajar guna mencegah perpecahan.

Abstract

Kepercayaan terhadap lembaga perwakilan, baik di tingkat pusat maupun di tingkat daerah selalu dalam posisi yang rendah. Kepercayaan rendah tersebut disebabkan banyaknya peraturan perundang-undangan yang tidak mendapat validitas dari masyarakat. Berdasarkan perspektif teori, validitas suatu peraturan perundang-undangan bisa didapatkan melalui partisipasi publik. Maka dari itu, pembentukan peraturan perundang-undangan harus dilakukan melalui partisipasi yang bermakna dalam rangka menjaga perwujudan demokrasi dan hak asasi manusia masyarakat. Berdasarkan hal tersebut, tim kami menginisiasikan program pengabdian kepada masyarakat yang memiliki dua tujuan, pertama yakni memberikan pemahaman kepada anggota dewan dan masyarakat mengenai pentingnya partisipasi yang bermakna dalam pembentukan regulasi. Maka dari itu, metode yang digunakan dalam pengabdian masyarakat ini adalah metode focus group discussion dengan melibatkan anggota Dewan Perwakilan Rakyat Daerah Provinsi Jawa Barat, buruh di Kota Bandung, dan Badan Eksekutif Mahasiswa di Universitas Padjadjaran. Alasan pemilihan buruh dan mahasiswa untuk mewakili unsur masyarakat sebab buruh merupakan kelompok masyarakat yang rentan secara ekonomi dan menjadi pihak terdampak langsung dari Rancangan Peraturan Daerah yang saat ini sedang disusun, yakni Raperda Jaminan Sosial Ketenagakerjaan. Sedangkan alasan pemilihan mahasiswa sebab dalam praktiknya mahasiswa seringkali memiliki aspirasi dalam jalannya pemerintahan. Hasil dari program pengabdian ini yakni terwujudnya forum yang dapat memfasilitasi buruh dan mahasiswa untuk menyampaikan aspirasi dalam pembentukan peraturan daerah, meskipun demikian program ini belum bisa memastikan apakah aspirasi tersebut dipertimbangkan dan diberikan penjelasan mengenai diterima ataukah tidaknya, namun kami berhadap ada kesadaran dan pemahaman yang muncul dari sosialisasi yang kami lakukan mengenai pentingnya partisipasi yang bermakna dalam pembentukan peraturan perundang-undangan.

Abstract

Law No. 4 of 2023 on the Development and Strengthening of the Financial Sector has given a new authority to the Deposit Insurance Corporation (LPS) to place funds in order to handle bank liquidation problems. This authority makes LPS like a neo Lender of Last Resort (LoLR) institution that the central bank generally plays. The placement of funds by LPS can pose a great risk considering that the bank that receives the placement of funds falls into the category of banks under the restructuring of the Financial Services Authority (OJK) and does not meet the requirements of receiving loans or short-term liquidity financing from Bank Indonesia (BI). The research shows that: first, the authority of LPS as a neo LoLR in the form of fund placement can still be debated because it creates a double LoLR that is not in accordance with the principle of division and separation of powers. However, in a historical perspective, the authority to place LPS funds has existed since the mass economic crisis conditions caused by COVID-2019 with the issuance of PP No. 33 of 2020. Second, BI’s short-term liquidity loans or financing have more comprehensive requirements than the requirements for the placement of funds from LPS. These different requirements are very dangerous because they have the potential to ignore the character of predictability and knowledge in monetary constitutionalism. Even if the authority to place LPS funds exists, the implementation must apply the principles of prudence and risk management to anticipate potential unpredictable losses.

