Abstract

This study seeks to explore the role of the political system in supporting the influence of macro variables on economic growth in the world's Islamic countries. Data obtained from the world bank during 2010-2021. The econometric model used in the research is the Generalized Method of Moments (GMM). The main finding is that the political system has a significant negative effect on growth. This negative effect is caused by the low value of the political index determined by world governance indicators. In addition, foreign direct investment and remittances are still the main variables in supporting economic growth in the Islamic countries of the world. In contrast, interest rates show negative effects on economic growth. Further results show that an ineffective political system is unable to strengthen the relationship between foreign direct investment, remittances, and interest rates on economic growth. These findings serve as an evaluation for the 2025 OIC internal implementation action program.AbstrakPraktik Rentenir masih banyak ditemukan di Kabupaten Tanah Datar, dengan berbagai alasan masyarakat masih banyak melakukan pembiayaan pada rentenir, perilaku ini menimbulkan banyak masalah dalam tatanan kehidupan sosial. Penelitian ini bertujuan untuk, pertama: melihat setting sosial maraknya praktik rentenir, kedua: menemukan program/langkah-langkah strategis yang dapat digunakan untuk mencegah maraknya praktik rentenir. Metode penelitian yang dipakai dalam penelitian ini adalah penelitian kualitatif, yaitu proses mencari data dan menyusun secara sistematis, data tersebut diperoleh dari hasil wawancara, catatan lapangan, maupun dokumentasi, dengan cara mengorganisasikan data ke dalam kategori, menjabarkan ke dalam unit-unit, melakukan sintesis, menyusun ke dalam pola, yang diakhiri dengan membuat kesimpulan, sehingga mudah dipahami oleh diri sendiri maupun orang lain. Penelitian yang menyimpulkan bahwa: pertama, Faktor-faktor yang mempengaruhi masyarakat melakkan pembiayaan kepada rentenir adalah karena adanya kebutuhan yang mendesak dan kebutuhan akan modal usaha. Kedua, Faktor-faktor yang melatarbelakangi masih maraknya praktik rentenir di Kabupaten Tanah Datar, yaitu: faktor ekonomi, faktor sosial, faktor informasi dan faktor kemudahan proses. Selanjutnya penelitian ini juga merekomendasikan langkah-langkah strategis pencegahan rentenir yaitu: memaksimalkan pelaksanaan program unggulan Makan Randang di Kabupaten Tanah Datar, mendirikan koperasi berbasis Nagari/Jorong/Komunitas di Kabupaten Tanah Datar dan melakukan pendampingan ekonomi kreatif untuk masyarakat di Kabupaten Tanah Datar.

Abstract

Agricultural goods transactions with toke (in Bahasa is known as a traditional market agent) always carry a weight cutting of one to 2 kilograms per bag. Risk reduction is considered a burden to be borne. Therefore, how to study the law in the aspect of risk imposition when transactions occur between plantation farmers and toke in traditional markets. The aim of this research was to examine how weighing is carried out and the recognition of the weight of agricultural products on scales is associated with possible risks that will occur in the future. This research method was qualitative, field research. Data sources were garden sellers/farmers and toke in traditional markets. Data collection through interviews and examination of artifacts. Data analysis technique was qualitative descriptive. The research finding showed that when the agricultural harvest was sold, there was a scale cut of around 2 kg per bag, such as chilies, ginger, corn and so on. The result of reducing the scale in dealing with the risks that will occur with irregular goods. The risk was borne by the farmer/seller, this was suspected and endangers the continuity of the relationship between farmer, toke, retailer towards objects that change naturally. Cutting the weight of the scales was still permitted as long as it was within appropriate limits. Recommendations for cutting the weight of the scales when changing goods and not fixed goods.

Abstract

Abstract

Cheering the smallest price of several piles of fruit prices is a fruit-selling strategy to get more consumers. This study aims to understand the description of the smallest price cheers on the fruit sales strategy against the view of fiqh muamalah. What attracts buyers so that they decide to buy and how their interest is raised by hearing price cheers. This is field research conducted in Batusangkar Market. The research employed qualitative descriptive research methods and the research data were obtained from sellers and fruit buyers who shout the smallest price cheer. Data retrieval techniques used in-depth interviews and direct observation of buyers. Interviews were conducted face-to-face with the informants until the same information was obtained. The results show that the strategy of cheering the lowest price from several prices based on piles of fruit quality serves as a driving force and attracts consumers. This strategy is closer to bay' najasy which can drive buyers to buy their merchandise. Therefore, buyers or sellers must ensure that the price they are shouting represents the fruit piles that are visible. When a buyer approaches the place of merchandise, he/she could clearly see the goods being traded.

