Abstract

The rapid growth of digital advertising as a key component of the digital economy has intensified concerns over the protection of personal data and privacy rights. The primary legal problem addressed in this research is the inability of Indonesia’s current data protection framework to adequately regulate data-driven digital advertising practices and prevent unlawful identification of individuals, particularly when compared to South Korea’s more advanced regulatory regime. This study aims to comparatively analyze the legal frameworks governing personal data and privacy protection in digital advertising in Indonesia and South Korea and to propose a legal development model for Indonesia. This research employs a normative legal research method using a comparative statutory approach, focusing on Indonesia’s Law on Personal Data Protection and South Korea’s Personal Information Protection Act, along with its enforcement regulations. Legal norms are examined through statutory provisions and supported by relevant legal and academic literature. The findings demonstrate substantial regulatory disparities between the two countries. South Korea has established a comprehensive and technologically responsive legal framework, incorporating detailed data classification, recognition of pseudonymized data, strict profiling limitations, and strong institutional enforcement. In contrast, Indonesia’s legal framework remains structurally limited, relies heavily on undelivered implementing regulations, and insufficiently addresses indirect identification and advanced data-processing practices in digital advertising. This study proposes targeted legal reforms for Indonesia, including the integration of pseudonymization, enhanced data classification, criminalization of unlawful identification, and mandatory tracking notifications to strengthen privacy protection in the digital advertising ecosystem.

Abstract

This study examines the integration of arbitration mechanisms and project management in resolving international trade disputes. Arbitration is chosen as the preferred dispute resolution method due to its confidential, flexible, final, and binding nature, as well as the international enforceability of its awards. In contrast, resolving international commercial contract disputes through Indonesian courts has proven to be time-consuming, involving multiple layers of appeal, and resulting in judgments that are difficult to enforce across jurisdictions. This normative juridical research employs primary and secondary legal materials to analyze legal issues and managerial approaches within arbitration. Romli Atmasasmita’s Integrative Legal Theory is used to bridge the values of legal certainty, utility, and justice, while project management concepts are applied to structure arbitration proceedings as a project consisting of planning, execution, and closing phases. The findings indicate that arbitration procedures align with the project life cycle, enabling dispute resolution to be carried out more effectively and systematically. The integration of these two approaches is evident in international commercial contracts, where arbitration clauses are commonly included as the designated dispute resolution mechanism.

Abstract

Kartu Indonesia pintar (KIP) merupakan pengembangan dari program Bidikmisi yang telah dilaksanakan sejak tahun 2010. Program ini resmi diperkenalkan pada tahun 2020 dan mengalami perbaikan pada tahun 2021 melalui peluncuran Kuliah KIP Merdeka. Penelitian ini bertujuan untuk untuk mengetahui peran locus of control internal sebagai variabel moderasi dalam pengaruh pengendalian diri, gaya hidup, dan kemampuan pengelolaan keuangan terhadap kepatuhan keuangan mahasiswa penerima bantuan pendidikan. Dengan menggunakan pendekatan kuantitatif dan data primer dari 186 responden melalui teknik purposive sampling, analisis dilakukan dengan menggunakan PLS-SEM melalui WarpPLS 8.0. Instrumen diuji menggunakan validitas konvergen, validitas diskriminan, dan keandalan komposit. Hasil penelitian menunjukkan bahwa pengendalian diri dan kemampuan pengelolaan keuangan memiliki efek positif yang signifikan terhadap kepatuhan keuangan, sedangkan gaya hidup tidak memiliki efek yang signifikan. Lokus kontrol internal telah terbukti memperkuat pengaruh pengendalian diri, tidak memoderasi pengaruh gaya hidup, dan melemahkan pengaruh keterampilan manajemen keuangan. Temuan ini memberikan kontribusi empiris terhadap pengembangan literatur tentang perilaku keuangan mahasiswa dan menjadi dasar perumusan program untuk meningkatkan literasi dan disiplin keuangan. Penelitian ini memberikan kontribusi empiris terhadap literatur tentang perilaku keuangan mahasiswa, khususnya dalam konteks program bantuan pendidikan, dan berfungsi sebagai dasar bagi perguruan tinggi dan pemerintah dalam merancang intervensi untuk meningkatkan literasi dan disiplin keuangan.

