Abstract

This research aims to analyze the role of law as an instrument of modernization in sustainable rural development in Indonesia. The problem faced is the lack of legal protection for rural communities, especially vulnerable groups such as women and children, as well as the inability of existing legal policies to be effectively implemented in the field. This research uses a qualitative method with a juridical sociological approach, collecting data from document analysis of laws and policies related to village development. The results show that the involvement of village communities and the support of NGOs are essential to improve the effectiveness of legal protection and development sustainability. In conclusion, strong legal protection and government and NGO collaboration are needed to create inclusive and sustainable rural development.ABSTRAKPenelitian ini bertujuan untuk menganalisis peran hukum sebagai instrumen modernisasi dalam pembangunan pedesaan yang berkelanjutan di Indonesia. Persoalan yang dihadapi adalah kurangnya perlindungan hukum bagi masyarakat desa, terutama kelompok rentan seperti perempuan dan anak-anak, serta ketidakmampuan kebijakan hukum yang ada untuk diterapkan secara efektif di lapangan. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis sosiologis, mengumpulkan data dari analisis dokumen peraturan perundang-undangan dan kebijakan terkait pembangunan desa. Hasil penelitian menunjukkan bahwa keterlibatan masyarakat desa dan dukungan NGO sangat penting untuk meningkatkan efektivitas perlindungan hukum dan keberlanjutan pembangunan. Kesimpulannya, perlindungan hukum yang kuat dan kolaborasi pemerintah serta NGO diperlukan untuk menciptakan pembangunan pedesaan yang inklusif dan berkelanjutan.

Abstract

This paper analyzes the gap between data protection regulations and the implementation of the right to privacy in Indonesia from a juridical normative perspective. Despite the enactment of the Personal Data Protection (PDP) Law in 2022, significant challenges remain in ensuring the protection of personal data. These challenges include vague legal definitions, limited enforcement mechanisms, and insufficient provisions for regulating emerging digital technologies such as artificial intelligence and big data. Additionally, public awareness of privacy rights remains low, further exacerbating the ineffective implementation of the law. Through a comparative analysis with international frameworks like the GDPR, this paper highlights key areas for improvement in Indonesia's data protection landscape. Recommendations include establishing a centralized data protection authority, enhancing legal provisions for technological advancements, and increasing public engagement to ensure the effective protection of privacy rights in the digital age.

Abstract

The rapid growth of digital platforms has given rise to new challenges in the protection of privacy rights, particularly in cases of digital slander. This study explores the intersection of privacy protection and digital slander dissemination in Indonesia, focusing on the impact of post-truth dynamics. Using a normative juridical approach, the research examines Indonesia’s legal framework, including the 1945 Constitution, the Electronic Information and Transactions Law (ITE Law), and the Personal Data Protection Law (PDPL), to evaluate the effectiveness of legal mechanisms in safeguarding individuals' privacy in the digital space. The study identifies key gaps in privacy protection, particularly in the context of the post-truth environment, where misinformation and emotional manipulation often overshadow factual accuracy. Comparative analysis with international legal frameworks highlights best practices that could inform reforms in Indonesia. The study concludes with recommendations for legal reforms aimed at enhancing privacy protection and addressing the complexities of digital slander in the era of post-truth.

Abstract

This study examines the legal arrangements in Indonesia for handling the spread of false information through social media bots, employing a normative juridical analysis. The proliferation of disinformation through automated bots has become a significant challenge to public trust, social cohesion, and democratic processes. This paper explores the adequacy of existing legal frameworks, such as the Information and Electronic Transactions Law (ITE Law), the Indonesian Penal Code, and the Election Law, in addressing bot-generated false information. The study identifies key challenges, including technological limitations, legal ambiguities, and jurisdictional issues, and compares Indonesia’s regulatory approach with that of the European Union and the United States. The research highlights the need for clear legal definitions, enhanced platform accountability, improved enforcement capabilities, and greater international cooperation to effectively address this issue. The study concludes with recommendations for legal reforms and increased public awareness to mitigate the adverse impact of social media bots on public discourse in Indonesia.

Abstract

Abstract. Viewed from the perspective of law enforcement, with the rarity of filing a claim for compensation or a request to merge a claim for compensation, it requires careful research because after all the core of law enforcement is upholding rights and carrying out obligations. The purpose of this study is to show that the use of the right to claim compensation or a request for compensation is very rare. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research was conducted. The results of this study indicate that the method of claiming compensation can be done by merging a claim for compensation in a criminal case, through unlawful acts and through a request for restitution.

