Abstract

Penelitian ini bertujuan untuk mengkaji pengelolaan zakat di Yayasan Rahmatan Lil-Alamin Jakarta Timur melalui penerapan sistem manajemen mutu ISO 9001:2015 serta menilai kesesuaiannya berdasarkan tinjauan hukum Islam. Penelitian ini menggunakan pendekatan kualitatif dengan metode observasi, wawancara, dan dokumentasi. Data diolah dan dianalisis secara induktif. Hasil penelitian menunjukkan bahwa penerapan ISO 9001:2015 pada pengelolaan zakat Yayasan Rahmatan Lil-Alamin mencakup tujuh prinsip manajemen mutu: fokus pelanggan, kepemimpinan, keterlibatan semua pihak, pendekatan proses, perbaikan berkelanjutan, pengambilan keputusan berbasis bukti, serta manajemen hubungan. Penerapan prinsip-prinsip tersebut tercermin dalam program Kampung Harapan dan mendukung efektivitas pengumpulan serta pendistribusian zakat. Dari perspektif hukum Islam, pengelolaan zakat ini telah sesuai dengan prinsip akuntansi syariah yang merujuk pada PSAK 109, termasuk dalam pelaporan keuangan, distribusi zakat konsumtif dan produktif, serta akuntabilitas terhadap muzakki dan mustahik. Abstract

This research is motivated by the fact that there is still a lot of unproductive agricultural land in West Java, even though the agricultural sector contributes a lot to the community's economy. There needs to be an effort to involve various components of society, especially Islamic boarding schools, in increasing the productivity of agricultural land through cooperation using the muzâra'ah system involving many parties to improve the welfare of farmers and Islamic boarding schools. The aim of this research is to analyze and discover land management practices, cooperation models, and the impact of agricultural cooperation on the welfare of farmers in West Java. This research is field research using a qualitative approach. The research results show that, First, agricultural land management practices in West Java are collaborated with various parties, both internal Islamic boarding schools such as students, teachers and administrators as well as with the surrounding farming community. The two Islamic boarding school agricultural collaborations with the muzâra'ah system in West Java were expanded in scope, not just farmers and landowners, but there were elements of academics, government, the business world, financial institutions, markets and non-governmental organizations. Islamic boarding schools innovate agricultural cooperation with the quintuple helix model using multi contracts, namely connecting these parties to optimize the agricultural business being collaborated. Islamic boarding schools also build aspects of farmers' spirituality through guidance on the application of religious values in agricultural cooperation. Third, Islamic boarding school agricultural cooperation is able to absorb agricultural labor, so that farmers are able to improve their economy, have permanent jobs and increase their religious understanding and practice.

Abstract

This article discusses the practice of smallholders in Mekarjaya Village, Gantar District, Indramayu Regency purchasing and selling land owned by Perhutani in accordance with Islamic law. Perhutani BKPH Haurgeulis, Mekarjaya Village Government, and smallholders were observed in the field to collect data for this qualitative descriptive study. Interviewing, observation, and documentation studies are methods of data collection. According to the findings of the study, farmers in Mekarjaya Village purchased and disposed of arable land through secret agreements or without the knowledge of the landowner (Perhutani). The buying and selling is accomplished by making direct offers to interested parties, who then determine the desired price. If both parties agree, the transaction is completed with a receipt as evidence. Because the object being traded does not belong to the seller, the practice of buying and selling does not meet the criteria. This practice is prohibited by Islamic law because it violates the terms and conditions of buying and selling.Keywords: Buying and selling; Cultivated Land; Islamic law AbstrakArtikel ini mendiskusikan tentang praktik jual beli tanah garapan milik Perhutani oleh para petani penggarap di Desa Mekarjaya Kecamatan Gantar Kabupaten Indramayu ditinjau dari kacamata Hukum Islam. Penelitian ini menggunakan metode deskriptif kualitatif dengan pengambilan data melalui studi lapangan terhadap pihak Perhutani BKPH Haurgeulis, Pemerintah Desa Mekarjaya, dan petani penggarap. Teknik pengumpulan data melalui wawancara, observasi dan studi dokumentasi. Hasil penelitian menyatakan bahwa praktik jual beli tanah garapan oleh petani Desa Mekarjaya dilakukan dengan akad bawah tangan atau tanpa sepengetahuan pihak pemilik tanah (Perhutani). Jual beli tersebut dilakukan dengan cara menawarkan langsung kepada yang berminat kemudian mereka menentukan harga yang dikehendaki. Jika kedua belah pihak setuju maka transaksi dilakukan dengan bukti kwitansi. Praktik jual beli tersebut tidak memenuhi syarat khususnya dalam objek yang diperjualbelikan, karena bukan milik si penjual. Dalam pandangan Hukum Islam praktik tersebut tidak diperbolehkan karena adanya pelanggaran mengenai ketentuan dan syarat-syarat jual beli.Kata Kunci: Jual beli; Tanah Garapan; Hukum Islam

Abstract

The purpose of this study is to determine the implementation of policies in the development of the Minapolitan area as a potential for tourism in Losarang District, Indramayu Regency, the driving and inhibiting factors that occur, as well as the strategies and efforts made. This type of case study research with qualitative methods were obtained through literature and field studies, with data collection techniques through observation, interviews and documentation studies. Data were analyzed using qualitative analysis with three steps, namely data reduction, presentation, and verification. The results of the study show: 1) the implementation of the policy for the development of the minapolitan area as a potential for tourism in Indramayu district is not optimal as seen from the dimensions of policy implementation which have not been fulfilled properly, namely aspects of policy communication, resources, dispositions, and bureaucratic structure; 2) factors that support this policy are potential natural resources and local cultural wealth, and inhibiting factors are problems with the quality of human resources, infrastructure, lack of regional regulations and legal instruments at the technical level of implementation, budget, public awareness, technology and media public information; 3) the efforts made by the local government to include the development of Minawisata in the regional development plan and communicate it to related parties. Minapolitan entrepreneurs are modernizing salt production so that it has a tourism appeal. While the community's efforts are to take real action to organize the area, clean up waste so that it attracts tourists to come to their area.

Abstract

Social loans are an important tool for developing local economies, especially in remote areas such as rural areas. The Indonesian Village City Savings and Loan Cooperative (KSU) is one of the business entities that provides loan capital to its members. The purpose of this study is to determine the mechanism of social loan agreements in the Multipurpose Cooperative (KSU) of the Indonesian Village City and to determine the perspective of Islamic Economic Law on loan agreements in the Multipurpose Cooperative (KSU) of the Indonesian Village City. This research method uses a descriptive research type with a qualitative approach. Data collection was carried out through observation and interviews with the Management and members of the Savings and Loan Cooperative (KSU) of the Indonesian City Village. The results of the study show that first, the loan application procedure involves several steps such as becoming a member, filling out forms, completing documents and the approval stage. The maximum loan provision is 80% of the savings balance with a loan tenor of 12 months and 18 months. The payment system is made in installments through salary deductions and is subject to a 5% interest. For borrowing members who are late, there are no sanctions or fines but there is a time dispensation. Second, the loan application and management mechanism at the Multipurpose Cooperative has met sharia principles through transparent and structured governance, such as deductions from salary installments and a guarantee policy provided in the form of the amount of member savings balances. However, social loans at the Multipurpose Cooperative contain an element of benefit (profit) of 5%, which according to some scholars can be classified as usury because of the addition of value to the principal loan, even though the benefit is returned to members through the Business Result Remainder (SHU).
