Abstract

The rule of law as stated in the Constitution of the Republic of Indonesia, namely article 1 Section 3 of the 1945 Constitution which states explicitly that the State of the Republic of Indonesia is a rule of law, of course, has juridical consequences that must be accounted for in the practice of community life, nation, and state. By claiming to be a rule of law, Indonesia must fulfill and realize all the requirements and principles contained in a rule of law, namely the state has the obligation and provides legal certainty for protection to realize the welfare of its citizens. The research method used is normative legal research. the welfare state is briefly described as a series of public policies and state activities in integrating economic policies and social policies for the sake of achieving prosperity.

Abstract

The purpose of writing this article aims to provide an understanding related to how the status of property rights certificates with the enactment of the negative publication system. The research method used is a normative research method. The results of the research are (1) The regulation of land ownership rights by the people in Indonesia is regulated in Law no. 5 of 1960 concerning Agrarian Principles which was later explained in more detail through Government Regulation no. 24 of 1997 concerning Land Registration as the legal basis and contains procedures for the process and settlement and, (2) Legal certainty regarding land ownership rights with the application of a negative publication system is evidenced by a land certificate which will have a permanent position after 5 (five) years. ) years no one has sued or proved otherwise. Tujuan dari penulisan artikel ini bertujuan untuk memberikan pemahaman yang berkaitan dengan bagaimana kedudukan sertipikat hak milik dengan berlakunya sistem publikasi negatif. Metode penelitian yang digunakan adalah metode penelitian normative dengan pendekatan perundang-undangan dan konseptual. Hasil penelitiannya adalah (1) Pengaturan hak atas kepemilikan tanah oleh masyarakat di Indonesia diatur dalam Undang-Undang No. 5 Tahun 1960 tentang Pokok – Pokok Agraria yang kemudian dijelaskan lebih detail melalui Peraturan Pemerintah No. 24 Tahun 1997 Tentang Pendaftaran Tanah sebagai dasar hukumnya dan memuat mengenai tata cara proses dan penyelesaiannya dan, (2) Kepastian hukum mengenai hak atas kepemilikan tanah dengan berlakunya sistem publikasi negatif dibuktikan dengan sertipikat tanah yang dimana akan memiliki kedudukan yang tetap ketika setelah 5 (lima) tahun tidak ada yang menggugat atau membuktikan sebaliknya.

Abstract

The purpose of this study is to analyze the provisions of e-ciggarette in several countries in Southeast Asia and then to examine the existing regulations in Indonesia to date. The research method used in this study is a normative legal research method with an invitation approach and a comparative approach. Results from smoking studies (show) that in neighboring countries, policies towards e-cigarettes vary. In Brunei Darussalam, Malaysia, Singapore and Vietnam, e-cigarettes are equated with tobacco cigarettes so that they use existing regulations in terms of importation, sale, and so on. Meanwhile in Cambodia, there are new regulations at the level of a Circular, Ministry of Assistance that increase sales, and places where e-cigarettes are not permitted. Thailand chose to combine existing regulations and issue new regulations related to e-cigarettes. However in Indonesia this has not been done and is only profit-oriented 57% of the customs according to the country. Tujuan studi ini adalah untuk menganalisis ketentuan e-ciggarette pada beberapa Negara di Asia Tenggara yang kemudian dikaitkan dengan regulasi yang ada di Indonesia hingga saat ini. Metode penelitian yang digunakan dalam studi ini adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan perbandingan. Hasil dari penelitian menyatakan (menunjukkan) bahwa di negara-negara tetangga, kebijakan terhadap rokok elektrik bervariasi. Di Brunei Darussalam, Malaysia, Singapura dan Vietnam rokok elektrik disamakan dengan rokok tembakau sehingga menggunakan aturan yang sudah ada baik itu dalam hal importasi, penjualan, dan sebagainya. Sementara di Kamboja, ada ada aturan baru setingkat Surat Edaran Kementerian yang mengatur impor, penjualan, dan tempat-tempat yang tidak diperbolehkan mengonsumsi rokok elektrik. Thailand memilih mengombinasikan antara aturan yang sudah ada dan menerbitkan regulasi baru terkait rokok elektrik. Namun di Indonesia hal tersebut belum dilakukan dan hanya berorientasi pada keuntungan 57% dari bea cukai yang dibayarkan kepada negara.

