Abstract

Abstract: This research is aimed to determine factors that cause the distribution of traditional liquor in Makassar , and also to understand the steps and preventive efforts taken by the police and pp police in handling crimes of traditional liqior distribution in Makassar. The research method that the author uses is the empirical method, namely with the data in the field as the main source , the results of interviews and observations. Factors that affecting people in Makassar distributing traditional liquor are: Economic Factors , Family Factors and Social environment. Besides, Factors that causing people in Makassar consuming traditional liquor are: Social Environmental Factors , Family Factors , State Task and Leisure . Next, efforts taken by the police officers and pp police in handling the distribution of traditional liquor in Makassar , are: Pre- emtive Efforts , Preventive efforts and Repressive efforts. The suggestion of this research is the need for efforts to control , supervise , circulation of traditional liquor by conducting socialization or coaching to the community about the dangers of consuming liquor . Abstrak: Penelitian ini bertujuan untuk mengetahui faktor-faktor yang menyebabkan terjadinya peredaran minuman keras tradisional di Kota Makassar dan untuk mengetahui langkah-langkah atau upaya penanggulangannya oleh pihak kepolisian dan satpol pp dalam menanggulangi peredaran minuman keras tradisional di Kota Makassar. Metode penelitian yang penulis gunakan adalah metode empiris yaitu dengan adanya data-data di lapangan sebagai sumber utama , hasil wawancara dan observasi. Faktor-faktor yang mempengaruhi masyarakat di Kota Makassar mengedarkan minuman keras tradisional adalah: Faktor Ekonomi, Faktor Keluarga dan Lingkungan Sosial. Faktor-faktor yang menjadi alasan masyarakat di Kota Makassar mengkonsumsi minuman keras tradisional adalah: Faktor Lingkungan Sosial , Faktor Keluarga , Karena Tugas Negara dan Sebagai Hiburan . Upaya-Upaya yang dilakukan oleh pihak kepolisian dan satpol pp dalam menanggulangi peredaran minuman keras tradisional di Kota Makassar , yaitu: Upaya Pre-emtif , Upaya Preventif dan Upaya Represif. Saran penelitian ini adalah perlunya upaya pengendalian , pengawasan , peredaran minuman keras tradisional dengan cara mengadakan sosialisasi atau pembinaan pada masyarakat tentang bahaya mengkonsumsi minuman keras .

Abstract

This research was conducted with the objectives of (1) To find out and analyze the effectiveness of giving Land and Building Tax (PBB) incentives in Makassar City, (2) To analyze the Implementation of Land and Building Tax (PBB) Incentive Policies in Makassar City. The research method used in this study is an empirical juridical approach, which examines the legal provisions that apply in society. Data collection is done through observation, interviews, and documentation. This study analyzes the effectiveness of providing land and building tax incentives with a ratio approach and the effectiveness theory. The data used are the results of interviews and data on the provision of tax incentives in 2020. Based on the results of the research conducted, the researchers concluded that the level of effectiveness in providing tax incentives is not yet effective because the results of a comparison of taxpayers who take advantage of tax incentives are still very small compared to the number of taxpayers in cities. Makassar, or only 1.65% of the total 356,130 taxpayers, only 5,881 took advantage of tax incentives. Obstacles found in this study are the ineffectiveness of communication and socialization and the existence of restrictions on social interaction, and adaptation in the organizational environment.

Abstract

This research encapsulates an attempt to thoroughly investigate and analyze the constitutionality of customary justice in the context of dispute resolution among indigenous peoples, with particular emphasis on the ways in which disputes are resolved through customary justice institutions in Tana Toraja Regency. The research method applied was a combination of a normative (doctrinal) legal research approach relating to legal theory and doctrine, and an empirical (non-doctrinal) legal research approach focusing on practical experience and field observations. The findings of this study underscore the importance of considering the political context of law in evaluating the constitutionality of customary justice, given that the system is faced with a range of complex challenges. In practice, the dispute resolution process through customary justice in Tana Toraja Regency is organized by a reconciliatory judge, who is tasked with facilitating the process of deliberation between the disputing parties with the aim of reaching a mutually acceptable agreement or decision. Recommendations from this study highlight the need for legislative efforts to formulate clearer laws and regulations regarding the role and procedures of customary justice in resolving disputes in indigenous communities. There is also a need for local policies that support the role of conciliatory judges in the customary justice system in Tana Toraja. This research not only provides a deeper understanding of customary justice practices, but also provides a foundation for improved policies and better legal practices in the future, which can strengthen the protection of indigenous peoples’ rights and support sustainable and inclusive development.

Abstract

The purpose of this research is to understand and analyze the regulation of unfair business practices in the digital business era in Indonesia, as well as the impact of unfair competition on innovation and business sustainability in the future. This research employs a normative research method, using primary and secondary legal materials obtained through literature and the analysis of books, journals, and cases, particularly those available on the internet, literature books, and laws. The research results indicate that unfair competition in Indonesia is regulated by the ITE Law No. 11 of 2008 and Law no. 5 of 1999, but there are still gaps in oversight, especially in the digital sector. The ITE Law focuses more on electronic transactions and personal data protection, while the Anti-Monopoly Law has not fully accommodated new challenges such as predatory pricing and market dominance by large platforms. As a result, unfair competition can lead to market monopolies, a decrease in MSME turnover, and future losses for consumers. The research recommendation is that the anti-monopoly law has been effective in reducing unfair competition in the digital sector, but the government needs to provide further support, especially regarding the limitations of the KPPU under the existing regulations, without disrupting existing industries. Also, to prevent the negative impacts of unfair competition, tighter oversight is necessary, especially in competition within the digital sector, such as e-commerce.
