Abstract

This study evaluates the role of constitutional amendments in strengthening democratic governance in Indonesia through qualitative juridical analysis. This research examines how amendments to the Indonesian Constitution since the Reform Era have affected the democratic process and governance structure. Key changes include the establishment of the Constitutional Court, direct presidential elections, and greater regional autonomy. The research findings show that while these amendments have contributed significantly to democratisation by improving the separation of powers, checks and balances, and the protection of human rights, there are still some challenges to effective implementation. The study concludes with recommendations for further reforms to strengthen Indonesia's democratic governance framework.

Abstract

This research examines the role of Indonesia's Constitutional Court in constitutional review and interpretation, focusing on its development, key jurisprudential contributions, and the balance between judicial activism and restraint. Through a comprehensive analysis of landmark cases and scholarly literature, this research highlights the impact of the Constitutional Court on law and governance in Indonesia. The research reveals that while the Constitutional Court has demonstrated judicial activism by protecting fundamental rights and shaping the democratic process, it has also exercised restraint to maintain institutional balance and avoid political overreach. The Court's rulings on issues ranging from human rights to electoral law underscore its important role in upholding constitutional principles. However, the research also identified challenges relating to consistency, transparency and independence, which are critical to maintaining the Court's legitimacy and effectiveness. The findings suggest that the Court's ability to address these challenges will be critical to its future role in Indonesia's democratic framework.

Abstract

This paper examines the protection of human rights under the Indonesian Constitution, focusing on the progress that has been made and the challenges faced. Using a combination of juridical analysis and literature review, it evaluates the effectiveness of constitutional provisions designed to protect human rights and their alignment with international standards. The research highlights significant achievements, including including human rights guarantees in the 1945 Constitution and establishing key institutions such as the National Human Rights Commission (Komnas HAM) and the Constitutional Court. Despite these advances, the study identifies persistent problems such as inadequate law enforcement, systemic discrimination, and limited access to justice. These findings underscore the need for better implementation mechanisms, greater institutional support, and targeted policies to address the gap between constitutional ideals and practical outcomes. The paper concludes with recommendations for future research and policy reforms to strengthen human rights protection in Indonesia.

Abstract

This paper examines the normative aspects of decentralization and constitutional law in Indonesia, focusing on the balance between regional autonomy and national unity. Through a doctrinal analysis of constitutional provisions, key legislation, and judicial interpretations, alongside qualitative case studies, the study explores how Indonesia has navigated the complex relationship between empowering local governance and maintaining a cohesive national identity. The findings reveal that while the legal framework provides for significant regional autonomy, challenges remain in ensuring uniformity in law enforcement, addressing regional disparities, and preventing fragmentation. The study highlights the need for a nuanced approach to decentralization that accommodates regional diversity while fostering national unity, offering recommendations for strengthening local governance, enhancing equitable resource distribution, and refining the legal and regulatory frameworks.

Abstract

This study critically examines the constitutionality of the presidential nomination threshold provision stipulated in Law No. 7/2017 on General Elections. By conducting a juridical analysis, this research explores the legal and constitutional underpinnings of the presidential nomination threshold, which mandates a minimum percentage of parliamentary seats or popular votes for a political party or coalition to nominate a presidential candidate. The analysis explores the historical context, legislative intent and judicial interpretation of the threshold provision. It also assesses the impact of these provisions on political competition, electoral fairness and democratic representation in Indonesia. It identifies potential constitutional conflicts and proposes legal reforms to enhance the legitimacy and inclusiveness of the presidential election process. Through a comprehensive legal review, this research aims to contribute to the ongoing discourse on electoral law and democratic governance in Indonesia.

Abstract

The realisation of human rights constitutes a crucial element in the establishment of social justice and the safeguarding of individual dignity. In Indonesia, legal policies pertaining to human rights have evolved since the advent of the reform era, with the advent of numerous regulations and the establishment of institutions dedicated to the protection of human rights. This research employs a literature study method to analyze the impact of legal policies on human rights enforcement in Indonesia. The study analyzes relevant regulations, legal precedents, and academic literature to identify challenges and opportunities in the implementation of human rights policies. The findings reveal that, although Indonesia has witnessed significant advancements in the legislative realm, persistent challenges persist in ensuring consistent policy implementation. These obstacles encompass deficiencies in law enforcement, shortcomings in institutional competence, and the influence of political dynamics upon policy implementation. Hence, enhancements in legal governance and the fortification of human rights institutions are indispensable to guarantee the effective enforcement of human rights in Indonesia.

