Abstract

The Indonesia Smart Program (PIP) is a strategic governmental initiative designed to enhance access to higher education for students from economically disadvantaged backgrounds. Despite its intended benefits, the program’s implementation within faith-based higher education institutions—such as Raden Intan State Islamic University (UIN) in Lampung—continues to encounter structural and ethical challenges, particularly among scholarship recipients residing in Ma’had al-Jami’ah (Islamic boarding schools). This study aims to examine the implementation of Minister of Education and Culture Regulation No. 10 of 2020, identify both supporting and inhibiting factors, and evaluate the policy through the lens of Islamic public law (Fiqh Siyasah Tanfidziyah). Employing a descriptive qualitative method and a normative-sociological approach, the study finds that while the PIP has contributed positively to educational participation, it still faces issues related to data validation, delays in fund disbursement, and misallocation of resources. From the perspective of Islamic jurisprudence, the findings underscore the necessity of upholding the principles of trustworthiness, justice, and transparency in public policy implementation. Ongoing evaluation and reform are essential to align the program with Islamic ethical values and to promote more equitable educational outcomes.

Abstract

As part of reformation outcomes, the substitute heir in Islamic inheritance law has been long heeded by Indonesian jurists. However, amidst the facet of the traditional scheme, Indonesian Religious Court judges (judex factie) have not shared the same implementation of this succession. This article endeavors to examine the practice of substitute heir in the field. Relies on the Religious Court decisions as the primary source, this article argues that the norm of substitute heir (Article 185 of The Compilation of Islamic Law) has been implemented restrictedly according to The Compilation and the Supreme Court consensus. Restricted interpretation means the descendants of the pre-deceased side-relative was not accounted as substitute heir. It implies that the state reformation attempt in Islamic inheritance law has not come into play in the way the state desires.[Sebagai bagian dari hasil reformasi, substitute heir dalam hukum waris Islam telah lama diperhatikan oleh para ahli hukum Indonesia. Namun, di tengah sisi skema tradisional, hakim Pengadilan Agama Indonesia (judex factie) belum memiliki kesamaan pelaksanaan suksesi ini. Artikel ini mencoba mengkaji praktek penerapan substitute heir di lapangan. Berpijak pada putusan Pengadilan Agama sebagai sumber data utama, artikel ini berargumen bahwa norma ahli waris pengganti (Pasal 185 Kompilasi Hukum Islam) telah dilaksanakan secara terbatas menurut Kompilasi dan konsensus Mahkamah Agung. Penafsiran terbatas berarti keturunan dari kerabat menyamping yang telah meninggal dunia terlebih dahulu tidak diperhitungkan sebagai ahli waris pengganti. Ini menyiratkan bahwa upaya reformasi negara dalam hukum waris Islam belum diterapkan sesuai yang diinginkan negara.]

Abstract

Zakat has a strategic role in reducing poverty and increasing the economic empowerment of the people.However, in reality, most of the zakat is only managed traditionally so that the benefits have not been felt.The purpose of this research is to reveal productive zakat in the form of scholarships from the National Amil Zakat Agency or Baznas Bandar Lampung City in improving human resources from a legal perspective. This research is included in field research whose data is obtained from Baznas Bandar Lampung City.This research concludes that Baznas Bandar Lampung City provides scholarships to as many as 25 students from UIN Negeri Raden Intan Lampung and ITERA.Zakat funds distributed by Baznas Bandar Lampung City amounted to Rp. 66,900,000.In the perspective of Islamic law, scholarship zakat is valid and included in productive zakat.This is based on the arguments of the Koran, Prophetic traditions and MUI Fatwa in 1996. Zakat scholarships provide many benefits, including increased access to education, which helps mustahik to access higher education. Zakat scholarship is also able to improve the quality of human resources because it succeeds in producing scholars who have knowledge so that they are ready to compete in the world of work and are involved in regional development.

Abstract

The revision of Article 15 of Law No. 39 of 2008 through Law No. 61 of 2024, which removes the limit on the number of ministries, has caused academic concern regarding the potential concentration of executive power, which is contrary to the principle of checks and balances in Indonesia's presidential system. This study aims to analyze the legal implications of this revision on the president's prerogative rights and to examine the principles of fiqh siyasah dusturiyah as the ethical basis for limiting power. The research method uses a normative legal approach with descriptive-analytical analysis, combined with a conceptual and statute approach, as well as a fiqh siyasah dusturiyah approach that focuses on the principles of maslahah mursalah, 'adl, and syura. The results of the study show that removing the limit on the number of ministries has the potential to cause constitutional overreach because it weakens the legislative oversight function and opens up opportunities for patronage politics. The fiqh siyasah dusturiyah perspective emphasizes that the formation of ministries must be oriented towards the public interest, not pragmatic political interests. The integration of positive law and fiqh siyasah dusturiyah produces a constitutional ethics model that balances formal legality and the morality of power The implications of this study recommend limiting the president's prerogative rights through proportional, efficient, and public interest-oriented regulatory revisions.
