Abstract

Investasi ilegal dan pinjaman online ilegal merupakan permasalahan yang semakin meningkat di Kota Malang pada tahun 2021-2022, yang menyebabkan kerugian finansial dan tekanan psikologis bagi masyarakat. Rendahnya literasi keuangan dan kurangnya pemahaman mengenai ciri-ciri investasi dan pinjaman ilegal menjadi faktor utama masyarakat mudah terjerat dalam praktik tersebut. Penelitian pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pengetahuan dan kewaspadaan masyarakat Kota Malang terhadap bahaya investasi ilegal dan pinjaman online ilegal melalui kegiatan penyuluhan dan edukasi. Metode yang digunakan adalah deskriptif kualitatif dengan pendekatan partisipatif, melibatkan 120 peserta dari berbagai kelompok masyarakat. Data dikumpulkan melalui pre-test dan post-test, wawancara, serta diskusi kelompok terfokus (FGD). Hasil menunjukkan peningkatan signifikan dalam pemahaman peserta, dengan persentase peserta yang mampu mengidentifikasi ciri-ciri investasi dan pinjaman ilegal naik dari 28% pada pre-test menjadi 82% pada post-test. Selain itu, terjadi perubahan sikap yang positif, dimana masyarakat menjadi lebih kritis dan berhati-hati dalam mengambil keputusan investasi dan pinjaman. Namun, tantangan seperti akses informasi dan membedakan fintech legal dan ilegal masih perlu mendapat perhatian. Penyuluhan ini membuktikan efektivitasnya dalam meningkatkan literasi keuangan dan diharapkan dapat menjadi langkah awal dalam melindungi masyarakat dari risiko investasi dan pinjaman ilegal di era digital.

Abstract

Kekerasan Dalam Rumah Tangga (KDRT) masih menjadi masalah sosial yang signifikan di Indonesia meskipun telah ada regulasi hukum yang tegas. Penelitian ini bertujuan untuk menganalisis peran hukum pidana dalam pencegahan KDRT serta mengevaluasi efektivitas sosialisasi yang dilakukan oleh berbagai pihak dalam upaya pencegahan tersebut. Metode penelitian yang digunakan adalah kualitatif deskriptif dengan pengumpulan data melalui wawancara mendalam dan studi literatur. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang No. 23 Tahun 2004 telah memberikan kerangka hukum yang jelas, implementasinya masih terkendala oleh ketidakpedulian aparat penegak hukum, stigma sosial terhadap korban, dan keterbatasan akses korban terhadap layanan hukum. Sosialisasi pencegahan KDRT masih terbatas dan belum menjangkau seluruh lapisan masyarakat, terutama di daerah terpencil. Penelitian ini merekomendasikan peningkatan kapasitas aparat penegak hukum, perluasan cakupan sosialisasi, dan penguatan perlindungan hukum bagi korban agar pencegahan KDRT dapat lebih efektif dan komprehensif.

Abstract

The main objective of this research is to provide a deeper understanding of the relationship between the legislature and the executive in the implementation of oversight, as well as to identify the challenges faced by the legislature in carrying out the oversight function. This research uses a normative approach, descriptive analytical in nature. The results of the study the authority of the DPR in overseeing government policies, whether through working meetings, interpellation, the right of inquiry, and oversight of state financial management, is an integral form of oversight in ensuring government accountability and transparency. However, in practice, legislative oversight faces a number of significant challenges. One of the main challenges is the dominance of executive power in the presidential system of government, which often hampers the effectiveness of parliamentary oversight. Tensions between the legislature and the executive, as well as the politicisation of oversight influenced by the political interests of certain parties, are factors that reduce objectivity in carrying out legislative oversight functions. In addition, the capacity of human resources in the DPR is also an obstacle, where limited knowledge, skills, and a lack of competent expert staff prevent optimal oversight. To strengthen legislative oversight, efforts are needed to increase the capacity of human resources in the legislature, both through the recruitment of competent expert staff, ongoing training, and increased transparency in the management of the state budget. Strengthening the oversight functions of the DPR, as well as the involvement of the media and the public in oversight, are also solutions that can improve the effectiveness of oversight of executive policies. With these measures, it is hoped that the DPR can better perform its functions, ensure more transparent, accountable and pro-people government policies, and realise a more democratic and corruption-free government. Overall, despite the challenges in legislative oversight, the legislature still has an obligation to perform its oversight function optimally. Strengthening the capacity of the legislature as well as efforts to increase transparency in executive policies are key to realising better governance in Indonesia

