Abstract

This study addresses the main legal issue concerning the management of underground space in major cities in Indonesia amid rapid urbanization. The current regulations, such as the Basic Agrarian Law, do not provide clear provisions regarding the right to use underground space, leading to legal uncertainty and potential conflicts of interest. The position of this research is to analyze existing regulations through a normative juridical approach and propose legal solutions that are more adaptive to the needs of urban modernization. This paper examines the limitations of current regulations and suggests the need for more comprehensive, specific legislation governing underground space rights. The main findings of this study reveal the inadequacy of the existing legal framework in accommodating the management of underground space fairly and sustainably, and the urgency for regulatory reforms that are more responsive to Indonesia’s urbanization developments.

Abstract

The research aimed to analyze the alignment between the judge's decision in cases of domestic violence against children and the provisions of Law Number 23 of 2004 on the Elimination of Domestic Violence and Qonun Number 9 of 2019 on the Implementation of Handling Violence Against Women and Children. The study also considered moral considerations and the overall benefits. The research methodology employs a case law study, which involves examining court decisions to get insight into the application of the law in specific circumstances. Specifically, the study focuses on the Decision of the Tapak Tuan District Court Judge Number 37/Pid.Sus/2020/PN. Case law is utilized to examine court rulings to comprehend how the law is implemented in specific instances. The library research method is employed in conjunction with a sociological juridical perspective. The data for the research is sourced from the Law and various pertinent articles addressing the research difficulties. Furthermore, to bolster the ideas of the study, the paper also incorporates the findings of several empirical studies. According to the findings, it appears that the judge primarily focuses on formal factors and gives little weight to material considerations in their decision-making process. This aligns with the viewpoint expressed by Member Judge II and the concurring opinion within the panel of judges. However, the author acknowledges and values the decision made by the panel of judges. The author recognizes the challenging nature of the judges' task, as they must not only consider the legal interests involved in the case, but also consider the community's sense of justice in order to achieve legal certainty.

Abstract

This study delves into the integration of customary law values with modern mediation in resolving land disputes in Indonesia, often marked by tensions between individual and communal interests as well as between customary law and national law. Employing a normative legal research methodology, this investigation explores relevant regulations, including the Basic Agrarian Law (UUPA) and the Law on Arbitration and Alternative Dispute Resolution, to understand how to harmonize the principles of customary law and mediation without undermining the supremacy of law at the national level. The research identifies two core issues: how distributive and procedural justice can be realized through this integration. Findings indicate that formal recognition of customary mediation outcomes and a comprehensive regulatory framework are crucial for establishing a fair and effective dispute resolution mechanism. This study advocates for the development of regulations that celebrate legal diversity, positioning land dispute resolution as a process that interweaves human values with local wisdom while simultaneously reinforcing the legitimacy of customary law within the national legal framework.

Abstract

Amidst the roaring tide of globalization, cross-border transactions—particularly in the realm of gifts—emerge as a landscape rife with legal challenges. A complex tapestry weaves itself from the threads of differing legal systems, document validity, and the unavoidable nuances of international recognition. In this arena, notaries stand as pillars of trust, ensuring that gift deeds transcend mere text to become legitimate statements acknowledged across jurisdictions. This study seeks to delve deeper into the role of notaries in crafting international gift deeds while identifying the hurdles they face: from bewildering regulatory differences and intricate tax provisions to the advent of underutilized new technologies. The research employs a normative legal approach, analyzing both national and international regulations. Law No. 2 of 2014 concerning Notary Services and the Hague Convention serve as lenses through which to comprehend how public documents achieve global recognition. Furthermore, legal principles such as lex loci celebrationis and the principle of mutual recognition are explored as foundations for resolving emerging cross-border legal issues. In conclusion, notaries play a vital role in upholding legal certainty in cross-border gift transactions. They are not merely navigators in a tumultuous sea of law but also connectors that bring clarity amidst confusion. It is recommended that notaries continually sharpen their skills and knowledge of international law as a proactive step to enhance services in an increasingly dynamic landscape of cross-border transactions.

Abstract

: This research was conducted to obtain an explanation of corruption eradication policies in Denmark and Indonesia. In addition, to find out the justice-based corruption eradication policy in a comparative study of Indonesia and Denmark. This research uses a normative juridical method with a literature study. Based on this, the required results are that corruption eradication policies in Indonesia and Denmark have significant differences. Denmark inserts corruption eradication provisions into each of its laws and regulations and uses a strict element of transparency in state financial management. Denmark utilizes social sanctions supported by the legal culture of its highly law-abiding society. Second, the policy reconstruction that can be used in Indonesia to eradicate corruption adopts the Danish policy. Namely, the anti-corruption agency with independent status integrates corruption eradication regulations into national legislation emphasizing strict sanctions and transparency of state financial management correlated with the wealth of state officials. The independence of the Corruption Eradication Commission is crucial. Applying Denmark’s mechanisms could lead to a breakthrough in corruption eradication in Indonesia.