Abstract

The purpose of this study is to analyze the arrangements related to marriage agreements in Indonesia and examine the authority possessed by notary related to marriage agreements after the Constitutional Court Decision. This paper is a normative legal research method since the focus of the study departs from the vagueness of norms by using several approaches: statute approach, conceptual approach, and analytical approach. The results of the study indicated that arrangements related to marriage agreements are subject to the provisions of the Marriage Law and the Civil Code. Referring to the provisions in Article 29 of the Marriage Law, it is understood that at or before the marriage takes place both parties with mutual consent can enter into a written agreement ratified by the civil registration officer, after the contents also apply to third parties. Furthermore, there has been a change in the authority of the Notary after the Constitutional Court’s Decision, however, until now the Notary has not been able to ratify the marriage agreement as referred to in the Constitutional Court’s Decision. For that we need a new mechanism that can be regulated in implementing regulations related to the authority of a Notary to ratify a marriage agreement, which the result that the ratification of a marriage agreement made by anNotary can be accessed by the public and can provide legal certainty for the parties involved in the marriage agreement, including third parties and also notaries who ratify.

Abstract

The problem of equating the concepts of dispute and default results as legal practitioners tending to assume that every case with an arbitration clause is a dispute that must be examined at an arbitration institution even though the case is not necessarily a dispute because cases, disputes and default have different concepts, nature and causes. According to international instrument, arbitration clause is mandatory for cases that submitted to the arbitration. It shall have clearly regulated under agreement of the parties to the dispute. Thus if there a dispute when implementing their agreement then the settlement brought before arbitration. Unfortunately in the reality is different. This research is used normative legal research methods with approaches: (1) Analitical and Conceptual Approach, and (2) The Statue Approach. The result of this research is between arbitration institutions and general justice must implimentated in harmony and must contribute to each other in creating justice, certainty and benefit of the law in carrying out their duties. Only with this harmony will creating a suitability of judicial competence which is fair to all parties. Regulation regarding the definition of arbitration dispute should be clearly and explicitly stipulated in the general provisions of the Arbitration Law and Alternative Dispute Resolution so that all parties may understanding to and the justice, legal certainty in determining in related cases of the competence of arbitration can be achieved.

Abstract

The purpose of this study is to gain insight and knowledge related to why the notary's authority is needed to receive money deposits in transactions between parties related to deeds made and to find out about the formulation of the notary's authority to receive money deposits in transactions between parties related to deeds made in the future. The type of research used in this study is a normative legal research. The urgency of the need for the notary's authority to receive money deposits in transactions between parties related to deeds made, if an official takes action outside his authority, it is called an unlawful act. The formulation of the notary's authority to receive money deposits in transactions between parties related to deeds made in the future by prioritizing the prudential principle or the principle of caution which is a principle that requires a notary to pay attention to and consider all possible impacts or risks that may occur due to his actions in carrying out his duties as a notary. Tujuan penelitian ini ialah guna mendapatkan wawasan dan pengetahuan terkait mengapa diperlukannya kewenangan notaris dalam menerima titipan uang dalam transaksi para pihak berkenaan dengan akta yang dibuatnya serta untuk mengetahui mengenai formulasi kewenangan notaris dalam menerima titipan uang dalam transaksi para pihak berkaitan dengan akta yang dibuatnya di masa yang akan datang. Jenis penelitian yang dipergunakan dalam penelitian ini adalah jenis penelitian hukum normatif. Urgensi diperlukannya kewenangan notaris dalam menerima titipan uang dalam transaksi para pihak berkaitan dengan akta yang dibuatnya, apabila seorang pejabat melakukan tindakan diluar wewenangnya, maka disebut sebagai perbuatan melanggar hukum. Formulasi kewenangan notaris dalam menerima titipan uang dalam transaksi para pihak berkaitan dengan akta yang dibuatnya di masa yang akan datang dengan mengedepankan prudential principle atau prinsip kehati-hatian yang merupakan prinsip yang mengharuskan seorang notaris untuk memperhatikan dan menimbang segala kemungkinan dampak atau risiko yang mungkin terjadi atas tindakannya dalam menjalankan tugasnya sebagai notaris.
