Abstract

In the Malind Anim community in Buti, many couples only marry based on customary law, so they do not yet have a marriage certificate. The aim of this community service is to provide understanding to the community about the importance of registering marriages and also to facilitate people who have not legally married to be registered and to carry out marriages in churches and civil registries. The implementation method is carried out in 3 stages, namely starting from data collection, counseling about the importance of legalizing marriage as an administration for eradicating educational backwardness and implementing mass weddings. The result of this service was that 24 couples had entered into religious and legal marriages and 24 of these couples had religious marriage certificates and also marriage certificates from the Merauke Regency Government, namely the Civil and Population Registry Office.

Abstract

The creative industries have been set by the government as one of the pillars of national economic development, according to OPUS Creative Economy 2020 report, the contribution of the creative economy subsector to the national PDP reached Rs. McKinsey & Company through its research in 2016 stated that Indonesia is becoming one of the four most potential countries for the digital music industry in Asia, revenue or market value of streaming music in Indonesia in 2020 is estimated to reach $148 million or around IDR 2.1 Trillion and the growth rate is expected to reach 6.4 percent by 2024, creating market value around $190 million. One of the forms of music produced by the people in Indonesia and in particular in Merauke district was born from the local community of bands, such as Coffe Break, Kaki Abu, Amandus (Black Lebel One Scout), Jeppo (KANADA), and Anjhas Noya. (No Name Crew). Nevertheless, the potential economic gain cannot be achieved optimally if the importance of legal protection of intellectual property rights (IPR) is disregarded. In general, this research is intended to find out and analyze the extent to which the legal protection of IPR for music/song creations in the Band Community in Merauke district. This research uses the method of empirical juridic research.

Abstract

The Indigenous Papuan People (OAP) in Matara village still have several couples who only marry based on customary law so that they do not have legal certainty in the aspect of marriage as evidenced by a marriage certificate. The purpose of this service is not only to provide assistance and legal counselling on the importance of marriage registration but also to realise the orderly administration of population in Matara village through marriage through church marriage and civil registration. The implementation method is carried out in various stages, including starting from data collection, counselling and procedures for implementing marriage. The results of the service are 6 (six) couples who have performed traditional marriages but have not been recorded in the civil registry because religious marriages have not been held and recorded under state law

Abstract

Artikel ini membahas tentang ciri-ciri dan perkembangan common law sebagai suatu sistem hukum di dunia. Cara yang digunakan untuk menemukan jawaban artikel ini adalah dengan mencari literatur-literatur yang memuat fakta-fakta terkait bagaimana common law berkembang hingga menjadi seperti sekarang ini. Kemudian menganalisis ciri-ciri yang menjadikannya unik. Hasil yang diperoleh adalah perkembangan sistem hukum common law dimulai pada masa feodalisme di Kerajaan Inggris hingga meluas ke Amerika Serikat dan terus dipelajari hingga saat ini. Metode berpikir menggunakan metode induktif, yaitu cara berpikir dari hal yang khusus, dan menarik kesimpulan yang bersifat umum. Ciri-ciri hukum common law, yaitu yurisprudensi dipandang sebagai sumber hukum utama, dianutnya doktrin tatapan decisis, dan adanya sistem adversary dalam proses peradilan.

Abstract

Penelitian ini bertujuan untuk mengetahui peran visum et repertum dalam menyusun surat dakwaan oleh jaksa penuntut umum serta untuk mengetahui kekuatan pembuktian visum et repertum sebagai alat bukti dalam kasus tindak pidana penganiayaan. Untuk mendukung penelitian ini, penulis menggunakan metode yuridis empiris dengan data yang diperoleh melalui sumber primer dan sekunder; kemudian data tersebut dianalisis secara deskriptif dan kualitatif. Dari hasil penelitian yang dilakukan, dapat diketahui bahwa visum et repertum memiliki peran penting dalam memberikan gambaran yang jelas mengenai luka-luka yang dialami oleh korban dengan mencocokkan hasil visum et repertum dengan kesaksian saksi yang ada. Visum et repertum juga berperan dalam menentukan pasal yang disangkakan untuk memenuhi unsur-unsur pidana dari tindakan terdakwa sehingga memudahkan jaksa dalam menyusun surat dakwaan. Kekuatan pembuktian visum et repertum sebagai alat bukti yang sah dalam kasus tindak pidana penganiayaan memiliki kekuatan pembuktian yang tinggi, setara dengan alat bukti lainnya yang juga diajukan oleh jaksa penuntut umum dalam persidangan, karena merujuk pada ketentuan hukum acara pidana. Selain itu, visum et repertum tidak memiliki kekuatan yang mengikat dan tidak bersifat memaksa bagi hakim.