Abstract

Penelitian ini mengkaji penegakan hukum terhadap tindak pidana penggelapan dalam perusahaan, dengan fokus pada analisis hukum terhadap Putusan Nomor 1967/Pid.B/2022/PN Mdn. Tindak pidana penggelapan menimbulkan tantangan signifikan terhadap integritas dan stabilitas keuangan perusahaan, sering kali disebabkan oleh individu yang memanfaatkan posisinya untuk kepentingan pribadi. Tujuan penelitian ini adalah untuk mengidentifikasi isu-isu pokok seputar penegakan hukum dalam kasus penggelapan dan menganalisis efektivitas kerangka hukum yang ada di Indonesia. Menggunakan pendekatan kualitatif dengan analisis hukum normatif, penelitian ini mengungkapkan bahwa meskipun terdapat regulasi yang memadai, penegakan hukum masih menghadapi hambatan seperti kurangnya bukti yang kuat dan pengaruh eksternal yang dapat merusak proses hukum. Temuan ini menunjukkan perlunya peningkatan kapasitas bagi aparat penegak hukum dan penguatan regulasi untuk memperbaiki pencegahan dan penuntutan kasus penggelapan. Penelitian ini bertujuan untuk memberikan kontribusi terhadap pengembangan kebijakan dan praktik hukum di Indonesia, memastikan lingkungan hukum yang lebih kuat untuk tata kelola perusahaan.

Abstract

This study aims to analyze and reconstruct the national land law system in Indonesia based on the principles of social justice and the social function of land. The main focus of this research is to identify challenges in the implementation of social justice principles, including agrarian conflicts, legal uncertainty, and the marginalization of indigenous communities. The methodology employed is normative legal research, with data collection entailing the examination of secondary documents pertinent to the execution of the Basic Agrarian Law (UUPA). The results of the study indicate that the reconstruction of the land law system based on social justice and the social function of land can improve community access to land resources, reduce conflict, and encourage sustainable development. These findings also suggest the need for policy reform and more effective law enforcement to address social dynamics on the ground. Policymakers can expect this research to provide recommendations for the formulation of regulations that are fairer and more responsive to community needs.

Abstract

This research investigates Indonesia’s legal framework for addressing human smuggling, focusing on the integration of penal policies targeting its root causes and evaluating the impact of international collaborations in law enforcement. Despite existing literature on human smuggling, critical gaps remain, particularly in understanding the role of criminal policy as part of social policy and the practical effects of international cooperation. The study aims to answer two primary questions: the role of criminal policy in addressing human smuggling crimes in Indonesia and the non-penal policies Indonesia has implemented to combat human smuggling. This research adopts a normative legal methodology, analyzing Indonesia’s Criminal Code, the Eradication of Trafficking in Persons Law, the Suppression of Migrant Smuggling Law, and relevant international frameworks like the Bali Process. The study reveals that an effective approach to combating human smuggling requires a balance of penal and non-penal measures, strong adherence to territorial sovereignty, and enhanced international cooperation. It finds that while penal policies act as deterrents, non-penal strategies, such as victim protection and public awareness campaigns, are equally crucial. Additionally, the study highlights the importance of regional and international collaborations in strengthening law enforcement, emphasizing the need for specialized legal framework to address human smuggling.

Abstract

This article examines the legal integration of customary law into Indonesia’s national land law system, with specific reference to the constitutional framework and the Basic Agrarian Law. The purpose of this study is to analyze the status of customary law, identify its impacts on land tenure and use, and formulate legal strategies to harmonize customary and national law toward equitable and sustainable land governance. Employing a normative juridical method, the research draws on primary legal materials, including statutory regulations, constitutional provisions, and jurisprudence, supported by secondary academic sources. The findings indicate that although customary law is constitutionally recognized, its implementation remains inconsistent due to legal fragmentation, administrative constraints, and sectoral regulatory conflicts. To address this, the study proposes a pluralistic legal model based on codification, procedural innovation, institutional reform, and participatory law-making to ensure the effective and just integration of customary land systems within the national legal order.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan uang paksa (dwangsom) sebagai strategi alternatif dalam upaya pengembalian kerugian keuangan negara akibat tindak pidana korupsi. Praktik korupsi di Indonesia telah menyebabkan kerugian negara dalam jumlah besar, sementara mekanisme pemulihan yang tersedia seperti pidana penjara dan pembayaran uang penggantibelum sepenuhnya efektif dalam menjamin pengembalian aset negara secara maksimal. Dwangsom, sebagai sanksi yang bersifat accessoir dan subsidair, dapat digunakan sebagai alat tekanan hukum terhadap terpidana yang tidak mematuhi putusan pengadilan, khususnya dalam perkara perdata yang berkaitan dengan pengembalian aset. Penelitian ini menggunakan metode yuridis normatif melalui pendekatan peraturan perundang-undangan dan putusan pengadilan. Hasil kajian menunjukkan bahwa dwangsom dapat berfungsi sebagai tekanan psikologis yang mendorong pelaksanaan putusan secara sukarela melalui ancaman kewajiban membayar sejumlah uang setiap hari keterlambatan. Dengan sifatnya yang fleksibel dan efisien, dwangsom berpotensi menjadi solusi dalam mempercepat pemulihan aset tanpa melalui proses eksekusi yang panjang.
