Abstract

As a village located on the coast, Pabean Udik Village has many problems which are covered in environmental hygiene aspects. This Community Service contains an environmental framework in supporting the circular economy concept, given the increasing interest of practitioners and theorists in the circular economy. The method of implementing this Community Service uses the Preparatory Stage which includes the process of field visits, handling priority issues and data collection and needs analysis followed by the Implementation Phase with Hearings, Compilation of Village Regulations and Peer Review. The results of the draft Village Regulations that had been prepared by the Service Team have been received by the Head of the Udik Customs Village which is expected to be resolved to become a legal umbrella as an effort to resolve the problem of disposing of garbage. the results of observations during the activity show that the importance of knowledge of the surrounding community about the importance of environmental cleanliness interspersed with qualified technology, especially through legal arrangements for payments related to bank waste. It is hoped that this service activity can be continued in the following year so that people can understand the importance of environmental cleanliness with the existence of a legal umbrella.

Abstract

The development and adaptation of digitalization have exerted a significant influence various aspects of human life. In the realm of law, the impacts of digitalization can be observed through transformations contract formation. Contract Lifecycle Management Software emerged to facilitate the business contract processes for legal practitioners. However, by considering the various conveniences it offers, within its own sphere of application, such new technology can potentially give rise to legal issues. The legal research method in this research is normative juridical. The purpose of this research is conducted with the aim of examining the validity of utilizing Contract Lifecycle Management Software in simplifying the implementation of business contract processes in Indonesia, along with its concept of accountability for the potential occurrence of losses due to breach of contract. The research findings indicate that in its utilization, contracts formed through Contract Lifecycle Management Software can be deemed valid. However, it is necessary to draw the attention of the involved parties to continue adhering to the contract conditions stipulated within the applicable regulations. The responsibility for actions such as losses due to breach cannot be attributed to the technology itself, but rather directed towards its users due to arising errors or negligence.

Abstract

ABSTRACTThis article discusses a community service program aimed at empowering disabled students (santri) in efforts to prevent stunting through green business initiatives in Babakankaret Village. Stunting is a serious issue that affects child development and the quality of human resources. In this context, disabled students play a crucial role as change agents who can raise community awareness about the importance of balanced nutrition and healthy lifestyles. The program includes training in sustainable agricultural management and the cultivation of productive land utilizing local potential, such as fruit farming. In addition to enhancing the knowledge and skills of the students, this initiative also creates job opportunities and strengthens the village's economy. With support from various stakeholders, it is hoped that this program can help reduce stunting rates and create a healthy and independent generation in Babakankaret Village. This research highlights the importance of an inclusive approach to stunting prevention that involves all segments of society, including individuals with disabilities.Keywords: Stunting, Green Business, DisabilityABSTRAKArtikel ini membahas program pengabdian kepada masyarakat yang bertujuan memberdayakan santri disabilitas dalam upaya pencegahan stunting melalui inisiatif green business di Desa Babakankaret. Stunting merupakan masalah serius yang mempengaruhi perkembangan anak dan kualitas sumber daya manusia. Dalam konteks ini, santri disabilitas berperan penting sebagai agen perubahan yang dapat meningkatkan kesadaran masyarakat tentang pentingnya gizi seimbang dan pola hidup sehat. Program ini meliputi pelatihan manajemen pertanian berkelanjutan serta pengelolaan lahan produktif yang memanfaatkan potensi lokal, seperti pertanian tanaman buah. Selain meningkatkan pengetahuan dan keterampilan santri, inisiatif ini juga menciptakan lapangan kerja dan memperkuat ekonomi desa. Dengan dukungan dari berbagai pihak, diharapkan program ini dapat membantu menurunkan angka stunting dan menciptakan generasi yang sehat dan mandiri di Desa Babakankaret. Abstract

