Abstract

Pengabdian kepada masyarakat terintegrasi dengan KKM Online (Kuliah Kerja Mahasiswa) Universitas SultanAgeng Tirtayasa. Yang bertujuan untuk meningkatkan daya tarik wisatawan untuk datang ke wisata yang ada diWewengkon Adat Kesepuhan Citorek. Strategi pengembangan wisata di Wewengkon Adat Kesepuhan Citorekmenjadi salah satu sektor yang sangat penting dalam keeksistensian suatu daerah, semakin terkenalnya wisataitu maka akan semakin dikenal pula daerah tersebut. Namun sejak adanya pandemic Covid-19 sektor pariwisatamenjadi terabaikan karena para wisatawan yang semakin sedikit untuk bepergian apalagi sejak adanya PSBB(Pembatasan Sosial Berskala Besar) hingga adanya PPKM (Pemberlakuan Pembatasan Kegiatan Masyarakat).Wisata alam yang ada di Wewengkon Adat Kesepuhan Citorek sendiri meliputi Gunung Luhur (Negri DiatasAwan), Gunung Keneng dan Kebun Stawberry. Daya tarik wisatawan dalam sektor wisata tentunya harusditingkakan supaya perekonomian masyarakat sekitar pulih kembali maka dari itu dibutuhkan suatu strategiyang dapat menarik wisatawan untuk datang ke wisata tersebut, banyak fasilitas–fasilitas yang harus ditambahkan seperti spot poto, fasilitas tempat camping, kamar mandi, sofenir, makanan khas Wewengkon AdatKesepuhan Citorek,dan juga perbaikan infrastrukturjalan.Untuk memperkenalkan wisatayang ada diWewengkon Adat Kesepuhan Citorek ini kita dapat mempromosikannya melalui sosial media yang ada, sepertiYoutube, Facebook, Instagram, Twitter, Tiktok yang dikelola resmi oleh pihak pengelola wisata yang ada diWewengkon Adat Kesepuhan Citorek serta adanya parsitifasi mahasiwa KKM kelompok 4 Desa CitorekSabrang sendiri, pembuatan Video Vlog wisata menjadi salah satu kegiatan yang masuk ke dalam programutama dalam bidang tata kelola pemerintahan yang dilakukan oleh mahasiswa KKM kelompok 4 Desa CitorekSabrang.

Abstract

Human rights abuses occurring in Gaza, including civilian casualties, have been countlessly reported. Despite numerous resolutions presented, particularly to the United Nations (UN) Security Council (UNSC), data from the UN reveals that they have unfortunately been vetoed. South Africa initiated a legal action before the International Court of Justice (ICJ) accusing Israel of breaching the 1948 Genocide Convention—a treaty to which both nations are Parties to. Based on doctrinal analysis, this paper raises one big question; whether the UNSC, that is supposed to uphold international peace and security, will become a stumbling block in the quest for justice for the Palestinian and fails to serve its purpose? This paper argues that judging from Netanyahu’s statement that Israel will not follow and perform any ICJ’s decisions and the United States, being one of the UNSC permanent members will use any necessary measures within the UNSC to prevent such decision from being enforced. This paper concludes that the veto power within the UNSC hinders the pursuit of justice for the Palestinians and the ability of certain member states to veto resolutions creates challenges in the Council’s effectiveness and compromises its capacity to address the conflict for the pursuit of justice.

Abstract

Efforts to improve access to and quality of education remain critical, yet gaps persist between theoretical initiatives and practical implementation, particularly in underdeveloped and marginalized regions. This study addresses the urgent need to enhance community awareness of education’s significance in navigating the challenges of globalization. Through community education and qualitative data collection, innovative strategies are introduced to engage local communities and promote active participation in educational activities. The approach emphasizes revitalizing educational awareness by identifying effective practices, implementing targeted interventions, and systematically evaluating their outcomes. These efforts aim to bridge the gap between awareness and action, fostering a culture of education that drives social and economic progress. By strengthening community involvement and improving the understanding of education’s transformative potential, this initiative contributes to sustainable development and positions education as a cornerstone for empowering future generations in an increasingly globalized world.

