Abstract

The presence of the government, which guarantees the availability of halal products and services through the JPH, Law has not provided legal certainty for Muslims to consume halal goods and services because they are still found circulating in the market without certification. This research aims to explore the complexity of problems in implementing JPH. The method used is qualitative with a normative and empirical approach. The analysis was carried out using Lawrence Friedman's legal system theory, which is relevant to Soerjono Soekanto's legal effectiveness theory, Robert W Mockler's legal supervision theory, and Philippe Nonet and Philip Selznick's responsive theory. This research concludes:  first, legal uncertainty is caused by regulatory uncertainty due to rapid regulatory changes without good coordination between stakeholders. Second, a monitoring system that has not been integrated causes technical problems to be resolved slowly. Third, legal culture, such as literacy, knowledge, and legal awareness of the community and business actors, is inadequate. This research contributes as evaluation material in the implementation of JPH because it is comprehensive by using several legal theories as a guide for problem analysis. This evaluation material will have implications for improving the Authority's performance in the future.

Abstract

This study explores economic neglect as a dimension of domestic violence within Indonesian divorce cases, analyzed through the lens of Fatima Mernissi’s Islamic feminist framework. Mernissi’s framework is particularly relevant in Muslim-majority contexts, as it critically challenges patriarchal interpretations of Islamic legal norms that continue to shape family law adjudication. Using a qualitative design that integrates juridical-normative and socio-legal approaches, the study analyzes 16 divorce decisions issued by five Religious Courts in Indonesia between 2016 and 2025. The findings reveal that economic neglect never occurs in isolation: 100% of cases intersect with other forms of violence, including psychological, physical, and social abuse. Three patterns of economic neglect are identified: total neglect (37.5%), partial neglect (43.75%), and neglect accompanied by economic exploitation (18.75%). However, only 18.75% of the cases culminated in the imposition of full economic sanctions, reflecting the limited enforcement of women’s economic entitlements. Significant regional disparities were also found, with courts in East Java demonstrating greater consistency than those in other regions. The study proposes legal reforms, including explicit recognition of economic neglect as an autonomous form of domestic violence in Article 9 of the Act of the Republic of Indonesia Number 23 of 2004 concerning the Domestic Violence Elimination Law (UU PKDRT) and reformulation of Articles 80 and 84 of the Compilation of Islamic Law (KHI). These reforms are intended to reinforce enforceable post-divorce economic responsibilities, advance substantive justice, and foster greater consistency in judicial practice at the national level.

Abstract

This research analyzes the current legal framework governing the rights of a wakif’s heirs under Indonesian waqf law and proposes a model of regulatory reform aimed at enhancing waqf governance and minimizing potential inheritance disputes. The urgency of this research arises from the increasing number of waqf dispute cases brought before Indonesian Religious Courts, many of which involve heirs claiming ownership of assets already pledged as waqf. These disputes reflect ongoing legal uncertainty and the lack of clear regulatory provisions governing heirs’ procedural rights, a condition that risks weakening both the long-term sustainability of waqf management and the overall stability of the legal system. The objectives of this study are twofold: (1) to analyze the normative and socio-legal factors contributing to heirs’ involvement in waqf disputes, and (2) to propose a legal reform framework that clarifies their position within the waqf system. Using a normative juridical method with statutory and conceptual approaches, the study finds that the ambiguity of Law No. 41 of 2004 concerning Waqf, particularly the absence of the term “wakif’s heirs” in Article 6, creates interpretive gaps leading to recurrent ownership claims. To address these issues, this paper proposes revising the Waqf Law to explicitly recognize the limited supervisory rights of heirs while maintaining the sanctity of waqf as perpetual charity. This proposed reform seeks to align the principles of Islamic jurisprudence with national law in order to ensure legal certainty, reduce the potential for disputes, and strengthen the overall effectiveness of waqf governance. The study contributes conceptually by redefining heirs’ legal standing and practically by promoting a conflict-resilient and sustainable waqf ecosystem in Indonesia.