This research aims to identify the status of condominium hotels and to determine the legal implications of any deviation from the intended function of flats, both for the unit condotel’s owner and developer. In a condominium hotel, the unit owner is unable to control their unit, as their role is as an investor. Consequently, the unit owner is not permitted to occupy their unit for residential purposes because it is intended to be rented out as a hotel. Furthermore, the unit owner is not included in the PPPSRS, as all activities within the condominium hotel are carried out by the hotel operator. The lack of definitive regulations in Indonesia has given legal uncertainty due to the position between flats and hotel regulations. Hence, there has been a non-conformity between the main purpose of the building as stated in the Building Construction Permit (IMB), the role of the developer which has the potential to cause a conflict of interest with unit owners, as well as the reduction in interest in property investment in Indonesia. This research is normative-juridical with a statutory and conceptual approach. This research uses library research data collection techniques with descriptive and prescriptive data analysis techniques. The result of this research is that condominium hotels can be classified as flats through the adaptation of residential and business functions and involving owners such as PPPSRS to appoint and supervise the hotel operator. This research presents an implementation solution that can enhance legal certainty for owners and operators of hotels. Penelitian ini bertujuan untuk mengidentifikasi status kondominium hotel dan untuk mengetahui implikasi hukum atas penyimpangan fungsi rumah susun terhadap pemilik unit dan developer kondominium hotel berdasarkan perspektif regulasi rumah susun di Indonesia. Dalam konsep kondominium hotel, pemilik unit tidak dapat menguasai unit miliknya secara absolut karena kedudukannya hanya sebagai investor, sehingga unit tersebut tidak dapat digunakan sebagai tempat tinggal, melainkan akan disewakan kembali sebagai hotel. Selain itu, pemilik unit tidak tergabung dalam PPPSRS karena seluruh kepentingan bersama diurus dan dikelola oleh operator hotel sebagai perpanjangan tangan developer yang kerap dipersamakan dengan PPPSRS. Tidak adanya regulasi yang dapat digunakan sebagai landasan hukum seluruh aktivitas di kondominium hotel menyebabkan adanya ketidakpastian hukum karena kondominium hotel berdiri di antara regulasi rumah susun dan perhotelan. Akibatnya adalah terdapat celah untuk melakukan penyeludupan dan penyimpangan hukum, seperti ketidaksesuaian fungsi bangunan sebagaimana yang tertera dalam Izin Mendirikan Bangunan (IMB), peran developer yang terlalu mendominasi melalui operator hotel yang berpotensi menimbulkan konflik dengan para pemilik, serta potensi menurunnya minat investasi properti di Indonesia. Penelitian ini merupakan penelitian yuridis-normatif dengan pendekatan perundang-undangan dan konseptual. Penelitian ini menggunakan teknik pengumpulan data secara kepustakaan, serta teknik analisis data deskriptif dan preskriptif. Hasil penelitian ini menunjukan bahwa kondominium hotel dapat dikategorikan sebagai rumah susun melalui penyesuaian fungsi hunian dan usaha, serta melibatkan para pemilik sebagai PPPSRS untuk melakukan penunjukan dan pengawasan operator hotel sebagai pengelola. Penelitian ini menawarkan solusi implementatif yang dapat memperkuat kepastian hukum bagi pemilik dan pengelola.