Abstract

This article explores the deterioration of democracy in Indonesia attributed to the lack of effective opposition within its presidential multiparty system. The dominance of fat coalitions in the legislature has undermined the checks and balances function of the House of Representatives (DPR), reducing it to a body that merely approves government proposals including problematic legislation and controversial public programs without meaningful scrutiny. The lack of institutional support and incentives for opposition parties has contributed to this dysfunction, as coalition participation offers access to public office, funding, and legal protection, while opposition yields none. In response, this article proposes the institutionalization of the Rights of the Opposition,  which includes: the right to hold leadership positions in DPR organizational bodies; special rights in the legislative process such as the right to delay the deliberation of constitutionally significant or publicly controversial bills; the right to initiate and lead oversight mechanisms; influence budget deliberations; and participate in the appointment of public officials. It also outlines the need for specific incentives such as protocol privileges, financial resources for policy research, and eligibility for state honours. Framed within the concept of constitutional repair, the article identifies key pathways for reform based on four interrelated aspects: specificity, feasibility, temporality, and priority. These reforms aim to strengthen the DPR’s capacity for oversight and restore its role as a democratic counterbalance to executive power.

Abstract

Artikel ini mengajukan pola fast-track legislation dalam pembentukan Peraturan Daerah tentang Pembubaran Bank berbentuk BUMD yang dalam tahap likuidasi oleh LPS. Persoalan yang dikaji dalam artikel ini adalah karena adanya prinsip otonomi daerah bagi Pemerintah Daerah dalam pelayanan publik berupa pembentukan dan pembubaran bank BUMD pada satu sisi, namun pada sisi lain LPS yang berwenang melakukan likuidasi tidak dapat menunggu lama proses pembentukan Perda secara reguler karena dapat menggangu prinsip prediktabilitas dan kepastian hukum penyelesaian likuidasi bank. Artikel ini beragumen bahwa pola fast-track legislation dapat menjadi jalan tengah dua rezim hukum yang berbeda yakni hukum perbankan bagi LPS dan rezim hukum pemerintahan daerah bagi pemerintah daerah itu sendiri. Pola fast-track legislation itekankan pada perencanaan kumulatif terbuka, tidak perlunya Naskah Akademik, penyederhanaan dan percepatan waktu pembahasan maupun penetapan, pengesahan dan pengundangan.

Abstract

Abstract: Law No. 15 of 2019 provides an opportunity for a continuous process -which means an inter-period- in legislation making. Even though on the one hand it seems to solve the problem, but on the other hand, the conception of inter-period is still problematic in this concern. One of the occurring problems is the inappropriateness of the concept with the design of period of the legislation bodies as outlined by the constitution. This paper seeks to analyze how the design of the period of the legislation bodies in Indonesia is actually related to the concept of inter-period in legislation making. The study used juridical-normative method with descriptive-analytic techniques. This study revealed the three characteristics of the design of the period of the legislation bodies: fixed term, same period, and terminated-returned together. The analysis also disclosed that the legal political aspect in legislation making is periodic in nature, which does not match with the concept of inter-period legislation making.Abstrak: Undang-undang (UU) Nomor 15 Tahun 2019 memberikan peluang terjadinya proses pembentukan UU yang berkelanjutan dalam arti berlangsung antarperiode atau lintas periode masa jabatan. Kendati pada satu sisi tampak solutif, pada sisi yang lain konsepsi pembentukan UU lintas periode tersebut masih problematis. Salah satu di antara permasalahannya ialah konsep pembentukan UU lintas periode tersebut mungkin tidak cocok dengan desain masa jabatan lembaga pembentuk UU yang digariskan oleh konstitusi. Tulisan ini berusaha menganalisis bagaimanakah desain masa jabatan lembaga pembentuk UU di Indonesia berkaitan dengan ide pembentukan UU yang berkelanjutan dalam arti lintas periode. Metode penelitian yang digunakan ialah yuridis-normatif dengan teknik deskriptif-analitis. Studi ini menunjukkan bahwa desain masa jabatan pembentuk UU memiliki tiga karakter yakni fixed term, sama lamanya, serta diakhiri dan diawali kembali secara bersama-sama. Dengan desain tersebut politik legislasi bersifat periodik sehingga pada dasarnya tidak cocok dengan konsepsi pembentukan UU lintas periode.

