Abstract

Abstract A classic issue that still raises debate is the adaptability of Islamic law. Scholars of Islamic law are required to broaden the approach in responding to problems in the community. Philosophy, sociology, and anthropology are considered appropriate to be used as an approach in determining the law. This research uses a library research method that aims to describe the determination of Islamic law through philosophical, sociological, and anthropological approaches. From this research, it is found that in the context of determining the law, the disciplines of sociology, philosophy, and anthropology are a tool to approach in determining the law, not a methodology. The methodology of Islamic law istinbath is considered sufficient by using methods that have been developed by fuqaha scholars both salaf and contemporary. Keywords: Ijtihad, Taklid, Istinbath, Abstrak Persoalan klasik yang masih menimbulkan perdebatan adalah kemampuan adaptasi hukum Islam. Para sarjana hukum Islam dituntut untuk melakukan perluasan pendekatan dalam merespon permasalahan di umat. Filsafat, sosiologi, dan antropologi dipandang tepat untuk dijadikan alat pendekatan dalam menetapkan hukum. Penelitian ini menggunakan metode penelitian kepustakaan atau library research yang bertujuan untuk mendeskripsikan penetapan hukum Islam melalui pendekatan filosofis, sosiologis, dan antropologis. Dari penelitian ini ditemukan bahwa dalam kontkes penetapan hukum, disiplin sosiologi, filsafat, dan antropologi adalah sebuah alat untuk melakukan pendekatan dalam penetapan hukum, bukan merupakan metodologi. Metodologi istinbath hukum Islam dipandang telah mencukupi dengan menggunakan metode yang telah dikembangkan oleh para ulama fuqaha baik salaf maupun kontemporer. Abstract

Abstract This study examines the division of Islamic law into immutable laws (tsawâbit) and changeable laws (mutaghayyirât) within the framework of Sharia. The article highlights the importance of understanding immutable laws as an unchanging foundation, while flexible laws should be interpreted and implemented according to the continuously evolving social and cultural dynamics. In the post-revelation era, the task of Muslims is to interpret and apply the revelation in the context of the modern and ever-changing society. The plurality of interpretations and the diversity of expressions in practicing Islam are considered inevitable and not erroneous as long as the methodology used is accountable. The concept of the "Islamic peaceful path" developed by Nusantara scholars is expected to provide solutions to resolve conflicts and tensions, as well as to promote progress in various aspects of life, including science and economy. Keywords: Division, Immutable and Changeable Laws Abstrak Penelitian ini mengkaji pembagian hukum Islam menjadi hukum yang tetap (tsawâbit) dan yang berubah (mutaghayyirât) dalam konteks syariah. Artikel ini menyoroti pentingnya pemahaman terhadap hukum yang bersifat tetap sebagai fondasi yang tidak berubah, serta fleksibilitas hukum yang bersifat berubah agar dapat diinterpretasikan dan diimplementasikan sesuai dengan dinamika sosial dan budaya yang terus berkembang. Pasca era pewahyuan, tugas umat Islam adalah menafsirkan dan mengaplikasikan wahyu dalam konteks masyarakat modern yang terus berubah. Pluralitas penafsiran dan keragaman ekspresi pengamalan Islam dianggap tak terhindarkan dan bukan merupakan kesalahan selama metodologi yang digunakan dapat dipertanggungjawabkan. Konsep "jalan damai Islam" yang dikembangkan oleh ulama Nusantara diharapkan dapat menjadi solusi untuk menyelesaikan konflik dan ketegangan, serta mendorong kemajuan dalam berbagai aspek kehidupan, termasuk ilmu pengetahuan dan ekonomi. Abstract

Economic development in the 20th century had a huge impact on the sustainable development of mankind. On the other hand, however, it has a negative impact on living ecosystems. In many aspects such as the orientation of the interests of sustainable development, the economy and the environment are considered as two opposing aspects. Sustainable Development Based on this, a relatively new concept emerged, namely the green economy. The green economy is a concept that supports human well-being and cares about environmental and ecosystem sustainability in economic development. But on the negative side, economic development can also have an impact on the reduction of natural resources through over-exploitation, industrial pollution, oil, water, and air pollution due to flooding, and the impact on climate change. Islam has an ideal concept of sustainable development. At least there are fundamental rules for supporting sustainable development, namely the implementation of fiqh al-bi'ah based on maqashid sharia for the management of Islamic resources in the economy. Islam has an ideal concept of sustainable development. At least there are basic rules to support sustainable development, namely the application of fiqh al-bi'ah based on maqashid Sharia law to manage Islamic resources in the economy.

