Abstract

Legal considerations by judges play a crucial role in law enforcement and are key to realizing justice in society. From both legal and sociological perspectives, judges are often seen as representatives of noble values, even symbolically referred to as God's representatives on Earth. Therefore, each ruling is expected to reflect not only formal legal aspects but also the substantive values of justice that resonate within society. However, in reality, there is often a gap between public expectations and judicial decisions, with many judgments failing to meet society's sense of justice and truth.

Abstract

State-Owned Enterprises (SOEs) in Indonesia play an important role in the economy, but face challenges in transparency and accountability after Law No. 1 of 2025. This study analyzes changes in SOE financial management from a philosophical legal perspective. The results show that the elimination of the phrase "SOE capital comes from separated state assets" obscures the legal status of SOE assets and has the potential to create legal uncertainty. In addition, the provision that SOE managers are not state administrators can reduce transparency, accountability, and open loopholes for abuse of authority, as well as create the risk of uncertainty in the application of the law, especially within the framework of eradicating corruption.

Abstract

Credit agreements in conventional banks play an important role in supporting economic development, but they pose challenges for legal protection for debtors due to the imbalance of rights and obligations in standard agreements. A juridical analysis of banking regulations and practices shows that although the principle of prudence and POJK No. 42/POJK.03/2017 have been implemented, the resolution of defaults still often occurs through litigation, which is less effective and does not optimally protect debtors. This research concludes the need for regulatory updates and non-litigation dispute resolution mechanisms to strengthen debtor legal protection.

Abstract

The Notary is obliged to read the deed in the presence of the audience and therefore is obliged to face the Notary. On the other hand, it will have an impact on the deed becoming invalid and the Notary's civil liability. This research is normative legal research using statutory and case approaches, with the source of research material being secondary data obtained through a literature study. The results of this research show that, philosophically, the legality of a Notary's deed made without the presence of an audience is related to truth and justice, that with the presence of an audience, it is true that the audience is present so that he can listen to the contents of the deed read by the Notary so that the deed becomes valid because its truth can be accounted for. Juridically, the presence of an audience in front of a Notary when making a deed is a provision of Article 16 paragraph (1) letter m UUJN which states that a Notary in carrying out his or her position is obliged to read the deed in the presence of the audience so that the Notary's deed becomes valid if it is based on this juridical provision. The validity of Notarial deeds made without the presence of an audience according to Supreme Court Decision Number 1615 K/Pdt/2018/2020 is that the deeds were declared invalid and null and void, and the Notary was deemed to have committed an unlawful act because the plaintiff was proven to have never appeared before the Notary.

Abstract

This research aims to determine the legal responsibility of the notary regional supervisory board which has given a written warning sanction to the notary which is contrary to the norms of Article 53 paragraph (2) of the PTUN Law and to find out the legal remedies that the notary can take against the decision of the notary regional supervisory board which has been stated wrong by the PTUN according to Notarial Legal Perception. The research method used is normative juridical legal research. The results of the research show that the legal responsibility of the Notary MPW in giving written warning sanctions to notaries must be carried out carefully and under provisions aimed at maintaining the integrity of the notary profession, protecting the rights of notaries, and ensuring that the supervision process is carried out objectively and transparent. Notaries disadvantaged by MPW decisions declared wrong by the PTUN have several legal routes that can be taken to defend their rights. This step includes filing an appeal, a civil lawsuit, and efforts to rehabilitate the good name. Notaries need to follow proper legal procedures and obtain adequate legal advice to optimize the chances of success in their legal efforts. This legal route reflects justice and protection of notary rights in the notarial legal system in Indonesia

Abstract

The termination of a fixed-term employment agreement (PKWT) is regulated by applicable laws and regulations, including but not limited to the Employment Law. A PKWT can automatically terminate upon the expiration of the agreed-upon term, or it may also be terminated prior to the specified time if there are valid reasons, such as a breach of contractual provisions, force majeure circumstances, or mutual agreement between the parties. The termination procedure must be carried out in accordance with the provisions written in the agreement, with written notice provided to the other party within a sufficient timeframe for that party to make necessary preparations. Employees are entitled to receive all rights stipulated in the agreement, including but not limited to salary, benefits, and other entitlements, until the last day of employment. Conversely, the employer is obligated to provide valid and clear evidence of termination to avoid disputes in the future. If the termination is conducted in a manner that does not comply with the procedure or without a justifiable reason, the employee has the right to file a lawsuit to claim their entitlements. Therefore, it is essential for both parties to understand and adhere to the provisions contained in the employment agreement and to ensure that there are clear clauses regarding the conditions and procedures for terminating the agreement.

