Abstract

This research describes fiqh literacy regarding joint property which has become an academic rumor referring to the Book of Sabilal Muhtadin by Sheikh Arsyad, which is a reference for studies on joint property in Indonesia. Because of this, it is necessary to re-read the concept of joint property, which was born from the culture of the Banjar people, namely the property of taboo, which was initiated by Sheikh Arsyad, because the reference is not from the Book of Sabilal Muhtadin.This research uses a type of normative research using historical, hermeneutic, netnographic, conceptual and philosophical approaches. Data was collected by means of literature studies that refer to the book of Sabilal Muhtadin and articles and studies of parties who are concerned about the book in correspondence. The findings of this research indicate that the Islamic legal methodology used by Sheikh Arsyad regarding the concept of joint property is a product of his ijtihad taking into account the local culture of the Banjar community. Although there is a misrepresentation of fiqh literacy regarding joint assets in the Sabilal Muhtadin Book which is used as a literary reference. Sheikh Arsyad's genealogical thoughts regarding joint property, although not contained in Sabilal Muhtadin's Book, have become a local legal doctrine that has been transformed into a global insight using the methods of islah, maslahah mursalah, urf, and adatul muhakkamah.However, this concept will not be degraded, because it has been practiced for a long time and has become a living law that contains beneficial values.

Abstract

Penelitian ini mengkaji implementasi prinsip-prinsip syariah dalam operasional Koperasi Kita di Ma'had Al-Irsyad Lil Banat, Yala, Thailand. Koperasi ini didirikan sebagai bagian dari upaya meningkatkan kesejahteraan ekonomi anggota dan memenuhi kebutuhan operasional sekolah berbasis syariah. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan teknik observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa Koperasi Kita menerapkan prinsip-prinsip syariah dalam berbagai aspek operasionalnya, seperti akad murabahah, mudharabah, musyarakah, qardul hasan, dan ijarah. Prinsip tauhid dan akhlak menjadi landasan utama dalam transaksi dan pengelolaan koperasi, yang mencerminkan nilai-nilai kejujuran, transparansi, dan keadilan. Meskipun koperasi ini telah beroperasi sesuai syariah, tantangan yang dihadapi antara lain kurangnya pemahaman mendalam tentang ekonomi Islam di kalangan pengelola serta sistem administrasi yang masih manual. Oleh karena itu, diperlukan edukasi berkelanjutan dan pengembangan sistem berbasis teknologi untuk meningkatkan efisiensi operasional koperasi. Studi ini memberikan kontribusi dalam memahami dinamika koperasi syariah di lingkungan pendidikan Islam, khususnya di wilayah minoritas Muslim seperti Thailand Selatan.

Abstract

This research aims to explore the trading practices between farmers and middlemen in Purwodadi Village, Central Kalimantan, focusing on the trade of key limes and kecombrang (torch ginger), while analyzing the transaction mechanisms, evaluating them from the perspective of Islamic economics, and determining their socio-economic impacts. Using a qualitative descriptive approach, the study was conducted in Purwodadi Village, with middlemen and farmers involved in the trade as the research subjects and the trading activity itself as the research object. Data were collected through non-participant observation, semi-structured interviews, and documentation. The findings reveal that the trading mechanism is based on trust and strong social relationships, with farmers choosing to sell their harvest to middlemen for market certainty and ease of distribution, while middlemen secure a stable supply of goods. From the perspective of Maqashid Sharia (the objectives of Islamic law), this system reflects principles of justice and benefit, as transactions are conducted fairly and mutually beneficially. This research contributes to understanding trading practices through the lens of Maqashid Sharia, which has not been extensively studied in local trade contexts, affirming the crucial role of social relationships and trust in sustaining traditional trading systems. Additionally, it provides insights into how principles of justice and benefit are applied in rural economic practices, offering a new perspective in Islamic economic studies, particularly in assessing trust-based transactions in the agricultural sector.

