Abstract

Indonesia has aggressively combated narcotics over the past decade, yet it remains one of the countries with the highest incidence of narcotics offenses, exacerbated by cross-border trafficking. To prevent and eradicate narcotics abuse and illicit trafficking that endanger society, the nation, and the state, Law Number 35 of 2009 on Narcotics was enacted. This law regulates the use of narcotics for medical purposes, health services, and physical and social rehabilitation, and also stipulates sanctions such as imprisonment, fines, rehabilitation, and capital punishment. This study aims to examine the factors that cause offenders to become victims of narcotics abuse and to analyze criminal liability for victims of narcotics abuse based on Decision Number 193/Pid.Sus/2025/PN.Sdn. This research employs a qualitative approach with descriptive analysis. The findings indicate that narcotics abuse is caused by internal factors and external environmental factors, including lack of family attention and support during adolescent development, peer influence, and free social interaction, all of which may lead to narcotics abuse and jeopardize the future of young individuals. Criminal liability for narcotics abusers may be imposed under Article 127 paragraph (1) letter (a) of Law Number 35 of 2009 on Narcotics, with a maximum imprisonment of four (4) years. Therefore, this situation requires an active role of the government in increasing public legal awareness of the dangers of narcotics, as well as community participation in narcotics eradication efforts.

Abstract

The illegal distribution of psychotropic substances in Indonesia, particularly in relation to the misapplication of Article 112 of Law Number 35 of 2009, constitutes a critical challenge to the effective implementation of essential regulations. A significant number of cases show that users or individuals who merely “possess” prohibited substances are sentenced to severe penalties without adequate consideration of their personal background, thereby necessitating a comprehensive understanding of criminological aspects and the burden of criminal liability. This study employs doctrinal legal research combined with empirical legal methods. Data were collected through observational research and literature review. The analysis was conducted using qualitative legal analysis through an explanatory approach. The findings reveal that the factors motivating selected offenders to act as providers include a combination of intrinsic and extrinsic motives, ranging from financial pressure to psychological deterioration caused by substance dependence. From a juridical perspective, the imposition of criminal liability in Decision Number 257/Pid.Sus/2025/PN.Mgl is consistent with the elements of intent (mens rea) and the defendant’s capacity to bear criminal responsibility. In sentencing, the judge emphasized substantive justice by imposing a prison sentence of three (3) years, taking into account that the narcotics were intended for personal use.

Abstract

Cases of Domestic Violence (DV) as reflected in Court Decision Number 544/Pid.Sus/2025/PN Tjk illustrates how violence within the household sphere can develop into a criminal case that must be resolved judicially through proceedings. The research problems addressed in this study are the factors causing the occurrence of Domestic Violence (DV) crimes and the judicial considerations in imposing sanctions on perpetrators of Domestic Violence (DV) based on Court Decision Number 544/Pid.Sus/2025/PN Tjk. The research method employed is a normative juridical approach combined with an empirical approach, and the conclusions are drawn using deductive reasoning to provide a general overview of the answers to the research problems based on the findings of the study. The results of the study indicate that Domestic Violence (DV) crimes are influenced by multidimensional factors, such as economic conditions, inability to control emotions, unequal power relations, and patriarchal culture, which are exacerbated by the victim's economic and psychological dependence and low level of legal awareness. A victimological perspective shows that victims of DV are in a weak and vulnerable position, indicating that DV is a social problem requiring state intervention. Based on Court Decision Number 544/Pid.Sus/2025/PN Tjk, judges impose sanctions by considering juridical, sociological, and philosophical aspects, including the physical and psychological impacts suffered by victims, in order to achieve deterrence, justice, and legal protection for victims of Domestic Violence. Recommendations suggest that law enforcement officers, the government, and the community need to strengthen efforts to prevent Domestic Violence through legal education, increased awareness of equality within households, and economic and psychological protection for victims. Inter-institutional synergy and preventive–rehabilitative approaches are essential to break the cycle of violence. Judges, in deciding Domestic Violence cases, are expected to prioritize victim protection and substantive justice by considering the sociological and psychological aspects of victims and applying a victimological perspective, so that court decisions provide not only legal certainty but also maximum protection for victims.

