Abstract

Dalam tatanan Masyarakat ada sejumlah nilai sosial yang berlaku, yang tidak jarang banyak dihadapkan pada berbagai kendala, memitigasi kendala tersebut diperlukan dengan pembinaan hukum. Pembinaan hukum harus dilakukan dengan sebuah pendekatan yang sistemik termasuk di dalamnya budaya hukum. Kepatuhan budaya hukum pada PT. Bio Inti Agrindo (PT.BIA) salah satunya dilakukan dengan melakukan penyuluhan hukum. Pengabdian di Area Estate C PT. BIA ini menggunakan metode sosialisai/penyuluhan berupa Peningkatan Kesadaran Hukum Pencegahan Tindak Pidana Kekerasan Dalam Rumah Tangga (KDRT) dengan teknik ceramah dari narasumber, studi kasus, dan diskusi/tanya jawab. Hasil dari pengabdian kepada masyarakat yang telah dilaksanakan ini disambut dengan respon yang positif oleh para pekerja pada Area Estate C PT. BIA dimana akibat yang ditimbulkan oleh KDRT juga berdampak luas, misalnya cacat, trauma, stress, timbul konfik bahkan pembunuhan, serta bagi anak dapat menganggu proses tumbuh kembang selain itu tentu KDRT juga memiliki dampak negatif baik lain diantaranya menurunkan pruduktifitas kerja. Berdasarkan hasil yang diperoleh dari pengabdian ini dapat disimpulkan bahwa sosialisasi hukum ini sangat bermanfaat bagi para pekerja di Area Estate C PT. BIA untuk menumbuhkan rasa kesadaran hukum secara kolektif.

Abstract

Perilaku menyimpang salah satunya adalah minum-minuman keras yang berujung pada tindak pidana. BIA dimana minum-minuman keras memiliki dampak negatif baik diantaranya biasa menyebabkan tindak pidana dan menurunkan produktivitas kerja. Berdasarkan hasil yang diperoleh dari pengabdian ini dapat disimpulkan bahwa sosialisasi hukum ini sangat bermanfaat bagi para pekerja di Area Estate A PT. BIA untuk menumbuhkan rasa kesadaran hukum secara kolektif.

Abstract

The ongoing investigation sheds light on a criminal case. The purpose of this study is to analyze the legality of the termination of the investigation of corruption cases carried out by the KPK as a result of the enactment of Article 40 of Law No. 30 of 2002. This research focuses on the authority of the KPK in stopping the investigation process of corruption crimes through the Investigation Termination Order (SP3). With the type of normative juridical-based research, the research is centered on literature research taken from the study of the election, literature studies, and other scientific works then analyzed using qualitative research methods that are oriented to the conceptual certainty approach and the case approach. The main problems found include the legality of SP3 by the KPK in corruption crimes. The results of the study show the position of the KPK as a super body institution, in the enforcement of corruption crimes, it has several special authorities because it is regulated in a specialist manner in its own provisions, including the authority to investigate based on philosophical, sociological, and juridical aspects, where the essence of the KPK's authority is a rational effort in eradicating corruption and realizing law enforcement oriented towards justice and legal certainty. The recommendation given is that investigations and investigations by the KPK must be carried out professionally, efficiently, and effectively by paying attention to the conditions that must be met before the investigation is carried out, so that synergy and coordination between law enforcement officials are needed.

Abstract

This recognition requires further regulation through a Government Regulation and serves as a procedural requirement for being acknowledged as indigenous peoples. The purpose of this article is to provide us an overview of how the recognition requirements for indigenous peoples as outlined in legislation, both before and after the enactment of the Criminal Code. Additionally, it examines the struggles of indigenous peoples in Ecuador, who have organized themselves into indigenous groups to fight for the rights that have been taken away from them. This research employs a statutory approach, a comparative approach, and an interdisciplinary approach in law commonly referred to as socio-legal research. As a result of this, indigenous peoples often find themselves in a weak position relative to the dominant authority of the state. The government needs to provide political recognition affirming that indigenous peoples are equal legal subjects with the state and possess the capacity to act legally to represent their interests as indigenous groups. With the enactment of the National Criminal Code set for 2026, this recognition may pave the way for indigenous peoples to become equal parties when engaging with the state in matters of customary criminal law. Additionally, the indigenous movement in Ecuador serves as a significant point of reflection. Their ability to unite indigenous peoples and nations under a national framework has profoundly influenced the political and legal landscape.

Abstract

Students as a manifestation of the nation should be clear and kept away from things that can damage the future, including the dangers of drugs. This is realized because students are a group that is quite broad and easily influenced. The aim of this service is an educational outreach activity on the latent dangers of drug abuse among YPK Merauke High School students as a series of Legal Literacy Roadshows in 2023 to increase understanding and legal awareness about the bad effects of drugs. The method used is in the form of conveying information through socialization and leaflets/social media. The result of this service is increasing the knowledge of YPK Merauke High School students about the latent dangers of drugs and obtaining comprehensive drug prevention and control information.

Abstract

Regional Head Elections (Pilkada) are a form of implementing direct democracy in Indonesia which provides space for the people to choose their leaders. However, in practice, disputes over regional election results often occur, either due to differences in vote results or serious violations that affect the election process. The Constitutional Court (MK) plays a strategic role in resolving regional election results disputes based on the provisions of Law Number 10 of 2016, especially Article 158 which regulates the threshold for vote differences and exceptions for structured, systematic and massive (TSM) violations. This research uses a normative juridical method with an analytical approach to statutory regulations, Constitutional Court decisions, and empirical data related to the 2024 Pilkada. The results of the research show that the application of the vote difference threshold provisions provides initial screening for incoming lawsuits, while proving TSM violations remains the main challenge due to the complexity of the evidence and political pressure. The conclusion of this research confirms that the role of the Constitutional Court is very important in maintaining the legitimacy of the regional election results and the integrity of the democratic process in Indonesia.