Abstract

This research aims to initiate the revival of prorogation in civil procedural law in Indonesia and also design a relevant model to be implemented. In fact, all judicial processes in Indonesia must be guided by and apply the principles of simple, fast and low-cost justice. It is important to apply this principle in order to provide legal certainty in a short time and also make the courts an affordable means for all parties. However, in practice the civil justice process in Indonesia still tends to be slow and complicated, which often makes it difficult for justice seekers. The Supreme Court then created a simple claims institution to resolve cases where the value of the claim was not too large efficiently and reduce the flood of cases at the Supreme Court. However, simple lawsuits can only be used for certain cases so the scope of the case is very limited plus simple lawsuits are not able to significantly reduce the backlog of cases in the Supreme Court. So a solution is needed to overcome judicial problems in ordinary civil cases and also to reduce the backlog of cases at the Supreme Court. Prorogation, which is no longer practiced, can shorten the judicial process, which can then reduce the backlog of cases at the Supreme Court. This research is a type of normative juridical research carried out using the literature study method. The research results show that prorogation can be applied to realize simple, fast and low-cost justice in ordinary civil cases and can also reduce the backlog of cases at the Supreme Court. The application of prorogation in modern Indonesian civil procedural law requires several modifications to adapt to the needs and developments of the times. These modifications include simplifying the requirements for lawsuits and legal remedies as well as integrating e-court as a means of implementation. Penelitian ini bertujuan untuk menggagas penghidupan kembali prorogasi dalam hukum acara perdata di Indonesia dan juga merancang model yang ideal untuk diterapkan. Sejatinya seluruh proses peradilan di Indonesia harus berpedoman dan menerapkan prinsip peradilan yang sederhana, cepat, dan biaya ringan. Prinsip tersebut penting diterapkan guna memberikan kepastian hukum dalam waktu yang singkat dan juga menjadikan pengadilan sebagai sarana yang terjangkau bagi seluruh pihak. Namun, pada praktiknya proses peradilan perdata di Indonesia masih cenderung lamban dan berbelit-belit sehingga kerap kali menyulitkan para pencari keadilan. Mahkamah Agung kemudian membuat lembaga gugatan sederhana guna menyelesaikan perkara yang nilai gugatannya tidak terlalu besar dengan efisien dan mengurai banjir perkara di Mahkamah Agung. Namun, gugatan sederhana hanya dapat digunakan untuk perkara-perkara tertentu sehingga ruang lingkup perkaranya sangat terbatas, gugatan sederhana juga tidak mampu mengurai penumpukan perkara di Mahkamah Agung secara signifikan. Sehingga dibutuhkan solusi guna mengatasi masalah peradilan dalam perkara perdata biasa dan juga untuk mengurangi penumpukan perkara di Mahkamah Agung. Prorogasi yang sudah tidak lagi dipraktekan dapat mempersingkat proses peradilan, yang kemudian dapat menurunkan penumpukan perkara di Mahkamah Agung. Penelitian ini merupakan jenis penelitian yuridis normatif yang dilakukan dengan metode studi kepustakaan. Hasil penelitian menunjukan prorogasi dapat diterapkan guna mewujudkan peradilan sederhana, cepat, dan berbiaya ringan pada perkara perdata biasa dan juga dapat mengurai penumpukan perkara di Mahkamah Agung. Penerapan prorogasi dalam hukum acara perdata modern Indonesia memerlukan beberapa modifikasi guna menyesuaikan dengan kebutuhan dan perkembangan zaman yang ada. Modifikasi tersebut mencakup penyederhanaan persyaratan gugatan dan upaya hukum serta pengintegrasian e-court sebagai sarana pelaksana.

Abstract

This article aims to examine the position of a substitute heir who has killed a direct heir, based on Civil Inheritance Law, and analyze specific conditions under which the substitute heir, the perpetrator of the killing, could still inherit. To analyze this issue, a normative juridical research method is employed. For ease of research, the author presents a case illustration that is not based on real events. The data is collected through  literature studies and analyzed qualitatively. The necessary data sources include the Civil Code (KUHPerdata), the Compilation of Islamic Law (KHI), and relevant scholarly journals. This study concludes that the position of A1 as a substitute heir is obstructed from inheriting because they have killed A, based on the provisions of Article 838 of the Civil Code. However, there are specific conditions that could allow A1 to still receive their inheritance rights, considering that the inheritance still belongs to P, not A. One possible approach is for A1 to file a lawsuit in the District Court, requesting the judge to render a fair decision by taking into account factors of justice and the emotional relationship between A1 and P.

Abstract

This research aims to analyze the implementation of the Complete Systematic Land Registration (PTSL) program as an effort to accelerate Agrarian Reform, which aims to create justice and welfare for the people as mandated by the Constitution. The issue is focused on the agenda of accelerating Agrarian Reform through the Complete Systematic Land Registration, which has proven to have a positive impact on Indonesian society in terms of providing legal certainty of land ownership, thereby preventing the potential for agrarian conflicts. This research uses qualitative methods with a legislative approach and a conceptual approach, resulting in a juridical-normative type of study. Data were collected through unstructured observation methods and analyzed qualitatively. This study concludes that land registration in Indonesia until 2017 (before the PTSL program) only resulted in 46 million registered land parcels, whereas as of now, it has reached 117.9 million registered land parcels by September 2024. With the existence of land ownership certificates as proof of ownership, it will be able to provide legal certainty and minimize agrarian conflicts, thereby enabling the government's efforts in the Acceleration of Agrarian Reform to be achieved effectively.

