Abstract

Innovation is a new method to improve the quality of an existing programme or item.  Innovation is a new thing that requires a process in its application. This means that not all innovations can be directly accepted/adopted by the general public. Innovations need to be communicated first, then the innovation decision process, which is the process of a person/individual accepting or rejecting an innovation. Employee placement innovation needs to be done through placing employees in the most appropriate place or position, with the right employee placement will increase the morale of the employee concerned.  The purpose of the study was to determine the process of placing ASN employees in the Talaud Regency public relations and protocol section. The method used in this research is a qualitative method with descriptive analysis. The results of this study indicate that the placement of ASN employees still does not pay attention to the specifications of education, experience, and employee skills.Keywords:  Innovation, Placement, State Civil Apparatus (ASN)Inovasi merupakan  metode baru untuk meningkatkan mutu/kualitas terhadap suatu program atau barang yang sudah ada.  Inovasi adalah hal baru yang memerlukan proses dalam pengaplikasiannya. Artinya bahwa tidak semua inovasi dapat secara langsung diterima/diadopsi oleh kalayak umum. Inovasi perlu dikomunikasikan terlebih dahulu, kemudian proses putusan inovasi, yakni proses seseorang/individu menerima atau menolak suatu inovasi. Inovasi penempatan pegawai perlu dilakukan melalui jalan penempatan pegawai pada suatu tempat atau jabatan yang paling sesuai, dengan penempatan pegawai yang tepat akan meningkatkan semangat kerja pegawai yang bersangkutan.  Tujuan penelitian untuk mengetahui proses penempatan pegawai ASN di Kabupaten Talaud bagian humas dan protokol. Metode yang digunakan dalam penelitian ini adalah metode kualitatif dengan analisis deskriptif. Hasil penelitian ini menunjukkan bahwa penempatan pegawai ASN masih kurang memperhatikan spesifikasi pendidikan, pengalaman, dan keterampilan pegawai.Kata Kunci :  Inovasi, Penempatan , Aparatur Sipil Negara (ASN)

Abstract

Cases of non-performance of contract. on the part of the aggrieved party bring the case to the criminal realm. The charge reported is the fraud article, even though the criminal offense has not been fulfilled. So that it has the potential to cause wrong criminalization, the main problem is the inaccurate use of the fraud article against defaults which are basically civil. The research method uses normative juridical with decision analysis and criminal and civil law studies related to non-performance of contract. and fraud. The results show that non-performance of contract. can only turn into a criminal offense of fraud if there are elements of intent, bad faith, use of deception, or falsification of agreements with the intention of benefiting oneself against the law. Therefore, law enforcement officials should be careful in distinguishing non-performance of contract. and fraud cases to avoid abuse of the law that harms the parties concerned. The hopes and solutions proposed are proportional law enforcement by paying attention to the element of malicious intent in determining criminal offenses, as well as legal education to the public so that they understand the difference between the civil and criminal domains in contractual disputes.

Abstract

Religious Holiday Allowance is a mandatory worker's right that companies in Indonesia must fulfill as part of their legal responsibilities, which should also extend to online motorcycle taxi drivers. The platform worker status of online motorcycles taxi, who are typically bound only by work agreements, raises questions regarding their entitlement to this Religious Holiday Allowance. This paper aims to highlight the Circular Letter from the Ministry of Manpower Number M/3/HK.04.00/III/2025, which regulates the provision of Religious Holiday Allowance for online motorcycles taxi in the form of a religious holiday bonus. Using a socio-legal research method, this writing emphasizes the correlation between prevailing laws and regulations concerning the Religious Holiday Allowance for online motorcycles taxi drivers. The research findings indicate that online motorcycle taxi drivers have not comprehensively received their Religious Holiday Allowance rights due to their legal status as partners not being formally recognized within prevailing labor regulations. Furthermore, Circular Letter Number M/3/HK.04.00/III/2025 is non-binding, making the implementation of religious holiday bonus provisions contingent upon the individual policies of each platform company.

Abstract

The development of artificial intelligence technology has given birth to deepfake technology which has the potential to be misused to damage a person's digital identity. This research aims to analyze the mode of misuse of deepfake technology in Indonesia, examine its legal implications based on applicable laws and regulations, and examine the urgency of special regulation of deepfake in the Indonesian legal system. Applicable, as well as examining the urgency of special arrangements against deepfake in the Indonesian legal system. The research method used is normative juridical legal research with statutory and conceptual approaches, and data collection is carried out through literature study of primary, secondary, and tertiary legal materials tertiary. The results show that deepfake abuse can take the form of spreading fake videos, face forgery and digital identity-based fraud that harms victims socially, legally and psychologically. Although several articles in the ITE Law, Personal Data Protection Law, and Criminal Code can be used to charge perpetrators, these regulations have not specifically and explicitly regulated the characteristics and technical aspects of deepfake-based crimes. This creates obstacles in law enforcement and victim protection. Therefore, it is necessary to establish special regulations or amend existing laws so that the legal system in Indonesia is able to answer the challenges of deepfake technology appropriately, fairly, and effectively.