Abstract

This study aims to examine the criminal law provisions governing the arrest of Ananda Badudu as a crowdfunding-based fundraiser, as well as the criminal law defenses for Ananda Badudu as a crowdfunding-based fundraiser. The novelty of this study is to analyze the legal protection of the Anand Badudu case as a fundraiser on student protest in 2019. This study was conducted utilizing a normative legal approach. The result of this research are: The arrest of Ananda Badudu by the police was an arbitrary act as it was not in accordance with the provision contained therein The Code of Criminal Procedure as well as the Chief of Police Regulation that has resulted in a violation of human rights. That act alone is considered arbitrary and Ananda Badudu must get legal protection in accordance with the laws and regulations. One of the grounds why legal protection must be pledged is to create legal certainty.Penelitian ini bertujuan untuk mengkaji mengenai ketentuan hukum pidana tentang penangkapan Ananda Badudu sebagai penggalang donasi berbasis crowdfunding dan mengkaji tentang perlindungan hukum pidana terhadap Ananda Badudu sebagai penggalangan donasi berbasis crowdfunding. Kebaharuan penelitian ini adalah untuk menganalisis perlindungan hukum kasus Ananda Badudu sebagai fundraiser dalam kegiatan crowdfunding pada aksi mahasiswa tahun 2019. Penelitian ini menggunakan pendekatan yuridis empiris. Hasil penelitian ini adalah sebagai berikut: Penangkapan yang dilakukan oleh polisi terhadap Ananda Badudu tidak sesuai dengan prosedur yang sudah diatur di dalam undang-undang baik di dalam KUHAP maupun Perkapolri, sehingga menyebabkan suatu pelanggaran hak asasi manusia dan merupakan perbuatan sewenang-wenang serta Ananda Badudu harus mendapatkan perlindungan hukum sesuai dengan peraturan perundang-undangan. Salah satu alasan mengapa perlindungan hukum harus diberikan ialah agar menciptakan suatu kepastian hukum.

Abstract

In the practice the maritime boundary delimitations can cause the overlap of claims between states with opposite or adjacent coasts. Regarding the maritime boundary between Indonesia and Timor-Leste, there was never a maritime boundary between both States, so it needs a settlement of disputes of maritime boundary delimitation between both parties. Therefore, these research aims to explain the methods and principles that could be used in resolving maritime boundary delimitation dispute between state with opposite or adjacent coasts based on international law and analyze how obstacles and solution to solve maritime boundary delimitation dispute between Indonesia and Timor-Leste (East Timor). This research uses normative legal research and Empirical Research Methods. The results of the research show that: (1) the maritime boundary delimitation between Indonesia and Timor-Leste uses enclaving, equidistant, and three-step approach method. (2), Indonesia and Timor Leste have the potential to determine maritime boundaries in the three areas, namely the area to the north of the Oecusse (Ombai Strait), to the north of Timor Island (Wetar Strait) and to the south of Timor Island (Timor Sea). Timor-Leste will still get a maritime territory in District Oecusse but the extent would be negotiated with Indonesia first, while in the Wetar Strait, the territorial sea division of the two countries would consider the outer islands of both countries.

Abstract

This study analyzes effect of European Union's implementation economic embargo on Russia after Russian invasion of Ukraine. Embargoes imposed was stoppage imports of petroleum and natural gas  from Russia. This situation  impact of circulation oil and natural gas prices on global market because Russia is the world's largest supplier oil and natural gas. The purpose study is to analyze effect of  implementation Russian embargo on international trade sector and examine impact implementation embargo sanctions on Russian economy. The research methodology used is normative juridical. The results show that implementation of embargo against Russia will trigger escalation the price of crude oil and natural gas which are becoming scarce on the global market and significantly reduce availability of grain, wheat, barley and corn commodities while for Russia this case cause increase inflation due to Russia lost most of its shares in international markets.

Abstract

On July 12 2019, there was a pipe leak and a gas bubble oil spill belonging to PT Pertamina. PT Pertamina's pipeline leak in Karawang waters which has an impact from the oil spill threatens the ecosystem and the people around Karawang waters. Marine pollution cannot be seen only as a problem that occurs in the sea, because the oceans and land are an ecosystem unit that cannot be separated and are affected by one another. As a result of this incident, a problem arose regarding PT Pertamina's legal liability due to a pipe leak that caused marine pollution in Karawang waters. This research uses the normative juridical method. The purpose of this research is to find out the regulation of marine pollution actions carried out by PT Pertamina in the offshore area and to analyze the form of accountability. The results of the study can be concluded, firstly, that the regulation of marine pollution actions based on UNCLOS 1982 is contained in Articles 192, 194, 195, 196 and Law Number 32 of 2009 concerning Environmental Protection and Management. Secondly, in the form of liability for marine environmental pollution as a result of PT Pertamina's oil spill, there are three legal responsibilities (administrative liability, civil liability, and criminal liability).Keywords: Marine Pollution, Oil Spills, Accountability, UNCLOS 1982.

