Abstract

Class I narcotics crimes that are not plants are serious crimes that have a wide impact on public health, security, and order, and threaten the future of the nation's generation. One of the important problems in handling narcotics crimes is ensuring legal certainty in the application of criminal sanctions to perpetrators who commit acts without rights and against the law. The problems raised are: Legal Certainty in the Application of Sanctions Without Rights and Against the Law on Class I Narcotics Crimes that are not Plants Based on Decision Number 528 / Pid.Sus / PN Tjk. and What are the factors causing perpetrators to commit Class I narcotics Abuse based on the principle of justice. The research method uses a normative and empirical juridical approach. The normative juridical approach is taken through a literature study by examining relevant laws and regulations, doctrines, and legal literature. Meanwhile, the empirical approach is carried out by interviewing parties involved or directly understanding the case to obtain a factual picture regarding the application of the law in the field. The results of the study indicate that the application of criminal sanctions to the defendant in Decision Number 528/Pid.Sus/2025/PN Tjk has fulfilled the principle of legal certainty, especially regarding the fulfillment of the elements of "without rights and against the law" as regulated in Article 112 paragraph (1) of Law Number 35 of 2009 concerning Narcotics. However, there are still several inhibiting factors in the application of legal certainty, These include differences in legal interpretation, limited evidence, and the influence of non-juridical factors in the law enforcement process. Factors causing class I drug abuse include environmental factors, drug dependence, and family factors. The judge's considerations in the decision emphasized aspects of legal certainty and community protection, but did not fully reflect the principle of substantive justice that prioritizes a rehabilitative approach for drug abusers as victims of dependence. The imposition of prison sentences on class I drug users still raises debate regarding its suitability with the objectives of punishment and the spirit of rehabilitation mandated by law. The suggestion from this study is that the handling of class I drug abuse cases needs to prioritize substantive justice through the implementation of rehabilitation for pure abusers, supported by the active role of the community in prevention in order to create legal certainty and suppress drug distribution.

Abstract

The crime of drug abuse and illicit trafficking is a serious crime that has far-reaching consequences, both for public health conditions, social stability, and the future of the nation's future generations. In order to combat this crime, Law Number 35 of 2009 concerning Narcotics regulates strict and severe criminal sanctions, including the possibility of imposing the death penalty on certain perpetrators. The application of the death penalty in narcotics cases has caused polemics among academics and legal practitioners. The issues raised are: how to implement criminal accountability through the application of the death penalty for perpetrators of narcotics crimes based on Decision Number 280/Pid.Sus/2025/PN Tjk and what factors are taken into consideration in applying the principle of proportionality in sentencing according to Decision Number 280/Pid.Sus/2025/PN Tjk. The research method uses a normative and empirical juridical approach. The normative juridical approach is taken through a literature study by examining relevant laws and regulations, doctrines, and legal literature. Meanwhile, the empirical approach is carried out by interviewing parties involved or directly understanding the case in order to obtain a factual picture regarding the application of the law in the field. The results of the study indicate that criminal responsibility for the perpetrator in Decision Number 280/Pid.Sus/2025/PN Tjk has fulfilled all elements of a crime as regulated in Article 114 paragraph (2) of Law Number 35 of 2009 concerning Narcotics. These elements include the existence of an unlawful act, the existence of an element of error in the form of intent (mens rea), the ability of the perpetrator to be held legally accountable, and the existence of a clear causal relationship between the act committed and the resulting consequences. The application of the death penalty in this case is based on the consideration that the amount of Class I narcotics not plants controlled and distributed by the defendant has exceeded the threshold stipulated in the provisions of legislation. The application of the principle of proportionality in sentencing by the judge not only considers the severity of the act committed, but also takes into account various factors inherent in the perpetrator. These factors include internal and external conditions, such as economic background, level of education, personality, social environment, and cultural influences that shape the perpetrator's behavior. The suggestion from this study is that the government and society must continue to increase efforts to prevent narcotics crimes. These efforts can be carried out through strengthening education, fostering morals and religious values, and increasing supervision of the social environment. With the existence of sustainable prevention measures and involving various elements of society.

Abstract

Criminal conspiracy in narcotics offenses represents a form of organized crime that poses a serious threat to society and the state. This research aims to analyze the criminal liability of the defendant involved in a conspiracy to possess Class I non-plant-based narcotics, as examined in the High Court Decision No. 247/Pid.Sus/2024/PT Tjk. This study uses a normative juridical and empirical juridical approach. The normative juridical method is based on the review of relevant legal sources, particularly Law No. 35 of 2009 on Narcotics. The empirical juridical method includes interviews with law enforcement officers to understand the application of the law in practice. The results show that the defendant was proven legally and convincingly to have engaged in a criminal conspiracy to unlawfully possess Class I narcotics, specifically methamphetamine (sabu). The judge applied Article 112 paragraph (1) in conjunction with Article 132 paragraph (1) of the Narcotics Law, sentencing the defendant to 7 years of imprisonment and a fine of IDR 1,000,000,000 with a subsidiary of 3 months of detention. This ruling reflects an integrated criminal justice process—investigation, prosecution, and sentencing—that prioritizes fairness and legal certainty. This research recommends that law enforcement officials improve professionalism, independence, and consistency in applying conspiracy provisions to enhance deterrence and combat narcotics distribution more effectively.

