Abstract

Digitalization has brought convenience in job search, but it also raises the risk of misuse of personal data, especially through the fraudulent mode of freelance job vacancies. This research aims to analyze the legal responsibility of digital platforms in protecting users' personal data as well as the implementation of Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) in handling cybercrime cases. The research method used is qualitative descriptive, with a literature study approach to relevant regulations and cases that occur. The results of the study show that digital platforms have an obligation to ensure the security of user data, including by implementing a verification system and preventing data leaks. The PDP Law provides a strong legal basis in protecting the rights of personal data owners, but its implementation still requires increased public awareness and stricter supervision.

Abstract

Bullying or intimidation in English, refers to a series of aggressive actions or negative behavior carried out repeatedly by one individual or group of individuals against other people who are weaker or less powerful. Acts of bullying can be physical, verbal, or social, and aim to hurt, frighten, or harm the victim. Bullying often occurs in educational environments between students. Usually bullying that occurs in schools is carried out by seniors against their juniors. Bullying can have a serious impact on the victim's psychological, emotional and social well-being. Therefore, need for legal training for students at SMAN 1 Kandanghaur Indramayu, considering that the legal consequences resulting from these acts of bullying are very serious for the victim's survival. Legal coaching is carried out with the aim of creating high legal awareness among students so that they can eliminate cases of bullying in the educational environment. The method for implementing this legal guidance is carried out by providing counseling on bullying material that discusses the legal aspects for perpetrators of bullying. The result of this counseling is that student enthusiasm is very high so that the extension team can facilitate an active discussion forum for students to share their experiences related to bullying, which can be responded to directly by teachers and school principals, then the extension team provides legal advice regarding the incident. ABSTRAK Perundungan atau bullying dalam Bahasa Inggris, merujuk pada serangkaian tindakan agresif atau perilaku negatif yang dilakukan secara berulang-ulang oleh satu individu atau sekelompok individu terhadap orang lain yang lebih lemah atau kurang berdaya. Tindakan perundungan dapat bersifat fisik, verbal, atau sosial, dan bertujuan untuk menyakiti, menakut-nakuti, atau merendahkan korban. Perundungan acap kali terjadi di lingkungan pendidikan yang dilakukan antar siswa/siswi. Biasanya perundungan yang terjadi di sekolah dilakukan oleh para senior kepada juniornya.  Perundungan dapat memiliki dampak yang serius pada kesejahteraan psikologis, emosional, dan sosial korban. Oleh karena itu, perlunya pembinaan hukum kepada siswa/siswi di SMAN 1 Kandanghaur Indramayu, mengingat akibat hukum yang ditimbulkan dari tindakan perundungan tersebut sangat serius bagi keberlangsungan hidup korban. Pembinaan hukum dilakukan dengan tujuan dapat menciptakan kesadaran hukum yang tinggi antar siswa/siswi sehingga dapat menghapus kasus perundungan di lingkungan pendidikan. Metode pelaksanaan pembinaan hukum ini dilakukan dengan cara penyuluhan materi perundungan yang membahas aspek hukumnya bagi pelaku perundungan. Hasil dari penyuluhan ini yaitu antusiasme siswa/siswi sangat tinggi sehingga tim penyuluh dapat memfasilitasi forum diskusi yang aktif untuk siswa/siswi menceritakan pengalamannya terkait perundungan, yang mana hal tersebut dapat ditanggapi secara langsung oleh guru-guru dan kepala sekolah, lalu tim penyuluh memberikan nasihat hukum terhadap kejadian tersebut.

Abstract

The Indonesian state is a state of law that actually prioritizes law over politics. The Indonesian state in regulating the structure of the state administration and the actions of its people always prioritizes the laws that have been compiled and made by the government and must also be implemented. In its implementation, the State of Indonesia has set up a judicial institution which specializes in overseeing the code of ethics of a Judge who will decide the case, namely the Judicial Commission. The purpose of this study is to determine the neutrality of an independent institution, namely the Honorary Council of the Constitutional Court in carrying out its duties using a research method approach to legislation or pre-existing literature. In the discussion of this paper, several new facts were found regarding the supervision carried out by the Judicial Commission as a judicial supervisory institution that only supervises Supreme Court Judges but does not supervise Constitutional Judges. Indeed, if the Constitution conducts direct supervision of Constitutional Judges, it will certainly lead to non-neutrality in the implementation of such supervision.

Abstract

According to Article 1(3) of the 1945 Constitution of the Republic of Indonesia, Indonesia is a rule of law state, meaning that governance must be conducted based on legal principles. The concept of a rule of law state is closely related to the democratic system implemented in Indonesia. Democracy is a system of government that emphasizes the principle of popular sovereignty, in which the people hold the highest power in state governance. However, despite the people's fundamental role in shaping and directing the country, Indonesia's democracy index has shown a decline. This study aims to analyze the causes of democratic decline in Indonesia and the consequences of democratic erosion. The research adopts a normative legal approach, utilizing secondary data from journals, articles, and legislation. The findings reveal that, in practice, democracy often experiences distortions. As a result, Indonesia's democracy has significantly deteriorated, dropping three places in 2024 to rank 59. To address this issue, several solutions can be implemented. First, the government must ensure freedom of speech, expression, and the press to uphold democratic values. Second, public access to government information must be improved to promote transparency and accountability. Third, it is essential to strengthen the performance of government institutions, including the legislative, executive, and judicial branches, to prevent the concentration of power in a single entity. Lastly, enhancing the legal framework is necessary to impose stricter deterrents against violations of democratic principles. Thus, to prevent further democratic decline and safeguard Indonesia's democratic integrity, the government must evaluate its governance practices and ensure that democracy remains a true reflection of the people's sovereignty rather than a system dominated by the state.

