Abstract

Strengthening the normative foundation and maqāṣid orientation of Indonesia’s religious court system allows it to render fair judgments for the parties while safeguarding the future of children. While Islamic family law is often studied normatively, limited attention is given to its lived application in plural legal settings. Using a descriptive qualitative approach with socio-legal and phenomenological methods, data were collected through purposive sampling of 20 participants, including traditional leaders, religious figures, and village officials. Field observations and the analysis of local documents, including customary manuscripts, sermons, and marriage records, serve to complement the data. The findings reveal that family resilience emerges from a dynamic interplay between Islamic and customary norms, particularly in areas like inheritance, marriage, and gender roles. Integration of maqāṣid al-sharī‘ah occurs through contextual reinterpretation aligned with communal structures and values. Differences between the communities are notable in the role of traditional authority, the interpretation of qiwāmah, and dispute resolution mechanisms. This study contributes to the discourse on Islamic legal pluralism by presenting a contextual model of normative integration. It highlights the potential of a culturally grounded and adaptive Islamic legal framework to strengthen sustainable family systems across diverse local contexts.

Abstract

This study explores the social reality surrounding discrepancies in Qibla direction among mosques in Palembang City, which, based on astronomical and scientific assessments, have proven to be inaccurate. The research aims to analyze community responses to these directional inconsistencies and to propose solutions that integrate modern technology and astronomical science into religious practice in a more thoughtful and contextually sensitive manner. Employing a sociological framework rooted in ethnographic and cultural anthropological approaches, the study collected data through Qibla recalibration observations, in-depth interviews, and literature review. The findings were analyzed using a descriptive qualitative method, complemented by astronomical and scientific perspectives. The results reveal that the misalignment of Qibla direction in many mosques largely stems from reliance on approximate traditional methods (taqribi), shaped by local wisdom, and from limited understanding of precise astronomical calculations and digital calibration tools. Nevertheless, the community exhibits a socially harmonious and religiously tolerant stance, prioritizing Islamic brotherhood (ukhuwah Islamiyah) over strict alignment with the Shafi'i school’s doctrinal precision. As a constructive step forward, this study suggests the need for community-based astronomical education and hands-on training in Qibla calibration applications. Such efforts can help improve directional accuracy while preserving social cohesion and preventing potential conflicts within religious communities.

Abstract

This study investigates the operations of unlicensed zakat institutions, with particular attention to problems such as the absence of accountable reporting, the misallocation of zakat funds away from legitimate beneficiaries (mustahik), and the emergence of fraudulent claimants (jockeys). This study adopts a qualitative approach with an exploratory design to understand the phenomenon of zakat institutions' non-compliance with sharia principles, particularly in the context of legality and governance. The findings reveal structural and operational shortcomings contributing to non-compliance and misalignment with existing policies. The study advocates a shift in research orientation from predominantly ritualistic dimensions toward justice-oriented and religiously humanist policy frameworks. It emphasizes the need to prioritize equitable distribution over technocratic classifications of mustahik while resisting communal or political domination, particularly in political networks. The politicization of zakat, particularly in the context of the 2024 election, has undermined its spiritual and social objectives. Ensuring compliance with sharī‘ah principles is therefore crucial for establishing legal certainty, strengthening public trust, and enabling zakat to realize its full potential as a transformative instrument for community empowerment in Indonesia.

Abstract

Kafā’ah (equivalence) constitutes a fundamental principle in Islamic marriage law, aimed at ensuring compatibility between the bride, the groom, and their respective guardians. In East Java, this principle intersects with the cultural practice of calculating weton a Javanese astrological system used to predict harmony and marital success demonstrating how religion and local traditions converge in shaping marital norms. This study aims to analyze the integration of weton practices into the concept of kafā’ah within the socio-legal framework of Islamic marriage law in Indonesia. Employing a qualitative approach, it draws on socio-legal analysis of primary Islamic legal sources, local customs, and state regulations. The data were obtained through document analysis, literature review, and interviews with religious leaders and community figures in East Java. The findings reveal that weton calculation is widely regarded as a cultural expression of kafā’ah, reflecting communal efforts to preserve marital harmony. Although rooted in tradition, it is often interpreted through a religious lens, thereby shaping community perceptions of marriage readiness. This dynamic interplay between Islamic jurisprudence and Javanese wisdom not only sustains local traditions but also enriches the understanding of compatibility in Indonesian marriage law. The study emphasizes the importance of incorporating cultural context into legal development, illustrating how practices such as weton serve to bridge the normative framework of Islamic law with the socio-cultural realities of Indonesia.

Abstract

The backpacker umrah phenomenon reflects the community’s aspiration to perform worship in a more flexible and economical manner, yet it simultaneously generates serious concerns from both positive law and sharī’ah perspectives, as it is conducted outside the framework of official state mechanisms. This study analyzes backpacker Umrah from the perspective of Maqashid al-Shariah and legal sociology and offers ideal regulations that protect pilgrims. This research is an empirical legal study that uses primary data from a Google Form questionnaire to analyze the reasons and objectives of pilgrims performing Umrah as backpackers, supported by legal materials in the form of statutory regulations. The research findings demonstrate that the phenomenon of backpacker umrah embodies broader social dynamics and represents community responses to economic constraints and technological developments, as pilgrims increasingly opt for a more flexible and affordable mode of worship. In the perspective of legal sociology and maqashid asy-syariah, this practice demonstrates a culturally legitimate social construction, but it creates tension with formal regulations, particularly in aspects of security, legal protection, and compliance with legislation. Although it provides benefits to some segments of society, backpacker umrah still carries potential harms that need to be addressed proportionally. Based on the findings of this study, it is recommended that regulations governing ḥajj and umrah be more effectively organized to prevent long queues for pilgrims, and that specific provisions addressing backpacker umrah be formulated to ensure legal protection, along with guarantees of safety and comfort for those undertaking the pilgrimage independently.