Abstract

This research provides a comparative analysis, namely a comparison of Islamic capital market regulations in Indonesia and Malaysia. This study highlights the role of Indonesia's Financial Services Authority (OJK), which has largely been discussed in the existing literature, but has not had a comprehensive review of the effectiveness of the Islamic Capital Market. This research builds on previous research, emphasizing the role of the OJK in market regulation, This study uses a library research approach combined with a comparative approach to analyze the comparative governance framework and regulatory practices in the two countries. The survey results show that as of April 2019, Indonesia had 629 issuers on the Indonesia Stock Exchange (IDX), of which Islamic stocks accounted for 65% of the total shares, while Malaysia had 911 issuers in 2018, and Islamic stocks accounted for 76%. This shows a significant difference in the development and acceptance of the Islamic capital market between the two countries. Furthermore, this study highlights the importance of a coordinated, independent and accountable OJK to improve the effectiveness of sharia compliance in the Indonesian capital market. Overall, both indicate that Shariah supervision and compliance in capital markets in Indonesia and Malaysia have been well implemented, but there is still room for improvement. In addition, there is a strong commitment to improving market integrity and transparency, but challenges in terms of supervision, financial literacy, and fatwa consistency need to be overcome to achieve maximum implementation.

Abstract

Penelitian ini mengkaji peran Bank syariah Indonesia (BSI) dalam menyalurkan dana sukuk untuk membiayai infrastruktur Kementerian Agama di Palangka Raya. Dengan keterbatasan anggaran pemerintah, sukuk menjadi alternatif pembiayaan yang krusial. Melalui metode kualitatif seperti tinjauan literatur, wawancara, dan observasi, penelitian ini menemukan bahwa BSI telah memfasilitasi pendanaan tujuh dari sepuluh proyek infrastruktur antara tahun 2021 dan 2023, termasuk pembangunan ruang kuliah dan fasilitas praktikum. Kemitraan BSI dan Kementerian Agama mempercepat pembangunan infrastruktur yang dibutuhkan masyarakat, sekaligus memastikan kepatuhan terhadap prinsip syariah. Penelitian ini menyarankan peningkatan kerjasama, sosialisasi manfaat sukuk, transparansi alokasi dana, serta evaluasi berkala terhadap efektivitas proyek untuk mendukung infrastruktur berkelanjutan berbasis syariah di Palangka Raya. BSI berperan penting dalam mendukung ekonomi syariah dan pembangunan fisik di wilayah tersebut.

Abstract

Indonesia is dubbed a maritime country because its water area is larger than its land area and consists of many islands. Indonesia's natural resources on land alone are already abundant, let alone the vast water areas that hold even more wealth of resources that can be utilized. However, do dreams and facts about the richness of marine resources correlate? This article discusses the welfare of coastal communities, opportunities, and challenges in optimizing the utilization of marine resources. Nearly 40 million people live in coastal areas, raising the question of why they have a low level of welfare despite this great potential. This article outlines the factors causing the low welfare of coastal communities and the associated challenges. Indonesia has a great opportunity to improve the welfare of coastal communities and the Indonesian economy through proper and effective management of marine resources if the challenges are overcome. With this article, it is hoped that readers can understand and actively contribute to maximizing the utilization of marine resources for every element of society. Library Research is the research method used with a descriptive approach to produce outputs that are easily understood by various groups. This article shows the vast potential and opportunities that marine resources hold for society and the economy in Indonesia if utilized effectively and efficiently.

Abstract

Trading is a lawful activity in Islam, requiring adherence to Sharia principles to ensure ethical and blessed business practices. Trade can occur through various mediums, including traditional markets, modern marketplaces, social media, and even merchant ships. Panyiuran ships serve as floating markets along the Barito River, Central Kalimantan, providing economic opportunities for traders and consumers in different villages. This study aims to analyze (1) the economic activities of traders on Panyiuran merchant ships, (2) the types of Sharia contracts applied in these trade transactions, and (3) the alignment of these activities with Islamic economic principles. This research employs a qualitative field study approach, utilizing purposive sampling to select participants, including three traders, one ship owner, one laborer, and three consumers. Data collection methods include observation, interviews, and documentation, analyzed through data reduction, presentation, and verification. Findings reveal that trade activities on Panyiuran ships resemble market transactions, with various goods being sold weekly in different locations. The applied Sharia contracts include Ijarah (rental agreements between traders and ship owners), Ujrah (wage contracts for laborers), and Ijab and Qabul (mutual consent in sales transactions). These activities comply with Islamic economic principles, particularly Muamalah Maddiyah and Muamalah Al-Adabiyyah, ensuring ethical trade practices.