Abstract

This research aims to find out the position of investor in the build operate transfer (BOT) agreement and the responsibility of investor due to default in the BOT agreement for market revitalisation. The government cooperates with investor to overcome capital difficulties. But there are still many default disputes in the implementation of the market revitalisation BOT agreement. Example, in Cikampek I Market, Metro City Market and Cibitung Main Market. This research is urgent to conduct because default disputes can result in financial and reputational losses for the government, and have negative impact on society. This research method is normative legal research. The novelty of this research is to explore the position of investors in BOT agreements in the face of possible negative impacts on economic, social, environmental and the application responsibilities for defaults by providing examples of real cases. The result of this study is that in the BOT agreement, the investor's position includes financing in development, management with risk management, transfer to ownership. The investor's responsibility due to the default of the market revitalisation BOT agreement includes compensation with dispute resolution for postponement of obligations in the addendum, fines, termination of the agreement.

Abstract

Peraturan daerah merupakan bagian dari peraturan perundang-undangan yang ada di Indonesia. Dalam hierarki peraturan perundangan-undangan sebagaimana diatur dalam Undang-Undang Nomor 12 Tahun 2011 bahwa Perda kabupaten/kota berada diurutan ketujuh setelah Perda Propinsi. Kabupaten Bungo sebagai daerah yang otonom, mempunyai kewenangan untuk menetapkan peraturan daerah. Dalam kurun waktu Tahun 2016-2019 pemerintahan daerah kabupaten Bungo sudah menetapkan 61 Perda. Perda yang ditetapkan sudah berdasarkan berdasarkan Program pembentukan peraturan daerah. Propemperda merupkan instrumen perencanaan program pembentukan perda yang disusun secara terencana, terpadu, dan sistematis. Dalam penetapan Propmerda bagian dari kewenangannya DPRD. Dalam Pasal 149 Undang-Undang Nomor 23 Tahun 2014 DPRD mempunyai 3 fungsi, yang salah satunya adalah Pembentukan Peraturan Daerah.

Abstract

Pengaturan mengenai modifikasi karya cipta tidak dijelaskan secara terperinci sehingga terdapat pelanggaran yang kerap terjadi. Perlindungan hak cipta mengenai pelanggaran modifikasi ciptaan pihak asing yang dilakukan tanpa izin di Indonesia menjadi pembahasan yang penting dan menarik untuk diteliti, pasalnya Indonesia merupakan salah satu negara anggota yang tergabung dalam WIPO (World Intellectual Property Organization). Metode penelitian yang digunakan ialah penelitian normatif dengan Pendekatan Undang-Undang yaitu UU Nomor 28 Tahun 2014 tentang Hak Cipta, dan Pendekatan Kasus dengan Putusan Nomor 31/Pdt.Sus-Hak Cipta/2020/PN.Niaga.Jkt.Pst. Temuan hasil penelitian ini ialah : (a) Pengaturan mengenai modifikasi karya cipta yang terdapat dalam UU No. 28 Tahun 2014 dikaitkan dengan kasus pelanggaran modifikasi karya cipta yang terdapat dalam objek wisata Rabbit Town di Jawa Barat (b) Perlindungan hukum yang diberikan terhadap pihak asing yang menjadi korban pelanggaran hak cipta modifikasi ciptaan yang digunakan tanpa izin di Indonesia dengan dibutuhkannya peraturan yang dapat menyelesaikan sengketa hak cipta internasional yang diatur dalam perjanjian Konvensi Bern dan TRIPs Agreement (c) Penyelesaian hukum yang dilakukan dengan mengacu kepada Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta serta bagaimana penerapan hukum pidana yang diberikan.