Abstract

Abstrak Usaha UMK pengolahan buah carica khas Dieng menjadi produk minuman khas dengan nama NSR Carica, membutuhkan sentuhan teknologi. Pengelolaan usaha yang tidak tertib menjadikan usaha tidak terukur. Mulai stock barang masuk, barang keluar, transaksi yang dilakukan dan lainnya masih manual dengan menulis di buku saja. Ketika melayani banyak pembeli dan orderan, kadang tidak lupa dicatat. Belum lagi beberapa masukan konsumen yang kesulitan menancapkan sedotan ke cup NSR Carica. Sehingga pelatihan dan pendampingan yang dilakukan merupakan kelanjutan dari program pengabdian masyarakat yang telah dilakukan pada tahun 2022. Evaluasi dari program di tahun sebelumnya akhirnya membawa solusi untuk diadakannya pelatihan penggunaan aplikasi kasir pintar sebagai upaya tertib administrasi. Selain itu, rebranding juga dilakukan agar lebih memberikan kesan menarik bagi konsumen dan dengan perbaikan kemasan menindaklanjuti saran-saran konsumen. Dari kegiatan pelatihan dan pendampingan yang dilakukan, hasilnya yaitu branding baru dengan cup yang mudah ditusuk oleh sedotan, keterampilan pengelolaan usaha berbasis teknologi dengan penggunaan aplikasi kasir pintar, dan juga pembukuan usaha NSR Carica menjadi tertib dan terpantau di aplikasi kasir pintar. Dengan hasil di atas, NSR Carica semakin kuat berdiri sebagai usaha mikro dan kecil untuk meningkatkan perekonomian masyarakat sekitar. Kata Kunci: Kasir Pintar, NSR Carica, Rebranding, Teknologi, Tertib Administrasi Abstract The UMK business of processing Dieng's typical carica fruit into a typical drink product called NSR Carica requires a touch of technology. Unorganized business management makes the business unmeasurable. Starting from incoming stock, outgoing goods, transactions made and others are still manual by writing in books only. When serving many buyers and orders, sometimes they don't forget to record them. Not to mention some consumer input who have difficulty inserting straws into the NSR Carica cup. So that the training and mentoring carried out is a continuation of the community service program that was carried out in 2022. Evaluation of the program in the previous year finally brought a solution to hold training on the use of the smart cashier application as an effort to order administration. In addition, rebranding was also carried out to provide a more attractive impression to consumers and with improvements to the packaging following up on consumer suggestions. From the training and mentoring activities carried out, the results were new branding with cups that were easily pierced by straws, technology-based business management skills with the use of the smart cashier application, and also the bookkeeping of the NSR Carica business became orderly and monitored in the smart cashier application. With the above results, NSR Carica is increasingly standing strong as a micro and small business to improve the economy of the surrounding community. Abstract

The study aims to identify, describe and analyze the Service Satisfaction Rate of BPJS Health Participants on JKN Mobile Applications in Tomohon City. Data is collected through observation techniques, interviews and interviews as well as documentation. The results of this study, showed the level of satisfaction of the client received by the participants of BPJS Health in Kelurahan Talete Kota Tomohon through online media mobile application JKN related to human resources and applications used. Some officials are not aware of the existence of the Mobile JKN application, and do not receive socialization from any party including BPJS Health. And not all participants can use the mobile JKN app and not all the participants feel at ease with the presence of the mobile application JKN, because at the time of its use there are many obstacles, impediments and problems, such as server errors, features in the application do not work properly, as well as the application often happens updates of the application too often.

Abstract

This research aims to dig deeper into the relationship between mood, emotions, and societal legal compliance. The urgency of research lies in understanding the role of individual moods and emotions in legal compliance in society. Stability, security, and justice in society depend primarily on the level of compliance with the law, and this research highlights that an individual's mood and emotions can be a crucial factor in such compliance behavior. The focus of this research lies in the approach taken in analyzing the relationship between mood, emotions, and legal compliance, in contrast to previous research, which focused more on external factors such as law enforcement or socio-economic characteristics. This research approach method is sociological juridical and focuses on qualitative data. This research provides new insights into how these psychological factors influence legal compliance behavior in society. The finding is that positive moods, such as happiness and peace, promote higher legal compliance, while negative moods, such as anxiety or anger, can reduce legal compliance. The conclusions of this research emphasize the importance of considering psychological aspects in designing effective law enforcement policies and strategies. Understanding how mood and emotions influence legal compliance behavior can improve legal compliance and create a safer and more stable environment.

