Abstract

The characteristics of perpetrators of sexual abuse against children appear in complex patterns of relationships. Studies that had discussed this phenomenon have only focused on the existence of victims, so they have not comprehensively explained the characteristics of the perpetrators. This study focuses on the question "How are the characteristics of perpetrators of sexual abuse against children?" To answer this question, this study uses a qualitative descriptive approach in exploring cases of sexual abuse against children through online media coverage. The reading of the news is focused on news headlines that contain cases, victims, and perpetrators of sexual abuse against children. Important findings in this study show that the perpetrators of sexual abuse against children are not least carried out by those closest to the child biologically, socially, and structurally, such as parents, neighbors, and teachers at school. Based on these findings, it is possible to formulate a concept of the crime of personal closeness as a contribution to this study. This study also recommends the importance of comparing cases, victims, and perpetrators of sexual abuse by interviewing groups of girls and boys on a more macro and more empirical basis.

Abstract

This study aims to evaluate the attitudes of leaders shaped after being trapped in the practice of money politics by voters in general elections based on Islamic law. This context tends to be overlooked by previous studies discussing the issue of money politics in elections. In addition to responding to the shortcomings of previous studies, this study also focuses on evaluating the characteristics and implications of money politics in shaping leaders' attitudes post-election based on Islamic law. This study employs a qualitative descriptive approach based on Islamic law to explore the characteristics, factors, and implications of money politics on leaders' attitudes post-election. The findings of this study reveal three important contexts regarding the characteristics of money politics in elections in Indonesia that contradict Islamic law. First, the practice of money politics in elections often appears in the form of cash payments, digital money, and the provision of projects with political aims. Second, money politics practiced in elections is frequently influenced by structural, cultural, and infrastructural factors oriented towards transactional politics. Third, the money politics conducted by actors in the elections has shaped opportunistic, pragmatic, and even corrupt attitudes among leaders post-election.

Abstract

Prior to 1966, Indonesia was regarded as a country with an outdated order system. After the establishment of a new social order characterized by the incorporation of markets into people's lives, this period came to an end. The market's integration into society has transformed traditional self-sufficiency through subsistence production practices into a market-oriented and centralized modern society oriented toward the market. Various local beliefs, values, and practices have been supplanted with new ones as a result of the modern nation's formation. The national language, which functions as a measure of nationalism, has become a central factor that has transformed and threatened local languages. As a result, the influence of local languages has diminished significantly as urbanization, the offspring of welfare programs, has increased. National legal policies are enforced despite coexisting with customary laws, demonstrating modernization's dominance over marginalized local cultures. Under the guise of "progress," the new lifestyle is a component of the modernization project that not only shapes a new social practice but also disorients values and adds new hues to the system of ideas, values, and social practices that serve as the basis for societal development.

Abstract

The submission of dowry in the form of land (Sompa Tanah), as practiced by the Bugis community in Bone, reflects the flexibility of local mechanisms in addressing real-world challenges based on the ideal values of tradition. This study is important in the broader discourse on dowry, which often highlights cultural legitimacy in perpetuating violence and the subordination of women. The provision of Sompa Tanah in Bugis society serves as a cultural, legal, and religious mechanism to establish legal certainty regarding rights and obligations in marital relations. This descriptive qualitative research draws on observation and interview data, which are then analyzed contextually to understand their relevance to social management within the community. The findings indicate that Sompa Tanah functions as a legal mechanism that not only regulates rights and obligations in marriage but also provides legal certainty within the marital bond. The legal security afforded to women serves as a safeguard for their rights as wives and mothers within a patriarchal society. As a legal mechanism, Sompa Tanah ensures social order and gains customary and cultural legitimacy, which strengthens the position of women in the Bugis social structure. Additionally, marriage, as a social bond, carries the risk of divorce, which is also legally acknowledged. Consequently, this paper recommends further comparative studies to explore the practice of Sompa Tanah across different regions to gain more comprehensive and in-depth knowledge.