Abstract

Abstract: This study analyzes the resolution of obstacles to electronic land rights registration in land sale and purchase cases. The rules in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 3 of 2023 concerning the issuance of electronic documents in land registration activities. This regulation regulates the issuance of electronic documents in land registration activities by setting limits on the terms used in its regulations. However, there are obstacles found in the implementation of land rights registration which were studied by the author using descriptive-analytical research methods, secondary data sources, and primary data, obtained from library research, and interviews with related parties. The results of this study are that land rights in the sale and purchase case cannot be registered because the buyer was declared dead shortly after the signing and there were registration obstacles in the PPAT account after confirmation to the relevant land agency, the heirs of the buyer are required to make a court decision. Abstract

Undang-Undang Dasar 1945 (UUD 1945) mengatakan Presiden dan Dewan Perwakilan Rakyat (DPR) adalah dua kelompok besar yang dapat membuat undang-undang dan peraturan. DPR adalah badan pemerintahan yang tugasnya adalah membuat dan menyetujui undang-undang. Presiden, sebagai kepala negara, bertugas menetapkan kebijakan dan membuat peraturan pemerintah. Dalam pelaksanaannya, kedua lembaga ini memiliki hubungan yang saling berkaitan dalam proses legislasi. Sejarah kewenangan DPR mengalami berbagai perubahan sejak era kolonial hingga masa reformasi, yang kemudian diperkuat melalui sistem check and balances dengan mekanisme multi-partai serta independensi dari eksekutif. DPR punya tiga fungsi utama, yakni legislasi, penganggaran, serta pengawasan, yang kewenangannya diatur dalam UU MD3, UU PPP, serta berbagai regulasi lain yang berkaitan dengan pembentukan undang-undang dan pengelolaan keuangan negara. Presiden, di sisi lain, bertugas membuat kebijakan ekonomi, politik, dan sosial untuk seluruh negara. Ini termasuk mengangkat dan memberhentikan menteri, membuat peraturan pemerintah, dan menangani hubungan dengan negara lain. DPR memiliki kekuasaan legislatif, tetapi Presiden masih dapat mengajukan, membahas, dan menandatangani rancangan undang-undang. Ini berarti eksekutif dapat terlibat dalam proses legislasi. Dalam gagasannya mengenai trias politika, Montesquieu menekankan perlunya cabang legislatif, eksekutif, dan yudikatif untuk memiliki kekuasaan yang terpisah. Namun dalam kenyataannya, DPR dan Presiden sering berbagi area kekuasaan yang sama dalam hal proses legislasi. Undang-undang dapat diusulkan oleh Presiden, dan dia juga memiliki suara dalam bagaimana undang-undang tersebut dibicarakan hingga ditandatangani menjadi undang-undang. Pada konteks ini, hal ini menunjukkan pemerintah mempunyai suara yang besar dalam bagaimana aturan dibuat di Indonesia. Karena itu, keseimbangan kekuasaan antara DPR dan Presiden sangat penting untuk membuat undang-undang dan aturan yang adil dan demi kepentingan terbaik masyarakat.

Abstract

Demokrasi sebagai sistem pemerintahan senantiasa mengalami perkembangan seiring dengan perubahan sosial, politik, dan teknologi yang terjadi dalam masyarakat. Di Indonesia, demokrasi tidak bersifat statis, melainkan dinamis dan adaptif terhadap berbagai perubahan zaman, termasuk dalam era digital yang ditandai oleh kemajuan teknologi informasi dan komunikasi. Penelitian ini bertujuan untuk mengkaji dan menganalisis tantangan yang dihadapi demokrasi Indonesia dalam konteks digitalisasi, dengan fokus pada pengaruh media sosial terhadap proses politik nasional.Media sosial telah menjadi ruang publik baru yang memungkinkan masyarakat untuk mengekspresikan pendapat, berdiskusi, serta berpartisipasi secara aktif dalam isu-isu politik dan kenegaraan. Fenomena ini menciptakan peluang besar bagi perluasan partisipasi politik, terutama di kalangan generasi muda, namun juga menghadirkan tantangan serius seperti disinformasi, polarisasi, dan manipulasi opini publik melalui buzzer politik dan algoritma digital.Temuan penelitian menunjukkan bahwa meskipun media sosial dapat memperkuat nilai-nilai demokrasi dengan membuka akses terhadap informasi dan partisipasi politik, namun penggunaannya yang tidak terkontrol juga berpotensi merusak tatanan demokrasi dengan menyebarkan ujaran kebencian, hoaks, dan membentuk “ruang gema” yang menghambat dialog antar pandangan. Penelitian ini menyimpulkan bahwa demokrasi Indonesia akan terus bertahan dan berkembang jika mampu mengelola dinamika media sosial secara bijak dan inklusif sebagai bagian integral dari sistem demokrasi yang dinamis.

Abstract

Kasus pembunuhan berencana Ferdy Sambo menjadi perhatian publik yang luas karena adanya perubahan putusan secara signifikan dari tingkat Pengadilan Negeri, Pengadilan Tinggi, hingga Mahkamah Agung. Perubahan tersebut menimbulkan pertanyaan publik mengenai konsistensi putusan hakim, serta bagaimana asas-asas hukum seperti keadilan, kepastian hukum, dan kesetaraan di hadapan hukum diterapkan dalam perkara tersebut. Penelitian ini bertujuan untuk mengkaji bentuk inkonsistensi dalam putusan kasus Ferdy Sambo serta menganalisis faktor-faktor yang mempengaruhi pertimbangan hakim dalam menjatuhkan putusan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi kepustakaan. Hasil penelitian menunjukkan bahwa perbedaan putusan di setiap tingkat peradilan, khususnya dalam perubahan sanksi dari pidana mati menjadi penjara seumur hidup, telah menimbulkan ketidakpastian hukum di tengah masyarakat. Selain itu, adanya dissenting opinion dalam putusan Mahkamah Agung memperlihatkan bahwa perbedaan pandangan antar hakim merupakan hal yang tidak dapat dihindari dalam pelaksanaan kekuasaan kehakiman yang merdeka. Namun, hal ini tetap perlu dikaji secara objektif agar tidak mengaburkan prinsip keadilan.