Abstract

Indonesia as one of the largest archipelagic countries in the world has varied geographical conditions, diverse customs, and cultural resources, including traditional knowledge and traditional cultural expressions that are very rich. These geographical conditions and the diversity of customs and culture play an important role in creating products that have a unique character. One of them is the potential to give birth to Intellectual Property (IP) products in the field of Geographical Indications (GI) found in Wasur National Park, South Papua, but so far none have been registered and owned either by community groups, local governments both Merauke Regency and South Papua Province. To answer the problems that have been formulated in this research is a normative-empirical legal research method. Normative-empirical legal research is legal research whose object of study includes statutory provisions (in abstracto) and its application to legal events (inconcreto) in society, especially developments regarding the protection of IG. The results showed that the protection of GIs in Indonesia itself is currently regulated through Law Number 20 of 2016 concerning Trademarks and Geographical Indications. GI also has a correlation with a very important community economy and has historical value (product reputation, consumer protection, and the environment). Some medicinal plants and spices that grow in Wasur National Park have distinctive characteristics that are influenced by local geographical and climatic factors. Therefore, products such as ginger, turmeric, or cloves from this area have the potential to be granted Geographical Indication (GI) status.

Abstract

Food security investments have brought conflict between local indigenous communities and the government in South Papua. The research aims to encourage protection and recognition efforts from the state towards indigenous peoples' entities. This research uses socio-legal studies. The research found sixteen plants that function as medicine. Inventory in the form of "recording" communal intellectual property is the first step to protecting all communal intellectual property that has never been recorded before. The Yei Indigenous People or the local government should work together to register with the Ministry to obtain rights to communal intellectual property, which will impact state action in protecting and defending communal intellectual property rights.

Abstract

This recognition requires further regulation through a Government Regulation and serves as a procedural requirement for being acknowledged as indigenous peoples. The purpose of this article is to provide us an overview of how the recognition requirements for indigenous peoples as outlined in legislation, both before and after the enactment of the Criminal Code. Additionally, it examines the struggles of indigenous peoples in Ecuador, who have organized themselves into indigenous groups to fight for the rights that have been taken away from them. This research employs a statutory approach, a comparative approach, and an interdisciplinary approach in law commonly referred to as socio-legal research. As a result of this, indigenous peoples often find themselves in a weak position relative to the dominant authority of the state. The government needs to provide political recognition affirming that indigenous peoples are equal legal subjects with the state and possess the capacity to act legally to represent their interests as indigenous groups. With the enactment of the National Criminal Code set for 2026, this recognition may pave the way for indigenous peoples to become equal parties when engaging with the state in matters of customary criminal law. Additionally, the indigenous movement in Ecuador serves as a significant point of reflection. Their ability to unite indigenous peoples and nations under a national framework has profoundly influenced the political and legal landscape.

Abstract

Introduction: Controlling corruption by relying too much on a legal approach cannot always be implemented, but what needs to be made effective and efficient is non-law-based prevention efforts through local wisdom approaches.Purposes of the Research: This research is focused on exploring anti-corruption cultural values in the Kei community as an internalization of efforts to prevent corruption where so far similar research has been minimal.Methods of the Research: The type of normative juridical research is then analyzed using qualitative research methods that are oriented towards a value approach and a policy approach. Data were taken from journal literature studies and other scientific works.Results of the Research: The results of the study show that the Maren and/or Yelim praxis can become a forum for togetherness for the Kei people as a fundamental basis for eradicating corrupt behaviour as well as an effort to realize and build anti-corruption integrity values, including, honesty, caring, independence, discipline, responsibility, hard work, modest, brave, and fair.

Abstract

Regional Head Elections (Pilkada) are a form of implementing direct democracy in Indonesia which provides space for the people to choose their leaders. However, in practice, disputes over regional election results often occur, either due to differences in vote results or serious violations that affect the election process. The Constitutional Court (MK) plays a strategic role in resolving regional election results disputes based on the provisions of Law Number 10 of 2016, especially Article 158 which regulates the threshold for vote differences and exceptions for structured, systematic and massive (TSM) violations. This research uses a normative juridical method with an analytical approach to statutory regulations, Constitutional Court decisions, and empirical data related to the 2024 Pilkada. The results of the research show that the application of the vote difference threshold provisions provides initial screening for incoming lawsuits, while proving TSM violations remains the main challenge due to the complexity of the evidence and political pressure. The conclusion of this research confirms that the role of the Constitutional Court is very important in maintaining the legitimacy of the regional election results and the integrity of the democratic process in Indonesia.
