Abstract

Desa Cibunar, Kecamatan Rancakalong, Kabupaten Sumedang memiliki potensi lokal yang besar berupa keanekaragaman budaya, usaha mikro, kecil, dan menengah (UMKM), serta hasil pangan lokal. Namun, potensi tersebut belum sepenuhnya dipahami dan dimanfaatkan secara optimal oleh masyarakat, terutama dalam aspek pengelolaan, promosi, dan keberlanjutan. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pengetahuan dan kesadaran masyarakat melalui kegiatan sosialisasi dan edukasi terkait potensi budaya, UMKM, dan pangan lokal Desa Cibunar. Metode pelaksanaan kegiatan dilakukan melalui pendekatan partisipatif berupa sosialisasi, edukasi, pendampingan, serta keterlibatan langsung dalam aktivitas masyarakat, termasuk kegiatan pendidikan, UMKM, kesehatan, dan pelestarian budaya. Sasaran kegiatan meliputi masyarakat desa, pelaku UMKM, anak-anak usia sekolah, serta kader masyarakat. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat terhadap pentingnya pelestarian budaya lokal, pengembangan UMKM berbasis potensi desa, serta diversifikasi dan pemanfaatan hasil pangan lokal. Kegiatan sosialisasi juga mendorong partisipasi aktif masyarakat dalam kegiatan pendidikan, kesehatan, dan ekonomi kreatif, serta memperkuat sinergi antara mahasiswa dan masyarakat desa. Simpulan dari kegiatan ini adalah bahwa sosialisasi dan edukasi yang dilakukan secara partisipatif mampu menjadi strategi efektif dalam mendukung pemberdayaan masyarakat desa berbasis potensi lokal. Kegiatan ini diharapkan dapat menjadi model pengabdian masyarakat yang berkelanjutan dan direplikasi di desa lain dengan karakteristik serupa.

Abstract

Children in conflict with the law constitute a vulnerable group that requires special legal treatment to safeguard their rights and mitigate the adverse effects of criminal proceedings on their physical, psychological, and social development. In Indonesia, this protection is primarily governed by Law Number 11 of 2012 on the Juvenile Criminal Justice System, which prioritizes restorative justice and diversion as the main approaches for resolving juvenile cases. This study examines the regulatory framework, implementation, and effectiveness of legal protection for children in conflict with the law, with particular attention to the application of restorative justice and diversion and the fulfillment of children’s rights at each stage of the criminal justice process. The research employs a normative juridical approach, supported by empirical case data from the West Java High Prosecutor’s Office covering 2022–2024 (n = 788), with cases predominantly involving boys. The findings indicate that although the existing legal framework provides relatively comprehensive safeguards, implementation remains suboptimal due to inconsistent application of norms, weak inter-agency coordination, and limited social support for rehabilitation and reintegration. Strengthening institutional coordination, improving procedural compliance, and expanding community-based support are therefore essential to enhance the effectiveness of child protection within the juvenile justice system.

Abstract

ABSTRACTThe increasing criminalization of Notaries as a result of the expansion of legal liability beyond the limits of formal truth in the making of authentic deeds has created a chilling effect on civil legal services in Indonesia. This study aims to examine and analyze the disconnection of Notarial legal responsibility, as well as the impact of criminalization and the resulting chilling effect on civil law services in Indonesia. The research employs a normative juridical method using statutory and qualitative descriptive approaches. The results of this study indicate that the disconnection in the limits of Notarial formal liability and the increasing criminalization of Notaries have generated a chilling effect that adversely affects legal certainty, civil legal services, and public trust in authentic deeds.Keywords: Legal Protection; False Statements; Appearing Parties; Authentic Deed.ABSTRAKMeningkatnya kriminalisasi terhadap Notaris sebagai akibat dari perluasan pertanggungjawaban hukum oleh notaris yang melampaui batas kebenaran formil dalam pembuatan akta autentik, sehingga menimbulkan chilling effect terhadap pelayanan hukum keperdataan di Indonesia. Penelitian ini bertujuan untuk mengetahui dan menganalisis diskoneksi tanggung jawab hukum Notaris serta dampak kriminalisasi dan chilling effect terhadap pelayanan hukum keperdataan di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan dan analisis deskriptif kualitatif. Hasil penelitian ini menunjukkan bahwa diskoneksi batas pertanggungjawaban formil Notaris dan meningkatnya kriminalisasi telah menimbulkan chilling effect yang berdampak pada kepastian hukum, pelayanan hukum keperdataan, dan kepercayaan masyarakat terhadap akta autentik.Kata Kunci: Perlindungan Hukum; Keterangan Palsu; Penghadap; Akta Otentik.