Abstract

The value of West Lampung's traditional cultural expressions has not been maximized for the local inhabitants. This article will explain how to implement the local government-requested preservation of West Lampung traditional expressions and their use in accordance with the Economic Analysis of Law framework. The results of the discussion indicate that the Protection and Utilization of Traditional Cultural Expressions has only reached the inventory stage, based on Law No. 28 of 2014 regarding Copyright, Law No. 5 of 2017 regarding Promotion of Culture, Law No. 11 of 2010 regarding Cultural Conservation and Regulations Government No. 6 of 2015 regarding Museums, and Regulation of the Minister of Culture No. 106 regarding Intangible Cultural Heritage of Indonesia. The Economic Analysis of Law demonstrates that West Lampung's traditional cultural expressions must be optimized in order to boost the region's income. This can be maximized through the collaboration of the local government with academics in the arts, artists, Youtubers, artists, and other parties who are already aware of what the global community desires as connoisseurs, so that professional processing can affect the welfare of the people of West Lampung

Abstract

This research aims to find legal protection against digital signature users as consumers associated with the principle of justice. This research uses a normative juridical approach by focusing on secondary data. The research specification used is descriptive-analytical. The research stages were carried out through library research and field research as support. Data collection techniques were carried out through document studies and interviews. While data analysis is carried out in a qualitative, juridical manner. The results showed that since the enactment of Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE), the legal force and legal certainty of electronic information, electronic documents, and electronic signatures as valid evidence in electronic transactions such as e-commerce and e-business have the same legal force and legal certainty as the original. As a suggestion, in an effort to increase the effectiveness of the enactment of Law Number 11 of 2008 in conjunction with Law Number 19 of 2016 concerning Electronic Information and Transactions (ITE), it is necessary to immediately issue a Government Regulation (PP) as an implementing regulation so as not to cause confusion for the community and, of course, the government itself in its law enforcement

Abstract

The agrarian dispute over customary land in the Register 45 Mesuji Forest Area is a structural conflict involving the state, corporations, and local communities. The verification of production forest areas and the issuance of management permits to private entities without taking into account the rights and existence of the communities that have long managed and used the land are the main causes of this dispute. The current settlement strategy, which has involved coercive measures and litigation, has not worked and has even prolonged the war and exacerbated human rights abuses. The objectives of this study are to evaluate the efficacy of non-litigation dispute settlement, analyze the features of agricultural conflicts in Register 45 Mesuji, and investigate how customary land disputes are resolved in other nations. Statutory, conceptual, and comparative legal techniques are all part of the normative juridical research methodology. The research results of the study demonstrate that agricultural conflicts in Register 45 are complex and cannot be adequately settled by a formal court system alone. Since non-litigation dispute resolution techniques like discussion and mediation promote inclusive discourse, lessen conflict escalation, and uphold community rights, they have a higher chance of achieving substantive justice. Studies comparing South Africa, Brazil, and the Philippines demonstrate that the state's active mediation role and acknowledgement of indigenous peoples' collective rights are essential to the long-term settlement of agricultural disputes. This study suggests a Register 45 conflict resolution approach that uses multi-party mediation focused on restorative justice and human rights protection, temporary acknowledgment of community management rights, and participatory inventory.

Abstract

Permufakatan jahat merupakan suatu perbuatan dua orang atau lebih telah sepakat akan melakukan kejahatan. Kejahatan yang mengundang banyak perhatian masyarakat terutama Pemerintah Indonesia ialah tindak pidana narkotika. Narkotika adalah zat atau obat yang berasal dari tanaman atau bukan tanaman, baik sintetis maupun semisintetis, yang dapat menyebabkan penurunan atau perubahan kesadaran, hilangnya rasa, mengurangi sampai menghilangkan rasa nyeri , dan dapat menimbulkan ketergantungan. Korban dari narkotika sendiri tidak mengenal usia mulai dari anak-anak, remaja, dewasa, hingga lanjut usia pun menjadi sasaran para pelaku kejahatan narkotika. Permasalahan dalam penelitian ini yakni apa saja faktor penyebab dan bagaimana pertimbangan hakim terhadap permufakatan jahat tindak pidana narkotika golongan 1 studi putusan Nomor : 146/Pid.Sus/2022/ PN Tjk. Metode penelitian menggunakan pendekatan yuridis normatif . Kejahatan narkotika dan psikotropika adalah salah satu penyakit yang ada dalam masyarakat, kejahatan yang berasal dari masyarakat, oleh masyarakat dan resikonya juga berakibat kepada masyarakat, maka penang gulangannya juga harus mengikut sertakan masya rakat, tanpa partisipasi seluruh lapisan masyarakat secara terpadu mustahil penanggulangannya akan berhasil. Narkotika di sisi lain sering digunakan di luar kepentingan medis dan ilmu pengetahuan, yang pada akhirnya akan menjadi suatu bahaya bagi si pemakai, dan juga dapat memberi pengaruh pada tatanan kehidupan sosial masyarakat, bangsa dan Negara. Penyalahgunaan narkotika dapat mengakibatkan sindroma ketergantungan apabila penggunaannya tidak di bawah pengawasan dan petunjuk tenaga kesehatan yang mempunyai keahlian dan kewenangan untuk itu. Hal ini tidak saja merugikan bagi penyalahgunaan, tetapi juga berdampak sosial, ekonomi dan keamanan nasional, sehingga hal ini merupakan ancaman bagi kehidupan bangsa dan negara.