Abstract

This study examined the bainduk samang system in rice huler. The relationship between farmers and rice huler owners in accommodating rice/grain harvesting objects as trade objects. The purpose of how to bainduk samang that provides benefits in economic transactions such as capital, accounts receivable and accompanied by buying and selling between rice huller owners and farmers. Types of field research with descriptive qualitative methods. This research approach is with a phenomenological approach in the cold water community of Koto Tangah Padang. The results of this study show that the motives of farmers to do bainduk samang as a form of farmers' efforts for the sustainability of being able to grow crops. With the cooperation of Bainduk Samang to the owner of Huler. As a result, the contract is carried out with accounts receivable and buying and selling. The form of buying and selling is conditional, that is, it is to be sold to the lender at a price below the market. Abstract

Persoalan penyelesaian sengketa jaminan fidusia pada pelaksanaan akad murabahah, dalam praktek eksekusi sering menimbulkan kegaduhan dan keresahan di tengah-tengah masyarakat Pihak penerima fidusia sering melaksanakan eksekusi sepihak pada objek jaminan tanpa memberitahukan terlebih dahulu kepada pemberi fidusia. Bahkan tak jarang penerima fidusia bertindak arogan dan menarik secara paksa. Di sisi lain, kejadian yang tak kalah menyedihkan yang berujung anarkisme yang mengakibatkan meninggal dunia karena diamuk massa saat mengeksekusi objek jaminan fidusia. Penelitian ini adalah penelitian lapangan yang didukung dengan hukum empiris dengan pendekatan kualitatif. Tujuan penelitian ini untuk melihat bentuk-bentuk penyelesaian sengketa jaminan fidusia pada PT. Mandala Multifinance Cabang Sijunjung, menganalisis efektifitas bentuk-bentuk penyelesaian sengketa serta kendala dalam penerapan bentuk-bentuk penyelesaian sengketa tersebut. Hasil penelitian menunjukkan bahwa dalam penyelesaian sengketa jaminan fidusia pada akad murabahah di PT. Mandala Multifinance Cabang Sijunjung dengan mengedepankan karakteristik masyarakat dan kearifan lokal masyarakat yang elegan dan humanis masih relevan untuk dilaksanakan, sehingga dapat memberikan keseimbangan kedudukan hukum antara kreditur dan debitur guna memprioritaskan keadilan dan kepastian hukum.

Abstract

Baitul Maal wa Tamwil (BMT) is one of the financial institutions engaged in financial services based on sharia principles in carrying out its activities. However, Baitul maal wa tamwil is not uncommon or frequent bad credit disputes committed by customers intentionally or unintentionally. This research is quantitative research, namely field research by exploring data sourced from BMT El Ummu Rahimah Sijunjung Regency, West Sumatra regarding dispute resolution in Baitul Maal Wa Tamwil. The data collected uses field research (Field Research), namely collecting data through interviews, observations and other materials. In resolving bad credit disputes at Baitul maal wa tamwil, there are alternative solutions that must be taken by customers, namely through litigation (in court) and non-litigation (out of court). However, the settlement of bad credit disputes at BMT El Ummu Rahimah is resolved in a non-litigation manner, namely dispute resolution outside the court. There are several steps taken by BMT El Ummu Rahimah in resolving bad credit disputes, namely giving warning letters, providing relief and the existence of settlements made amicably in the event of bad credit by customers. But what is no less important is that BMT El Ummu Rahimah is unable to return the customer's money. So that BMT El Ummu Rahimah was audited and all of its goods were confiscated.

Abstract

This research was motivated by the emergence of electronic contracts, while every contract contains provisions and implementation of khiyar al-majlis, namely the right of the parties to the transaction to choose to continue or cancel a business transaction as long as the parties are still present at the transaction location. Due to the unclear existence and mechanism for implementing khiyar al-majlis in electronic contracts, this research was urgent. The aim of this research was to determine the existence and mechanism for implementing khiyar al-majlis in electronic contracts. The research method used was normative legal research with a systematic legal approach. Researchers use secondary data or legal materials obtained and processed using selective categorization. All of this legal material was grouped based on criteria that were appropriate to the problems and themes, then analyzed descriptively and analytically. The law of khiyar al-majlis was described and analyzed with explanation, study, systematization, interpretation, and evaluation. The results of this research showed that the existence of khiyar al-majlis in electronic contracts was only legal because the parties were not in the same transaction location as in conventional contracts. Then, the mechanism for implementing khiyar al-majlis could occur directly or indirectly in electronic contracts. This study contributes to the development and actualization of Islamic economic law in the digital era.

