Abstract

This study analyzes effect of European Union's implementation economic embargo on Russia after Russian invasion of Ukraine. Embargoes imposed was stoppage imports of petroleum and natural gas  from Russia. This situation  impact of circulation oil and natural gas prices on global market because Russia is the world's largest supplier oil and natural gas. The purpose study is to analyze effect of  implementation Russian embargo on international trade sector and examine impact implementation embargo sanctions on Russian economy. The research methodology used is normative juridical. The results show that implementation of embargo against Russia will trigger escalation the price of crude oil and natural gas which are becoming scarce on the global market and significantly reduce availability of grain, wheat, barley and corn commodities while for Russia this case cause increase inflation due to Russia lost most of its shares in international markets.

Abstract

On July 12 2019, there was a pipe leak and a gas bubble oil spill belonging to PT Pertamina. PT Pertamina's pipeline leak in Karawang waters which has an impact from the oil spill threatens the ecosystem and the people around Karawang waters. Marine pollution cannot be seen only as a problem that occurs in the sea, because the oceans and land are an ecosystem unit that cannot be separated and are affected by one another. As a result of this incident, a problem arose regarding PT Pertamina's legal liability due to a pipe leak that caused marine pollution in Karawang waters. This research uses the normative juridical method. The purpose of this research is to find out the regulation of marine pollution actions carried out by PT Pertamina in the offshore area and to analyze the form of accountability. The results of the study can be concluded, firstly, that the regulation of marine pollution actions based on UNCLOS 1982 is contained in Articles 192, 194, 195, 196 and Law Number 32 of 2009 concerning Environmental Protection and Management. Secondly, in the form of liability for marine environmental pollution as a result of PT Pertamina's oil spill, there are three legal responsibilities (administrative liability, civil liability, and criminal liability).Keywords: Marine Pollution, Oil Spills, Accountability, UNCLOS 1982.

Abstract

Corruption in Indonesia has occurred at all levels of society as if corruption in Indonesia is never-ending to be discussed. Many law enforcers are involved in corruption, causing a community confidence crisis. Regardless, on the other hand, society is also apathetic and permissive towards criminal acts of corruption; society is also a contributor to corruption, especially in the implementation of the general and regional elections. It happens because of the perception that money politics is a natural thing in an imperfect democracy. This condition occurs because it is supported by the weak legal substance related to the crime of corruption. The weak legal substance is caused by legislative process errors, resulting in errors at the application and execution stages. So, it is necessary to examine the model of drafting laws related to the crime of corruption using normative juridical methods, namely analysing various laws related to the crime of corruption with a comparative approach by comparing the model of Indonesia's and Malaysia's anti-corruption laws drafting. The results showed that the drafting of corruption crimes in Indonesia is spread in several laws that can potentially cause disparities in justice. On the other hand, the drafting model of corruption crimes in Indonesia is carried out by separating the Criminal Code from the anti-corruption law, while in Malaysia, the drafting of the anti-corruption law is mutually reinforcing with the Penal Code.

Abstract

Indonesia’s location between the Indian and Pacific Oceans positions it as a crucial maritime route, thereby revealing significant maritime opportunities. This strategic location also presents significant vulnerabilities, especially from foreign vessels involved in unlawful activities, including illegal, unreported, and unregulated (IUU) fishing. IUU fishing represents a widespread issue that threatens regional security and the sustainability of marine ecosystems, ultimately impacting food security and economic viability.  This research adopts a normative legal methodology, incorporating an extensive literature review to examine the philosophical underpinnings and regulatory benchmarks pertinent to Indonesia's enforcement framework addressing IUU fishing.  This analysis scrutinizes current legal resources and explores the intricate dynamics of overlapping jurisdictions among maritime agencies, intensifying enforcement inefficiencies and generating operational uncertainties. This study proposes implementing the Single Agency Multi-Tasks (SAMT) system as a comprehensive approach to enhance law enforcement efforts targeting foreign vessels involved in IUU fishing within Indonesia's Fisheries Management Areas (FMAs), considering the existing challenges.  The SAMT framework aims to centralize authority within the Marine Security Agency (BAKAMLA) to streamline operations and improve regulatory compliance, ultimately contributing to a strong maritime governance structure. The results highlight the importance of implementing legal reforms and establishing coordinated governance mechanisms by national and international maritime regulations. This study significantly enhances the discussion surrounding optimizing fisheries management and reinforcing Indonesia’s sovereignty in its maritime areas while also tackling the widespread challenges IUU fishing activities present.

Abstract

This article examines the urgency of legal reform to enhance investor protection in Indonesia’s crypto asset market, emphasizing the regulatory uncertainty that obscures legal liability in cases of system failure, unilateral platform closure, or investor losses. This research adopts descriptive research specifications, using normative juridical research, using two methods of statutory and comparative approaches. Data collection is done through literature review and then analyzed through qualitative method. The findings reveal that Indonesia’s legal system still relies heavily on individual civil claims based on Article 1365 of the Civil Code, without anticipatory legal instruments. Drawing from MiCA’s best practices, this article highlights the need for prescriptive, risk-based, and investor-oriented legal principles to build a fair and legally certain digital ecosystem.