Abstract

Kasus anak yang ikut serta dalam jaringan narkotika telah menjadi sebuah tantangan yang tidak kunjung surut dalam upaya melindungi generasi muda pemerus bangsa. Anak selaku pihak yang mengembani tanggung jawab atas keberlanjutan serta kemajuan negara telah seharusnya dipelihara, hal tersebut selaras dengan pembukan aline-4 yang menyatakan “melindungi segenap bangsa Indonesia dan tumpah darah Indonesia.”. Pemidanaan bagi pelaku penyalahgunaan narkoba merupakan hal yang selaras dengan tata cara penegakan Undang-Undang yang berlaku di Indonesia akan tetapi dalam konteks anak yang berhadapan dengan hukum tata cara penegakan pidananya terdapat perbedaan. Anak yang ikut serta dalam tindak pidana narkotika akan dianggap sebagai korban dikarenakan anak adalah kaum rentang yang sudah sepatutnya dilindungi. Permasalahan yang akan diteliti dalam skripsi ini ialah bagaimana bentuk perlindungan hukum terhadap anak yang terlibat dalam jaringan peredaran narkotika berdasarkan putusan nomor 35/Pid.Sus-Anak/2025/PN.Tjk serta apa saja faktor penghambat dalam upaya perlindungan anak yang terlibat dalam jaringan peredaran narkotika berdasarkan putusan nomor 35/Pid.Sus-Anak/PN.Tjk. Penelitian ini menggunakan pendekatan yuridis normatif dan empiris, dengan terdiri dari data sekunder dan data primer. Dengan pengumpulan data melalui studi kepustakaan, serta wawancara dengan hakim dan pihak kepolisian. Sebagai pembahasan dalam penelitian ini bentuk perlindungan hukum pada anak yang terlibat dalam jaringan narkotika ialah dengan pemeriotasan rehabilitasi baik secara medis maupun sosial agar anak dapat bertumbuh kembang secara optimal, pengurangan pemidaan pada anak. Dimana seorang anak harus dikurangi pemidanaannya dan maksimal setengah dari ancaman pidaana bagi pelaku dewasa, serta diversi atau penyelesaian perkara di luar pengadilan, serta faktor yang menjadi penghambat dalam perlindungan anak yang terlibat dalam jaringan peredaran narkotika ialah Peer Group dimana lingkungan pergaulan anak akan berpengaruh besar dalam pemaparan anak dengan narkoba, disdungsi keluarga yang menyebabkan anak mencari validasi di tempat yang berpotensi mencelakakannya, serta kondisi ekonomi yang akan memposisikan anak dibawah banyak tekanan. Sebagai saran dalam penelitian ini adalah aparat penegak hukum patut mengutamakan pendekatan secara Restoratiev Justice serta mengedepankan rehabilitasi pada anak agar masa depan anak bisa terjami serta tumbuh kembang anak dapat terjamin. Serta diharapkan kepada orang tua agar senantiasa melakukan pengawasan secara proporsinal agar anak jauh akan pemaparan narkotika.