Abstract

Legal considerations by judges play a crucial role in law enforcement and are key to realizing justice in society. From both legal and sociological perspectives, judges are often seen as representatives of noble values, even symbolically referred to as God's representatives on Earth. Therefore, each ruling is expected to reflect not only formal legal aspects but also the substantive values of justice that resonate within society. However, in reality, there is often a gap between public expectations and judicial decisions, with many judgments failing to meet society's sense of justice and truth.

Abstract

Lecturers as professional educators and scientists have a main task, one of which is to carry out community service. Community service is carried out as part of the Tridharma of College. One form of community service is by providing legal aid to the community, such as the advocate profession which can provide legal assistance in court or outside the court. The problem arose when the Law on Advocates prohibited civil servant lecturers from becoming and acting as advocates, meaning that civil servant lecturers were prohibited from carrying out the profession of advocates and acting as advocates. However, after the Constitutional Court Decision Number 150/PUU-XXII/2024, civil servant lecturers were finally able to act as advocates in providing free legal assistance to the community.

Abstract

State-Owned Enterprises (SOEs) in Indonesia play an important role in the economy, but face challenges in transparency and accountability after Law No. 1 of 2025. This study analyzes changes in SOE financial management from a philosophical legal perspective. The results show that the elimination of the phrase "SOE capital comes from separated state assets" obscures the legal status of SOE assets and has the potential to create legal uncertainty. In addition, the provision that SOE managers are not state administrators can reduce transparency, accountability, and open loopholes for abuse of authority, as well as create the risk of uncertainty in the application of the law, especially within the framework of eradicating corruption.

Abstract

Judicial power is the main pillar in the judicial system that guarantees the upholding of law and justice. Judges as law enforcers have a strategic role in maintaining the integrity and public trust in judicial institutions. The independence and professionalism of judges must always be maintained so that they are not tainted by violations of the code of ethics and behavior that is contrary to judicial values. This study aims to analyze the role of the Judicial Commission in enforcing the code of ethics of judges with Judge DA case study, who was involved in drug abuse and other ethical violations. The research methods used are normative law and empirical juridical, with a focus on laws and regulations, Judicial Commission decisions, academic literature, and media coverage. The results of the study show that Judicial Commission has implemented a systematic supervisory mechanism, starting from verifying reports to imposing sanctions by the Judges' Honorary Council. The dishonorable dismissal of Judge DA reflects Judicial Commission's firmness in enforcing the code of ethics, but also highlights weaknesses in the system of selection, coaching, and supervision of judges. This case has an impact on the decline in the image of the judicial institution, but also becomes a momentum for improvement and evaluation of the supervision system to be more effective and preventive. This study concludes that strong supervision and cooperation between the Judicial Commission and other institutions, such as the Supreme Court, are very necessary to maintain the dignity of judges and increase public trust in the judiciary in Indonesia.

Abstract

This study aims to analyze the expansion of monopoly rights granted by the President to State-Owned Enterprises under Law No. 1 of 2025 from the perspective of legal philosophy. The research method used is normative-philosophical with conceptual, historical, and juridical approaches through literature and regulatory analysis. The monopoly rights provision explicitly expands presidential authority to appoint State-Owned Enterprises’ as sole operators in vital sectors. While constitutionally grounded in Article 33 of the 1945 Constitution, such expansion raises concerns regarding distributive justice and legal certainty. Law No. 1/2025 lacks clarity on the required regulatory form, opening room for ambiguous interpretation and potential market inequality. From both positive law and progressive legal theory perspectives, unchecked monopolies may harm healthy market competition. Analysis through Aristotle’s justice theory, utilitarianism, progressive law, and law and economics approaches reveals the need for limitations based on justice, transparency, and public service efficiency. In conclusion, the expansion of monopoly rights must be regulated within a clear and accountable legal framework to protect public interest and avoid harming other business actors.

Abstract

The development of artificial intelligence, becoming increasingly complex, has sparked profound debates regarding its legal status, particularly whether AI can be considered a legal subject. To address this issue, this study adopts an existentialist philosophical approach, focusing on the concepts of freedom, consciousness, and responsibility as the fundamental elements of human existence. The research employs a qualitative approach with a philosophical analysis of the concepts of subjectivity and existence, drawing on the ideas of prominent existential thinkers such as Jean-Paul Sartre and Martin Heidegger. The findings indicate that although AI is capable of independent action and mimicking decision-making processes similar to humans, it lacks self-consciousness and existential freedom—traits that are inherently human. Therefore, from an existentialist perspective, AI does not meet the criteria to be regarded as a legal subject, as it does not possess authentic existence or the moral responsibility associated with legal subjects. Based on these findings, it can be concluded that the legal status of AI is more appropriately viewed as an object of law, requiring special regulation, rather than as an entity with legal rights and obligations akin to humans.