Abstract

The growing number of petitions for marriage annulment and divorce raises a complex legal challenge, as each is grounded in different legal purposes and carries distinct implications. This issue has emerged in several cases before the Religious Courts within the DKI Jakarta High Religious Court jurisdiction, notably Case Number 3000/Pdt.G/2023/PA.JS, where both claims were filed simultaneously. This study aims to analyze the legal construction and judicial reasoning of judges in deciding cumulative applications for annulment of marriage and divorce lawsuits in the Religious Court within the jurisdiction of the DKI Jakarta High Religious Court. This study adopts a descriptive–analytical socio-legal method, drawing on legal construction theory, judicial reasoning, law enforcement principles, and the doctrine of maslahah mursalah to critically analyze judges’ legal reasoning and judicial outcomes. Data were analyzed through normative legal analysis supported by case law. The findings reveal that the legal construction applied by judges in handling the accumulation of annulment and divorce claims prioritizes justice, legal certainty, and human rights protection by harmonizing procedural law with substantive Islamic legal principles. The novelty of this research lies in formulating a coherent legal solution that legitimizes the selective acceptance of claims, enabling courts to resolve procedural conflicts while safeguarding the legal status and post-divorce rights of wives and children. This approach offers a workable judicial framework for adjudicating comparable cases within the Religious Courts.

Abstract

Domestic violence remains a persistent social problem in Indonesia despite the enactment of the Law on the Elimination of Domestic Violence (Law No. 23/2004). The persistent discrepancy between legal norms and their enforcement, evidenced by low reporting levels and reliance on non-legal dispute resolution, signals a crisis of legal legitimacy. This study aims to identify public meaning distortions regarding domestic violence in Pekalongan, Central Java Indonesia and analyze their implications for the delegitimization of the law. Employing a socio-legal approach, data were collected through interviews, observations, and questionnaires involving 50 informants in Pekalongan. The findings identify four principal forms of distortion: domestic violence is perceived as a private family matter (38%), a means of discipline or instruction (20%), a source of social disgrace (18%), or an act that is not considered criminal (14%). Only 10% of informants defined it as a legal crime. Consequently, respondents preferred family mediation (34%) or divorce (26%) over court proceedings (10%). Symbolic Interactionism analysis reveals that social interactions prioritize symbols of family harmony and honor over victims' rights, diverting cases from the judicial system. Viewed through the perspective of Symbolic Interactionism, the study finds that social interactions often prioritize family harmony and social honor over the rights of victims, which ultimately diverts cases from the formal justice system. The study concludes that legal ineffectiveness stems from deep semiotic conflicts, underscoring the need to reconstruct public meanings to align domestic violence with criminal justice principles.

Abstract

This study examines the internalization of Sharia values within secular Turkish society through the maqāṣid al-sharī'ah framework. It focuses specifically on the Naqshbandi Sufi order, one of the most influential Sufi movements in contemporary Turkey. The research is based on qualitative data collected from 12 participants, consisting of Naqshbandi sheikhs, senior disciples, community educators, and active members in Istanbul, Ankara, and Konya. Data were gathered through in-depth interviews, direct observation of dhikr assemblies and community activities, documentary analysis, and review of academic literature and podcasts related to Sufism and Sharia. Content analysis was conducted using four analytic categories: leadership charisma, institutional networks, pedagogical practices, and community-based religious activities. Data validity was strengthened through triangulation across interviews, observations, and documentary sources. The findings reveal that although the Naqshbandi order maintains a strong ethical and spiritual foundation, deeper internalization of Sharia values still requires sustained cross-community dialogue, institutional capacity building, and the development of interpretive frameworks that bridge classical Islamic traditions and modern scholarly frameworks. The study concludes that cultivating sharī‘ah values in a secular national context requires balancing respect for tradition with adaptation to contemporary social challenges, thereby fostering ethical, contextually relevant, contextually relevant, and sustainable forms of spiritual and social practice.