Abstract

Press freedom is currently facing new challenges along with the development of information technology. In the midst of the application of the ITE Law and the Criminal Code on press freedom, it has caused a special debate about the boundary between enforcement and protection of press activities. Although press freedom has been specifically regulated in Law No. 40 of 1999 concerning the Press, law enforcement practices still show the use of other articles that have the potential to limit press activities. This study aims to analyze juridically and sociologically the dynamics of press freedom in the implementation of the ITE Law and the Criminal Code in Indonesia. The method used is normative legal research with a legal, conceptual, and sociological approach to law, through the study of legal norms, principles, and doctrines relevant to press freedom. The results of the study show that the ITE Law and the Criminal Code on press freedom often override the press law as lex specialis. As a result, the settlement of press disputes is easily contravened by interests directed at the criminal mechanism rather than the ethical mechanism and the right of reply that has been regulated in the press law. This condition has a juridical effect, legal and sociological uncertainty, resulting in a chilling effect for press personnel and potentially limiting the function of the press as a supervisor of power. This research contributes to the development of press law through strengthening the concept  of lex specialis of the Press Law and harmonizing regulations to ensure the protection of press freedom in a democratic legal country.

Abstract

Integrasi masif Kecerdasan Buatan (AI) ke dalam arsitektur E-Notary Indonesia menjanjikan efisiensi administratif yang eksponensial sekaligus memicu ancaman eksistensial terhadap sistem hukum perdata melalui Paradoks Keadilan Algoritma. Jauh dari entitas yang bebas nilai, arsitektur kotak hitam AI secara inheren rentan untuk secara diam-diam mereplikasi dan memperkuat bias historis. Ketidakjelasan algoritma ini secara sistematis menurunkan prinsip dasar ketidakberpihakan notaris dan mengancam untuk menghilangkan status akta otentik sebagai bukti sempurna (volledig bewijskracht). Krisis struktural ini semakin diperparah oleh kekosongan akut norma hukum dan disonansi tajam antara UU Notaris (UUJN), yang menjunjung doktrin kehadiran fisik, dan UU Informasi dan Transaksi Elektronik (UU ITE), yang secara eksplisit mengecualikan akta notaris dari kategori dokumen elektronik yang sah. Dengan menggunakan penelitian yuridis normatif dengan pendekatan konseptual, studi ini secara kritis menganalisis bahaya ketidakjelasan sistem otonom tersebut. Berlandaskan pada Teori Hukum Progresif, terdapat kebutuhan mendesak akan rekonstruksi regulasi yang mutlak untuk menyinergikan inovasi digital dengan keadilan substantif. Tata kelola ini diusulkan melalui tiga pilar: melembagakan Kecerdasan Buatan yang Dapat Dijelaskan (Explainable AI/XAI) untuk memastikan transparansi pengambilan keputusan, mewajibkan pengawasan Manusia dalam Lingkaran (Human-in-the-Loop/HITL) sebagai otoritas diskresioner akhir, dan memanfaatkan keamanan kriptografi berbasis blockchain untuk menjamin kekebalan data.