Abstract

Penelitian ini mengkaji penegakan hukum pidana terhadap pengemudi yang lalai memarkirkan kendaraan di badan jalan sehingga menyebabkan kecelakaan lalu lintas yang mengakibatkan korban jiwa. Latar belakang penelitian ini didasarkan pada masih rendahnya tingkat kesadaran hukum dan kepatuhan pengemudi terhadap peraturan lalu lintas, khususnya larangan parkir di badan jalan yang dapat membahayakan keselamatan pengguna jalan lainnya. Dalam praktiknya, pelanggaran parkir di badan jalan sering kali dianggap sebagai pelanggaran ringan dan sepele, padahal dalam kondisi tertentu dapat menimbulkan dampak hukum yang serius, termasuk hilangnya nyawa seseorang. Oleh karena itu, diperlukan analisis mendalam terhadap penerapan hukum pidana dalam kasus-kasus kelalaian tersebut. Penelitian ini secara khusus menelaah Putusan Nomor 1195/Pid.Sus/2024/PN Tjk sebagai representasi penerapan hukum pidana terhadap perbuatan kelalaian pengemudi. Permasalahan yang dikaji meliputi dua aspek utama, yaitu faktor-faktor yang menyebabkan pengemudi melakukan kelalaian dalam memarkir kendaraan di badan jalan hingga menimbulkan korban jiwa, serta bagaimana penegakan hukum pidana diterapkan terhadap perbuatan tersebut berdasarkan peraturan perundang-undangan yang berlaku. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dan pendekatan yuridis empiris. Pendekatan yuridis normatif dilakukan melalui studi kepustakaan dengan menelaah peraturan perundang-undangan, doktrin hukum, dan putusan pengadilan yang relevan. Sementara itu, pendekatan yuridis empiris dilakukan melalui penelitian lapangan guna memperoleh data pendukung sebagai pelengkap data sekunder. Data yang diperoleh dianalisis secara yuridis kualitatif. Hasil penelitian menunjukkan bahwa kelalaian pengemudi dipengaruhi oleh rendahnya kesadaran hukum, faktor kelalaian pribadi, serta minimnya kepatuhan terhadap rambu dan aturan lalu lintas. Majelis Hakim dalam putusan tersebut menilai bahwa unsur kealpaan telah terpenuhi secara sah dan meyakinkan, sehingga terdakwa dijatuhi pidana sebagai bentuk penegakan hukum, efek jera, dan perlindungan terhadap keselamatan pengguna jalan.

Abstract

Class I narcotics crimes that are not plants are serious crimes that have a wide impact on public health, security, and order, and threaten the future of the nation's generation. One of the important problems in handling narcotics crimes is ensuring legal certainty in the application of criminal sanctions to perpetrators who commit acts without rights and against the law. The problems raised are: Legal Certainty in the Application of Sanctions Without Rights and Against the Law on Class I Narcotics Crimes that are not Plants Based on Decision Number 528 / Pid.Sus / PN Tjk. and What are the factors causing perpetrators to commit Class I narcotics Abuse based on the principle of justice. The research method uses a normative and empirical juridical approach. The normative juridical approach is taken through a literature study by examining relevant laws and regulations, doctrines, and legal literature. Meanwhile, the empirical approach is carried out by interviewing parties involved or directly understanding the case to obtain a factual picture regarding the application of the law in the field. The results of the study indicate that the application of criminal sanctions to the defendant in Decision Number 528/Pid.Sus/2025/PN Tjk has fulfilled the principle of legal certainty, especially regarding the fulfillment of the elements of "without rights and against the law" as regulated in Article 112 paragraph (1) of Law Number 35 of 2009 concerning Narcotics. However, there are still several inhibiting factors in the application of legal certainty, These include differences in legal interpretation, limited evidence, and the influence of non-juridical factors in the law enforcement process. Factors causing class I drug abuse include environmental factors, drug dependence, and family factors. The judge's considerations in the decision emphasized aspects of legal certainty and community protection, but did not fully reflect the principle of substantive justice that prioritizes a rehabilitative approach for drug abusers as victims of dependence. The imposition of prison sentences on class I drug users still raises debate regarding its suitability with the objectives of punishment and the spirit of rehabilitation mandated by law. The suggestion from this study is that the handling of class I drug abuse cases needs to prioritize substantive justice through the implementation of rehabilitation for pure abusers, supported by the active role of the community in prevention in order to create legal certainty and suppress drug distribution.