Abstract

The presidential election in Indonesia in 2024 has raised controversy in the process and implementation of democracy. However, this context has not been comprehensively discussed in previous studies. In addition to answering the shortcomings of previous studies, this research also focuses on the question of how the forms, factors, and implications of democratic controversy on the legitimacy of presidential election results in Indonesia 2024. This research reveals three important findings related to democratic controversy in the 2024 presidential election in Indonesia. First, politicians’ and election organisers’ feeble commitment to complying with the rules of democratic elections. Second, the massive intervention of politicians and election organisers in the electoral process. Third, the controversy of democracy in the 2024 presidential election in Indonesia has long implications for citizens’ attitudes towards the legitimacy of election results. From these three contexts, it can be reflected that the democratic controversy in the 2024 Presidential Election in Indonesia not only caused democratic controversy in the electoral process and implementation, but also formed negative attitudes and perceptions of citizens towards the legitimacy of election results.

Abstract

This study aims to explore and evaluate studies that have addressed issues of democratic failure in the last two decades, 2004-2024. In addition to using bibliometric analysis, this study also uses VOSviewer application-based software in exploring and evaluating entity patterns, themes, and developments of studies that focus on discussing democratic failure in the last two decades, 2004-2024. From exploring 1063 total documents, this study found that the United States, the United Kingdom, and the Russian Federation are the most active in publishing studies focusing on democratic failure in Democratization Journal, Journal of Democracy, Political Quarterly, and Third World Quarterly. However, these studies have not been able to intervene and respond to the structural, cultural, and even spiritual challenges that underlie the difficulty of implementing a democratic political system in the era of globalization. This study also recommends the importance of future studies to analyze the factors and implications of the failure of democracy in concept and practice on the welfare of the people in a country.

Abstract

Abortion by children is not only an impulsive act but also a rational choice, which is crucial to explain and evaluate. However, this phenomenon has been overlooked in previous scholarly discussions. In addition, responding to the gaps in previous studies, this study aims to explain the forms, factors, and implications of abortion by children in urban areas as a rational choice. Using a qualitative descriptive approach based on case studies, this study reveals three important findings. First, the practice of abortion by children in urban areas is carried out in various ways, both medical and non-medical. Second, abortions performed by children in urban areas are often influenced by social pressures such as their partners, parents, and the community. Third, abortion among children in urban areas has long-lasting implications for their physical, mental, and social well-being. Based on these findings, this study also recommends the importance of future studies that conduct intensive interviews to reveal the motives and modes of children in having more reflective abortions.

Abstract

Cases of underage marriage have continued to increase, supported by religious law, and accepted by Indonesian Muslims. To analyze this phenomenon, this study is an empirical legal study using a qualitative descriptive approach. The data was obtained through observation, interviews, and a search for religious texts/arguments. The analysis was constructed to explain the relationship between the practice of early marriage and the use of the texts of the Qur'an and Hadith as the main sources in Islamic law. It shows that this exegetical approach has helped perpetuate the practice of underage marriage, as it not only promotes a partial and purely textual understanding of Islam's teachings regarding marriage but is also easily manipulated to promote certain views, as a form of religious manipulation of underage marriages. As a result, marriage is taught and understood from a purely doctrinal perspective, without considering the health and well-being of the married couple. Instead, this study recommends using an integrated approach that continuously strives to prevent the underage marriage, one capable of obtaining a comprehensive understanding that recognizes the interests of all stakeholders including underage couples. Only then can a comprehensive understanding of religious teachings and experiences be obtained

Abstract

Preferences for 2024 leaders can be seen from the electability of leaders in the 2019 general election. This preference indicates that the prospective leaders who will emerge in the 2024 general election are a continuation of political activity in 2019. This study aims to explain the preferences of prospective leaders in the 2024 general election. Because so far there are still few studies that pay special attention to the preferences of prospective leaders in the context of futuristic elections. This research is descriptive qualitative in nature. Data collection was conducted through a process of reading 1,000 online news articles using the search keywords "2019 and 2024 general elections in Indonesia" on the Google search engine. The analysis in this study was conducted by reducing, describing, and interpreting the data thematically inductively. The findings in this study show that the preferences of prospective leaders in the 2024 general election are not much different in terms of profession or social status. This study also recommends the importance of research that analyzes the preferences of prospective leaders in the 2024 elections with a more empirical approach.