Abstract

This study investigates the dynamics of integrating Islamic Family Law (Fiqh al-Usrah) into Muslim community education within minority contexts in contemporary Japan. Positioned in the interdisciplinary intersection of Islamic Education Studies and Islamic Legal Studies, it explores how legal and ethical principles of Islamic family life are transmitted amid public misconceptions of Islam, linguistic and cultural barriers, and differing levels of individual religious commitment. Using a socio-legal qualitative design with thematic analytical techniques, the research draws on primary data obtained through interviews, observations, and documentation of Muslim community activities, complemented by secondary scholarly  sources. Fieldwork was conducted in Tokyo and Ibaraki between July and August 2024, involving Japanese converts, migrant Muslim families, and mosque administrators. Thematic analysis reveals two dominant patterns: first, families who experience positive religious transformation through strong community engagement; and second, those whose Islamic identity weakens due to secular environments and cultural pressures. The integration process is supported by individual agency, the active role of mosques and Muslim organizations, and culturally embedded religious expression, including arts-based initiatives. Conversely, limited access to formal Islamic education and the socio-cultural  dominance of the non-Muslim majority remain persistent challenges. This study contributes to scholarly discourse on the contextual integration of Islamic law and education in minority contexts. It underscores the importance of systematic, community-based strategies to strengthen Islamic family identity and enhance Muslim minorities' constructive participation in Japanese society.

Abstract

This study seeks to examine the dynamics of Islamic legal reasoning applied by Muhammadiyah and Nahdlatul Ulama (NU) in addressing environmental challenges, with particular attention to the paradox reflected in their acceptance of mining concessions granted by the state. In Indonesia, Muhammadiyah and NU have long played significant roles in environmental discourse through fatwas, congress resolutions, and official statements that emphasize ecological responsibility. However, their recent acceptance of mining concessions raises critical questions regarding moral consistency and the direction of Islamic legal reasoning. This research employs a socio-legal approach by examining official documents issued by both organizations using the combined framework of uṣūl al-fiqh and socio-legal theory. The analysis focuses on patterns of legal reasoning, sources of legitimacy, and the socio-political dynamics shaping institutional ijtihād. The findings indicate that Muhammadiyah predominantly applies a purificatory, normative textual, rational, and systematically organized approach, while Nahdlatul Ulama (NU) demonstrates a more flexible and contextual orientation that is deeply rooted in classical fiqh traditions. Nevertheless, in the context of mining concessions, both organizations exhibit a shift toward pragmatic-economic interpretations of religious texts and maqāṣid al-sharī‘ah. This shift exposes a fundamental tension between normative ideals and political–economic realities, highlighting the susceptibility of Islamic legal reasoning to structural pressures. This article contributes to the advancement of fiqh al-bi’ah within Indonesian Islamic legal scholarship by providing a critical reflection on the future direction of Islamic jurisprudence that maintains a strong commitment to ecological justice while engaging the complexities of contemporary socio-political realities.

Abstract

The crisis of legal culture and the low level of public trust in Indonesia’s legal system suggest that reforms centered on normative and institutional dimensions have failed to address the deeper cultural roots of the problem. One crucial factor that has been relatively overlooked is the role of legal education, particularly Islamic Higher Education, in reproducing or transforming legal cultural orientations. This article examines the patterns, comparative orientation, and socio-legal implications of the legal education curricula at five Islamic higher education institutions, namely UIN Syarif Hidayatullah Jakarta, UIN Sunan Kalijaga Yogyakarta, UIN Maulana Malik Ibrahim Malang, Universitas Muhammadiyah Yogyakarta (UMY), and Universitas Nahdlatul Ulama Indonesia (UNUSIA), during the period 2020–2025. This research uses a socio-legal approach with a comparative method based on an analysis of official curriculum documents, including course structure, credit distribution, graduate learning outcomes, and course plans. The findings indicate the dominance of a normative-formalistic orientation in the legal curriculum, both in the country's positive law and in Islamic jurisprudence. Comparatively, UIN Sunan Kalijaga is relatively the most progressive thru its interdisciplinary-sociolegal approach, followed by UMY with a reformist-social orientation, while UIN Malang emphasizes the ethical-spiritual dimension. Conversely, UIN Jakarta and UNUSIA tend to maintain a formalistic-doctrinal curriculum structure. However, all these innovations are additive and have not yet resulted in a structural repositioning of the core curriculum. Theoretically, this research places Lawrence Friedman's theory of legal culture as the main framework, enriched by Pierre Bourdieu's theory of cultural capital, maqāṣid al-sharīʿah, and Amin Abdullah's integrative-interconnectedness paradigm. This article underscores the need to reposition Islamic legal education curricula so that they are oriented toward substantive justice and the transformation of legal culture.