Abstract

The objective of this research project is to conduct an in-depth examination of the role of law in environmental dispute resolution within the context of urban Yogyakarta. By employing a qualitative methodology, this study examines the factors affecting the implementation of environmental legislation and the efficacy of legal instruments in addressing disputes. This study seeks to elucidate the role of law in environmental dispute resolution in Yogyakarta, examine the obstacles and impediments encountered in the implementation of environmental law, and analyse the efficaciousness of the existing dispute resolution mechanisms. To this end, it employs qualitative methods, with a particular focus on primary data obtained through observation, interviews, and documentation. The findings demonstrate that, despite an adequate legal framework, the efficacy of environmental dispute resolution is constrained by challenges inherent in law enforcement, public awareness, and economic considerations.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi peran nilai-nilai filosofis hukum dalam membentuk landasan etika hukum di tengah transformasi digital yang sedang berlangsung di Indonesia. Fokusnya adalah untuk memahami bagaimana nilai-nilai tersebut dapat memandu praktik hukum dalam konteks teknologi digital yang semakin merambah ke dalam berbagai aspek kehidupan. Studi ini dilakukan dengan pendekatan studi pustaka yang mendalam terhadap literatur hukum, filsafat, dan etika, serta penelusuran teori-teori hukum terkait nilai-nilai filosofis. Hasil penelitian menunjukkan bahwa nilai-nilai filosofis hukum, seperti keadilan, kebenaran, dan kesetaraan, memiliki peran yang krusial dalam membentuk landasan etika hukum pada era transformasi digital. Nilai-nilai ini tidak hanya menjadi panduan dalam menghadapi tantangan etika baru yang muncul seiring dengan perkembangan teknologi digital, tetapi juga menjadi landasan untuk menjaga integritas, keadilan, dan kebenaran dalam sistem hukum Indonesia yang semakin terdigitalisasi. Dengan memahami dan menerapkan nilai-nilai filosofis hukum secara bijaksana, diharapkan bahwa hukum di Indonesia dapat tetap relevan, adil, dan beretika dalam menghadapi tantangan era digital yang terus berkembang.

Abstract

Makalah ini menyajikan analisis yuridis terhadap implementasi UU No. 39 Tahun 1999 tentang Hak Asasi Manusia di Indonesia. Penelitian ini menggunakan pendekatan penelitian doktrinal, dengan mengkaji teks-teks hukum, kasus-kasus hukum, dan literatur sekunder untuk mengevaluasi kerangka kerja hukum dan penerapan praktisnya. Tema-tema utama yang dianalisis meliputi kerangka hukum, mekanisme penegakan hukum, efektivitas kelembagaan, kesadaran masyarakat, dan perspektif komparatif. Temuan-temuan menunjukkan bahwa meskipun kerangka hukum yang ditetapkan oleh UU No. 39 tahun 1999 cukup kuat dan selaras dengan standar hak asasi manusia internasional, implementasinya menghadapi berbagai tantangan seperti keterbatasan sumber daya, kelemahan institusional, dan rendahnya kesadaran masyarakat. Analisis komparatif dengan yurisdiksi seperti India, Afrika Selatan, dan Filipina menyoroti praktik-praktik terbaik yang dapat diadaptasi ke dalam konteks Indonesia. Laporan ini diakhiri dengan rekomendasi untuk memperkuat Komnas HAM, mendorong independensi peradilan, meningkatkan akuntabilitas penegakan hukum, meningkatkan kesadaran publik, dan mengadopsi praktik-praktik terbaik internasional untuk meningkatkan implementasi hukum hak asasi manusia di Indonesia.

Abstract

Penelitian ini mengeksplorasi implikasi yuridis dan normatif dari UU No. 11/2008 tentang Informasi dan Transaksi Elektronik (UU ITE) terhadap UUD 1945, khususnya berfokus pada keseimbangan antara kebebasan berekspresi dan keamanan siber. UU ITE, yang diberlakukan untuk mengatur transaksi elektronik dan penyebaran informasi, telah menjadi bahan perdebatan mengenai kesesuaiannya dengan hak-hak konstitusional. Penelitian ini menggunakan analisis yuridis dan normatif untuk menilai bagaimana UU ITE sejalan dengan prinsip-prinsip yang diabadikan dalam UUD 1945, memeriksa ketentuan-ketentuannya dalam konteks menjaga kebebasan berekspresi sambil memastikan keamanan siber. Dengan mengevaluasi pasal-pasal kunci dan interpretasi hukum, studi ini menyoroti potensi konflik dan sinergi antara jaminan konstitusional dan regulasi siber. Temuan-temuan tersebut menggarisbawahi perlunya penyempurnaan legislatif untuk menyelaraskan kepentingan-kepentingan ini, dan menyarankan amandemen yang meningkatkan kepastian hukum dan melindungi hak-hak individu tanpa mengorbankan keamanan nasional. Analisis ini berkontribusi pada wacana yang sedang berlangsung tentang peran hukum dalam mengelola teknologi komunikasi dan informasi digital di Indonesia.