Abstract

This paper presents a critical investigation into the use of foreign language interpreters in Indonesian courts by integrating insights from applied linguistics and legal scholarship. The primary goal is to assess current translation practices, identify the systemic barriers to accuracy, and propose actionable strategies for reform. Using the Critical Literature Review (CLR) approach, the study draws from scholarly sources indexed in Scopus, GARUDA, and Google Scholar, focusing on literature published between 2015 and 2025. The review identifies a number of recurring issues, including the overreliance on unaccredited ad hoc interpreters, recurring errors in rendering legal terminology, and undue influence from courtroom actors, all of which undermine interpreter neutrality. These problems often result in significant legal ramifications such as nullified legal documents, flawed judicial decisions, and the infringement of defendants’ rights. Additionally, the absence of standardized interpreter training and certification, combined with uneven policy implementation across regions, further complicates the situation. In response, the study recommends solutions such as realistic courtroom simulations for interpreter training, the adoption of digital tools like bilingual legal term databases, and interdisciplinary cooperation to formulate inclusive and rights-focused translation standards. Policy-level interventions are also suggested, including the revision of Supreme Court Circular No. 3/2023 and the incorporation of globally recognized best practices. While offering important contributions, the study also notes limitations, particularly in terms of regional representativeness and the underexplored role of AI in legal translation. Ultimately, the findings reinforce the importance of bridging linguistic expertise and legal frameworks to strengthen translation quality and promote equitable access to justice in Indonesia’s legal system.

Abstract

This community service project endeavours to present English literature as a new vehicle for advancing local cultural tourism through online media. As the world remains culturally influenced by globalization, there is an increasing necessity to equip local communities, particularly youth, with creative means of conserving and disseminating heritage in a compelling manner. With English literary expression and internet media brought together, students are invited to compose poems, short stories, and stories that promote local knowledge and tourist attractions. Field activity like practice of the story based on actual cultural experience and classes on English literature and content creation online are part of the program. The end products are electronic literary pieces that can be posted on the world wide web, and they are meant to market local culture to the global community. The project not only improves people's English and computer skills but also instills pride in local heritage and community identity.

Abstract

Not only limited to individual decisions, it turns out that there are several things that can make female victims of domestic violence reluctant to report the violence they experienced. This study aims to analyze the causes why women victims of domestic violence are reluctant to report their cases. This literature study research found that cultural, gender, and social structure factors are one of the causes of women victims of domestic violence who are reluctant to report gender-based violence problems in the domestic sphere. In addition,  problems of legal culture and institutional capacity that are not yet gender-sensitive, such as limited training of apparatus, lack of integrated assistance services, and the risk of secondary victimization during the legal process strengthen the vulnerable position of victims of domestic violence, making women victims of domestic violence make the decision not to report the domestic violence they experience.

Abstract

This article examines the impact of Constitutional Court Decision No. 105/PUU-XXII/2024, which restricted criminal defamation claims by institutions under the Electronic Information and Transaction Law. The ruling asserts that only individual persons—not state bodies, corporations, professions, or institutional entities—may file criminal defamation reports. Employing a normative legal method with statutory and constitutional approaches, the study analyses the decision’s implications for public oversight over governmental power, democratic deliberation, and institutional accountability. This paper argues that the decision strengthens citizens’ freedom of expression and the informal mechanism of checks and balances, while also reducing the potential misuse of criminal defamation provisions to silence criticism. However, the effectiveness of the ruling depends on judicial interpretation, harmonisation with other legal frameworks, and the institutional internalisation of democratic norms. The research concludes that although the decision contributes to the protection of civil liberties, a more systematic enforcement strategy, judicial guidelines, and legal reform are required to prevent retaliatory litigation through non-criminal avenues. Furthermore, this study contributes to constitutional scholarship by positioning the decision as a landmark shift from state-centred reputational protection towards citizen-centred constitutional guarantees. It highlights the need for a coherent legal architecture that safeguards critical expression as an essential component of democratic control over power. By mapping doctrinal consequences and practical enforcement gaps, this article offers a framework for evaluating future court rulings and policy reforms related to defamation, digital rights, and state accountability in Indonesia. Thus, the decision not only redefines the boundaries of criminal defamation but also provides momentum for strengthening constitutional democracy through legal culture transformation, legislative harmonisation, and strategic judicial oversight.

Abstract

This research aims to analyze the forms of legal protection for parties disadvantaged in unwritten agreements (oral contracts), which remain widely practiced in Indonesian society due to factors such as trust, simplicity, and cultural habits of informal transactions. Despite their prevalence, unwritten agreements often create vulnerabilities when disputes arise, as the absence of written documentation complicates the process of proving rights and obligations in legal proceedings. The study adopts a normative juridical approach combined with empirical data collection through interviews and case analysis to understand how such agreements are treated in practice. Findings indicate that while Article 1320 of the Indonesian Civil Code recognizes the validity of oral agreements as long as they meet essential legal requirements—consent, capacity, a specific object, and lawful cause—the practical enforcement faces challenges. Courts often encounter difficulties due to the weak evidentiary value of oral testimony compared to written contracts. Legal protection for disadvantaged parties is predominantly repressive, realized through litigation mechanisms (civil lawsuits) and non-litigation pathways such as mediation and arbitration. However, preventive legal protection is still limited, as public awareness of legal risks and the use of written or digital contracts remains relatively low. This research emphasizes the urgent need for regulatory reform, particularly in strengthening the recognition of electronic evidence under Indonesian law, and promoting legal literacy to encourage society to document agreements more effectively. By highlighting both theoretical and practical dimensions, the study contributes to the development of contract law discourse in Indonesia and provides policy recommendations to improve the balance of legal protection between parties in contractual relations.
