Abstract

The tradition of "uang panai'", a traditional dowry in Bugis-Makassar wedding ceremonies, plays a crucial role in preserving cultural heritage while adapting to contemporary societal changes. This study adopts a qualitative ethnographic approach to explore the evolving criteria for determining the price of uang panai' and its implications on social dynamics within the Bugis-Makassar community. Data were collected through observations and interviews with informants from various districts, supplemented by literature studies. The findings reveal that while lineage remains a predominant criterion, factors such as wealth, education, and occupation have gained significant importance. Wealthy and noble families often demand higher uang panai' to maintain their social status and ensure compatible marital matches. Education and occupation also significantly influence the dowry's value, reflecting the community's increasing emphasis on social mobility and economic stability. This study's novelty lies in its detailed examination of the interplay between traditional practices and modern socioeconomic factors, providing a comprehensive understanding of uang panai's' evolving role. The research highlights the dual function of uang panai' as a symbol of respect and a potential source of economic pressure, offering insights for balancing cultural preservation with economic realities. These findings contribute to the broader discourse on cultural adaptation and suggest avenues for future research on mitigating financial burdens associated with traditional practices. By elucidating the contemporary dynamics of uang panai', this study enhances our understanding of cultural practices and their adaptation in a rapidly changing society.

Abstract

Postponement of Debt Payment Obligations (PKPU) is a legal mechanism that allows debtors to restructure based on approval from creditors. based on the Bankruptcy Law and PKPU, provides legal protection to creditors during the debt restructuring process. This article examines in depth the position and rights of creditors during the PKPU process and after the court decision. The research method uses a normative juridical approach to provide descriptive descriptions based on legal literature, statutory regulations and related court decisions. The research method used is a normative juridical approach with descriptive analysis of legal literature, legislation, and related court decisions. The research findings show that creditors have significant rights in the PKPU process, including the right to file a PKPU petition, the right to vote in creditor meetings, and the right to receive payments according to the agreed-upon settlement plan. Additionally, creditors have the right to demand the implementation of the settlement plan or receive a portion of the proceeds from the liquidation of the debtor's assets in the event of bankruptcy. However, the exercise of these rights often faces various challenges, such as delays in court proceedings, lack of transparency in the execution of the settlement plan, and legal uncertainties that may disadvantage creditors. The research concludes that although creditors' rights are clearly outlined in the law, practical implementation still shows gaps between theory and practice. Efforts are needed to enhance the efficiency of court processes and transparency in the execution of settlement plans to ensure optimal protection for creditors. Recommendations include improving the capacity of human resources in judicial institutions, implementing information technology to expedite administrative processes, and increasing oversight of settlement plan implementation. This article aims to contribute to the understanding and handling of issues related to the position and rights of creditors in the PKPU process, and serve as a reference for legal practitioners, academics, and stakeholders in the field of bankruptcy law and PKPU in Indonesia.

Abstract

This study aimed to identify and describe factors affecting the students’ readiness in studying English for Specific Purposes at the Business English Communication Program. This study used a descriptive qualitative method. The informants in this study were four students at the Business English Communication Program who were selected purposively. This study used interview questions to collect the data. Based on the research results, there are three factors affecting the students’ learning readiness, namely physical conditions (including a healthy diet and regular exercise), learning motivation (career development and the importance of feeling comfortable and confident are the biggest motivations for students in participating in ESP learning), and learning materials (searching for additional information and sources, as well as applying learning materials in real-life contexts in each student's field). It can be concluded that physical and mental health, a high motivation to learn, and active seeking for additional resources are required to apply in learning courses of English for Specific Purposes.

Abstract

This study aims to examine the application of the principle of good faith in contractual agreements and to analyze the legal protection afforded to borrowers in online loan transactions under this principle. The core issue addressed is how the principle of good faith is operationalized in digital loan agreements and its implications for borrower protection. Employing a qualitative approach with a descriptive-analytical method, the research investigates legal instruments and practices governing online lending platforms in Indonesia. The findings reveal that the principle of good faith plays a pivotal role in ensuring fairness, transparency, and accountability in online credit transactions. This principle serves as a normative foundation for safeguarding borrowers’ rights, particularly within the framework of the Indonesian Civil Code, Law No. 11/2008 on Electronic Information and Transactions, and Financial Services Authority Regulation No. 6/POJK.07/2022. The study highlights the necessity of reinforcing good faith as a legal instrument to mitigate asymmetrical power relations and promote legal certainty in digital financial services. These findings imply the need for stronger regulatory enforcement and borrower education to foster equitable financial inclusion in the digital era.