Abstract

Hukum menjadi aturan tata kehidupan masyarakat tertujukan untuk menciptakan keamanan serta ketertiban yang konsekuensinya merupakan segala tindakan serta perilaku komponen masyarakat harus sesuai dengan nilai hukum berlaku. Penelitian tertujukan untuk Mempertanggungjawabkan Tindak Pidana Penganiayaan Terhadap Anggota TNI (Studi Putusan Nomor: 359/Pid.B/2022/PN.Tjk). Penelitian memakai pendekatan hukum normatif serta pendekatan hukum empiris. Sumber data dipergunakan merupakan data sekunder serta jenis data dipergunakan meliputi data sekunder serta data utama. Proses analisis data dideskripsikan dan dianalisis secara kualitatif, serta hasil analisisnya diinterpretasikan pada bentuk kesimpulan deduktif, yaitu jawaban atas permasalahan sesuai hasil penelitian. Sesuai hasil penelitian serta pembahasan yang diuraikan, disimpulkan bahwa majelis hakim akhirnya serta secara meyakinkan menetapkan terdakwa Rachmad Ardian Saputra Bin Diansyah F Nata bersalah atas tindak pidana “penganiayaan”. Dengan hukuman penjara satu tahun delapan bulan, terdakwa tetap pada penahanan prapersidangan serta penahanan serta masa tahanan terdakwa sudah dikurangi seluruhnya dari pidana dijatuhkan serta terdakwa membayar biaya perkara sebanyak Rp 2.000. Pertimbangan Hakim pada Menjatuhkan Putusan Tindak Pidana Penganiayaan Anggota TNI Kajian Putusan No: 359/Pid.B/2022/PN Tjk. sempurna sebab hakim menilai bahwa perbuatan dilakukan oleh terdakwa sangat bertentangan menggunakan aturan hukum positif ada serta bahkan perbuatan dilakukan oleh terdakwa membuat korban pusing serta memaksa korban buat beristirahat selama beberapa hari sebagai akibatnya beliau bisa melakukan aktivitas sehari-hari, yaitu bekerja menjadi anggota TNI.

Abstract

This thesis discusses the judge's considerations towards perpetrators of criminal acts against drug dealers of class 1 type of crystal methamphetamine. Narcotics are one of the serious problems faced by society, and crystal methamphetamine dealers are one of the main actors in the illicit trafficking of narcotics. This study aims to analyze and understand how judges in the Indonesian justice system consider various aspects in sentencing perpetrators of drug trafficking crimes, especially crystal methamphetamine. The problem taken in this study is to determine the judge's considerations in making legal decisions and whether factors such as the background of the perpetrator, the nature of the perpetrator in the trial can influence the judge and relevant legal aspects, and what factors cause someone to dare to commit unlawful acts and including the Narcotics Law based on Decision Number: 906 / Pid.Sus / 2024 / PN TJK. The research method used is a qualitative approach with a case study, where data is collected through interviews, observations, and analysis of related documents. The results of the study indicate that there are several factors that encourage someone to finally choose to become a dealer and one of them is the economic factor and the lack of education of the perpetrator, and there are also reasons why someone becomes a dealer is because he is a user as well as environmental factors are also the reason why someone decides to become a dealer and the judge's considerations in deciding the case are the background of the perpetrator, the evidence presented, the role of the defendant and paying attention to whether the defendant is involved in a larger network and considering the nature of the perpetrator during the trial and the cooperation of the perpetrator during the investigation. The suggestion in the study is that there needs to be better cooperation between law enforcement agencies, the government, and civil society organizations in preventing and overcoming narcotics trafficking. Adjustments in legal policies also need to be made to consider the rehabilitation of perpetrators as an alternative to imprisonment, so that perpetrators can reintegrate into society better.
