Abstract

From the results of the study it was found that the implementation of the contract/agreement used in Jorong Sungai Nagari Taluk, Lintau Buo was a contract agreement carried out by the shop owner with the chief craftsman using a wholesale system (shirkah abdan) which was explained directly or verbally without the others. Between the chief mason and workers also uses a wholesale system (shirkah abdan) which is explained verbally/spokenly, but wages for construction workers are calculated daily as the custom for construction workers in Lintau Buo. In the contract/agreement that is carried out there is an agreement to give bonus wages if the work is completed before the due date where the number of working hours per day is not set because the workers try to get the job done quickly in the hope of getting a bonus. But in reality the bonus has not been clear until now. So that in giving wages there is an act of breaking promises or defaults on construction workers. Where construction workers feel disadvantaged because each member does not receive a wage bonus. Breach of promise in a contract is regulated in the Compilation of Sharia Economic Law article 36.

Abstract

This paper aims to analyse politically and legally the phenomenon of divorce in Tanah Datar Regency, with a special emphasis on infidelity among state civil servants. This is due to the fact that divorce within the government is often a major concern in the legal and political context. Field research (Fiel Research) is a descriptive normative research methodology used in this writing. The data sources of this research consist of primary data sources and secondary data sources. The primary data source is the cause of divorce among state civil servants and the secondary data source is a book.The primary data source is the causes of divorce among state civil servants and the secondary data source is books and articles related to the factors that cause divorce among state civil servants. The results showed that the submission of divorce permits by civil servants in the Tanah Datar Regency government was due to family economic problems where the wife's income was greater than the wife's income. Family economic problems where the wife's income is greater than the husband's, disharmonious relationships between husband/wife, frequent arguments and indications that the husband/wife partner is having an affair. In the context of prevention efforts, the Regional Government of Tanah Datar Regency has issued Circular Letter Number 100.3.44-999-BKPSDM-2023 concerning Prohibition of Cheating for All ASN and PPNPN within the government of Tanah Datar Regency by visiting integrity and moral values in community life.

Abstract

This research was conducted to examine the effectiveness of the implementation of the independ- ence guidance program granted to correctional clients at Bukittinggi Probation and Parole Office (BAPAS Bukittinggi) toward the harmony of the client’s household. This research uses a qualitative descriptive approach where primary data is obtained by submitting questions to the correctional officers and clients of BAPAS Bukittinggi related to the implementation of independence guidance granted to clients. Based on this research, it was found that independent guidance for clients can be carried out and can be applied effectively so that clients have skills and economic independence from the work results obtained based on the skills they get from guiding. The implementation of independence guidance is not free from supporting and inhibiting factors in implementing the independence guidance granted to clients of BAPAS Bukittinggi, however, BAPAS Bukittinggi has strategies to overcome these inhibiting factors so that guidance can still be provided to clients. The efforts made to overcome obstacles to the implementation of independence guidance include: overcoming budget limitations, the im- plementation of guidance is carried out by providing independence guidance to the client by means of personal guidance by visiting the client's residence, to overcoming significant geographic locations, guidance is carried out by providing online guidance and carrying out guidance activities at the closest location to the client's own domicile; and to overcome limited facilities and infrastructure, the strategy implemented is optimizing existing equipment and infrastructure. [Penelitian ini dilakukan guna melihat efektivitas pelaksanaan bimbingan kemandirian yang diberikan kepada klien BAPAS Bukittinggi terhadap keharmonisan rumah tangga klien tersebut. Penelitian ini menggunakan pendekatan deskriptif kualitatif dimana data primer diperoleh melalui wawancara terhadap petugas dan klien BAPAS Bukittinggi berkaitan dengan substansi pelaksanaan bimbingan kemandirian. Berdasarkan penelitian ini, disimpulkan bahwa pembimbingan kemandirian dapat dilaksanakan dan diterapkan secara efektif sehingga klien memiliki keahlian dan kemandirian secara ekonomi melalui keterampilan yang mereka peroleh dari kegiatan bimbingan. Pelaksanaan pembimbingan kemandirian yang diberikan kepada klien BAPAS Bukittinggi tidak luput dari faktor pendukung dan penghambat. Akan tetapi, BAPAS Bukittinggi memiliki strategi untuk mengatasi fak- tor-faktor penghambat sehingga pembimbingan tetap dapat diberikan kepada klien. Adapun upaya- upaya yang dilakukan dalam mengatasi faktor penghambat pelaksanaan pembimbingan kemandirian antara lain: untuk mengatasi keterbatasan anggaran pelaksanaan bimbingan dilakukan dengan cara memberikan bimbingan kemandirian kepada Klien melalui bimbingan personal dengan mendatangi tempat tinggal klien; untuk mengatasi letak geografis yang luas maka pembimbingan dilakukan se- cara daring dan melakukan kegiatan bimbingan di lokasi terdekat dari domisili klien; adapun untuk mengatasi keterbatasan sarana dan prasarana, strategi yang diterapkan adalah mengoptimalkan sarana dan prasarana yang tersedia.]