Abstract

Indonesia’s location between the Indian and Pacific Oceans positions it as a crucial maritime route, thereby revealing significant maritime opportunities. This strategic location also presents significant vulnerabilities, especially from foreign vessels involved in unlawful activities, including illegal, unreported, and unregulated (IUU) fishing. IUU fishing represents a widespread issue that threatens regional security and the sustainability of marine ecosystems, ultimately impacting food security and economic viability.  This research adopts a normative legal methodology, incorporating an extensive literature review to examine the philosophical underpinnings and regulatory benchmarks pertinent to Indonesia's enforcement framework addressing IUU fishing.  This analysis scrutinizes current legal resources and explores the intricate dynamics of overlapping jurisdictions among maritime agencies, intensifying enforcement inefficiencies and generating operational uncertainties. This study proposes implementing the Single Agency Multi-Tasks (SAMT) system as a comprehensive approach to enhance law enforcement efforts targeting foreign vessels involved in IUU fishing within Indonesia's Fisheries Management Areas (FMAs), considering the existing challenges.  The SAMT framework aims to centralize authority within the Marine Security Agency (BAKAMLA) to streamline operations and improve regulatory compliance, ultimately contributing to a strong maritime governance structure. The results highlight the importance of implementing legal reforms and establishing coordinated governance mechanisms by national and international maritime regulations. This study significantly enhances the discussion surrounding optimizing fisheries management and reinforcing Indonesia’s sovereignty in its maritime areas while also tackling the widespread challenges IUU fishing activities present.

Abstract

This article examines the urgency of legal reform to enhance investor protection in Indonesia’s crypto asset market, emphasizing the regulatory uncertainty that obscures legal liability in cases of system failure, unilateral platform closure, or investor losses. This research adopts descriptive research specifications, using normative juridical research, using two methods of statutory and comparative approaches. Data collection is done through literature review and then analyzed through qualitative method. The findings reveal that Indonesia’s legal system still relies heavily on individual civil claims based on Article 1365 of the Civil Code, without anticipatory legal instruments. Drawing from MiCA’s best practices, this article highlights the need for prescriptive, risk-based, and investor-oriented legal principles to build a fair and legally certain digital ecosystem.

Abstract

Abstract: This article discusses legal provisions regarding the criminal act of trafficking in persons between Indonesia and China with the mail-order bride mode, which has recently occurred in various regions in Indonesia, and the criminal responsibility of the perpetrators of the trafficking in persons. The primary sources of this research are Law No. 21 of 2007 on the Eradication of Human Trafficking, the Criminal Law of the People’s Republic of China, Law No. 13 of 2017 concerning the Ratification of the Agreement between the Republic of Indonesia and the People’s Republic of China regarding Extradition, and the results of interviews with various party. The secondary sources come from scientific works that study or are related to the object of this research. Using juridical-empirical approach, this study results indicate that the criminal act of trafficking in persons with the order mode of the bride and groom between men with Chinese citizenship and women with Indonesian citizenship was committed by several parties, including Indonesian agents, Chinese agents, mail-order bride service users, and intermediary parties (makcomblang). The perpetrators of the crime of trafficking persons who are in Indonesia can be subject to criminal sanctions as stipulated in Law No. 21 of 2007 on the Eradication of Human Trafficking. Meanwhile, perpetrators who are domiciled in China can be subject to criminal sanctions through extradition based on an extradition agreement between China and Indonesia (July 1, 2009) which has been ratified by Law No. 13 of 2017 concerning the Ratification of the Agreement between the Republic of Indonesia and the People’s Republic of China regarding Extradition. Abstrak: Artikel ini mengkaji ketentuan hukum tentang tindak pidana perdagangan orang antara Indonesia dan Cina dengan modus pengantin pesanan yang akhir-akhir ini banyak terjadi di berbagai daerah di Indonesia dan  pertanggungjawaban pidana para pelaku tindak pidana perdagangan orang tersebut. Sumber utama penelitian ini adalah Undang-Undang Nomor 21 Tahun 2007 tentang Tindak Pidana Perdagangan Orang (TPPO), Criminal Law of the People’s Republic of China, Undang-Undang Nomor 13 Tahun 2017 tentang Pengesahan Persetujuan antara Republik Indonesia dengan Republik Rakyat Cina, dan hasil wawancara dengan berbagai pihak. Adapun sumber sekundernya berasal dari karya-karya ilmiah yang mengkaji atau berkaitan dengan objek penelitian ini. Menggunakan pendekatan yuridis-empiris, penelitian ini menemukan bahwa tindak pidana perdagangan orang dengan modus pengantin pesanan antara laki-laki berkewarganegaraan Cina dengan perempuan berkewarganegaraan Indonesia dilakukan oleh beberapa pihak, yang meliputi agen Indonesia, agen Cina, pengguna jasa pengantin pesanan, dan pihak perantara (makcomblang). Para pelaku tindak pidana perdagangan orang yang berada di Indonesia ini dapat dikenai sanksi pidana sebagaimana diatur dalam Undang-Undang Nomor 21 tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Sementara para pelaku yang berkedudukan di negara Cina dapat dikenai sanksi pidana melalui pemberlakuan ekstradisi berdasarkan persetujuan ekstradisi antara Cina dan Indonesia (1 Juli 2009) dan telah disahkan dengan Undang-Undang Nomor 13 Tahun 2017 tentang Pengesahan Persetujuan antara Republik Indonesia dengan Republik Rakyat Cina.