Abstract

Penegakan hukum dilingkungan TNI dilakukan secara bersama-sama dalam suatu sistem peradilan pidana militer, yang melibatkan beberapa unsur, antara lain: Penyidik, Ankum, Oditur dan Papera. Papera/Komandan satuan mempunyai kewajiban membina prajurit dalam menentukan karier sesuai kompetensi yang dipersyaratkan dalam peraturan di lingkungan TNI. Keinginan dan harapan seorang Papera/Komandan satuan adalah anak buah/prajurit dibawahnya berbuat yang terbaik demi kemajuan organisasi TNI yang dipimpinnya, tetapi dalam faktanya karena sesuatu hal ada beberapa Prajurit yang melanggar peraturan perundang-undangan, dengan melakukan tindak pidana. Tujuan pengabdian ini untuk menunjukan bahwa Atasan yang berhak menghukum (Ankum)/Komandan satuan mempunyai kewajiban membina prajurit dalam menentukan karier sesuai kompetensi yang dipersyaratkan dalam peraturan di lingkungan TNI. Keinginan dan harapan seorang komandan satuan adalah anak buah/prajurit dibawahnya berbuat yang terbaik demi kemajuan organisasi TNI yang dipimpinnya, tetapi dalam faktanya karena sesuatu hal ada beberapa Prajurit yang melanggar peraturan perundang-undangan, dengan melakukan tindak pidana. pengabdian kualitatif menggunakan pendekatan deskriptif untuk menghimpun data secara sistematis, faktual, dan cepat sesuai dengan gambaran saat dilakukan pengabdian. Hasil pengabdian ini menunjukan bahwa di dalam proses hukum yang berlangsung, Atasan yang berhak menghukum (Ankum) dan Papera memiliki 2 (dua) jalur dalam upaya mempertahankan anggota prajurit nya untuk tidak dihukum atau tidak diberhentikan dengan tidak hormat (dipecat) karena adanya pertimbangan kepentingan militer dengan beberapa pertimbangan seperti prajurit TNI tersebut memiliki kemampuan yang sangat dibutuhkan oleh satuan, prajurit TNI tersebut dinilai sehari-harinya berkelakuan baik atau pertimbangan lainnya, sehingga Ankum dapat berupaya melalui 2 (dua) jalur tesebut yaitu memberikan rekomendasi untuk dipertahankan sebagai prajurit TNI dan mengajukan upaya hukum sesuai aturan perundang-undangan.

Abstract

This study analyzes the role of good faith (itikad baik) in commercial transactions within the framework of Indonesian business law using a normative juridical approach. Good faith, as a fundamental principle of contract law, is recognized in the Indonesian Civil Code (KUHPerdata), particularly Articles 1338 and 1339, which emphasize that contracts must be executed in good faith and in line with propriety. Despite its doctrinal importance, the interpretation and enforcement of good faith in Indonesia remain inconsistent. Judicial practice shows variations between a subjective approach—focusing on honesty of intention—and an objective approach—emphasizing fairness, reasonableness, and protection of counterpart interests. This inconsistency creates legal uncertainty and weakens business confidence. Comparative analysis with German, Dutch, and international frameworks such as the UNIDROIT Principles and CISG highlights the importance of codifying and applying good faith uniformly to promote fairness and predictability. The findings recommend clearer legislative guidelines, the adoption of objective standards, judicial consistency, and alignment with international practices to strengthen contractual stability and Indonesia’s competitiveness in global trade.

Abstract

Hukum adat, sebagai sistem normatif yang mengatur kehidupan masyarakat tradisional Indonesia, memiliki kompleksitas dan kedalaman yang sering kali luput dari pemahaman umum. Tujuan penelitian ini untuk menunjukan bahwa Memahami karakteristik-karakteristik ini penting untuk mengidentifikasi baik tantangan maupun peluang dalam upaya mengintegrasikan hukum adat ke dalam sistem hukum dan pembangunan modern Indonesia. Penelitian kualitatif menggunakan pendekatan deskriptif untuk menghimpun data secara sistematis, faktual, dan cepat sesuai dengan gambaran saat dilakukan penelitian. Hasil penelitian ini menunjukan bahwa Kedudukan hukum adat dalam sistem hukum nasional Indonesia bersifat ambivalen. Di satu sisi, ada pengakuan formal dan upaya-upaya untuk mengintegrasikannya. Di sisi lain, implementasi praktisnya sering terhambat oleh dominasi hukum nasional dan kebijakan pembangunan yang cenderung mengabaikan kearifan lokal.

Abstract

Hukum adat seringkali dipandang sebagai anomali, tidak sejalan dengan tuntutan zaman modern yang mengedepankan efisiensi dan uniformitas. Tujuan penelitian ini untuk menunjukan bahwa Hukum adat, dengan filosofi keseimbangan dan keberlanjutannya, justru menyimpan kunci untuk mengatasi berbagai persoalan kontemporer yang dihadapi oleh masyarakat modern .Penelitian kualitatif menggunakan pendekatan deskriptif untuk menghimpun data secara sistematis, faktual, dan cepat sesuai dengan gambaran saat dilakukan penelitian. Hasil penelitian ini menunjukan bahwa sistem penyelesaian sengketa berbasis adat masih memiliki potensi besar dalam menjaga harmoni sosial dan memberikan akses keadilan yang lebih baik bagi masyarakat.

Abstract

This paper explores the historical development and contemporary issues of constitutionalism and the rule of law in Indonesia through juridical analysis and literature review. The study traces the evolution of Indonesian law from the colonial period, through the ratification of the 1945 Constitution, the Guided Democracy and New Order regimes, and the Reformation era. It highlights key milestones and challenges in building a strong constitutional democracy. Contemporary issues such as judicial independence, human rights, and governance are analysed to understand ongoing efforts and obstacles in strengthening the rule of law in Indonesia. By synthesising existing literature and legal texts, this paper provides a comprehensive overview of Indonesia's legal trajectory and current challenges, and offers insights into future reforms needed to enhance constitutional governance.