Abstract

Abstract: This article discusses legal provisions regarding the criminal act of trafficking in persons between Indonesia and China with the mail-order bride mode, which has recently occurred in various regions in Indonesia, and the criminal responsibility of the perpetrators of the trafficking in persons. The primary sources of this research are Law No. 21 of 2007 on the Eradication of Human Trafficking, the Criminal Law of the People’s Republic of China, Law No. 13 of 2017 concerning the Ratification of the Agreement between the Republic of Indonesia and the People’s Republic of China regarding Extradition, and the results of interviews with various party. The secondary sources come from scientific works that study or are related to the object of this research. Using juridical-empirical approach, this study results indicate that the criminal act of trafficking in persons with the order mode of the bride and groom between men with Chinese citizenship and women with Indonesian citizenship was committed by several parties, including Indonesian agents, Chinese agents, mail-order bride service users, and intermediary parties (makcomblang). The perpetrators of the crime of trafficking persons who are in Indonesia can be subject to criminal sanctions as stipulated in Law No. 21 of 2007 on the Eradication of Human Trafficking. Meanwhile, perpetrators who are domiciled in China can be subject to criminal sanctions through extradition based on an extradition agreement between China and Indonesia (July 1, 2009) which has been ratified by Law No. 13 of 2017 concerning the Ratification of the Agreement between the Republic of Indonesia and the People’s Republic of China regarding Extradition. Abstrak: Artikel ini mengkaji ketentuan hukum tentang tindak pidana perdagangan orang antara Indonesia dan Cina dengan modus pengantin pesanan yang akhir-akhir ini banyak terjadi di berbagai daerah di Indonesia dan  pertanggungjawaban pidana para pelaku tindak pidana perdagangan orang tersebut. Sumber utama penelitian ini adalah Undang-Undang Nomor 21 Tahun 2007 tentang Tindak Pidana Perdagangan Orang (TPPO), Criminal Law of the People’s Republic of China, Undang-Undang Nomor 13 Tahun 2017 tentang Pengesahan Persetujuan antara Republik Indonesia dengan Republik Rakyat Cina, dan hasil wawancara dengan berbagai pihak. Adapun sumber sekundernya berasal dari karya-karya ilmiah yang mengkaji atau berkaitan dengan objek penelitian ini. Menggunakan pendekatan yuridis-empiris, penelitian ini menemukan bahwa tindak pidana perdagangan orang dengan modus pengantin pesanan antara laki-laki berkewarganegaraan Cina dengan perempuan berkewarganegaraan Indonesia dilakukan oleh beberapa pihak, yang meliputi agen Indonesia, agen Cina, pengguna jasa pengantin pesanan, dan pihak perantara (makcomblang). Para pelaku tindak pidana perdagangan orang yang berada di Indonesia ini dapat dikenai sanksi pidana sebagaimana diatur dalam Undang-Undang Nomor 21 tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Sementara para pelaku yang berkedudukan di negara Cina dapat dikenai sanksi pidana melalui pemberlakuan ekstradisi berdasarkan persetujuan ekstradisi antara Cina dan Indonesia (1 Juli 2009) dan telah disahkan dengan Undang-Undang Nomor 13 Tahun 2017 tentang Pengesahan Persetujuan antara Republik Indonesia dengan Republik Rakyat Cina.

Abstract

Abstract: According to General Explanation of Presidential Decree No. 1/PNPS/ 1965 on Prevention of Misuse and/or Blasphemy, there are six religions in Indonesia. There are Islam, Kristen, Katolik, Hindu, Budha, and Khong Cu (Confucius). It raises the issue of Indonesian who choose conscience or religions out of the six religions. One example is the Ahmadiyya Muslim Community who choose their conscience. Ahmadiyya Muslim Community often received public rejection and some limitations from the Government of Indonesia.  This paper aims to: (1) examine and analyze the international instrument about the limitation in the right to freedom of thought, conscience, and religion (Forum externum); (2) observe and value the limitation in the right to freedom of thought, conscience, and religion (Forum externum) in Indonesia (Ahmadiyya Muslim Community case). Deploying normative legal research, this research argues that the limitations in religious activities and sealing of several places of worship of the Ahmadiyya Muslim Community by the Government have a legal basis in the international law of externum forum principle and that- the Government limitation on religious activities of Ahmadiyya Muslim community is designed and applied to protect public safety, order, health, or morals or the fundamental rights and freedoms of others. Abstrak: Berdasarkan Penjelasan Umum Penetapan Presiden Republik Indonesia No. 1/PNPS/1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama. Hanya Ada 6 agama di Indonesia yaitu Islam, Kristen, Katolik, Hindu, Budha dan Khonghucu (Confusius). Pembatasan enam agama tersebut menimbulkan persoalan mengenai bagaimana warga negara Indonesia yang memilih kepercayaan atau agama selain dari ke enam agama tersebut, seperti kelompok Muslim Ahmadiyya yang memiih kepercyaannya sendiri. Kelompok Muslim Ahmadiyya sering mendapatkan penolakan publik dan pembatasan-pembatasan dari Pemerintah Indonesia. Penelitian ini bertujuan untuk: (1) menguji dan menganalisis instrumen internasional mengenai pembatasan hak untuk berfikir, berkeyakinan dan beragama (forum eksternum); dan (2) mengamati dan menilai bagaimana implementasi hak untuk berfikir, berkeyakinan dan beragama (forum eksternum) di Indonesia (kasus Kelompok Muslim Ahmadiyya). Dengan pendekatan hukum normatif, penelitian ini membuktikan bahwa pembatasan-pembatasan dalam melakukan kegiatan keagamaan dan penyegelan beberapa tempat ibadah jemaah Ahmadiyya oleh Pemerintah memiliki basis hukum dalam hukum internasional yakni prisip forum eksternum dan pembatasan pemerintah terhadap kelompok Muslim Ahmadiyya diterapkan demi tercipta keselamatan, ketertiban, kesehatan, atau kesusilaan umum, atau hak-hak dan kebebasan-kebebasan mendasar milik orang lain.