Abstract

Artikel ini menganalisis dampak suntikan dana oleh Badan Pengelola Keuangan Haji Penelitian ini menganalisis dampak suntikan dana oleh Badan Pengelola Keuangan Haji (BPKH) terhadap kinerja keuangan PT Bank Muamalat Indonesia Tbk. dengan pendekatan kualitatif studi kasus pada data sekunder periode 2019–2024. Analisis difokuskan pada rasio kinerja keuangan utama (CAR, ROA, ROE, BOPO, NPF, FDR) dan aspek kepatuhan syariah. Hasil menunjukkan bahwa suntikan dana memperkuat permodalan dan menurunkan pembiayaan bermasalah, namun belum konsisten meningkatkan efisiensi operasional dan fungsi intermediasi. Kepatuhan syariah telah terintegrasi dalam tata kelola dan pelaporan. Temuan ini memberikan kontribusi akademis dalam kajian perbankan syariah serta implikasi praktis bagi BPKH, regulator, dan industri dalam merancang strategi penguatan kelembagaan berbasis nilai Islam

Abstract

This paper investigates the integration of carbon trading with the indigenous knowledge of the Dayak community in Central Kalimantan as a strategy to enhance food security and bridge development disparities. Given the severe environmental and health risks posed by high carbon dioxide (CO2) emissions, mainly from industrial activities, this topic is crucial for balancing economic growth with ecological sustainability in a region facing significant climate change and economic inequality challenges. The research employs a descriptive-qualitative approach, using an extensive literature review to explore the synergy between carbon trading mechanisms and traditional forest management practices. The study analyzes data on carbon trading, indigenous practices, and their combined impact on environmental conservation and community welfare in Central Kalimantan. The study finds that integrating carbon trading with the Dayak community's indigenous forest management practices can significantly reduce greenhouse gas emissions, preserve biodiversity, and enhance the economic well-being of local populations. This integration aligns with Islamic financial principles, emphasizing the balanced and sustainable use of natural resources. The findings suggest that this model can effectively improve food security, reduce development disparities, and support inclusive and sustainable development in Central Kalimantan. The insights gained from this study provide valuable guidance for policymakers addressing environmental and socio-economic challenges in regions vulnerable to climate change

Abstract

the implementation of infaq, sedekah and waqf crowdfunding in the perspective of Maqāṣid sharia, especially in the digital era, has now experienced an increase in reach and transparency so that it becomes an innovative fundraising model in the context of Islam. The purpose of this study is to explore the relevance of Maqāsid sharia, especially in maintaining religion (ḥifẓ al-dīn), soul (ḥifẓ al-nafs), reason (ḥifẓ al-'aql), descendants (ḥifẓ al-nasl) and property (ḥifẓ al-māl) as a guideline in formulating a more effective, efficient, and equitable management model for infaq, sedekah and waqf crowdfunding and to explore more deeply the mafsadat and mudharat of maqashid sharia in infaq, sedekah and waqf crowdfunding. This study uses a library method by analyzing various relevant literature sources. The results of the study indicate that when crowdfunding infaq, sedekah and waqf is carried out in accordance with the principles of maqāṣid sharia, it can become an innovative and sustainable model in managing social funds. In addition, when there is misappropriation in the management process, it will trigger mafsadat and mudharat which will result in failure to realize the welfare of the community. The author's recommendation based on this study is to improve the system with a basis of transparency, regulation, and education based on maqāṣid sharia. In addition, solid collaboration between the government, platforms, and Islamic financial institutions is very necessary in order to encourage the realization of a sustainable ecosystem