Abstract

The social justification for the practice of forced marriage among adolescents engaged in premarital sexual activity reveals a clear contradiction between prevailing social norms and the principles of Islamic law. However, this phenomenon tends to be overlooked in previous studies. In addition to responding to the shortcomings of existing studies, this study also aims to explain the characteristics of forced marriage practices for adolescents who engage in sexual activity outside of marriage. This research is a descriptive qualitative study that uses a case study approach. The findings indicate that forced marriage among adolescents is frequently employed as a means of safeguarding both individual and familial honor within the prevailing social value system of the community. There are three main findings that support this conclusion. First, the decision to arrange a forced marriage is usually made by the family without considering the teenager's personal wishes. Second, the reason this practice is accepted by the community is because it is believed to uphold shared moral values and standards of proper behavior. Third, the controversies that arise reflect the contradictions between the social system and the principles of Islamic law. The significance of this study rests in its contribution to enriching the discourse of Islamic law through a social reality-based approach, thereby creating space for contextual reinterpretation of the law with an emphasis on the welfare of its subjects.

Abstract

This study examines the quasi-judicial authority of the General Election Supervisory Agency (Bawaslu) in handling administrative violations and disputes related to the electoral process, using das sollen and fiqh siyasah as the analytical framework. Bawaslu’s authority is formally designed to reinforce legal certainty, yet its implementation still reveals significant imbalances. Evidence from practice shows inconsistencies between the normative dimension (das sollen) and the empirical reality (das sein), indicating that Bawaslu’s institutional role as a quasi-judicial body continues to leave room for suboptimal law enforcement. The research applies a normative-comparative approach with case studies in Indonesia, Mexico, Costa Rica, and the Philippines. The analysis highlights the urgency of reconstructing Indonesia’s electoral legal system, particularly Article 462 of Law No. 7 of 2017 on General Elections, so that Bawaslu’s decisions acquire executorial power. Comparative findings reveal that Costa Rica, Mexico, and the Philippines have independent and robust electoral courts whose rulings are final and binding. Viewed from the perspective of fiqh siyasah, electoral justice is not limited to legal-formal mechanisms but also encompasses substantive justice that fulfills the function of hisbah (oversight) and safeguards the constitutional rights of citizens (hifz al-huquq).

Abstract

The division of marital property often presents a complex legal dilemma. Greater judicial evaluation usually considers acquisition timing, sources, and separation agreements. Nevertheless, the recent Indonesian jurisprudence, especially the Supreme Court Circular Letter (SEMA) No. 1/2022 and Cassation Decision No. 377 K/Ag/2023 (5 April 2023), requires the introduction of the principle of the best interests of a child, as stipulated in the Child Protection Act, to the adjudication of marital property. This study adopts a qualitative documentary analysis that draws upon primary legal sources, including statutes, circular letters, and court decisions, and is supplemented by secondary academic literature. The analysis demonstrates how normative rules and jurisprudence integrate the child’s best interest into post-divorce asset allocation. The results indicate that a child’s welfare has become a necessary pillar in judicial reasoning, influencing courts to postpone the distribution of marital assets until children reach adulthood. This normative and jurisprudential shift highlights not only legal enforcement but also substantive justice, ensuring children’s decent living conditions. This research contributes by elucidating the legal significance of Decision 377 K/Ag/2023, which reinforces the role of the best interests principle in Indonesian family law and advances a progressive approach to the adjudication of marital disputes.

Abstract

Corruption, as an extraordinary crime, necessitates the application of a reversed burden of proof mechanism. However, its procedural implementation remains problematic and potentially infringes upon the rights of the accused. The urgency of this study lies in the need for a balanced legal reformulation, one that strengthens the effectiveness of anti-corruption efforts while upholding the Islamic conception of justice, particularly the principle of ḥifẓ al-māl (protection of wealth) as an essential element of maqāṣid al-syarī‘ah. This research analyzes theories of criminal evidence, the presumption of innocence, and the balanced probability principle, and further compares them with legal practices in other jurisdictions. The study employs a normative-juridical method combined with statutory, case, comparative, sociological, and futuristic approaches. Primary, secondary, and tertiary legal materials are examined through deductive and inductive reasoning. The findings reveal the necessity of legal reconstruction of Article 37 of the Anti-Corruption Law and Article 77 of the Anti-Money Laundering Law to address legal gaps and to provide procedural guidelines for the application of the reversed burden of proof by prosecutors, defendants, and judges. The existing mechanism lacks standardized evidentiary parameters, resulting in an imbalance between the prosecution and the defense. Instruments such as the State Officials’ Wealth Report (LHKPN) have the potential to strengthen evidentiary processes, yet remain underutilized. Therefore, a legal reformulation is required to establish clear procedural guidelines that integrate the balanced probability principle with the values of maqāṣid al-syarī‘ah. The study recommends revising the Anti-Corruption Law, synchronizing it with the new Criminal Code, and enhancing justice- and welfare-oriented legal instruments.