Abstract

The aim of this research is to analyze the legal policy  of drug and food control in Indonesia. This is because drug and food supervision is the competence of BPOM but also needs to coordinate with the Ministry of Health. Apart from that, the issue of sectoral ego arises between the two when handling a case. The urgency of this research is to build and achieve compliance with public health. This research uses a normative juridical method using a statutory regulation approach, conceptual approach, case approach and comparative approach. In addition to photographing the existing conditions of drug and food supervision, this study can offer a type of legal policy for institutional arrangements between BPOM and the Ministry of Health so that they become synchronized and harmonious. In addition, this study also provides recommendations in the form of the need for joint regulations between BPOM and the Ministry of Health regarding overlapping drug and food supervision authorities. This study is expected to help improve drug and food supervision because it starts from the clarity of its legal policy accompanied by updates to regulations and authorities between institutions.

Abstract

The study aims to analyze the application of John Rawls' Theory of Justice in Indonesia's health system policy, emphasizing how principles of justice can promote fairness and equality in the provision of health services, especially for disadvantaged populations.The method used was a judicial normative (doctrinal) approach. This study critically reviewed legal and philosophical texts relevant to the Indonesian health policy framework, integrating Rawls' theory as an analytical lens.The novelty of this research lies in the operationalization of Rawls' abstract philosophical principles into a structured evaluation framework (Rawlsian grid) and its application to the Indonesian socio-political and cultural context. This allows for a systematic assessment of inequalities in the health system and proposals for equitable policy solutions.The findings show that programs such as the National Health Insurance Scheme (JKN) have contributed to broader access to health care, but disparities remain in remote and underdeveloped areas. Using the Rawlsian grid, the study highlights challenges in budget allocation, health worker distribution, and infrastructure access. Recommended strategies include reallocating health budgets, fair distribution of health workers, expansion of telemedicine, and participatory planning.The concludes that integrating Rawlsian principles of justice through a structured evaluation framework can support a more inclusive and sustainable health system in Indonesia, ensuring fair and equal access to quality health services for all citizens.

Abstract

Wacana mengembalikan syarat Presiden ialah orang Indonesia asli seperti dalam UUD 1945 Sebelum Perubahan muncul ke publik sebagai respon atas isu mayoritas dan minoritas dalam penyelenggaraan negara, telah menimbulkan problematika ketatanegaraan. Rumusan masalah yang hendak diteliti adalah bagaimana wacana mengembalikan syarat Presiden orang Indonesia asli dalam perspektif ketatatanegaraan Indonesia dan bagaimana solusi terhadap wacana tersebut. Studi ini menganalisis problematika wacana mengembalikan syarat Presiden orang Indonesia asli dalam perspektif ketatanegaraan Indonesia serta solusi terhadap problematika tersebut. Studi ini menggunakan metode penelitian hukum normatif yang menitiktekankan pada studi kepustakaan. Dari studi ini dapat disimpulkan bahwa wacana mengembalikan Presiden ialah orang Indonesia asli tidaklah tepat karena mengandung nilai diskriminasi warga negara. Ketentuan Presiden warga negara sejak kelahiran dalam Perubahan UUD 1945 sudah tepat. Solusi untuk mengatasi persoalan tersebut khususnya isu mayoritas dan minoritas dalam penyelenggaraan negara, dapat menggunakan konvensi ketatanegaraan sebagai salah satu sumber hukum formil dalam hukum tata negara yang patut dihormati dan ditaati.

Abstract

The Third Amendment to the 1945 Constitution has regulated new requirements for presidential candidates. One of which is the requirement to be mentally and physically capable of carrying  out the duties and obligations of the presidential office. This research aims to find the reason for formulating norms or legal ratio of the formation of such a requirement. The nature of this research is qualitative research using a normative-empirical and comparative approach. The results reveal several legal ratios of the requirement. First, the requirement is considered important because the president has the highest position within the governmental structures. Second reason refers to the close relation between health and decision-making matters, and the third demonstrates reasonable and justifiable limitations from the perspective of human rights. Comparison with several countries exposes that the requirement is fundamental since the president has dual functions, namely a head of state and a chief of government. This research also exhibits that the legal basis of the requirement is not in accordance with the 1945 Constitution since the existing regulation takes the form of the Decree of the General Election Commission. Therefore, this research recommends the appropriate legal basis to further regulate mental and physical requirements by law which regulates some fundamental principles dealing with such requirements.