Abstract

The crime of drug abuse and illicit trafficking is a serious crime that has far-reaching consequences, both for public health conditions, social stability, and the future of the nation's future generations. In order to combat this crime, Law Number 35 of 2009 concerning Narcotics regulates strict and severe criminal sanctions, including the possibility of imposing the death penalty on certain perpetrators. The application of the death penalty in narcotics cases has caused polemics among academics and legal practitioners. The issues raised are: how to implement criminal accountability through the application of the death penalty for perpetrators of narcotics crimes based on Decision Number 280/Pid.Sus/2025/PN Tjk and what factors are taken into consideration in applying the principle of proportionality in sentencing according to Decision Number 280/Pid.Sus/2025/PN Tjk. The research method uses a normative and empirical juridical approach. The normative juridical approach is taken through a literature study by examining relevant laws and regulations, doctrines, and legal literature. Meanwhile, the empirical approach is carried out by interviewing parties involved or directly understanding the case in order to obtain a factual picture regarding the application of the law in the field. The results of the study indicate that criminal responsibility for the perpetrator in Decision Number 280/Pid.Sus/2025/PN Tjk has fulfilled all elements of a crime as regulated in Article 114 paragraph (2) of Law Number 35 of 2009 concerning Narcotics. These elements include the existence of an unlawful act, the existence of an element of error in the form of intent (mens rea), the ability of the perpetrator to be held legally accountable, and the existence of a clear causal relationship between the act committed and the resulting consequences. The application of the death penalty in this case is based on the consideration that the amount of Class I narcotics not plants controlled and distributed by the defendant has exceeded the threshold stipulated in the provisions of legislation. The application of the principle of proportionality in sentencing by the judge not only considers the severity of the act committed, but also takes into account various factors inherent in the perpetrator. These factors include internal and external conditions, such as economic background, level of education, personality, social environment, and cultural influences that shape the perpetrator's behavior. The suggestion from this study is that the government and society must continue to increase efforts to prevent narcotics crimes. These efforts can be carried out through strengthening education, fostering morals and religious values, and increasing supervision of the social environment. With the existence of sustainable prevention measures and involving various elements of society.

Abstract

Criminal conspiracy in narcotics offenses represents a form of organized crime that poses a serious threat to society and the state. This research aims to analyze the criminal liability of the defendant involved in a conspiracy to possess Class I non-plant-based narcotics, as examined in the High Court Decision No. 247/Pid.Sus/2024/PT Tjk. This study uses a normative juridical and empirical juridical approach. The normative juridical method is based on the review of relevant legal sources, particularly Law No. 35 of 2009 on Narcotics. The empirical juridical method includes interviews with law enforcement officers to understand the application of the law in practice. The results show that the defendant was proven legally and convincingly to have engaged in a criminal conspiracy to unlawfully possess Class I narcotics, specifically methamphetamine (sabu). The judge applied Article 112 paragraph (1) in conjunction with Article 132 paragraph (1) of the Narcotics Law, sentencing the defendant to 7 years of imprisonment and a fine of IDR 1,000,000,000 with a subsidiary of 3 months of detention. This ruling reflects an integrated criminal justice process—investigation, prosecution, and sentencing—that prioritizes fairness and legal certainty. This research recommends that law enforcement officials improve professionalism, independence, and consistency in applying conspiracy provisions to enhance deterrence and combat narcotics distribution more effectively.

Abstract

The value of West Lampung's traditional cultural expressions has not been maximized for the local inhabitants. This article will explain how to implement the local government-requested preservation of West Lampung traditional expressions and their use in accordance with the Economic Analysis of Law framework. The results of the discussion indicate that the Protection and Utilization of Traditional Cultural Expressions has only reached the inventory stage, based on Law No. 28 of 2014 regarding Copyright, Law No. 5 of 2017 regarding Promotion of Culture, Law No. 11 of 2010 regarding Cultural Conservation and Regulations Government No. 6 of 2015 regarding Museums, and Regulation of the Minister of Culture No. 106 regarding Intangible Cultural Heritage of Indonesia. The Economic Analysis of Law demonstrates that West Lampung's traditional cultural expressions must be optimized in order to boost the region's income. This can be maximized through the collaboration of the local government with academics in the arts, artists, Youtubers, artists, and other parties who are already aware of what the global community desires as connoisseurs, so that professional processing can affect the welfare of the people of West Lampung

Abstract

This research aims to find legal protection against digital signature users as consumers associated with the principle of justice. This research uses a normative juridical approach by focusing on secondary data. The research specification used is descriptive-analytical. The research stages were carried out through library research and field research as support. Data collection techniques were carried out through document studies and interviews. While data analysis is carried out in a qualitative, juridical manner. The results showed that since the enactment of Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE), the legal force and legal certainty of electronic information, electronic documents, and electronic signatures as valid evidence in electronic transactions such as e-commerce and e-business have the same legal force and legal certainty as the original.