Abstract

Marriages are required to be registered under the provisions of Law Number 1 of 1974, specifically Article 2. This registration plays a crucial role in establishing the legality of marriages and enables the utilization of different associated benefits. Meanwhile, unregistered marriages give rise to a range of legal issues, including uncertainties regarding lineage, concerns related to maintenance, and inheritance rights. In line with the Ministry of Home Affairs Regulation Number 109 of 2019 regarding Population Administration, couples involved have the option to obtain important documents such as the Population Identification Card (KTP), Birth Certificate, and Family Card (KK) by signing a Statement of Absolute Responsibility (SPTJM). This situation raises significant concerns regarding the legal implications of unregistered marriages. Therefore, this study aimed to employ an empirical legal approach with qualitative methods and obtained data through interviews, observations, and documentation. The data analysis used Miles and Huberman's method to uncover the meaning within Ministry of Home Affairs Regulation Number 109 of 2019 regarding Unregistered Marriages and unveiled the ambiguity in understanding the true meaning. Furthermore, a study conducted in Dharmasraya Regency in 2021 discovered the issuance of 69,144 Family Cards by the Directorate General of Population and Civil Registration, and 22,453 (32.47%) were unregistered marriages. Only 194 individuals applied for validation (isbat) within 3 years, where 101, 27, and 66 were accepted, rejected, and revoked, respectively. In conclusion, the community perceived their marriages to be legal due to the issuance of Ministry of Home Affairs Regulation Number 109 of 2019, even though the SPTJM did not legalize the concept or hold legal authority over the consequences.

Abstract

This study analyzes the content and practice of premarital agreements, as well as the impact of making a marriage agreement on the rights and obligations of husband and wife in Talawi Hilir Village, Talawi District. This research is a field research using a qualitative approach. In its implementation, it has a positive and negative impact on two married couples, making a prenuptial agreement has a positive impact, namely the rights and obligations of husband and wife have been regulated in a prenuptial agreement so that it makes it easier to carry out their role as husband and wife in fulfilling their rights and obligations.

Abstract

This research examines the application of the principles of fast, simple, and low-cost proceedings in murabahah financing disputes at the Bukittinggi Religious Courts. Specifically, it addresses the issue of declinatory exceptions filed by defendants, which impact the efficiency of the judicial process. These principles are critical for ensuring effective and equitable access to justice. The study aims to analyze the impact of rejecting declinatory exceptions on the trial process in murabahah financing cases. It also evaluates how the principles of fast, simple, and low-cost judicial proceedings are implemented in such disputes. A qualitative research method with a case study approach was employed. Data collection involved analyzing case records, judicial decisions, and related legal principles to understand the implications of declinatory exceptions on court efficiency. The findings indicate that the rejection of the declinatory exception by the panel of judges led to delays in the trial process without valid legal justification. The interim decision, which affirmed the Bukittinggi Religious Court's authority, contradicted the principle of expedited proceedings, thus increasing trial duration and costs. The study concludes that rejecting declinatory exceptions without proper justification undermines the principles of fast, simple, and low-cost trials. Judicial practices should align with these principles to improve efficiency in murabahah financing dispute resolution.

Abstract

Family resilience is a crucial factor to support community resilience, which later leads to the resilience of the nation and state. This study describes and analyzes family resilience through the use of agricultural zakat in Nagari Lima Kaum, Tanah Datar in West Sumatra. This study is empirical or sociological legal research that perceives law as a social phenomenon. Data collection techniques include interview and document study. This study concludes that the uniquetradition of paying zakat carried out by the local community in Nagari Lima Kaum known as basokek can strengthen family resilience. As seen from the accounting of zakat, while most of the muzakki belong to underprivileged community, they always issue zakat rice because this has been a religious tradition for generations believing that they must pay zakat. This tradition, however, tends to be abandoned, yet the essence of the practice is still carried out today. The zakat practice includes distributing payment of zakat rice to the poor, the needy, old widows, mosques, and even people who are studying. In overview, zakat is an activity aimed to increase piety to Allah s.w.t for the muzakki and fulfill basic needs for the mustahiq in realizing family resilience in the social and economic fields.