Abstract

Purpose: This study examines whether information asymmetry in digital markets can be understood as a form of epistemic injustice and to assess how the consumer protection frameworks of Indonesia and the Philippines respond to this problem. Research Design and Methodology: This research employs the normative legal research method and comparative approach, with epistemic injustice as the main philosophical, analytical lens. To supplement the analysis, the study utilizes key primary law sources, namely Law No. 8 of 1999 and Government Regulation No. 80 of 2019 from Indonesia; and Republic Act No. 7394 and the Internet Transaction Act of 2023 from the Philippines. Findings and Discussion: Information asymmetry is comprehensively identified as a form of testimonial and hermeneutical injustice that undermines consumers’ capacity as knowers. Normative analysis conclusively shows that both countries are reliant on general legal norms, incapable of philosophically and normatively capturing information asymmetry in today’s markets. In addition, deficiencies are also found in recent regulations, where algorithmic opacity and complaint-handling mechanism remain unaddressed. Implications: The study implies the need for comprehensive reform and proposes that legal development should move beyond broad fairness principles to operationalize specific digital safeguards, and clearer disclosures, along with verifiability and platform accountability standards.

Abstract

Introduction: Road users' legal awareness of the road itself is a key factor driving the urgency of creating safety and order on the roads. In Batam City, the Riau Islands Regional Police's (Polda Kepulauan riau) implementation of Electronic Traffic Law Enforcement (ETLE) is a means of enforcing traffic laws to increase public awareness and compliance with traffic laws through an electronic ticketing system based on Closed-Circuit Television (CCTV).Purposes of the Research: This research analyzes the implementation of ETLE in Batam City and its effectiveness in terms of increasing legal awareness of drivers, especially in Batam City, as well as various obstacles faced in the implementation of ETLE itself, both problems from the community and problems with law enforcement officers who organize ETLE.Methods of the Research: This research is an empirical legal study. The approaches used in this study are the statute approach and the sociological approach. The statute approach is used to examine the legal basis for implementing ETLE. Meanwhile, the sociological approach is used to understand how the law is applied in practice by the police. The data collection method for this research is through interviews with law enforcement officers, field observations, and analysis of secondary data from related sources.Results Main Findings of the Research: The final results of this research found that the implementation of ETLE implemented by the Riau Islands Regional Police (Polda Kepulauan Riau) in Batam City continues to face significant challenges and has not yet operated effectively. Although ETLE has recorded more than 1.526.013 traffic violations since its implementation, the extremely low rate of ticket resolution only approximately 13.232 offenders fulfilling their legal obligations. One of the main obstacles is inaccurate vehicle ownership data, particularly in cases where vehicles have changed ownership but the name transfer process has not been completed, resulting in violation confirmation letters failing to reach the actual offenders. Furthermore, the very limited number of static ETLE cameras restricts the scope of surveillance and causes many traffic violations to go unrecorded by the system.

Abstract

This article discusses the potential of IPR-based sustainable tourism in Indonesia, Malaysia, and Thailand, three Southeast Asian countries with immense cultural resources that can further develop the tourism industry. This analysis primarily assesses the adequacy of the relevant regulatory frameworks in bridging sustainability and tourism, particularly by utilising the relevant IPR regimes. Employing the normative legal research method, this study finds that all three countries are for the most part, normatively inadequate to adopt an IPR-based sustainable tourism system, due to the lack of emphasis on ‘social interests’ with regards to community development and its connection with the bigger and more urgent objective of environmental sustainability. However, the study also notes that Indonesia stands out as the country with the most comprehensive and locally sensitive IPR frameworks. These frameworks potentially facilitate a harmonious connection between the three domains through the perspective of Roscoe Pound’s Sociological Jurisprudence, specifically how law is viewed as an instrument for social engineering, which serves the objective of moving the tourism sector and its stakeholders towards a more sustainable approach.

Abstract

This study aims to analyse the regulation of the Indonesian National Standard (SNI) under Law Number 8 of 1999 concerning Consumer Protection and its implications for consumer protection in Batam City as a Free Trade Zone. The study is grounded in the discrepancy between das sollen and das sein, in which the prevailing legal framework obliges business actors to comply with SNI requirements, whereas in practice the implementation of SNI in Batam remains ineffective due to high certification costs, limited legal awareness among business actors, and the distinctive characteristics of the Free Trade Zone. This research employs a normative juridical method with statutory and case approaches, utilising primary, secondary, and tertiary legal materials. The findings demonstrate that Article 8 paragraph (1) and Article 4 letter (c) of Law Number 8 of 1999 impose an obligation upon business actors to implement SNI standards, while Article 19 paragraphs (1) and (2) provide consumers with the right to seek compensation for damages, and Article 45 paragraph (1) regulates the mechanism for dispute resolution through the Consumer Dispute Settlement Agency (BPSK). Nevertheless, normative inconsistencies between Law Number 39 of 2009 concerning Special Economic Zones and other related regulations have created obstacles to the implementation of SNI in Batam. Despite these challenges, the enforcement of SNI remains a legal obligation for business actors in order to ensure consumer protection, legal certainty, and the enhancement of trade quality within the free trade zone.