Abstract

Violence today does not only occur in the real world, but with the development of internet technology, it opens up opportunities for perpetrators to commit acts of violence by utilizing the internet, known as online gender-based violence (GBV). KBGO is more vulnerable to women and children, which not only causes suffering for victims physically, psychologically and even economically. The rights of victims have been deprived and their interests have been harmed by the perpetrators, so victims really need legal protection so that their rights are restored and their interests can be protected. Legal protection for victims of violence is provided by considering the losses suffered by victims, namely in the form of material and immaterial losses. Legal protection for women victims of online gender-based violence (KBGO), not only imposes punishment on the perpetrators of violence in the form of imprisonment and/or fines, but also provides the rights of victims who have been deprived and whose interests have been harmed by the actions of the perpetrators. The punishment that can be imposed on the perpetrators of violence has been regulated in Law Number 12 of 2022, including in the provisions of Article 14 and Article 15, with imprisonment and/or fines, even restitution, imposition of additional punishment or measures in the form of rehabilitation for the perpetrators, as stipulated in Article 16 and Article 17 of Law Number 12 of 2022. For legal protection of the rights of victims of violence, among others, it is regulated in Article 66 to Article 70 of Law Number 12 of 2022, which includes the right to handling, the right to protection and the right to recovery.Keywords:KBGO, Legal Protection, Victims, Women

Abstract

Advokat merupakan orang yang berprofesi memberi jasa hukum, baik didalam maupun diluar pengadilan. Dalam menjalankan tugas atau profesi sebagai advokat, ada kode etik atau pedoman yang harus dijadikan pijakan oleh para advokat. Disamping itu juga ada hak dan kewajiban yang harus dilaksanakan oleh advokat dalam memberikan jasa bantuan atau pendampingan hukum bagi kliennya. Hal tersebut secara tegas diatur dalam Undang-undang Republik Indonesia Nomor 18 tahun 2003. Diantara hak-hak seorang advokat yaitu memiliki hak independence, hak imunitas, hak meminta informasi, hak ingkar, hak untuk menjalankan praktek peradilan di seluruh wilayah indonesia, hak berkedudukan sama dengan penegak hukum lainnya. hak memperoleh honorium dan melakukan retensi, hak untuk melindungi dokumen dan rahasia klien, hak memberikan somasi dan hak membuat legal coment atau legal opinion. Selain hak-hak tersebut, advokat memiliki kewajiban menjunjung kode etik profesinya, menegakkan hukum termasuk supremasi hukum dan hak asasi manusia dan bersungguh - sungguh melindungi dan membela kepentingan kliennya dalam hal jasa hukum tertentu yang telah mereka perjanjikan.

Abstract

Dalam Islam pengasuhan anak disebut dengan hadhanah. Ulama fikih mendefinisikan hadhanah sebagai tindakan pemeliharaan anak-anak yang masih kecil, baik laki-laki maupun perempuan yang sudah besar tetapi belum mumayyiz, menyediakan sesuatu yang menjadikan kebaikannya, menjaganya dari sesuatu yang menyakiti dan merusaknya, mendidik jasmani, rohani dan akalnya, agar mampu berdiri sendiri menghadapi hidup dan memikul tanggung jawab. Jika terjadi perceraian dan pihak istri meningeal dunia dan sementara anak masih dibawah umur, maka berdasarkan perspektif Undang-undnag Nomor 23 tahun 2002 tentang Perlindungan Anak, apabila ibunya meningeal dunia, hak asuh anak tersebut jatuh kepada ayahnya selama dipandang sang ayah akan mampu mengasuh dan menjaga keselamatan anaknya. Akan tetapi jika sang ayah dipandang tidak mampu dengan beberapa alasan, maka hak asuh anak yang masih dibawah umur tersebut berada pada keluarganya. Sedangkan berdasarkan perspektif Kompilasi Hukum Islam, apabila ibunya telah meninggal dunia, maka hak asuh dapat dilimpahkan kepada selain ibu dengan memberi urutan yang berhak mengasuh anak adalah Wanita-wanita dari garis lurus ibu, ayah Wanita-wanita dari garis lurus ayah, saudara perempuan dari anak yang bersangkutan, saudara perempuan sedarah dari garis samping ibu, dan saudara perempuan sedarah dari garis samping bapak.