Abstract

Penelitian ini bertujuan mengkaji Da'im Al-Ahkam, konsep fundamental dalam hukum Islam yang menegaskan sifat universal, abadi, dan kosmopolitan syariat. Kami menyelidiki bagaimana Islam mempertahankan relevansi dan kemaslahatannya di tengah dinamika zaman, dengan menganalisis keselarasan antara pembuat hukum, individu, dan objek hukum. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan studi pustaka, menelaah literatur primer dan sekunder seperti Al-Qur'an, Hadis, dan kitab Ushul Fiqh. Pengumpulan data dilakukan melalui dokumentasi, dilanjutkan analisis deskriptif-analitis dan interpretatif. Hasilnya menunjukkan Da'im Al-Ahkam adalah fondasi filosofis yang memastikan hukum Islam berlaku universal, abadi, dan kosmopolitan. Asas-asas kunci seperti A'damul Haraj (menghilangkan kesulitan), Taqlilut Taqalif (meringankan beban), dan At-Tadrij Fit Tasyri' (penetapan bertahap) menunjukkan fleksibilitas syariat dalam mengakomodasi kapasitas manusia. Dampak penelitian ini adalah menegaskan bahwa Islam bukan hanya seperangkat aturan, melainkan sistem komprehensif yang dirancang untuk kebaikan dan kesejahteraan manusia sepanjang masa, mampu merespons tantangan zaman dengan hikmah ilahi dan menjadi pemersatu masyarakat.

Abstract

Both directly and indirectly, Sharia banking regulations in Indonesia are heavily influenced by the Fatwa of the National Sharia Council-Indonesian Ulema Council. In its fatwas, the National Sharia Council-Indonesian Ulema Council cites many fiqh principles as one of its legal foundations which shows that fiqh rules occupy a crucial position in the fatwas issued by the National Sharia Council-Indonesian Ulema Council. But unfortunately, research and scientific studies related to fiqh principles are currently still relatively few and receive less attention from academics. Therefore, this study aims to find out how fiqh principles are used in the National Sharia Council-Indonesian Ulema Council fatwas related to sharia banking to fill the void in scientific studies and attract scientific interest in this field. This research is normative legal research/legal research. The data used in this study were obtained from the Sharia Banking Fatwa Association compiled by the National Sharia Council-Indonesian Ulema Council. The data is then analyzed using a qualitative content analysis technique, which analyzes the contents of various texts and then systematically transforms them into a very organized and concise main summary. The results of this study indicate that from 2000 to 2018, the National Sharia Council-Indonesian Ulema Council issued 90 fatwas related to Islamic banking. Of the 90 fatwas, 87 fatwas used fiqh principles as one of their legal foundations. Overall, the fiqh principles used in the National Sharia Council-Indonesian Ulema Council Fatwa regarding Islamic banking total 39 principles with a frequency of use of 266 times. Where the rule "Basically, all forms of muamalah may be carried out unless there is an argument that forbids it" is the rule most often used with a frequency of use of 85 times and Fatwa 118/DSN-MUI/II/2018 concerning Guidelines for Guaranteeing Deposits for Customers of Sharia Banks is a fatwa that the most use of fiqh rules is as many as 11 rules. Then, the generalization of the 39 fiqh principles used in the National Sharia Council-Indonesian Ulema Council Fatwa regarding sharia banking has at least produced several theories, namely the theory of origin law, the theory of maslahat, the customary theory, the Khilafah theory, the wasilah theory, the promise theory, the majority theory, and several another theory. In addition, the National Sharia Council-Indonesian Ulema Council fatwas related to sharia banking has also made a positive contribution to the development of sharia banking in Indonesia. Finally, for future researchers, we provide suggestions in the form of future research related to the principles of fiqh and the National Sharia Council-Indonesian Ulema Council Fatwa.