Abstract

In recent years, the trafficking of women, particularly young girls, has shown a significant increase, representing a humanitarian crisis that requires urgent attention. The rapid advancement of information technology has transformed recruitment methods, where strategies such as phishing, algorithmic manipulation, and false promises through social media have become dominant instruments. However, the Law on the Eradication of Human Trafficking Crimes (Law No. 21 of 2007) has yet to accommodate an operational definition of “digital fraud,” creating disharmony with the Personal Data Protection Law (Law No. 27 of 2022) and the Sexual Violence Crime Law (Law No. 12 of 2022). This legal gap contradicts the principles of legality and legal certainty, ultimately weakening victim protection. Structural factors such as poverty and non-inclusive policies including the abolition of sectoral minimum wages under the Omnibus Law on Job Creation further exacerbate the vulnerability of rural women to exploitation. Therefore, a comprehensive revision of the Anti-Trafficking Law is urgently needed, integrating the principles of human rights protection, non-discrimination, and legal harmonization through the adoption of the Palermo Protocol, the ratification of ILO Convention C190, and the strengthening of community empowerment and digital literacy. These efforts are expected to realize substantive justice and enhance the effectiveness of Indonesia’s criminal law in breaking the chain of technology-based female trafficking.

Abstract

In recent years Cybercrime, including social engineering techniques, has become a serious threat in the digital era, requiring comprehensive handling. This discussion outlines the basic concepts of cybercrime, social engineering techniques, and the urgency from legal, regulatory, technological, and public awareness perspectives. Regulations such as Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE) are deemed insufficient to address the evolving complexity of cybercrime. Challenges in law enforcement, such as the transnational nature of crimes and limited resources, necessitate stronger regulations and enhanced capacity of law enforcement agencies. On the other hand, the development of advanced cybersecurity technologies, user education, and increased public awareness are crucial steps to prevent cyberattacks. Collaboration between government, private sector, and society is considered key to creating a secure digital environment. Recommendations include strengthening regulations, investing in security technologies, training IT professionals, and conducting public awareness campaigns. Through a holistic approach, it is hoped that the threat of cybercrime can be effectively minimized.

Abstract

This study examines legal vulnerabilities and the role of institutions in addressing sexual exploitation within mentor–mentee relationships in higher education. It highlights the power imbalances that make female students particularly vulnerable to becoming victims, the gaps within the existing legal framework, and the systemic challenges that perpetuate a culture of “silencing” around this issue. Although the Sexual Violence Crime Law (UU TPKS) provides a legal basis for victim protection, its implementation in universities remains largely ineffective. This article explores the importance of stronger institutional policies, improved reporting mechanisms, and awareness programs to prevent exploitation. The study emphasizes the crucial role of universities in creating a safe and ethical academic environment by ensuring that legal actions and internal policies align to protect victims and hold perpetrators accountable.

Abstract

Cases of human trafficking involving Indonesian citizens in the online gambling sector abroad have been increasing, highlighting the urgency of more effective legal protection. This study aims to evaluate gaps in Indonesia's legal system, particularly in the implementation of Law No. 21 of 2007 and the effectiveness of international cooperation in handling cross-border cases. The research employs a normative juridical approach by analyzing regulations, court rulings, and related policies to identify weaknesses in victim protection mechanisms. It also examines the role of law enforcement agencies and relevant institutions in the investigation and repatriation process of human trafficking victims. The findings reveal that legal protection for victims of human trafficking in the online gambling sector under Law No. 21/2007 faces challenges related to jurisdiction, legal system differences, and corruption. The implementation of international cooperation remains suboptimal, leading to ineffective victim protection. Therefore, regulatory revisions, strengthened repatriation and rehabilitation mechanisms, and an anti-corruption oversight system are needed to ensure justice for victims.

Abstract

Workplace violence against healthcare workers remains a persistent risk in health facilities, negatively impacting occupational safety, service quality, and institutional accountability. This research analyzes the scope of legal protection for healthcare workers in cases of violence, using one of the cases in public controversy as a contextual entry point to discuss the full spectrum of violence. The study aims to map the legal framework governing healthcare workers’ protection, examine hospitals’ responsibilities in prevention and response, and formulate feasible protection mechanisms and operational policy recommendations. Utilizing a normative-juridical approach with statutory and conceptual frameworks, the analysis indicates that Law Number 17 of 2023 concerning health explicitly recognizes healthcare workers’ rights to legal protection and occupational safety. However, significant implementation gaps persist at the institutional level, including weak reporting channels, inconsistent standard operating procedures, and insufficient anti-retaliation safeguards. The study concludes that effective protection requires translating statutory rights into robust operational hospital governance through zero-tolerance policies, integrated incident reporting and investigation systems, and comprehensive recovery support for victims.