Abstract

The primary issues in this thesis are the causes of siri polygamy, the effects it has on siri polygamous families, and how Tanah Datar Regency has dealt with siri polygamy. The purpose of this study is to investigate and elucidate the causes of siri polygamy in Tanah Datar Regency, as well as the effects and solutions related to this phenomenon. The study's findings indicate that: 1) There are frequent arguments between husband and wife, the husband feels capable, and it is customary to follow ancient customs. The second wife-to-be has not processed the previous husband's death certificate. The husband is worried and does not get permission from the first wife. 2) Siri polygamy has negative effects on children, spouses are unjust and insufficient in allocating their income, spouses are uncaring and hardly return home, wives feel betrayed, and marriages are not legally binding in Tanah Datar Regency. 3) Tanah Datar Regency's resolution of siri polygamy, Out of the five data sets, two had amicably (non-litigation) resolved their issues, with both families and the mother present. None of the data sets were settled in court. Regarding unregistered polygamous weddings, the local Nagari administration has not issued any particular regulations. 4) Unregistered polygamous marriages are regarded under Islamic family law as having no legal significance, with the children being entrusted to the mother and the woman having no rights to assert in the event of a divorce or inheritance. Islamic law permits polygamy as long as certain requirements are met, such as the need that it be done properly and with no more than four partners. In addition, the law and KHI stipulate that the woman cannot have children, has an irreversible illness, or is disabled. The husband also needs the consent of the first wife. There is also an assurance that the husband would be able to fairly provide for his wife and kids.

Abstract

The phenomenon of unregistered marriage in Tanah Datar, West Sumatra, reflects the complex interplay between customary traditions (adat), Islam, and the state within contemporary Minangkabau society. This article investigates how the traditional triadic authority—Tungku Tigo Sajarangan, consisting of ninik mamak (customary leaders), alim ulama (religious scholars), and cadiak pandai (intellectuals)—understands and responds to the increasing prevalence of unregistered marriage. Employing a qualitative approach through in-depth interviews and field observations, the study reveals that unregistered marriage is perceived not merely as a bureaucratic irregularity due to its absence in the state legal registry, but also as a deviation from both communal norms and the socio-cultural structure of the Minangkabau. This practice signals a broader shift in societal authority, wherein the influence of Tungku Tigo Sajarangan has diminished amid the rise of individualistic religious interpretations, the pressures of modernity, and the weakening of customary mechanisms of social control. The article argues that unregistered marriage serves as an indicator of the delegitimation of local cultural values, contributing to social fragmentation within the community. Addressing this issue necessitates a revitalization of customary institutions to restore their mediating role in balancing customary norms, Islamic principles, and national legal frameworks. Reinforcing local authority is thus imperative to counteract social disintegration and reestablish harmony within the marital order of Minangkabau society. [Fenomena nikah siri di Tanah Datar, Sumatera Barat, merupakan cerminan dari kompleksitas relasi antara adat, agama, dan negara dalam masyarakat Minangkabau kontemporer. Artikel ini mengeksplorasi bagaimana Tungku Tigo Sajarangan—yakni ninik mamak (pemimpin adat), alim ulama (otoritas agama), dan cadiak pandai (kaum intelektual)—memahami dan merespons praktik nikah siri yang kian marak. Penelitian ini menggunakan pendekatan kualitatif melalui wawancara mendalam dengan tokoh-tokoh adat dan observasi di lapangan. Hasil penelitian menunjukkan bahwa nikah siri tidak semata-mata dianggap sebagai pelanggaran administratif karena tidak dicatatkan dalam sistem hukum negara, melainkan juga sebagai bentuk penyimpangan terhadap norma adat dan struktur sosial komunal. Praktik ini menandai terjadinya pergeseran otoritas dalam masyarakat: peran Tungku Tigo Sajarangan semakin terpinggirkan akibat dominasi tafsir individual atas ajaran agama, pengaruh modernitas, serta melemahnya fungsi pengawasan sosial dari institusi adat. Lebih jauh, artikel ini mengemukakan bahwa nikah siri merupakan salah satu indikator delegitimasi terhadap nilai-nilai kultural lokal, yang berdampak pada disintegrasi sosial dalam komunitas Minangkabau. Situasi ini menuntut adanya revitalisasi peran lembaga adat agar dapat menjalankan fungsi mediasi antara kepentingan adat, syariat Islam, dan regulasi negara secara seimbang. Dengan demikian, penguatan otoritas lokal menjadi langkah strategis dalam menanggulangi fragmentasi sosial dan mengembalikan harmoni dalam tatanan perkawinan masyarakat Minangkabau.]

Abstract

This study aims to analyze the dynamics of Islamic family law reform in four Muslim countries: Egypt, Turkey, Pakistan, and Iraq with a historical and juridical approach. Islamic family law has a unique epistemological position because it is seen as part of a permanent and transcendent divine law. However, in practice, this law has undergone a significant reform process, especially under the pressure of modernity, secularization, and demands for social justice and gender equality. This study uses a qualitative method through library research with a descriptive-analytical and comparative approach, and utilizes primary and secondary legal sources from the four countries. The results of the study show that Egypt carried out family law reform through cross-school codification and the maqashid al-shariah approach, Turkey carried out full secularization by adopting the Swiss Civil Code, Pakistan implemented reform through the Muslim Family Laws Ordinance 1961 with procedural strengthening of women's rights, while Iraq displayed a pluralistic approach that combined elements of the Sunni and Shia schools of thought in the Personal Status Law of 1959. Although each country has a different model and context, all of them show a tendency to adapt fiqh law to contemporary social needs.