Abstract

This research examines the application of the principles of fast, simple, and low-cost proceedings in murabahah financing disputes at the Bukittinggi Religious Courts. Specifically, it addresses the issue of declinatory exceptions filed by defendants, which impact the efficiency of the judicial process. These principles are critical for ensuring effective and equitable access to justice. The study aims to analyze the impact of rejecting declinatory exceptions on the trial process in murabahah financing cases. It also evaluates how the principles of fast, simple, and low-cost judicial proceedings are implemented in such disputes. A qualitative research method with a case study approach was employed. Data collection involved analyzing case records, judicial decisions, and related legal principles to understand the implications of declinatory exceptions on court efficiency. The findings indicate that the rejection of the declinatory exception by the panel of judges led to delays in the trial process without valid legal justification. The interim decision, which affirmed the Bukittinggi Religious Court's authority, contradicted the principle of expedited proceedings, thus increasing trial duration and costs. The study concludes that rejecting declinatory exceptions without proper justification undermines the principles of fast, simple, and low-cost trials. Judicial practices should align with these principles to improve efficiency in murabahah financing dispute resolution.

Abstract

This research is based on the requirement to do work that is not in line with the obligation to provide capital, the system of difficulties at the work level needs to be discussed in an obligation that will be fulfilled. In line with this, to increase understanding of workers' rights in agricultural cooperation with a profit sharing system based on the principle of balance when linked to the level of difficulty of the work. This study aims to analyse the forms of rights and obligations in the palm sap processing cooperation, and how the profit sharing of the mukhabarah system is based on the principle of balance. This research is empirical legal research based on a qualitative descriptive with phenomenology. In data collection, researchers conducted interviews with research informants based on interview guidelines. This research was conducted in Nagari Supayang, Tanah Datar Regency, West Sumatra.The results of the study indicate that there is a heavier burden and greater risk to the manager. The work of managing palm sap requires more days, both climbing days and days of processing palm sap. The conclusion is that there is a dominance of workers' rights in profit sharing agricultural cooperation based on the principle of balance where workers get their rights based on the magnitude of the work responsibilities they carry.Keywords: Balance, Mudharabah, Mukhabarah, Profit Sharing, Workers' Rights. AbstrakPenelitian ini dilatarbelakangi oleh adanya kewajiban untuk melakukan pekerjaan yang tidak sejalan dengan kewajiban memberikan modal, maka sistem yang berkaitan dengan kesulitan pada pekerjaan perlu dibahas terutama terkait kewajiban tertentu yang akan dipenuhi. Sejalan dengan hal tersebut, penelitian ini ditujukan untuk meningkatkan pemahaman tentang hak-hak pekerja dalam koperasi pertanian dengan sistem bagi hasil berdasarkan asas keseimbangan apabila dikaitkan dengan tingkat kesulitan pekerjaan. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk hak dan kewajiban dalam koperasi pengolahan nira aren, dan bagaimana pembagian hasil sistem mukhabarah berdasarkan asas keseimbangan. Penelitian ini adalah penelitian hukum empiris berbasis metode deskriptif kualitatif dengan fenomenologi. Dalam pengumpulan data, peneliti melakukan wawancara dengan informan penelitian berdasarkan pedoman wawancara. Penelitian ini dilaksanakan di Nagari Supayang, Kabupaten Tanah Datar, Sumatera Barat. Hasil penelitian menunjukkan bahwa terdapat beban yang lebih berat dan risiko yang lebih besar bagi pengelola. Pekerjaan pengelolaan nira aren membutuhkan hari yang lebih banyak untuk menyelesaikan pekerjaannya, baik hari untuk pendakian maupun hari untuk pengolahan nira aren. Kesimpulannya adalah terdapat dominasi hak pekerja dalam kerjasama pertanian bagi hasil berdasarkan asas keseimbangan dimana pekerja mendapatkan haknya berdasarkan besarnya tanggung jawab pekerjaan yang diembannya.Kata kunci: Bagi Hasil, Hak Pekerja, Keseimbangan, Mudharabah, Mukhabarah.
